Abstract

This research is a normative research. One of the fulfillment of human rights is justice in equalizing the position of every citizen before the law, as stated in Article 27 paragraph (1) of the 1945 Constitution of the Republic of Indonesia. The right to equality before the law or what is commonly referred to as equality before the law is a principle that provides recognition and protection of human rights for every individual regardless of one's background. Therefore, it is true that Law Number 16 of 2011 concerning Legal Aid for People Who Are Less Capable to Guarantee Constitutional Rights of Citizens for Justice and Equality before the Law emerged. Legal aid is a legal service provided by advocates to the community seeking justice In the realm of criminal cases, the provision of legal assistance is described in Article 54 of the Criminal Procedure Code which explains that in the interests of defense, a suspect or defendant has the right to receive legal assistance from one or more legal advisers during the time and at each level of examination. The provision of legal assistance must be based on the principle of equality before the law as stated in the explanation of Law Number 8 of 1981 concerning Criminal Procedure Law. From the various analyzes that have been carried out, in the perspective of Islamic criminal law it can be concluded that the principle of equality before the law as described in Article 54 of the Criminal Procedure Code is equivalent to an order to provide legal aid which in Islamic criminal law is spelled out in Surah Al-Maidah verse 2 which states that as a fellow humans are ordered to help each other as a form of horizontal worship to fellow humans (habl minan-nas). In addition there are many more both in the Al Qur'an and the hadith of the prophet regarding the application of the principle of equality before the law.

Abstract

Happiness and serenity in living life is the hope of every individual, to achieve this there are many things that can be done, one of which is like increasing worship to Allah, but not all individuals have the same thoughts, there are individuals who choose to achieve happiness and tranquility by abusing it. illegal drugs such as narcotics. The purpose of this study was to describe the role of a psychological approach as an effort to overcome addiction for narcotics abusers. The method used in this research is a qualitative method with a literature study approach by tracing and reviewing several documents in the form of journals and books. From the analysis carried out, the psychological approach plays a role in rehabilitating narcotics abusers through the activity of reading the Koran, prayer therapy and giving tausiah.

Abstract

This study aims to see how Islamic boarding schools apply the totality of education by relying on exemplary, environment and habituation through various tasks and activities. So that all what children see, hear, feel and do is education. In the midst of globalization, people are increasingly individualistic and materialist, so education oriented to character values ​​is needed. In this context, the pesantren has succeeded in educating its students with these character values. School is a place where students experience a process of socialization, and influence children to conform (adapt) to prevailing norms. During the first years of children entering school, the school emphasizes the importance of the control function more than other functions. therefore there should be an integration of pesantren into the formal education system in public elementary schools (SDN).

Abstract

This study aims to analyze two types of interpretation in the double movement theory presented by Fazlur Rahman in his hermeneutical interpretation. As well as its application to the verses of the Koran related to pluralism, inclusivism, and polygamy. By using a qualitative methodology with the type of library research on the interpretation analysis presented by Fazlur Rahman, conclusions and results were found that there was a difference between Fazlur Rahman's interpretation and the interpretation of his predecessors. Despite the disagreements above, Fazlur Rahman's idea about the importance of contextual interpretation which he formulated in what he called double movements was too valuable not to be appreciated. While the various shortcomings as raised by several commentators as described above, it is our duty to complete them.

Abstract

Jual beli online, di dalamnya, ada praktik wakalah, seller mewakilkan kepada reseller. Adapraktik ijarah, seller menyewa reseller untuk memasarkan barang dagangannya. Ada praktik ju’alah,seller mengumumkan (sayembara) kepada para reseller untuk berlomba-lomba memasarkanbarangnya dengan bonus atau imbalan tertentu. Namun dalam kajian ini yang menjadikanpenekanannya adalah akad jual belinya kepada para konsumen, bukan seller ke reseller, sehinggadengan demikian, jual beli online ini jika dilihat dalam perspektif fikih mu’amalah dapatdikategorikan sebagai akad jual beli yang sah, jika barang yang ditawarkan itu memang sudah ada.Akan tetapi jika barang belum ada, melainkan hanya gambar dan barangnya belum berwujud (belumdibuat), maka hal itu dikategorikan sebagai akad salam yang sah. Itupun jika ra’sul mal (uangnya)dibayar di awal, bukan sistem pembayaran di rumah (COD), namun jika dibayar di rumah, maka akadsalam semacam ini, menurut para ulama fikih, tidak sah.

