Abstract

General Background: Child guardianship is a legal mechanism for protecting children who are no longer under effective parental authority, and appointment decisions should prioritize the best interests of the child. Specific Background: Minister of Social Affairs Regulation Number 7 of 2024 introduces more detailed mechanisms for assessing prospective guardians, including social assessment, home visits, Social Work Reports, and supporting suitability requirements. Knowledge Gap: Its implementation raises unresolved questions about the legal position of these assessments in judicial proceedings, their procedural status, and their relationship with judicial independence. Aims: This normative legal study, supported by a limited socio-legal perspective, examines the regulation’s implementation and legal position in relation to legal certainty, prospective-guardian assessment, and children’s rights. Results: The framework moves guardianship from predominantly administrative screening toward substantive, child-centered assessment, provides a broader factual basis for identifying risks before appointment, and supplies more detailed technical standards. Consistent application, however, depends on institutional capacity, professional assessment availability, inter-agency coordination, and judicial interpretation. Novelty: The study links the revised assessment framework with preventive legal protection, legal certainty, and the best interests of the child while preserving the court’s evidentiary authority. Implications: Continued coordination and clear procedural guidance are needed so that implementation remains consistent without limiting judicial independence or displacing the child’s welfare as the central consideration. Highlights: Social workers, home visits, and Social Reports broaden the factual basis for evaluating prospective caretakers. Early screening can identify risks of neglect, violence, exploitation, and property mismanagement before appointment. Uniform application depends on institutional capacity, inter-agency coordination, professional resources, and consistent judicial interpretation. Keywords: Child Guardianship, Children’s Rights Protection, Legal Certainty, Best Interests of the Child, Minister of Social Affairs Regulation Number 7 of 2024.

Abstract

General Background YouTube provides an expansive digital platform for foreign learners practicing Indonesian. Specific Background Diverse mother tongue backgrounds generate varying phonological errors that risk fossilization without linguistic evaluation. Knowledge Gap Previous phonological studies isolated Asian and European speakers without directly comparing Japanese open-syllable and American closed-syllable frameworks. Aims This qualitative case study describes and compares omission, substitution, and epenthesis errors between Japanese and American speakers while proving mother tongue interference. Results Analyzing YouTube speech revealed the Japanese speaker produced 38 errors dominated by omission and epenthesis, whereas the American speaker generated 29 errors dominated by vowel substitution. The Japanese open-syllable structure systematically triggers vowel additions, whereas the English phonological absence of the independent schwa /ə/ causes vowel substitutions. Furthermore, both speakers consistently omit the word-final nasal phoneme /ŋ/. Novelty This study explicitly contrasts Asian and Western phonological interference mechanisms within digital media speech data. Implications These empirical findings allow language educators to map language-specific pronunciation challenges and design targeted phonological exercises. Highlights The Japanese open-syllable system predominantly triggers omission and epenthesis errors during Indonesian speech. The absence of an independent schwa phoneme in American English primarily causes vowel substitution errors. Both Japanese and American speakers universally struggle with the omission of the word-final nasal phoneme. Keywords Phonological Interference; Vowel Substitution; Epenthesis; Mother Tongue; Fossilization

