An objective of JIKK: Jurnal Ilmiah Kajian Keimigrasian is to promote the wide dissemination of the results of systematic scholarly inquiries into the broad field of migration research. JIKK: Jurnal Ilmiah Kajian Keimigrasian is intended to be the journal for publishing articles reporting the results of research on migration studies. JIKK: Jurnal Ilmiah Kajian Keimigrasian invites manuscripts in the areas: Migration Studies; Social Studies; Border Studies; International Development; Citizenship Studies; Diaspora. JIKK: Jurnal Ilmiah Kajian Keimigrasian accepts articles in any business related subjects and any research methodology that meet the standards established for publication in the journal. The primary, but not exclusive, audiences are academicians, graduate students, practitioners, and others interested in business research. The primary criterion for publication in JIKK: Jurnal Ilmiah Kajian Keimigrasian is the significance of the contribution an article makes to the literature in business area, i.e., the significance of the contribution and on the rigor of analysis and presentation of the paper. Abstract

Peredaran gelap narkoba dikategorikan sebagai tindak kejahatan terorganisir transnasional dan ancaman yang bersifat nonmiliter untuk pertahanan negara. Kejahatan narkoba merupakan kejahatan yang terorganisir dengan jaringan yang luas dan bersifat rahasia baik dalam lingkup nasional maupun internasional. Peran Badan Narkotika Nasional (BNN) dan Pemerintah Daerah Kalimantan Barat (Pemda Kalbar) diperlukan untuk menghadapi permasalahan peredaran gelap narkoba di wilayah perbatasan. Sinergitas dalam menghadapi kejahatan transnasional peredaran gelap narkoba membuat penanganan permasalahan tersebut akan lebih efektif. Penelitian ini membahas sinergitas yang dilakukan BNN dan Pemda Kalbar dalam menghadapi ancaman non militer berupa kejahatan transnasional peredaran gelap narkoba di Kalimantan Barat untuk pertahanan negara. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan deskriptif. Hasil penelitian ini adalah (1) sinergitas yang dilakukan BNN dan Pemda Kalbar dengan melaksanakan program Pencegahan, Pemberantasan Penyalahgunaan dan Peredaran Gelap Narkoba (P4GN), (2) Pemda Kalbar memberikan peran kepada BNN untuk mengadvokasi pengambilan kebijakan yang dapat mendukung kegiatan-kegiatan dan program P4GN, (3) BNN dapat melakukan koordinasi dengan pemerintah Kabupaten/Kota melalui BNNK di masing-masing wilayah, (4) sinergitas yang dilakukan BNN dan Pemda Kalbar terkendala dengan belum adanya Perda yang mengatur pelaksanaan kegiatan bersama, (5) proses sharing anggaran untuk melaksanakan kegiatan yang mendukung pelaksanaan penanggulangan peredaran gelap narkoba terganggu.

Abstract

Rohingya first came to Arakan State, Burma (Myanmar) between the eighth and ninth centuries. They are a Muslim minority ethnic group who have been struggling for their indigenous identity. Their arrival in Arakan correlated with the British colonialism and Japanese colonialism (1942-1945) which played a crucial role in initiating the conflicts between Muslims and Buddhists. In consideration of various definitions, Rohingya are obviously defined indigenous because they have lived in a specific territorial for long with their own language, culture and religion. This paper aims to argue that the Rohingya issue should be seen as indigenous group. To address the issue, we use a qualitative approach relying on the available secondary sources by giving historical background, theoretical framework and discussing on inter-religious conflict issue, a form of struggle for indigenous recognition. It is found that despite qualifying the standards to be admitted as indigenous, the Rohingya have been still refused to be minority ethnic group, even not accepted to be legal citizen by the Myanmar government, they are seen as foreigners or illegal immigrants instead. Three lessons are learned from this study on the failure of Rohingya’s recognition. First, the two colonialists were the “dark records” of the Rohingya conflicts. Second, the Myanmar governments have not treated the Rohingya with fair and similar policy during the historical time. Third, all protests and demonstrations conducted throughout the world to condemn the Myanmar government and all financial supports should be done on behalf of humanity, not a religious-solidarity to avoid unexpected effects for inter-religion conflicts nationally and internationally.

Abstract

The mutation of the Covid-19 virus in various countries has made the Indonesian Government issue various public policies related to the entry and exit of foreigners both from and to Indonesian territory. The Directorate General of Immigration as the authorized agency in the service of visas and stay permits, issued several public policies during the pandemic, especially related to the entry ban of foreigners. Including when the Covid-19 case in India increased significantly, a policy was imposed to prohibit the entry of foreigners from India. Public Relations of the Directorate General of Immigration is also involved not only in policy making, where aspirations from the public are accommodated and then conveyed to policy makers, but also in disseminating established policies in the form of information that is easily understood by the public.

Abstract

The digital economy is growing rapidly in the era of globalization in line with the advancement of the internet and technology. In the digital world, all economic sectors become connected, so that all countries strive to develop innovation through technological adaptation to take advantage of the opportunities of the digital economy. The digital sector greatly affects other economy sectors and will be an asset in the future. Investment in the digital sector requires improving resource capabilities and developing new and greater information technologies. Singapore is currently classified as advanced which means it has a very high adoption rate of technology and information, but has limited domestic consumption, while Indonesia has a large digital market with the most dynamic economic growth in Southeast Asia but has uneven technology. Batam is supported by contributions from integrated industrial areas and its strategic location is chosen as a digital park location for both countries. Digital cooperation between Singapore and Indonesia through NDP investment in Batam aims to adopt technology in accelerating the movement of digital economy.