Abstract

Every citizen has the same right to obtain quality education. Even citizens whohave physical, emotional, mental, intellectual or social disabilities are also entitled toeducation even though they have to go through special education. With the existence of thisstudy aims to determine the social skills of students with special needs in SDN 2WringinomKab. Gresik, to find out the learning outcomes of students with special needs atSDN 2 WringinomKab. Gresik, and to find out how the influence of social skills on thelearning outcomes of students with special needs at SDN 2 WringinomKab. Gresik The typeused in this research is quantitative research, in this case the researcher uses independentcorrelation to look for relationships and test hypotheses between two or more variables. Theobject of asdalah research at SDN 2 Wringinom district. Gresik, researchers used productmoment correlation techniques. The data collection techniques the methods that researchersuse are observation, questionnaire and documentation, while for data analysis techniquesusing descriptive analysis and Inferential analysis. Hopefully with this research the teachershould increase student confidence (self-efficacy) so that students with special needs feelconfident in their potential and are able to complete their learning tasks as well as possible,and further researchers should conduct research on other aspects because there are manyother aspects / factors that affect ABK student learning outcomes.

Abstract

Human Rights are one of basic rights that had by every humanbeing who has become their destiny when they were born. Actually theHuman Rights are not state’s gifts, law or other human beings. Every humansneed human rights to protect their dignity, as well as a moral foundation inassociating and dealing each other. In Islam, human rights have a highpriority by prioritizing collective rights rather than individual rights. Islamalso teaches his people to respect each other and recognize the rights of one’slife, because live and death are the power of Allah Almighty. Human Rights inIslam are written in Al-Kulliyat Al-Khams, namely hifzh al-din (protectionagainst religion), hifzh al-nafs (protection of the soul), hifzh al-aql (protectionof reason), hifzh al-nasl (protection of offspring), and hifzh al-maal(protection of property). Abdurrahman Wahid of familiarly known as GusDur is a person who has extremly respect about the human values whichcontained in Al-Kulliyat Al-Khams and shows a high commitment to realize ofrespect for human rights. Therefore, it is very interesting to know HumanRights in Al-Kulliyat Al-Khams, Abdurrahman Wahid’s perspective to find outhow his thoughts in realizing to bring into reality the protection of basichuman rights.

Abstract

The expression of the Indonesian Islamic Community is the response ofMuslims to the development of modernity, so that the big of the Islamic revival isdivided into three groups, namely Islamic revivalisme, Islamic reformisme and Islamicfundamentalisme. Revival Islam gave to several movement groups, including:patienting Islam, traditionalist Islam, orthodox Islam, Neo-revivalisme, andconservative Islam. While reformist Islam gave to several movements, such as:modernist Islam, liberal Islam, substantial Islam, and Neo-modernists. while,fundamentalist Islam gave to radical Islam, militant Islam and even terrorisme.Methodologically the understanding of Islam, the modern and contemporary Islamicthought movements, as stated by loualy sufi consists of two, namely groups that use andapply the classical Islamic system and groups that use the paradigm of modern Westernepistemology in total or with a process of integration between modern scholarship. Westwith the treasures of Islamic scholarship. Based on this, it is worth mentioning that thediversity of Indonesian Muslims as a national treasure must be knitted so that interreligiousharmony is created as a characteristic of the true character of the Indonesiannation.

Abstract

Talent is a capacity or potential that is influenced by experience orlearning, talent is related to the possibility of mastering a pattern of behavior in certainaspects of life. In my opinion talent is innate which is the potential to actualize himself as aservant (abid) who serves Allah and is the potential to actualize himself as (Khalifatullah)on earth, therefore talent must always be developed through exercises, so that talent will bewill help to become a responsible caliph. There is a close relationship between intelligenceand talent of children. This is indicated by the understanding of the child's own talentwhich means great potential in a type of intelligence. While intelligence itself is dividedinto several aspects, namely logical and mathematical intelligence, language intelligence,visual-spatial intelligence or imagination, kinesthetic or physical intelligence, musicalintelligence, interpersonal or social intelligence, intrapersonal intelligence, naturalistintelligence, spiritual intelligence, and financial intelligence. . This means that a person'stalent can lead to one of these intelligences.

Abstract

Leadership in Islam is also called the caliph which is the executor of Allah's authority in realizing his various commands in the lives of fellow human beings. And the urgent problem at this time is women's leadership, many layers of society and Muslims themselves are debating about the existence of women's leadership, both of which have the same opinion regarding the legal position of women as leaders; First, the concept/interpretation that is forbidden and the second is that which allows it. Both are based on the verses of the Qur'an and the hadith of the prophet Muhammad SAW. Actually, this problem is not new, but it has been going on for centuries, and in Indonesia this is also very common. For these reasons, it is necessary to interpret the Qur'an and Hadith regarding women's leadership in a sharia perspective in order to know and analyze women's leadership.
