Abstract

Allah Almighty created humans as beings who cannot live without helping each other. One of the human activities in Muamalah is wages, in Fiqh it is called Ujrah. Wages are an issue that cannot be solved through discussion by parties or organizations, both private and government. It's as if wages are a task that always makes management think about setting policy. Islam offers the best solution to the wage problem to protect the interests of workers and employers without violating the legal rights of employers. The concept of Wages is established in the most appropriate way without putting pressure on any party. This type of research is descriptive qualitative and uses secondary data collection techniques. The results showed that  the pillars and wage requirements were as follows:  Wages and Workers (Mu'jir and Musta'jir), Shighat (Ijab Qabul), wages or rewards, and the existence of expediency.  Wages can be grouped into two parts, namely as follows: The wages already mentioned (Ajrul Musamma) Y i.e. the wages mentioned at the beginning of the transaction, the condition is that when it is mentioned it must be accompanied by a willingness (received) by both parties, Commensurate wages (ajrul mistli) Is a wage that is commensurate with its work and commensurate with the conditions of work.  In general, the provisions of islamic law regarding the determination of the payment of wages are as follows:  Wages are paid as soon as possible, Wages are given according to their ability and achievements, Wages are mentioned before work begins, and Wages are paid appropriately

Abstract

Islamic economics is known as an alternative solution for mankind to carry out economic activities. This system originates from Islamic teachings, which principally require the involvement of God in every activity. Even though it has been an alternative choice for a long time, it seems that this system has not been fully communicated to Indonesian society. This is evidenced by the relatively small market share of Islamic banking, even though the majority of Indonesia's population is Muslim. This article aims to analyze the communication system applied in the Islamic economic system, especially in the banking sector. The method used in this research is the library research method. The results of the study show that the course of the Islamic economic system in the banking sector, which has been implemented for more than 30 years in this country, has not developed significantly due to a weak communication system that has not touched market logic.

Abstract

Since the enactment of Law Number 23 of 2014 concerning Regional Government, there have been very significant different provisions in determining policies in each region, especially in the maritime and fisheries sector. In the previous regional government regulations, namely Law Number 32 of 2004, regional governments were given the broadest authority to manage resources in marine areas, but since the latest regulations, the maritime and fisheries section is included in concurrent government affairs which must be coordinated between the central government. , provincial government and district/city government. Therefore, it is necessary to further examine the limitations and direction of policy and authority that can be exercised by district/city regional governments in the maritime and fisheries sectors since the enactment of Law Number 23 of 2014 concerning Regional Government. The aim of this research is to discover the legal relationship between the central government and regional governments in the marine and fisheries sector, to discover concurrent government affairs between the central government and provincial and district/city regions in the marine and fisheries sector, and to discover the position of district/city governments in Law Number 23 of 2014 in determining policy direction in the marine and fisheries sector. This type of research is normative juridical, while the nature of this research is prescriptive. The data source used is secondary data by processing data from primary legal materials, secondary legal materials and tertiary legal materials. Document study data collection techniques, as well as using qualitative analysis. Based on the research results, it is known that the legal relationship between the central government and regional governments in the maritime and fisheries sector is part of concurrent government affairs, apart from that, concurrent government affairs are not mandatory government affairs but rather optional government affairs. Then it is understood that concurrent government affairs between the central government and provincial and district/city areas in the marine and fisheries sector as a whole are the authority and responsibility of the central government to make policies in the management of marine and national strategic space, as well as provincial regional governments being given the authority to manage natural resources in the sea in the region. Meanwhile, district/city governments are limited to supervising and empowering small fishermen and fish cultivation in district/city areas. Finally, it is known that the position of district/city governments in Law Number 23 of 2014 in determining policy direction in the marine and fisheries sector is limited to the empowerment of small fishermen and empowerment of fish cultivation businesses.

Abstract

Most business dispute resolution is carried out using litigation or dispute resolution through the trial process, which is the oldest method of dispute resolution in the world. Settlement of the dispute begins with filing a lawsuit with the district court and ends with a judge's decision. Dispute resolution through the judicial process can be referred to as law enforcement. In addition to dispute resolution through the litigation process, there is also dispute resolution through non-litigation, which is dispute resolution carried out using methods outside of court or using alternative dispute resolution institutions. In Indonesia, there are two types of non-litigation resolution, namely arbitration and alternative dispute resolution in accordance with Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution.
