Abstract

Background: Bullying and depression are psychological problems that continue to occur in university environments and have significant impacts on students’ mental well-being. Purpose : To describe the forms of bullying and the levels of depression among students of the Faculty of Social and Political Sciences at Sam Ratulangi University. Methods: This study used a descriptive quantitative design with the Olweus Bully Victim Questionnaire (OBVQ) and the Beck Depression Inventory-II (BDI-II) as research instruments. A total of 162 third-semester students participated and the data were analyzed using descriptive statistics. Results: The majority of students experienced bullying in the low category, particularly in verbal and relational forms, while physical bullying was rarely reported. Depression levels showed that half of the respondents were in the normal category, while the remainder experienced mild to severe depression. Conclusion: Although the bullying experienced by students generally occurred at low intensity, it was still associated with the emergence of depressive symptoms. This highlights the need for institutional attention toward bullying prevention and the provision of adequate mental health support for students.

Abstract

Government procurement is a strategic instrument in delivering public services and managing state finances, and therefore must be conducted in accordance with legal certainty, accountability, and the General Principles of Good Governance (Asas-Asas Umum Pemerintahan yang Baik/AUPB). Regulation of the National Public Procurement Agency Number 12 of 2021 (Perlem LKPP 12/2021) was enacted as a technical guideline for procurement through providers; however, its implementation raises several normative issues when examined in relation to Law Number 30 of 2014 on Government Administration (UU AP). This article aims to evaluate the compatibility of Perlem LKPP 12/2021 with the objectives and principles stipulated in UU AP 30/2014, to identify regulatory provisions that potentially create normative inconsistencies, and to propose recommendations for strengthening procurement governance. This study employs a normative juridical method using statutory, conceptual, and norm-mapping approaches. The findings indicate that several provisions of Perlem LKPP 12/2021—such as the authority of the Budget User Authority (KPA) as the final decision-maker in appeal objections, the obligation to submit a bid appeal guarantee amounting to 1% of the estimated contract value, ambiguous and multi-interpretable norms, non-affirmative advance payment arrangements for small enterprises, and one-sided performance evaluations of providers—are potentially inconsistent with the principles of legal certainty, prohibition of abuse of power, and legal protection as mandated by UU AP 30/2014. This article underscores the necessity of regulatory harmonization to ensure that technical procurement regulations do not exceed delegated authority, uphold legal protection, and promote fair, transparent, and accountable government procurement governance.

Abstract

The principle of freedom of contract is a fundamental principle in contract law which gives parties the authority to determine whether they will make an agreement, with whom the agreement is made, as well as the content and form of the agreement. This principle is rooted in the idea of ??autonomy of will which places contracts as the result of free agreement between the parties. However, in practice, the principle of freedom of contract is not applied uniformly to all types of contracts. Differences in the character of the parties, the purpose of the contract, and the interests protected by law cause variations in restrictions on freedom of contract, especially between government contracts and private contracts. Government contracts, even though they are in the form of agreements, cannot be separated from the state's function as organizer of public interests, so that freedom of contract in them experiences stricter restrictions. On the other hand, private contracts provide a wider space for freedom, although in practice they still face limitations due to the unequal bargaining positions of the parties. This research aims to analyze the concept of the principle of freedom of contract and compare its application in government contracts and private contracts in order to assess the relevance and legitimacy of this principle in modern contractual practice.

Abstract

This article discusses the dilemmas faced by Construction Consulting Service Providers when implementing lump sum contracts in projects funded by the government. The main issues arise during and after the consultancy services are performed. Lump sum contracts, which are based on payment for output, often lead to differing perceptions between Service Providers, Service Users, and Auditing Agencies regarding the accountability of payments. Service Providers sometimes feel disadvantaged, particularly when required to return payments for work performance that is not deemed satisfactory by Service Users or Auditors. This study analyzes the causes of these problems, focusing on the procurement process and the accountability of work completion. The research uses normative legal research, empirical legal research, and applies theoretical and legislative approaches, with primary and secondary data collected through reports and literature reviews. The findings suggest that the selection of lump sum contracts must align with the nature of the work, such as feasibility studies or surveys. Service Users should ensure standardized measurements to avoid discrepancies in perceptions among all parties involved. The study concludes that a shared understanding of the lump sum contract type is crucial for ensuring compliance with the contract's terms, and all parties must remain accountable, even if one feels disadvantaged by the other’s actions.