Abstract

Pendetensian merupakan bagian dari tindakan adiministratif keimigrasian yang dilakukan oleh seorang Pejabat Imigrasi berdasarkan UU No. 6 Tahun 2011 tentang Keimigrasian. Sedangkan penahanan merupakan bagian dari proses peradilan tindak pidana yang dilakukan oleh seorang PPNS keimigrasian berdasarkan hukum acara pidana. Pendetensian dan penahananmerupakan dua hal yang berbeda. Belum ada peraturan yang secara khusus mengatur masalah tersebut, sehingga pelaksanaan keduanya seringkali menimbulkan perdebatan. Dalam pelaksanaan proses penyidikan OAC cs. dijumpai beberapa kendala, yaitu belum adanya peraturan yang mengatur masalah pelaksanaan pendetensian pada proses penyidikan. Pelaksanaan pendetensian pada OAC cs merupakan bagian dari diskresi seorang Pejabat Imigrasi dikarenakan pelaksanaan penahanan tidak dapat dilakukan karena ancaman hukumannya dibawah 5 (lima) tahun. Lamanya masa pendetensian tidak mengurangi dari masa tahanan dari pidana yang dijatuhkan kepada terdakwa. Pada hakikatnya pendetensian memiliki tujuan yang sama dengan penahan yaitu membatasi kebebasan dari subjeknya dengan berada di suatu tempat tertentu menurut peraturan perundang-undangan.

Abstract

Immigration as the gatekeeper of the country is required to have human resources (HR) who have competence in the immigration field and have a thorough understanding of immigration technical matters. To achieve this optimally, several improvements are needed that must be made at the TPI Forensic Laboratory, Services at the Immigration Office and in the Language Laboratory as a means of support for students, in this case Taruna is proficient in foreign languages ​​other than Indonesian because later in the field will be directly dealing with various kinds of people. foreigners who come to Indonesia. This is related to the real situation in the field which shows that the Lab. Forensics for TPI has not yet reached an ideal state, which should be updated regularly according to their needs and demands. Apart from PCs and similar facilities, good electricity and good network is also something that is no less important. All of this with the main objective, namely, efforts to improve the quality of human resources and create ideal conditions with the supporting facilities for the learning of cadets, namely, the Forensic Laboratory for TPI and the Language Laboratory at the Immigration Polytechnic.

Abstract

Morotai Island Regency has a geoeconomic and geostrategic strategic location and is an area with great potential both in terms of tourism, the fishing industry, and various other industries. This potential has made the government set Morotai as a Special Economic Zone (SEZ) since 2014. This paper aims to find out the extent of the development of the Morotai SEZ on the regional economy and increase the welfare of the community, as well as know the role of immigration that can be carried out as a manifestation of one of the immigration functions, namelydevelopment public welfare. The results show that after the Morotai SEZ, although there has been an increase in local revenue, it has not significantly and consistently affected the economy due to the suboptimal use of local government over the potential of the Morotai SEZ. The role of the immigration function in the Morotai SEZ region must also be strengthened through the establishment of an immigration work unit in the Morotai SEZ region and the improvement of other immigration cooperation in order to facilitate the opening of international access, community mobility and business actors in various industries in Morotai, including other regions in eastern Indonesia, with the aim to improvethe welfare of the community.

For the sake of realizing the upholding of state sovereignty and security, Indonesia must prioritize the duties and functions of Immigration in filtering people who want to enter or leave the territory of Indonesia by upholding the principle of Immigration, namely selective policy, especially for immigration officers at immigration checkpoints at airports, ports, and even at cross-border posts that must always prioritize this principle, that is, only foreigners who benefit and benefit the Indonesian state can enter Indonesian territory. Abstract

People smuggling is one of the increasingly transnational organized crime. To eradicate the crime of human smuggling, the international community has established a convention of the United Nations Convention Against Transnational Organized Crime (UNTOC) and Protocol Against the Smuggling of Migrants by Land, Sea, and Air, Supplementing the United Nations Convention Against Transnational Organized Crime. One of the responsibility as a UNTOC participant is to preserve and protect the rights of people who are victims of people smuggling. Whereas in reality there are victims of people smuggling who complicity criminal acts. Victims who complicity can shelter under the UNTOC and its Protocol so that they are free from lawsuits. This thesis is to analyze how the legal review of victims who complicity in the occurrence of people smuggling by looking at the f complicity and relations between the perpetrators and victims.

Abstract

Illegal fishing, namely fishing activities by foreign people or vessels in waters that are the jurisdiction of a country, without permission from that country, or contrary to laws and regulations. The problem of Illegal fishing not only causes problems regarding Indonesia's natural resources but also raises various immigration problems from the initial detention until the perpetrators of illegal fishing are deported to their home countries. The process of Immigration Administration Action (TAK) causes a lot of costs to be incurred, therefore simplification of the Immigration Analyst Actions (TAK) process and new detention methods will reduce costs incurred in the process of managing illegal fishing actors.
