Abstract

The presence of children in public spaces has become a trigging reality to consider, because children use these spaces to play without taking into account their suitability for such activity. This article tackles children's use of the public square as a play space in Batna Province, Algeria. We adopted a mixed methodology that combines qualitative and quantitative elements to study the use and quality of a space used by children. The qualitative component allows us to explore human interactions and the environment, while the spatial analysis gives us an understanding of the physical layout of the context. The quantitative component aims to evaluate the opinions and preferences of children’s carers. To carry out this study, we conducted a field investigation, including direct observation on the site and interviews with children's carers in the square to find out their assessment and opinions on the quality of the space and its use. Moreover, an analytical study of the square plan was also implemented at the spatial and functional level, in order to reveal all the changes in space before and after use by children. The results of the study confirmed the lack of ease and flexibility of this space for use by children, and the results of the interview emphases the achieved findings, because the public space did not take the child as a user of it at all, neither in terms of space, nor planning and equipment, which led to falling into excessive use of it that resulted in lots of problems.

Abstract

Symbolic interaction is a form of reciprocal action carried out by two or more people to be able to translate and understand the symbols used in interaction. This includes interactions carried out by people who behave Fomo in a community. The research aims to find out the forms of Fomo behavior and understand the meaning of social action and symbolic interaction of members of the Makassar Move Community. The research used a qualitative approach with a case study strategy by determining informants using purposive informant selection. The results of this study found that Move Makassar members have a form of Fomo behavior by being so active in finding and sharing information about vespa matic and Move Makassar activities, always wanting to be involved in every activity, and excessive consumption of vespa matic accessories and modifications. The meaning of social action in the symbolic interaction of Move Makassar members is understood as an action that upholds the values of equality, togetherness and intimacy among them so that a sense of kinship arises.

Abstract

This research examines in more depth how legal certainty regarding the validity of marriage certificates of different religions is held abroad after being recorded and reported to the Population and Civil Registry Office (Dukcapil), where the couple resides upon returning to the homeland. With lex loci celebrationis and lex fori principles, the state is expected to accept, recognize, and respect as the basis for recording and registration with the Dukcapil. This type of research is normative research using a statutory and factual approach. The data collection method used literature study, field research, and interviews. Based on the results and discussion of the research, it is found that Indonesian Citizens (WNI) who enter into marriages of different religions abroad under International Civil Law (HPI) are valid and recognized. However, when viewed from the applicable marriage law in Indonesia, it is invalid because it still has to be based on religious law. However, sociologically, the community still recognizes and accepts the existence of interfaith marriages.

Abstract

Cases of stunting and malnutrition that children suffer from or have the potential to have negative consequences for the future of the younger generation. There are 91 cases in Cipocok Jaya District spread across 8 villages. This occurs due to various factors including poverty, low education, lack of knowledge regarding good nutritional intake for children. A strategy is needed to communicate intensively with communities with stunted and malnourished children so that they can get out of this situation. This research uses a qualitative approach through observation and interview data collection. The research results show that the communication strategy in handling stunting and malnutrition through the Stunting Free 2023 (Bessan) program in Cipocok Jaya District, Serang City uses a communication strategy approach which includes getting to know the audience, compiling messages, determining methods and selection and use of media which has been effective. The communication strategy to get to know the audience is carried out through surveys and data collection, identifying indicators of sufferers and potential stunting. The second strategy determines the micro-scale goal of reducing stunting sufferers, the macro-scale of stunting cases at zero, where this treatment accommodates community self-help. The next communication strategy is to develop messages so that people's lifestyle behavior becomes healthy by conveying the importance of nutritious food intake for children. Methods for determining the methods used are socialization and counseling, accommodating community self-help through healthy exercise activities, regular recitations, and Gowes Lur events. This series of activities is a collaborative innovation in Cipocok Jaya District which involves stackholders starting from the Serang City Health Office, Serang City DP3AKB, KUA, as well as cadres from both posyandu cadres and PKK Community Institution cadres. Research findings show the importance of consistent mentoring or accompanying posyandu cadres and PKK community organizations as an important instrument for a sustainable communication strategy in efforts to reduce stunting and malnutrition rates.

Abstract

This article examines the evolution of the morphological characteristics of the square as an urban public space within the historical Algerian city, focusing particularly on the case of the Ksar of Khanguet Sidi Nadji, a small town situated between Biskra and Khanchela at the foot of Djebel Chechar and on the edge of the eastern Zab. The study aims to analyze the impact of urban transformations on the morphological characteristics of the square over time, focusing particularly on the topological, geometric, and dimensional relationships. In doing so, it considers the historical context and the changes that the Ksar has undergone over time. To achieve this, a dual methodology was adopted, combining two integrated approaches. Firstly, the historical method was employed to study the original morphological characteristics of the square by relying on historical documents, particularly through the analysis of texts by travellers during the late nineteenth and early twentieth centuries. Secondly, typo-morphology was applied to analyze the current urban configuration of the square and extract its current morphological characteristics, while a comparative approach highlighted the various transformations it has undergone. The results reveal that despite its marginal presence in the traditional urban fabric, the morphological characteristics of the square remain closely linked to its original function as a public space. Urban developments have certainly altered its configuration, but its fundamental features such as the arrangement of buildings around the square, access points, and meeting places remain related to its initial role.

