An objective of JIKK: Jurnal Ilmiah Kajian Keimigrasian is to promote the wide dissemination of the results of systematic scholarly inquiries into the broad field of migration research. JIKK: Jurnal Ilmiah Kajian Keimigrasian is intended to be the journal for publishing articles reporting the results of research on migration studies. JIKK: Jurnal Ilmiah Kajian Keimigrasian invites manuscripts in the areas: Migration Studies; Social Studies; Border Studies; International Development; Citizenship Studies; Diaspora. JIKK: Jurnal Ilmiah Kajian Keimigrasian accepts articles in any business related subjects and any research methodology that meet the standards established for publication in the journal. The primary, but not exclusive, audiences are academicians, graduate students, practitioners, and others interested in business research. The primary criterion for publication in JIKK: Jurnal Ilmiah Kajian Keimigrasian is the significance of the contribution an article makes to the literature in business area, i.e., the significance of the contribution and on the rigor of analysis and presentation of the paper. The acceptance decision is made based upon an independent review process that provides critically constructive and prompt evaluations of submitted manuscripts.

Abstract

ABSTRAK Banyaknya pengangguran di wilayah Tangerang serta diiringi oleh tingginya permintaan pekerja Migran Indonesia dari negara yang memiliki kontrak kerjasama dengan negara Indonesia sehingga masyarakat bersedia menjadi PMI dengan tujuan agar mendapatkan kehdupan yang lebih baik. Jenis Pekerja Migran Indonesia pada sektor formal yang digolongkan kedalam jenis Pekerja Migran Indonesia yang bekerja pada pemberi kerja yang berbadan hukum. Aturan yang mengatur tentang persyaratan penerbitan paspor bagi calon pekerja migran Indonesia diatur dalam Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 8 Tahun 2014 tentang Paspor Biasa dan Surat Perjalanan Laksana Paspor. Surat Rekomendasi penerbitan paspor dari Dinas Ketenagakerjaan sebagaimana merupakan salah satu syarat penerbitan paspor bagi calon pekerja migran Indonesia, namun dalam implementasinya di Kantor Imigrasi Kelas I Non TPI Tangerang calon pekerja migran Indonesia khususnya pada sektor formal sering tidak mengurus penerbitan surat rekomenasi penerbitan paspor dari Dinas Ketenagakerjaan karena berbagai alasan. Oleh karena itu dijelaskan implementasi peraturan terhadap calon PMI yang mendaftarkan penerbitan paspor di Kantor Imigrasi Kelas I Non TPI Tangerang apakah aturan terhadap calon PMI sektor formal tersebut sudah optimal. Sehingga perlu adanya optimalisasi terhadap aturan yang mengatur tentang persyaratan penerbitan paspor bagi calon pekerja migran Indonesia khususnya pada sektor formal yang belum optimal. Hal ini dilihat dari sistem keimigrasian pada saat entry data hanya calon pekerja migran sektor informal saja yang diwajibkan menginput ID PMI sedangkan untuk calon pekerja migran Indonesia pada sektor formal tidak menginput ID PMI sehingga proses entry data bisa dilanjutkan. Maka urgensi dari surat rekomendasi penerbitan paspor dari Dinas Ketenagakerjaan hanya difokuskan kepada calon pekerja migran Indonesia pada sektor informal saja tidak terhadap calon pekerja migran Indonesia sektor formal. Kata Kunci: optimalisasi, aturan, pekerja migran Indonesia, formal ABSTRACT The high number of unemployed in the Tangerang area and accompanied by the high demand for Indonesian Migrant workers from countries that have a cooperation contract with the Indonesian state so that people are willing to become PMI with the aim of getting a better life. Types of Indonesian Migrant Workers in the formal sector are classified into the types of Indonesian Migrant Workers who work for employers who are legal entities. The rules governing passport issuance requirements for prospective Indonesian migrant workers are regulated in the Minister of Law and Human Rights Regulation Number 8 of 2014 concerning Ordinary Passports and Travel Letters Like Passports. Recommendation letter for issuing passports from the Manpower Office as one of the requirements for issuing passports for prospective Indonesian migrant workers, but in its implementation at the Immigration Office Class I Non TPI Tangerang prospective Indonesian migrant workers, especially in the formal sector, often do not take care of issuing recommendation letters for issuing passports from the Manpower Office for various reasons. Therefore, it is explained that the implementation of regulations for PMI candidates who register for passport issuance at the Class I Non-TPI Tangerang Immigration Office is explained whether the rules for PMI candidates in the formal sector are optimal. Therefore, it is necessary to optimize the rules governing the requirements for issuing passports for prospective Indonesian migrant workers, especially in the formal sector which is not yet optimal. This can be seen from the immigration system at the time of data entry, only prospective migrant workers in the informal sector are required to input PMI ID, while prospective Indonesian migrant workers in the formal sector do not enter PMI ID so that the data entry process can continue. Therefore, urgency of the recommendation letter for passport issuance from the Manpower Office is only focused on prospective Indonesian migrant workers in the informal sector, not on prospective Indonesian migrant workers in the formal sector. Abstract

