Abstract

Di dalam pendaftaran nama perusahaan banyak yang sama dan /atau identik dengan lapangan usaha yang sama, menimbulkan perselisihan dan kesalahpahaman sehingga terjadi sengketa hukum. Jurnal ini akan membahas rumusan masalah yaitu bagaimana implikasi asa itikad baik dalam pendirian nama perseroan terbatas dan apakah dalam Putusan memperlihatkan realisasi dari itikad baik, terhadap pengesahan pendirian hukum normatif. Bahan hukum primer dan sekunder yang meliputi kebijakan-kebijakan, peraturan Perundang-undangan yang berlaku di Indoneasia, teori hukum, aspek-aspek hukum, dan pendapat hukum yang telah diperoleh dari literatur, jurnal terdahulu dan hasil penelitian lain. Salah satu contoh kasus sebagai bahan analisis kasus berdasarkan Putusan Pengadilan nomor 194/G/2021/PTUN-JKT. Dalam penelitian ini fokus terhadap pembahasan atas fakta hukum, yang berupa Putusan Hakim tentang Gugatan terhadap Keputusan Menteri Hukum dan Hak Asasi Manusia republik Indonesia Nomor AHU-0027068.AH.01.01.Tahun 2021 tanggal 20 April 2021 Tentang Pengesahan Pendirian Badan Hukum Perseroan Terbatas PT. SHUNDA PLAFON INDONESIA. Sebagaimana dirumuskan dalam Pasal 2 Undang-undang Nomor 40 Tahun 2007 Tentang Perseroan Terbatas yang berbunyi: “Perseroan harus mempunyai maksud dan tujuan serta kegiatan usaha yang tidak bertentangan dengan ketentuan peraturan Perundang-undangan, ketertiban umum, dan/atau kesusilaan”. Dan serta tegas dalam pendirian Perseroan tidak boleh memiliki nama yang sama yang telah dipakai Perseroan lain, seperti terdapat dalam Pasal 16 Ayat (1): “Perseroan tidak boleh memakai nama yang telah dipakai secara sah oleh Perseroan lain atau sama pada pokoknya dengan nama Perseroan lain”.

Abstract

Rumusan masalah dalam penulisan ini adalah bagaimana pengaturan mengenai penggunaan tanaman ganja demi kesehatan dan apa yang menjadi pertimbangan hukum majelis hakim dalam memutus perkara nomor 83/Pid.Sus/2020/Pn.Kpg. Pengaturan mengenai penggunaan tanaman ganja demi kesehatan dapat digunakan untuk kepentingan pengembangan ilmu pengetahuan dan teknologi dan untuk reagensia diagnostik, serta reagensia laboratorium setelah mendapatkan persetujuan Menteri atas rekomendasi Kepala Badan Pengawas Obat dan Makanan. Majelis hakim yang memeriksa dan memutus perkara tindak pidana narkotika dengan terdakwa atas nama Reyndhart Rossy N. Siahaan dalam perkara nomor 83/Pid.Sus/ 2020/Pn.Kpg pada Pengadilan Negeri Kupang menjatuhkan pidana penjara tanpa memperhatikan hak asasi Reyndhart Rossy N. Siahaan yang membutuhkan peningkatan kesehatan setelah upaya pengobatan yang dilakukan ke beberapa rumah sakit tidak berhasil menyembuhkan penyakit saraf yang dideritanya.

Abstract

A prenuptial agreement is a legal instrument that grants married couples the authority to regulate the ownership of assets, rights, and obligations during marriage. In Indonesia’s legal system, its provisions have evolved from the Civil Code and Law Number 1 of 1974 on Marriage to the Constitutional Court Decision Number 69/PUU-XIII/2015. This decision is a significant milestone as it allows the agreement to be made not only before but also after the marriage. A postnuptial agreement may take effect either from the date of marriage or from the date the deed is signed. If it takes effect from the deed date, assets acquired beforehand remain as joint property, which carries legal implications, particularly concerning land ownership by foreign spouses. This paper discusses the legal development of postnuptial agreements and their impact on asset management, recommending that notaries explain potential legal risks and consider applying the agreement from the start of the marriage to prevent disputes.

Abstract

The governance of Indonesia’s development reflects an urgent need for a proactive control and evaluation system across the policy cycle. Previous studies have been largely technical and have not dissected the regulatory framework, leaving gaps in substance, institutional roles, and data integration. This urgency has grown following the enactment of Law Number 59 Year 2024 (RPJPN 2025–2045) and the direction of National Development Risk Management (MRPN), which demand evidence-based and risk-aware policymaking. This study analyzes the weaknesses of Government Regulation No. 39/2006, identifies the need for alignment with the new legal framework, and formulates strategic recommendations for reform. Using qualitative methods, including content and policy gap analysis, the study finds that the ex-post focus limits early detection, institutional roles and coordination remain unclear, evaluation results are not yet prerequisites for planning and budgeting, and data systems are not integrated with One Data Indonesia. Reform is needed to strengthen anticipatory controls, institutional coordination, mandatory linkage of evaluation to planning and budgeting, and interoperable digital systems. These changes are essential to ensure that evaluation becomes a responsive, adaptive, and accountable policy navigation tool. Reforming PP No. 39 Year 2006 is thus a prerequisite for accelerating the achievement of RPJPN targets and Indonesia’s broader development agenda

