Este artigo discute o processo de coleta online de assinaturas para proposições legislativas, tendo por ponto de partida o processo vigente para iniciativa popular na Califórnia. Nele, descreve-se como a assinatura online de petições de iniciativa popular funcionaria, bem assim como questões de segurança e outras objeções à coleta de assinaturas via internet poderiam ser abordadas e, finalmente, os prós e contras de se aplicar este método de coleta de assinaturas às iniciativas populares.

Abstract

It has been 18 years since the enactment of Law of The Republic of Indonesia Number 32 of 2002 on Broadcasting in Indonesia. During that time, Sistem Siaran Jaringan or commonly known as SSJ became the national broadcasting system. One of the elements in SSJ that differentiates it from the previous broadcasting system is the obligation for private broadcasters in Indonesia to broadcast local programs as much as 10% of their total broadcast hours. The hopes of Law of The Republic of Indonesia Number 32 of 2002 on Broadcasting, diversity of content and diversity of ownership, are often echoed in research related to broadcasting activities as a "revolution" from the previous broadcasting law which had the impression of being centralized from Jakarta. How are things now? Has this objective been implemented properly by private broadcaster in its broadcasting activities in Malang City?.

Abstract

Knowledge, skills and talents that may be utilized to provide professional services are human capital. The firm has a collective ability for the creation of ideas, innovations and appropriate solutions to help the company accomplish its business goals. The ability of human capital is for individuals to win the world's competition to offer employees with more financial value. Thus, this study is intended to establish the function of human capital in creating trustworthy human resources within the education sector. A qualitative technique is used in this study by gathering literature-based research data sources. The results demonstrate that the function of human capital is crucial in the education sector, since human capital provides a strong basis for the advancement of the educational world and for the creation of a new order that is essential in today's progressive world.

Abstract

Article 4 7(1) of Law No 23 of 2006 on the Administration of the Population (Adminduk) provides that the adoption of children is a legal act to transfer the rights of the child from the families of parents, legal guardians and others responsible for the care, education and bringing of children into the families of their adoptive parents by decision of the Court Basing this child acceptance on the concept or limitation of child adoption is a legal act with certain law-controlled goals and aims and inevitable legal consequences, such as the bodily and psychological responsibility of the child he or she accepts. Kid Recognition is a father's recognition of his kid born from lawful marriage with the agreement of the biological mother of the child. Kid acknowledgment is meant to provide the child a biological father/father, as well as legal civil ties. The provisions mentioned in the Elucidation of Article 49(1) of the Adminduk Law are acknowledgments that can only be made by the father/father, in this case there is no mother's acknowledgement; in other words, it is not automatically necessary to prove that the child was not born by the mother concerned. Elucidating Article 50(1) of the Child Legalization Administration Law is the ratification of the status of a child born outside the legal marital bond while registering the marriage of the child's two parents. Article 50(1) of the Administrative Law requires parents to notify the child's ratification to the Implementing Agency no later than 30 (thirty) days after the child's father and mother marry and acquire a marriage certificate. Child Recognition or Child Ratification can be performed for children born outside formal marriage. If the child's acknowledgement is restricted to a disclosure from his biological father, accepted by his birth mother, without being followed by the parents' marriage, yet in the Child Legalization, the child's mother and father are married. When documenting the wedding, the youngster is recognized as their biological kid. And this kid's ratification is a legal endeavor (rechtsmiddel) to offer a position as a legitimate kid through marriage by his parents.

Abstract

Este artigo tem por finalidade analisar a aplicação seletiva da interoperabilidade como standard regulatório na fronteira entre infraestrutura de telecomunicações e serviço de valor adicionado no caso do mobile payment no Brasil. O texto segue o método de abordagem comparativa e interdisciplinar, buscando identificar o contexto regulatório de cada subsistema no qual o standard de interoperabilidade está inserido. Foram identificados os principais elementos de possibilidade da opção regulatória por interoperabilidade no Brasil no âmbito das telecomunicações e nos novos serviços de pagamento. O texto serve como guia para análise da opção regulatória por interoperabilidade nas telecomunicações e nos novos serviços de pagamento. Originalidade/relevância – O artigo contextualiza o significado da interoperabilidade no atual contexto brasileiro para os novos serviços de pagamento.