Indonesia menjadi negara favorit untuk orang asing berinvestasi. Oleh karena itu, indonesia memiliki kebijakan keimigrasian berupa izin tinggal keimigrasian yang diatur pada UU Nomor 6 Tahun 2011 Tentang Keimigrasian, PP Nomor 31 Tahun 2013 Tentang Pelaksanaan UU Nomor 6 Tahun 2011 Tentang Keimigrasian, PP Nomor 26 Tahun 2016 mengenai perubahan kedua dari PP Nomor 31 Tahun 2013, dan PERMENKUMHAM Nomor 27 Tahun 2014 mengenai prosedur permohonan izin tinggal keimigrasian termasuk Izin Tinggal Kunjungan. seiring berjalannya waktu di masa pandemi covid-19, pemerintah indonesia mengeluarkan PP Nomor 48 Tahun 2021, yaitu perubahan ketiga dari PP Nomor 31 Tahun 2013. Tetapi, didalam PP Nomor 48 Tahun 2021 mengalami ketidakselarasan terhadap ketentuan perpanjangan Izin Tinggal Kunjungan. Rumusan masalah yang didapat adalah apa yang alasan pemerintah mengeluarkan PP Nomor 48 Tahun 2021 dan bagaimana letak ketidakharmonisasi hukum dalam PP Nomor 48 Tahun 2021 mengenai ketentuan perpanjangan Izin Tinggal Kunjungan. metode penelitian yang digunakan berupa penelitian hukum normatif dengan pendekatan statute approach. Hasil penelitian adalah pemerintah mengeluarkan PP Nomor 48 Tahun 2021 untuk pemulihan perekonomian nasional melalui reformasi regulasi untuk mempermudah orang asing berinvestasi di indonesia; selanjutnya letak ketidakharmonisasian hukum dalam PP Nomor 48 Tahun 2021 mengenai ketentuan perpanjangan izin tinggal kunjungan berada pada bagian ketentuan perpanjangan izin tinggal dari visa single trip, multiple trip, dan VOA dengan aturan sederajatnya seperti PP Nomor 31 Tahun 2013 dan PP Nomor 26 Tahun 2016 serta aturan khususnya yaitu PERMENKUMHAM Nomor 27 Tahun 2014.

Abstract

Globalisasi dan kemajuan teknologi membuat negara-negara di dunia sekaan tidak memiliki batas nyata (borderless world). Kondisi ini memudahkan bagi aktor internasonal memberikan pengaruh terhadap suatu negara dengan atau tanpa keberadaan dari aktor tersebut. Kemajuan teknologi tidak hanya berdampak positif, tetapi juga berdampak negatif (dual use). Kemunculan kejahatan terorganisir transnasional merupakan salah satu dampak negatif dari kemajuan teknologi. Kejahatan ini merupakan ancaman serius bagi negara-negara di dunia, khususnya negara berkembang dan rawan konflik. Terorisme merupakan salah satu bentuk kejahatan terorganisir transnasional yang dapat mengancam kedaulatan negara, keutuhan wilayah, dan keselamatan bangsa. Penelitian kepustakaan digunakan sebagai metode pada penelitian ini. Data dikumpulkan dari sumber-sumber sekunder yang relevan dengan topik, selanjutnya dilakukan analiss, pengorganisasian, dan penyajian data. Dari penelitian yang dilakukan, diketahui bahwa pelibatan Tentara Nasional Indonesia merupakan langkah yang tepat dalam pengatasi terorisme sebagai kejahatan terorganisir transnasional, mengingat tugas pokok dan fungsi, serta kapasitas dan kapabilitas Tentara Nasional Indonesia.

Abstract

Penelitian ini bertujuan untuk menjelaskan dan menjawab secara eksplisit serta empiris salah satu tantangan terbesar yang dihadapi oleh keimigrasian dalam bidang keamanan perbatasan, yakni pengembangan kecerdasan buatan pada kesisteman perbatasan pada Tempat Pemeriksaan Imigrasi di Indonesia, secara khusus di bandar udara internasional. Pembahasan yang dikaji dalam penelitian ini adalah penjelasan mengenai kecerdasan buatan dalam kesisteman perbatasan yang telah diciptakan di Indonesia maupun negara lain dan penjelasan mengenai seberapa pentingnya pengembangan kecerdasan buatan dalam meningkatkan keamanan perbatasan suatu negara secara dasar. Penelitian ini menggunakan metode penelitian kualitatif dalam ruang lingkup deskriptif analisis yang bertujuan memberikan hasil penjelasan secara naratif mengenai pentingnya keberadaan kecerdasan buatan dalam kesisteman perbatasan bagi keamanan perbatasan suatu negara. Hasil dalam penelitian ini menunjukan bahwa keberadaan kecerdasan buatan pada Tempat Pemeriksaan Imigrasi di Indonesia sangatlah dibutuhkan, tidak hanya di Indonesia, namun di seluruh dunia pun membutuhkan kecerdasan buatan dalam peningkatan keamanan perbatasan di setiap negara. Kesimpulan yang dihasilkan dalam penelitian ini ialah telah ditemukannya beberapa aspek poin penting terkait kecerdasan buatan dalam kesisteman perbatasan yang dapat dikembangkan secara optimal ke depannya dan dapat diimplementasikan secara global pada Tempat Pemeriksaan Imigrasi.