Abstract

Penelitian ini bertujuan untuk mengkaji secara kritis keterbatasan sistem hak cipta Indonesia dalam melindungi kearifan lokal sebagai bagian dari kekayaan budaya tradisional yang rentan terhadap eksploitasi komersial. Keberagaman budaya Indonesia yang berasal dari ribuan komunitas adat menjadikan ekspresi budaya seperti motif batik, seni pertunjukan, dan pengetahuan herbal sebagai objek yang bernilai ekonomi tinggi di pasar global. Namun, sistem hukum kekayaan intelektual yang berlaku saat ini belum mampu menjawab kebutuhan perlindungan yang berbasis hak kolektif dan prinsip keadilan budaya. Rumusan masalah penelitian ini mencakup: (1) Bagaimana sistem hukum hak cipta di Indonesia saat ini mengatur perlindungan terhadap ekspresi kearifan lokal sebagai bagian dari kekayaan budaya tradisional?; (2) Bagaimana rancangan sistem perlindungan hukum yang adil dan kontekstual terhadap kearifan lokal, khususnya dalam menghadapi eksploitasi komersial oleh aktor domestik maupun global? Penelitian ini menggunakan pendekatan socio-legal dengan kombinasi analisis normatif dan studi kasus. Data diperoleh dari studi peraturan perundang-undangan, studi litertur dari buku dan jurnal penelitiaan ilmiah, serta dokumentasi kasus-kasus eksploitasi budaya yang terjadi di Indonesia. Hasil penelitian menunjukkan adanya kekosongan hukum dalam pengakuan dan perlindungan hak kolektif komunitas adat atas karya budaya mereka. Eksploitasi sering terjadi tanpa pembagian manfaat, sehingga diperlukan model hukum sui generis yang mengakui hak komunal, melibaPTan hukum adat, dan menjamin mekanisme benefit-sharing yang adil. Penelitian ini merekomendasikan reformasi hukum nasional dengan pendekatan multikultural dan partisipatif sebagai solusi perlindungan terhadap kekayaan budaya tradisional.

Abstract

In Law No. 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations, there are still legal restrictions governing the rights of concurrent creditors. There are many conclusions which are the result of the unregulated rights of concurrent creditors which give rise to many new problems. The main objective in a process before the court is to obtain a judge's decision that has permanent legal force, but in bankruptcy cases, concurrent creditors often do not receive certainty and fair legal enforcement. The method used in this research is normative juridical by conducting research through literature on secondary data, especially primary legal materials in the form of statutory regulations and secondary legal materials in articles or journals, using the theory of just legal certainty. The results of research provide insight and direction to fill the legal vacuum in the regulation of concurrent creditor rights by including transparency and input into elements of special institutions that manage and determine bankruptcy assets in Law No. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations.

Abstract

This study examines the dynamics of economic welfare in ASEAN and BRICS countries within the context of globalization and digitalization, as measured by per capita income, unemployment rates, and poverty levels. Employing a panel data regression method covering 15 countries over the period 2007–2024, the findings indicate that globalization and digitalization shape welfare patterns that are heterogeneous and highly dependent on country-specific characteristics. Globalization, represented by trade openness and foreign direct investment (FDI), is associated with increases in per capita income and reductions in unemployment, although its impact on poverty alleviation remains uneven. Meanwhile, digitalization, measured through internet penetration, demonstrates a significant positive association with income growth and poverty reduction, underscoring the role of digital technology in expanding economic inclusion. Beyond global factors, welfare dynamics are also influenced by domestic conditions, particularly the quality of governance and the effectiveness of social policies. These findings highlight the importance of integrated and adaptive development strategies that respond to global dynamics and digital transformation. Policy recommendations include strengthening institutional capacity, promoting joboriented investment, and expanding digital infrastructure and literacy to narrow socioeconomic disparities in the era of digital globalization.

Abstract

Sexual violence against children constitutes a severe violation of human rights, leaving long-lasting impacts on the victims’ physical well-being, psychological state, and social life. This study examines the legal protection afforded to child victims, encompassing preventive measures, law enforcement actions, and post-incident rehabilitation. The research adopts a normative juridical approach, drawing on statutory analysis, literature review, and case examination. The findings reveal that legal instruments such as Law Number 35 of 2014 on Child Protection and Law Number 12 of 2022 on Sexual Violence Crimes provide a comprehensive framework for safeguarding victims. However, practical implementation remains challenged by limited resources, low public awareness, and the psychological barriers victims face in reporting incidents. The study recommends strengthening inter-agency cooperation, enhancing the quality of victim support services, and maximizing the use of technology in case reporting and handling.

Abstract

State control over rivers based on Article 33 of the 1945 Constitution of the Republic of Indonesia affirms the State’s role as regulator, manager, and guarantor of public welfare through water resources governance. Rivers constitute strategic natural resources because they traverse multiple administrative areas and influence ecosystem balance across regions. However, declining river carrying capacity—driven by spatial planning changes, environmental degradation, and uncontrolled human activities—can trigger flooding disasters with significant social, economic, and environmental impacts. Therefore, flood risk management must be implemented in an integrated manner through river and watershed (DAS) policies that address both flood magnitude reduction and vulnerability reduction. This study applies normative legal research using statutory, historical, and conceptual approaches to examine flood management policies in Indonesia. The findings indicate that river governance should be oriented toward sustainability, community participation, and social justice to achieve long-term public welfare.