Abstract

This study is intended to analyze the leadership of lecturers in influencing members of the Civic Education learning class faced with the Covid-19 Pandemic. The discussion focused on controlling tactics used by lecturers in-class activities, including the initial stage, the running stage, to the final step. Qualitative methods are used to discuss the problem, and the data analysis approach is carried out using descriptive techniques. Data was collected using interviews with selected lecturers, observations, and literature studies. The process is complemented by the role of the researcher as the main instrument. The data results show that the influence tactics used by lecturers in their leadership are adjusted to existing conditions, including the initial stage, the running stage, and the final stage referring to the dynamics of the Covid-19 pandemic condition.

Abstract

There are often legal problems, both concerning issues of authenticity, authenticity and proof because there is no law that specifically regulates personal data of agreement users via electronic means. The problem raised is how the problem of the authenticity, authenticity and integrity of the agreement electronically and how the validity of an agreement made electronically. The research method that the author uses is normative qualitative by using secondary data and reinforced by primary data or field data. The results of the study show that the authenticity, authenticity and integrity of the agreement electronically can be carried out using digital forensic tools. The use of information through electronic media concerning a person's personal data must be carried out with the consent of the person concerned. Agreements made electronically/digitally have the same evidentiary power as agreements made through manuals. Judges can use the evidentiary system with the development towards open evidence. Evidence obtained from anywhere as long as the truth can be accepted as long as it does not conflict with public order, considering that in conducting transactions in the current digital era, we will often use online media.

Abstract

In terms of community involvement, the conduct of regional head elections embodies the representational function inherent in popular sovereignty. The role of representation is one of the government's functions. As a result, the selection represents the aim of Government Science. The purpose of this research is to assess "Community Participation in the Conduct of Simultaneous Regional Head Elections during the Covid-19 Pandemic Period" in Banten Province (Case Study: Serang Regency, Pandeglang Regency, Cilegon City, and Tangerang City) in 2020. This study employs a qualitative research design in conjunction with a descriptive research method. The analysis used in this study is political participation from The International Encyclopedia of the Social Sciences. A conceptual definition is developed that Community Participation in Simultaneous Regional Head Elections is the active participation of voters in various voter participation levels in the 2015 simultaneous Regional Head Elections (Pilkada). 2020 in Banten Province, voter turnout will exceed 60% in the four regencies/cities hosting simultaneous regional elections on December 9 2020. Pandeglang Regency achieved 68.7 per cent in 2020, up from 56 per cent in 2015, Cilegon City achieved 79.79 per cent in 2020, exceeding the national target by as much as 63.51 per cent in 2015, Serang Regency earned 63.3 per cent in 2020, up from 50.8 per cent in 2015 Pilkada. South Tangerang City achieved 60.4 per cent in 2020. In 2015, voting turnout was 57 per cent, a considerable rise despite the current epidemic of Covid-19.

Abstract

The learning educates pupils that the key predictors of academic success are educational concepts and learning theories. Learning is a double process of communication: the teacher as an educator teaches while students teach. This is a qualitative type of research. Qualitative research is an investigation process which produces descriptive data of people and observed conduct in written or spoken terms. An interdisciplinary strategy is applied in this study, integrating management, pedagogy, sociology and psychology techniques. Two types of data sources are used in this study: Primary data. Primary information. Primary data are collected in field research from informants who, in this case, are professors of Islamic Religious Education directly. Research and analytical results show that: 1) there have been difference between students who follow the co-operative method of learning and students who follow the conventional method of learning; 2) there has been no difference between students with introverted personality type and students with extraverted personality.

Abstract

O artigo busca analisar a independência formal e a independência real das agências reguladoras no Brasil, nos diversos aspectos que a estruturam. Metodologia/abordagem/design – A análise apoia-se nas perspectivas histórica, doutrinária e institucional de direito comparado para a construção dos conceitos de regulação e agências reguladoras, abordando as questões da legitimidade e controle desses entes em um Estado Democrático de Direito. O estudo conclui que o transplante das estruturas legais que dão suporte à independência das agências reguladoras tem baixa eficácia frente às culturas normativa e política pré-existentes, o que poderá levar à redução de sua independência real. se que este artigo possa apoiar o trabalho de pesquisadores interessados nas relações das teorias da regulação com o histórico das agências reguladoras no Brasil. O artigo sintetiza conceitos relativos à regulação e às agências reguladoras, e sua evolução nos Estados Unidos e no Brasil, com foco nas questões de sua independência formal e real. As recentes propostas de modificações normativas e o dilema que se estabelece entre a independência das agências reguladoras e a agenda do Governo Federal são também apresentados.
