Abstract

Electronic commerce or e-commerce constitutes a commercial activity on the rise. Although it has many advantages, there are several lingering factors that prevent its consolidation, such as the lack of trust of the potential consumer/user. In order to overcome that obstacle, instruments of self-regulation were created in the field of advertising. Firms that wish to distinguish themselves favorably against their competitors have the option of adopting those instruments, which play a praiseworthy role regarding the target audience and constitutes a considerable improvement of consumer rights. However, on occasions, problems arise in the market when those systems of self-regulation bind third parties that did not voluntarily enter into a contract. This paper tackles the question of if self-regulation of advertising in the net can be put in place should it affects the honor of the third party not committed with the fair-practices document. In this article, we will refer to the particularities that arise from a case concerning the Chilean Law no. 20,168, of 2007, on unfair competition and self-regulation of advertising in the Internet pertaining WOM, Movistar, Entel, Claro and Virgin. The Chilean Law no. 20,168, of 2007 contributes to the goal of discouraging conduct contrary to good faith or good practices in advertising in conjunction with codes of conduct that have been approved in the field related to the systems of self -regulation.

Abstract

The image of Prince Diponegoro as a national hero of Indonesia is very strong. However, there are controversies and myths regarding his characterization. The researcher deconstructs the character of Prince Diponegoro by appropriating Raden Saleh's painting entitled Penangkapan Pangeran Diponegoro by tracing the authentic script from the autobiography of Babad Diponegoro. The manuscript is examined using an intertextuality approach. Prince Diponegoro is constructed based on the physical characteristics contained in the Babad Diponegoro text into a three-dimensional digital model. The results are then rearranged using the deconstruction method by detaching from the existing stereotype of Prince Diponegoro and displaying his character and habits as written in Babad Diponegoro. A number of questions to be answered through this research are what can be visualized from the character of Prince Diponegoro using a textual approach, especially based on Babad Diponegoro, why does the character and identity based on Babad Diponegoro need to be visualized and what methods can be used to bring out the body and character. through the use of digital technology which includes embodiment, motion, gesture, sound, light, interactivity so as to provide a new experience for the audience. The result was a series of movements and visuals that enriched the characterization of Prince Diponegoro. All characters, both those that have been formed for a long time and those that were only known after the translation of Babad Diponegoro, were shown in the virtual experiment entitled Hikayat Dipanegara. The results showed that appropriation using different dimensions and technology resulted in a new image of Prince Diponegoro. The crossing of signs that occurs between real and virtual experiences and in the context of time can provide a new experience which may change the perspective or understanding of things.

Abstract

Law as control should regard the reality, values and factors that determine every society's behaviour or action. As defined by the positivism and legal positivism paradigm, law enforcement should shift into a constructivist legal paradigm framework to reconstruct a more comprehensive law. Written law has a limited reach because it is quickly left behind by considering that the text of statutory rules is formulated in a different space and time than the current conditions. Through hermeneutic interpretation of the law, law enforcers are expected to understand every legal issue confined in legal texts and the context of the reality of the problem in depth. Law enforcers are guided by the methodology of legal discovery, which is driven by applicable laws and human behaviour. Every person who carries out every behaviour or action (actus) must be understood to the deepest or hidden layer, namely the subjective motivations behind his actions. Law enforcers must view reality as conceptual reality by making ideas as hypotheses to understand truth collectively and comprehensively.