Abstract

General Background: Blockchain is reshaping transactions, ownership, verification, smart contracts, tokenization, and digital governance, creating new legal objects for Islamic jurisprudence. Specific Background: In fiqh al-nawāzil, these configurations cannot be reduced to cryptocurrencies or product compliance because their legal character varies with architecture, functions, actors, rights, risks, and governance. Knowledge Gap: Empirical integration between technical knowledge, taḥqīq al-manāṭ, uṣūl al-fiqh, maqāṣid, and maʾālāt remains limited, while product-centred reasoning does not adequately capture system-level characteristics and consequences. Aims: This qualitative multi-stakeholder case study examined 28 informants through semi-structured interviews, legal vignettes, and documentary analysis to reconstruct digital ijtihād for blockchain-related cases. Results: Blockchain emerged as a multidimensional nāzilah; taḥqīq al-manāṭ functioned as the epistemic gateway linking technical reality with legal characterization; reasoning shifted from product-based classification toward systemic analysis and from post-hoc maqāṣid justification toward maṣlaḥah–mafsadah and consequence assessment. Novelty: The study formulates Substantive Digital Fiqh al-Nawāzil Theory, sequencing taṣawwur al-nāzilah, taḥqīq al-manāṭ, taʿyīn al-waṣf al-muʾaṡṡir, uṣūlī reasoning, maqāṣid evaluation, maṣlaḥah–mafsadah, maʾālāt al-afʿāl, legal determination, Shariah governance, and continuous monitoring. Implications: The framework supports object-first, systemic, consequence-sensitive, and multidisciplinary digital ijtihād for fatwas and Shariah governance. Highlights: Taḥqīq al-manāṭ linked technical facts with istinbāṭ al-ḥukm. Systemic legal characterization replaced product-centred classification across complex cases. Maqāṣid shifted toward maṣlaḥah–mafsadah and consequence-sensitive evaluation. Keywords: Fiqh Al-Nawāzil, Blockchain, Taḥqīq Al-Manāṭ, Substantive Digital Fiqh

Abstract

General Background: Civil servants assigned to Indonesia’s underdeveloped, frontier, and outermost island regions face distinctive geographic, infrastructural, transportation, and public-service constraints requiring context-sensitive administrative policies. Specific Background: Their welfare extends beyond remuneration to working conditions, career development, institutional recognition, rewards, and organizational support, while existing administrative arrangements remain predominantly general and uniform. Knowledge Gap: General policy standards do not adequately accommodate differences in regional difficulty, workload, geographic isolation, and assignment conditions, creating a gap between formal regulation and substantive fairness. Aims: This study analyzes welfare, reward, and recognition policies through legality, justice, legal certainty, proportionality, and good governance and formulates an ideal reconstruction using normative legal research with statutory and conceptual approaches. Results: The analysis demonstrates the need to move from uniform arrangements toward place-based and needs-based policies through regional identification, difficulty classification, proportional affirmative measures, and continuous evaluation and supervision. The reconstructed framework incorporates adaptive work culture, institutional trust, performance- and hardship-based rewards, and recognition integrated with competency and career development. Novelty: The study formulates a four-stage administrative policy reconstruction linking geographic characteristics directly to differentiated welfare and recognition arrangements. Implications: The framework provides a basis for substantive fairness, multidimensional employee welfare, stronger institutional commitment, and public-service quality in geographically disadvantaged island areas. Highlights: Uniform administrative standards inadequately reflect geographic hardship and assignment complexity. Regional difficulty classification provides a basis for proportional affirmative measures. Recognition should connect performance, institutional trust, competency development, and career progression. Keywords: Civil Servants (ASN), 3T Areas, Welfare, Appreciation, Recognition, State Administrative Law.

Abstract

General Background: Sustainable finance and climate-responsive fiscal policy are central to Indonesia’s transition toward a green economy and the financing of environmentally oriented public projects. Specific Background: Green Sukuk provides thematic Islamic financing for environmentally sustainable projects, while Climate Budget Tagging (CBT) identifies and monitors state-budget allocations for climate change mitigation and adaptation. Knowledge Gap: Previous studies have addressed Green Sukuk and green budgeting, whereas their joint contribution within a single empirical framework for Indonesian public infrastructure requires further assessment. Aims: This study analyzes Green Sukuk and CBT in relation to sustainable infrastructure development in Indonesia. Results: Panel data from seven ministries during 2018–2024 were estimated using a Fixed Effect Model. Green Sukuk and CBT jointly explained 89.86% of variation in sustainable infrastructure development. Green Sukuk recorded a positive coefficient of 0.037332, while CBT produced a substantially larger positive coefficient of 1.005269. The ministry-specific intercepts were negative, indicating declining development in the absence of these financing and budgeting mechanisms. Novelty: The study integrates thematic Islamic finance and climate-specific fiscal allocation within one ministry-level panel model. Implications: The findings support coordinated use of Green Sukuk and CBT for green project financing, climate-budget planning, transparency, accountability, and climate-oriented public expenditure. Highlights: Fiscal allocation recorded the substantially larger regression coefficient. Thematic Islamic financing showed a positive association with public green projects. Seven ministries displayed negative intercepts without the two funding mechanisms. Keywords: Sustainable Finance, Green Sukuk, Fiscal Instrument, Climate Budget Tagging, Sustainable Development