Abstract

Entrepreneurship is not solely associated with profit generation but also with the noble value of serving customers and society. In practice, two dominant perspectives often shape entrepreneurial decision-making: the practical-realistic perspective and the idealistic perspective. This study aims to analyze both perspectives in the context of entrepreneurship and identify their implications for profit orientation and service quality. The research applied a qualitative literature review with a comparative approach to national and international publications on business ethics, entrepreneurial practices, and decision-making paradigms. The findings reveal that the practical-realistic perspective positions profit as the main objective, in which service is treated as a business strategy, whereas the idealistic perspective views service as a moral calling where profit becomes a long-term outcome of customer satisfaction. The synergy of both perspectives forms the most effective entrepreneurial model in the current competitive era, leading to sustainable business growth based on balanced profit and service values. This research also identifies that implementing a hybrid model integrating both paradigms can simultaneously enhance competitiveness, business sustainability, and corporate social contribution.

Abstract

Operational risk remains a persistent challenge for commercial banks due to complex processes, high transaction volumes, and stringent regulatory requirements. Internal control functions are expected to strengthen prevention, detection, and response capabilities, yet performance evaluation frequently relies on outcome indicators that are partially outside the span of control of the evaluated unit. This study develops and tests an integrated evaluation model that combines Balanced Scorecard measurement, gap analysis, risk based prioritisation, and Root Cause Analysis to identify improvement priorities for an internal control unit in a commercial bank. An explanatory sequential mixed methods design was applied. Quantitative analysis used 14 Balanced Scorecard indicators for fiscal year 2024, standardised to a 1 to 5 scale, and combined with perception survey results from 50 respondents. A composite score was computed as Z_i=0.7X_i+0.3Y_i, and a gap score as G_i=5-Z_i. Priority ranking used PRI_i=G_i×w_i×R_i, where w_idenotes indicator weight and R_idenotes operational risk impact. Qualitative data were collected through semi structured interviews, limited observation, and document review to explain quantitative patterns and classify gap typologies. Results indicate high overall performance with a total index of approximately 4.56 out of 5.00, while gaps concentrate in a small subset of outcome oriented indicators. The highest priorities for Root Cause Analysis correspond to a financial outcome indicator, a stakeholder satisfaction indicator, and an efficiency indicator, reflecting misalignment between outcome metrics and controllable activities, as well as service and documentation constraints. The integrated model produces a structured improvement roadmap consisting of 22 actions grouped into quick wins for 2025 and strategic initiatives for 2026, and is validated through member checking and triangulation. The study contributes a practical and auditable approach to performance evaluation for internal control units in commercial banking by embedding span of control reasoning, risk based prioritisation, and actionable Root Cause Analysis outputs.

Abstract

Penelitian ini bertujuan untuk mengevaluasi program Badan Usaha Milik Desa (BUM Desa) Makmur Taduna dalam pengelolaan sumber daya terhadap kesejahteraan masyarakat di Desa Taduna, Kecamatan Kabaruan, Kabupaten Kepulauan Talaud. BUM Desa merupakan lembaga ekonomi desa yang dibentuk untuk meningkatkan kesejahteraan masyarakat melalui pengelolaan aset dan pengembangan usaha ekonomi. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif, menerapkan model evaluasi CIPP (Context, Input, Process, Product) dari Stufflebeam dan Zhang. Pengumpulan data dilakukan melalui wawancara mendalam, observasi partisipatif, dan dokumentasi terhadap informan yang terdiri dari Kepala Desa, Ketua BPD, pengurus BUM Desa, anggota, dan masyarakat. Hasil penelitian menunjukkan bahwa pada evaluasi konteks, tujuan pembentukan BUM Desa untuk meningkatkan kesejahteraan belum tercapai akibat keterbatasan kemampuan sumber daya manusia dalam pengelolaan usaha. Evaluasi masukan mengungkapkan bahwa perencanaan yang tidak matang menyebabkan pelaksanaan tidak transparan dan pengelolaan keuangan yang amburadul. Evaluasi proses menunjukkan berbagai hambatan signifikan, termasuk masalah perpindahan lokasi kios desa sebanyak tiga kali, penyalahgunaan keuangan oleh oknum pengurus, hasil penjualan yang tidak disetor dengan benar, dan konflik internal antar pengurus. Evaluasi produk menunjukkan bahwa sejak beroperasi kembali tahun 2024, program kios desa belum memberikan hasil signifikan baik bagi kesejahteraan masyarakat maupun pendapatan asli desa, bahkan mengalami kerugian Rp 20.000.000 pada tahun 2024. Penelitian ini merekomendasikan perlunya peningkatan kapasitas SDM, perbaikan sistem pengelolaan keuangan yang transparan dan akuntabel, serta penguatan pengawasan oleh BPD untuk keberlanjutan program BUM Desa.

