Abstract

This research is a study to analyze the protection of children in schools and the protection of teacher professionalism, especially to maintain a balance between protecting children's human rights in schools with the implementation of teacher professionalism which also needs to be protected in educating children. The specification or type of research in this study is descriptive in nature, using normative juridical research methods through several approaches: the statutory approach and the conceptual approach. The results showed that based on data from the Indonesian Child Protection Commission (KPAI) in the first semester of January to July 2022, 12 cases were recorded, consisting of 3 cases occurring in schools in areas under the auspices of the Ministry of Education and Culture with a percentage of 25%. Meanwhile, cases in the education unit under the auspices of the Indonesian Ministry of Religion were 9 cases or 75%. Based on education level, 2 (16.67%) cases of violence occurred at the Elementary School (SD) level. Middle school level was 1 (8.33%) case. Islamic boarding schools 5 (41.67%) cases. Madrasas are places of recitation/place of worship in 3 (25%) cases, and 1 (8.33%) place for music courses for kindergarten and elementary school aged children. The age range of the victims was between 5-17 years. Victims numbered 52 children with details of 16 (31%) boys and 36 (69%) girls. While the perpetrators totaled 15 people consisting of: 12 teachers (80%), 1 (6.67%) owner of the boarding school, 1 (6.67%) child of the owner of the boarding school, and 1 (6.67%) senior of the victim. On the other hand, violence against teachers is still common, for example, in August 2016 there was a beating of a father and son against a teacher at a well-known school in Makassar. This case felt very strange because according to the news, the child, who incidentally was a student of the battered teacher, also took the opportunity to throw punches at the time his father was "crazy" at school. In early February 2018, it was also reported that Achmad Budi Cahyanto, a teacher at SMAN 1 Torjun, Sampang, Madura, died after being beaten by a student named HZF. Therefore, the existence of Law no. 35 of 2014 concerning Amendments to Law no. 23 of 2002 concerning Child Protection, is intended to prevent arbitrary actions against Indonesian children, as well as Law no. 14 of 2005 concerning Teachers and Lecturers,

Abstract

Cases of price differences, forms that are too small or difficult to see by consumers, differences in price labels and receipt prices at the checkout, price placement that does not match the goods, writing that is blurry so that it is difficult to read are usually considered less important, but this is actually very detrimental and has violated Law Number 8 of 1999 concerning Consumer Protection. If it is related to Law Number 8 of 1999 concerning Consumer Protection in Article 4 letter (b) it is clearly stated that one of the consumer rights is the right to choose goods and services and obtain goods and services according to value and guarantee. From the results of observations made by researchers at Indomaret Matang Glumpang Dua, it was found that there are cases of differences in price tags and cashier prices, this can make consumers stuck with price tags with the price paid, our people's habits are not careful about refunds or looking back at the price list from the payment receipt , although there are no complaints from consumers regarding the price difference, this may be due to the low level of consumer accuracy or the habit of conducting traditional transactions. Errors on the price tag with the price list on the payment counter machine often occur at the Indomaret Matang Glumpangdua Minimarket, where the price listed and when paying for the difference is due to inaccurate administration, with price changes that occur too often following instructions from PT. Indomarco Prismatama will hereby cause a price difference.

Abstract

Indonesia is an archipelagic country surrounded by oceans. Aceh is the westernmost province of Indonesian territory. A number of districts are located on the coast of the Indian Ocean, most of the population lives in coastal areas. When viewed from the perspective of their livelihood, they are included in the category of poor people. The average livelihood of them is as a farmer and fisherman. Development of the People's Salt Business (PUGAR) as a national program was made with the aim of increasing the welfare of the Indonesian people, especially salt farmers. The purpose of this study was to evaluate the Empowerment Policy for the Coastal Poor through the Development of Integrated People's Salt Businesses with Geo-Membrane Technology in North Aceh District, the constraints and obstacles in implementing the policy. This study used a descriptive research method with a qualitative approach, technical data collection was carried out through interviews, observation, and documentation. The research findings were evaluated using William N. Dunn's policy evaluation theory with 3 (three) evaluation criteria, namely Effectiveness, Efficiency and Responsiveness. The results of the study show that the evaluation of the policy of developing people's salt businesses in Aceh district is the government's effort to empower poor communities in coastal areas to improve their welfare through the provision of facilities and infrastructure, land integration and salt business institutions (KUGaR). The aspect of duties and authority shows that it is dominated by the Maritime Affairs and Fisheries Service, while the technical team is more on the number of team personalities for fulfilling procedures only. Many technical tasks are carried out in Marine and fisheries. In addition, the technical team has not implemented its capacity according to the main duties and functions of the SKPD. Meanwhile PUGaR is comprehensive in nature covering all aspects of people's lives, including education, health and economic endeavors. Aspects of the distribution of aid for facilities and infrastructure and disbursement of the budget have been carried out optimally. While the tasks and functions of institutions (cooperatives) have not been able to motivate people to join salt business groups under the auspices of cooperatives, this shows that institutionally cooperatives have not made a significant contribution in increasing people's salt businesses. The resource aspect shows that the involvement of human resources in general in the development of the people's salt business has shown adequate results, but in terms of quality it is not optimal both at the group level and at the management institutional level. While the aspects of facilities and infrastructure and budgeting look quite convincing in accordance with the needs for developing the potential of the salt business.

Abstract

There are ups and downs, obstacles, challenges, and problems during the implementation and enforcement of Islamic sharia in North Aceh. The legal basis for enforcing Islamic sharia in Aceh is based on Qanun Number 5 of 2000 concerning the Implementation of Islamic Sharia as the foundation for the implementation of Islamic law. The supervision and control of the Qanun implementation belong to the Wilayatul Hisbah (Shari'a Police) as the authorized and legal agency. This study aims to analyze the actors’ communication strategy in enforcing Islamic shari’a in North Aceh, Indonesia. This study used a qualitative descriptive analysis. Observation, interviews, documentation were used to collect data. This study revealed that there was a fluctuation in the number of violations during the implementation of Islamic law in North Aceh. As its communication strategy, Wilayatul Hisbah of North Aceh conducted the following programs: (1) Enhancing understanding towards Islamic values; (2) Enhancing understanding and practice of the Koran; (3) Enhancing the quality of religious life and tolerance; (4) Fostering da’wah and Islamic sharia; (5) Deepening, developing and fostering sharia; and (6) Strengthening, developing, empowering and enhancing Islamic Sharia Court Cooperation. These six programs required immense and intense communication strategy. However, not all these programs have been implemented optimally due to factors such as a lack of budget, human resources, and the reluctance of actors. Such phenomenon occurred because of weak communication among actors resulting in the occurrence of many obstacles during the programs implementation.