Abstract

This study looks at China's "One Belt, One Road" initiative, which is grouped into two parts: the Maritime Silk Road Initiative and the Silk Road Economic Belt, both of which were revealed in 2013. Through the establishment of interconnected infrastructure projects such as ports, roads, railways, and pipelines, each component has the ability to reshape the global geopolitical landscape.The paper is divided into four sections to help the reader have a better grasp of the OBOR project and its impacts. This study describes trends and patterns of recent OBOR projects in Belt and Road Countries, analyzes the geopolitical implications of the OBOR, and investigates the integration of new migration patterns based on existing data and literature on current Chinese development. Using a geopolitical approach that identifies territorial and political power, This study examined prospective migration and integration patterns that may emerge as the OBOR initiative advancements. As a result, this paper concludes that the OBOR initiative is not only an international cooperation project, but something that also turns China's geopolitics power at various levels, has the potential to be momentous, and will simultaneously create opportunities for global partnership while also reshaping the existing migration pattern and a new geopolitics perspective.

Abstract

E-government in Indonesia is still developing particularly in some regional and central government offices. As a central government, the directorate general of immigration has been implemented very well in relation to the process of providing immigration documents such as passports, visas, and permission to stay for foreigners. However, in the field of law enforcement the directorate general of immigration have failed to demonstrate the development phase of e-government. The official website of the directorate general of immigration does not provide any information related to immigration law enforcement so that the legal awareness of the public about the dangers of violating immigration law is not well conveyed. Even the public does not know the investigation process if they commit immigration violations. Also, the agency did not provide both financial and nonfinancial access for the public to avoid immigration violations. All coordination activities are still done manually. The data used in this study is secondary data collected from academic literature and grey literature. The research materials were obtained by using search engines from google, google scholar, and an online library at flinders university.

Abstract

The People's Republic of China is one of the multi-ethnic countries in this world that is facing a number of prominent ethnic issues, including the Xinjiang Conflict which has received international attention in recent years. In the China's western autonomous region, ethnic tensions exist between the Han majority and the Uighur minority. This research is using a qualitative-descriptive method by relying on library studies from available secondary sources, this paper will try to explain the tension between the Uighurs and Hans ethnic groups through a constructivism perspective. In constructivism perspective, identity is one of the main ideas that shape the pattern of interaction between actors. It was found that the construction of Uighur and Han ethnic identities contributed to the creation of this ethnic tension, which is also related to how the conception of China's national identity is constructed.

Abstract

The Government of the Republic of Indonesia has issued the latest regulations regarding restrictions on granting entry permits and residence permits for foreign nationals who in the last 14 days have visited 11 countries that have been exposed to the Omicron Covid-19 variant to enter Indonesian territory with purpose to prevent the entry of a new variant of Covid-19 B.1.1.529 or known as Omicron. This regulation elicited various responses from the public and the media. This study aims to examine how the online media Kompas.com and detik.com framing the news regarding the issuance of this latest regulation. This study is qualitative study with framing analysis by Robert N. Entman method. The results show that the online media Kompas.com and detik.com have a positive tendency in responding to the emergence of regulations regarding restrictions on entry permits and residence permits for foreigners. This is shown by the delivery of the narrative that the issuance of the regulation is an effort to prevent the entry of the Omicron Covid-19 variant into the Indonesian Territory.

Abstract

Abstract: Business environment transformation drives by the growth of internet-based technology and movement of goods and people migration across borders. The digital technology connects all nations, business actors and netizen within network ecosystem that make migrants across border engaged to the jurisdiction and nation sovereignty as well as engage to the similar civil rights, worker right and human rights and the global netizen. This article examines business competitiveness in Indonesia through borders management area. Method is desk research, utilizing academic references data. The discussion and analysis cover the ideas of managing synergetic multistakeholders in border area, positioning migrants as research, primary stakeholder that entitled for border area services and sources for investment opportunities, and conduct governance based on universal human rights, Indonesian national interest, as well as providing business certainty and security protection for migrants and foreigners