Abstract

Urban planning in Algeria, manifested through its two main urban planning instruments, the PDAU (Urban Development Master Plan) and the POS (Land Use Plan), has accompanied a remarkable acceleration of urbanization in Algerian cities. This article focuses on private real estate development and its impacts on newly urbanized spaces and the mechanisms of their production within the coastal city of Skikda. Abstract

This study aims to shed light on the dilemma of physicians’ emigration and health care through two perspectives that are arguably conflicting. More specifically, the objective of this paper is to examine the fundamental rudiments of these two perspectives. While the first perspective focuses on the multifaceted right of physicians to emigrate which is represented predominantly by the liberalist, the second perspective focuses on the right of patients to obtain necessary health care provided by physicians, this approach is represented by the nationalists. To achieve our aim, the comparative method was used which is adequate in presenting the underlying premises of each approach after reviewing the existing literature. By extracting the main basic conjectures and refutations of contradictory statements and analyzing it profoundly, the study findings indicated that the advocate of physicians’ mobility is pointedly linked to patients’ health care, and any shortage in physicians due to departing will impact health care accessibility. The findings also suggest that both of the perspectives carry rational and realistic arguments, but the differences in the assumptions and the reductionism of the claims hinders and prevents the possibility of reconciling and combining them in order to reach a solution to what can be called the discrepancy dilemma of rights between physicians’ emigration and patient health care.

Abstract

Cross-sectoral cooperation is urgently needed in the protection of women migrant workers. Especially migrant workers from West Java who are the third largest contributor in Indonesia after East Java and Central Java. The protection of women migrant workers requires a gender sensitive approach, because each protection will have a different impact on women and men. Natural disaster made the women migrant workers were affected economically, socially, and mentally. Cross-sectoral collaboration needs to be carried out by BP2MI, private companies providing employment, civil society represented by non-governmental organizations and mass media, and academics represented by researchers. Quadruple Helix theory by (Carayannis & Campbell, 2010) is an approach in creating a synergy of cooperation from four actors, namely A (Academician), B (Businessman), C (Civil Society) and G (Government) to build cross-sectoral collaboration in West Java. A qualitative research method with descriptive exposure was used in this study. The results of the study show that the actors involved in the protection of women migrant workers have shown cross-sectoral collaboration named Migrant Worker Resources Center one-stop service (LTSA- MRC) with gender sensitivity perspectives.

Abstract

The trend of housing quality has become more intricate and has expanded to encompass all aspects of habitat. There are several significant challenges related to improving housing, both socially and in terms of economic and environmental considerations. Discussing the quality of new production methods requires an analysis based on various traditional criteria, using convenient indicators such as cleanliness, stability, safety, comfort, durability, flexibility, and aesthetic appeal. The principal aim of this study is to provide an objective assessment of the quality of Participative Subsidized Housing (LPA) in the municipality of EL-Khroube in Algeria. The methodology employed integrates a field survey and a resident questionnaire to appraise the comfort level offered by this housing type as well as the level of resident satisfaction. The results of the on-site observation indicated that the living environment does not offer an adequate level of comfort. This finding was corroborated by the questionnaire results, which revealed a prevailing sentiment of dissatisfaction among residents. This dissatisfaction can be attributed to issues pertaining to interior comfort and a dearth of local infrastructure and facilities. The results of this study will assist housing stakeholders in enhancing this mode of production through a collaborative and participatory approach.

Abstract

One of the financing contracts offered by Islamic banks is the Murabahah financing contract. The Murabahah financing contract functions to increase the utility of money and capital, as well as the utility of goods. Article 127 of the Compilation of Sharia Economic Law (KHES) allows the seller to request the buyer to provide collateral in the Murabahah contract. Fatwa DSN-MUI No. 03/DSN-MUI/IV/2000 regarding Murabahah permits banks to request collateral from financed customers. This provision aims to ensure that customers are serious about making payments. Based on KHES and the fatwa, banks are allowed to request collateral from customers to protect or ensure that their rights are not violated. In practice, to ensure that customers comply with payments, banks request collateral from customers. This collateral can be movable or immovable property. Collateral in the form of immovable property is called fiduciary collateral. Fiduciary collateral is regulated in Law No. 42 of 1999 concerning Fiduciary Collateral (UUJF). According to Article 5 paragraph 1 of UUJF, the imposition of collateral with fiduciary collateral "must" be made by a notarial deed. With this provision of UUJF, there is a difference. KHES and the fatwa of DSN MUI do not require financing contracts to be made using a notarial deed, while UUJF requires it to be made by a notarial deed. Islamic banks, some of which require financing contracts to be made by a notarial deed, while others do not. The adoption of UUJF in Islamic financing is considered inappropriate because it violates Sharia values. Objectives: (1) Explain the regulations used in Murabahah financing contracts in Islamic banks with fiduciary collateral according to the objectives of legal certainty and utility. (2) Describe the implementation of legal protection for customers using Murabahah financing contracts in Islamic banks with fiduciary collateral according to the objectives of legal certainty and utility. Research Method: Research approach: normative juridical. Research nature: descriptive analysis. Data types: secondary data and primary data. Sample determination technique: purposive sampling. Data collection technique: literature study and interviews. Data analysis technique: interpretation and legal analogy.