Abstract

Peningkatan populasi lansia, termasuk di lembaga pemasyarakatan, menimbulkan tantangan serius terhadap kualitas hidup, fungsi kognitif, dan kesejahteraan psikososial. Warga Binaan Pemasyarakatan (WBP) lansia menghadapi keterbatasan aktivitas fisik, ruang gerak, serta interaksi sosial yang berpotensi mempercepat penurunan fungsi fisik dan kognitif. Program ini bertujuan untuk meningkatkan kualitas hidup dan fungsi kognitif WBP lansia melalui penerapan inovasi Exercise Game Therapy berbasis Cognitive Motor Dual Task (CMDT) di Lapas Kelas IIB Sleman. Metode pelaksanaan meliputi observasi dan Focus Group Discussion (FGD), sosialisasi program, pemeriksaan awal, pelaksanaan intervensi, serta evaluasi program. Intervensi dilakukan melalui tiga komponen utama, yaitu Apik Raga, Apik Rasa, dan Apik Rengkuh, yang mengintegrasikan latihan fisik, stimulasi kognitif, dan interaksi sosial secara bertahap dan menyenangkan. Evaluasi menggunakan instrumen SF-36 untuk kualitas hidup, Mini Mental State Examination (MMSE) untuk fungsi kognitif, serta pemeriksaan tanda vital. Hasil menunjukkan adanya peningkatan signifikan pada skor kualitas hidup, khususnya pada aspek fungsi fisik, kesejahteraan emosional, dan fungsi sosial, serta perbaikan fungsi kognitif dan kesejahteraan psikologis WBP lansia. Program ini terbukti efektif, aplikatif, dan berpotensi berkelanjutan sebagai model intervensi kesehatan lansia di lingkungan pemasyarakatan.

Abstract

Dalam meningkatkan kekuatan struktural turbin angin Savonius, optimasi desain bilah dan pemilihan material menjadi faktor penting terutama untuk operasi pada kecepatan angin rendah. Turbin helix Savonius diketahui memiliki performa lebih baik dibandingkan model konvensional karena desain spiralnya yang menstabilkan torsi, sementara penggunaan airfoil shape blade mampu meningkatkan torsi hingga 10% dibanding tipe U tradisional. Pada penelitian ini, material PLA dipilih karena ringan dan ramah lingkungan, meskipun memiliki kelemahan berupa titik leleh rendah dan sifat rapuh. Untuk meningkatkan performa mekanisnya, digunakan dua variasi struktur, yaitu struktur solid sebagai kontrol dan struktur sandwich re-entrant sebagai struktur inti. Pengujian three-point bending menunjukkan bahwa struktur solid memiliki flexural strength tertinggi sebesar 55 MPa, sedangkan struktur re-entrant memiliki nilai 48,11 MPa. Namun hasil simulasi statis menggunakan Finite Element Method (FEM) memperlihatkan bahwa struktur re-entrant mampu mendistribusikan tegangan Von Mises lebih merata sehingga menurunkan konsentrasi stress pada area kritis blade. Sebaliknya, struktur solid menunjukkan total deformation paling kecil pada pembebanan 0,049 N untuk blade dan 0,1225 N untuk rangkaian turbin, yang menandakan kekakuan struktural lebih tinggi. Hasil simulasi Computational Fluid Dynamics (CFD) pada kecepatan angin 2 m/s menunjukkan bahwa struktur re-entrant menghasilkan pola aliran yang lebih stabil. Secara keseluruhan, struktur solid unggul dalam kekakuan dan flexural strength, sedangkan struktur re-entrant lebih baik dalam distribusi tegangan dan respons aerodinamik.