Abstract

General Background: The rapid expansion of peer-to-peer lending in Indonesia has generated complex regulatory challenges involving platform responsibility, contractual relationships, borrower safeguards, and lender risk allocation. Specific Background: Licensed platforms operate as digital intermediaries within tripartite relationships, while abusive debt collection, illegal operators, information asymmetry, and credit-default allocation create significant concerns for platform users. Knowledge Gap: Existing regulation leaves uncertainty regarding responsibility for lender losses, particularly when default arises from deficient credit scoring, fraud, or platform misconduct. Aims: This study examines the juridical position and responsibilities of licensed and unlicensed P2P lending operators and formulates a prescriptive framework for borrower and lender protection through normative legal research using statutory and conceptual approaches. Results: Licensed operators qualify as Other Financial Services Institutions and platform providers, maintain a mandate relationship with lenders, and bear vicarious liability for unlawful debt-collection practices. Unlicensed operators constitute financial-sector offenders whose agreements are void ab initio and unenforceable under the Ex Turpi Causa doctrine. Safeguards comprise preventive mechanisms, including CAMIL restrictions, SupTech, interest-rate limits, and Escrow and Virtual Accounts, alongside LAPS SJK, OJK sanctions, civil remedies, and integrated criminal enforcement. Novelty: The study proposes a mandatory Protection Fund to address lender exposure to default associated with platform fraud or negligence. Implications: This framework clarifies platform accountability while providing a regulatory basis for more balanced safeguards for borrowers and lenders. Highlight: Licensed platforms function solely as digital intermediaries within tripartite contractual relationships. Unlicensed operators’ agreements are void ab initio and unenforceable under the Ex Turpi Causa doctrine. A mandatory fund is proposed to address lender default-risk allocation gaps. Abstract

General Background The rapid advancement of artificial intelligence has introduced sophisticated digital manipulation technologies. Specific Background Consequently, synthetic media such as deepfakes frequently circulate on social networks, exposing young demographics to highly realistic fabricated content. Knowledge Gap While existing literature broadly addresses digital hoaxes, empirical research specifically examining regional academic populations' competencies in mitigating these threats remains underexplored. Aims This study investigates the verification capabilities of Universitas Al Asyariah Mandar cohorts in identifying synthetic manipulations and the subsequent role of such competencies in public opinion formation. Results Utilizing Renee Hobbs' framework and a qualitative approach, findings reveal that cohorts primarily encounter synthetic audio and face swaps via Reels and Explore algorithms. Driven by visual appeal and sharing habits, these manipulations initially shape user perceptions. However, individuals demonstrate robust capabilities to access, analyze visual discrepancies, evaluate sources against credible news, refrain from creating manipulations, and act responsibly by warning peers. Consequently, cross-referencing information neutralizes the initial deceptive power of synthetic media. Novelty The research uniquely synthesizes modern verification frameworks with Islamic communication principles, such as Tabayyun for verification and Qaulan Sadidan for ethical content creation, establishing a profound intersection between contemporary digital competencies and traditional ethical values. Implications Higher education institutions must prioritize targeted source verification and artificial intelligence education to cultivate resilient, critical attitudes against digital disinformation. Highlights Young adults frequently discover synthetic artificial intelligence manipulations through social network algorithm recommendations like Reels and Explore. Cross-referencing suspicious visual discrepancies with credible news outlets neutralizes initial deceptive perceptions. Modern digital verification competencies strongly align with Islamic ethical communication principles such as Tabayyun.
