Abstract

This study explores the concepts of qath’i and zhanniy  in the sources of Islamic law, namely the Qur'an and Hadith, from the perspectives of tsubut/wurud (authenticity of origin) and dalalah (implication of meaning). The research employs a literature review method with a qualitative approach and content analysis of classical and contemporary scholars' views. The findings indicate that the Qur'an is generally considered a qath’i al-wurud (definitive in transmission), while Hadits except for those classified as mutawatir are typically zhanniy al-wurud (speculative in transmission). In terms of dalalah, some texts are deemed qath’i due to their singular and unambiguous meanings, while others are considered zhanniy as they allow for multiple interpretations, such as verses regarding iddah (waiting period) and the procedure of ablution. This study emphasizes that distinguishing between qath’i and zhanniy is essential to prevent rigidity in religious practice, avoid extremism, and promote a moderate understanding of Islam. Abstrak: Perbedaan pemahaman terhadap nash-nash dalam al-Qur’an dan Hadis seringkali berpangkal pada persoalan q{at{‘i> dan z{anni>, baik dari sisi asal-usul maupun penunjukan maknanya, yang berdampak pada beragamnya fatwa dan mazhab dalam Islam. Olehnya itu, penelitian ini bertujuan untuk membahas konsep q{at{‘i> dan z{anni> dalam sumber hukum Islam, yakni al-Qur’an dan Hadis, baik ditinjau dari aspek s\ubut /wuru>d>d (kepastian asal sumber) maupun dala>lah (penunjukan makna). Metode yang digunakan adalah studi pustaka dengan pendekatan kualitatif dan analisis isi terhadap pandangan para ulama klasik dan kontemporer. Hasil penelitian menunjukkan bahwa al-Qur’an secara umum merupakan sumber hukum yang q{at{‘i> al-wuru>d>d, sedangkan Hadis, kecuali yang mutawatir, umumnya tergolong z{anni> al-wuru>d>d. Dari sisi dala>lah, terdapat nas} yang bersifat q{at{‘i> karena mengandung makna tunggal dan pasti, serta nas{ yang z{anni> karena membuka kemungkinan makna jamak dan multitafsir, seperti pada ayat tentang iddah dan tata cara wudhu. Penelitian ini menegaskan bahwa pembedaan antara q{at{‘i> dan z{anni>, penting untuk mencegah kekakuan beragama, menghindari sikap ekstrem, dan mendorong pemahaman Islam yang moderat (was{at{iah). Pemikiran Islam tentang q{at{‘i> dan z{anni> adalah hasil ijtihad ulama yang dinamis, kontekstual, dan responsif terhadap perkembangan masyarakat.

Abstract

Abstract This research discusses the concept of naskh according to Huseyin Atay's thought. In reality, scholars differ in addressing naskh in the Qur'an, there are groups of supporters and not a few who reject, one of whom is Huseyin Atay. This type of research is qualitative research based on literature (library research) using a rationality approach. The results of this study show that the fundamental thing about Atay's view regarding naskh is that there is no naskh in the Qur'an. This view is based on the conclusion that each verse has the validity of its own content and context. He continued, the view that states there is naskh between verses in the Qur'an contradicts QS. al-Nisa>'/4: 82 that if the Qur'an did not come from Allah, there would be contradictions in it. This research can be a reference in the study of ‘ulu>m al-Qur'a>n, especially related to naskh in Huseyin Atay's view. Abstrak Penelitian ini membahas tentang konsep naskh menurut pemikiran Huseyin Atay. Dalam realitasnya, para ulama berbeda dalam menyikapi naskh dalam al-Qur’an, terdapat kelompok pendukung dan tidak sedikit pula yang menolak, satu di antaranya adalah Huseyin Atay. Jenis penelitian ini adalah penelitian kualitatif berbasis kepustakaan (library research) dengan menggunakan pendekatan rasionalitas. Adapun hasil dari penelitian ini menunjukkan bahwa hal mendasar dari pandangan Atay terkait naskh adalah tidak ada naskh dalam al-Qur’an. Pandangan itu didasarkannya pada kesimpulan bahwa setiap ayat memiliki keabsahan dari kandungan dan konteksnya sendiri. Lanjutnya, pandangan yang menyatakan terdapat naskh antar ayat dalam al-Qur’an bertentangan dengan QS. al-Nisa>’/4: 82 bahwa seandainya al-Qur’an itu tidak datang dari sisi Allah tentulah ditemukan pertentangan di dalamnya. Penelitian ini dapat menjadi referensi dalam kajian ‘ulu>m al-Qur’a>n terutama terkait dengan naskh dalam pandangan Huseyin Atay.

Abstract

Abstract: This paper discusses adultery as a criminal offense in Islam based on the Prophetic traditions. It aims to explore the concept of zina, the sanctions imposed on perpetrators, and the relevance of applying Islamic criminal law in contemporary social contexts. Using a normative-theological approach and qualitative descriptive methods, the data are obtained from primary sources in the form of authentic hadiths and supported by secondary literature. The study reveals that Islam imposes firm sanctions against adultery, such as stoning for married offenders (muḥṣan) and flogging for unmarried ones (gairu muḥṣan), serving both as a preventive and educational measure to uphold public morality. In Indonesia, its application faces legal challenges, as adultery is classified as a complaint-based offense. This study recommends a reformulation of national criminal policies grounded in hadith values to realize a fair and moral legal system. Abstrak: Tulisan ini membahas perzinaan sebagai salah satu bentuk tindak pidana dalam Islam berdasarkan hadis-hadis Nabi Muhammad SAW. Penelitian ini bertujuan untuk menggali secara mendalam konsep zina, sanksi terhadap pelakunya, serta relevansi penerapan hukum zina dalam konteks sosial kontemporer. Menggunakan pendekatan normatif-teologis dan metode kualitatif deskriptif, data diperoleh dari literatur primer berupa hadis-hadis ṣaḥīḥ serta literatur sekunder pendukung lainnya. Hasil kajian menunjukkan bahwa Islam menetapkan sanksi tegas terhadap zina, seperti rajam bagi pelaku yang telah menikah (muḥṣan) dan cambuk bagi yang belum menikah (gairu muḥṣan), sebagai upaya preventif dan edukatif dalam menjaga moralitas publik. Dalam konteks Indonesia, penerapan hukum ini dihadapkan pada sistem hukum nasional yang menetapkan zina sebagai delik aduan. Kajian ini merekomendasikan reformulasi kebijakan hukum pidana nasional berbasis nilai-nilai hadis, demi mewujudkan sistem hukum yang adil dan bermoral.

Abstract

Abstract: The Mappatende tradition is an annual ritual performed by agrarian communities in Panggalo Village as a form of gratitude for the harvest. However, this tradition has received various perceptions among local residents, with some groups viewing it as a religious innovation (bid‘ah). This study aims to analyze the Qur'anic values embedded in the Mappatende tradition and how these values are implemented in the community’s social life. The research employs a qualitative approach using observation, in-depth interviews, and documentation methods. Data analysis is conducted through the Living Qur’an approach, which interprets how Qur’anic teachings are practiced contextually within local culture. The findings reveal that the Mappatende tradition embodies and expresses Qur’anic values such as gratitude (shukr), kinship (silaturahmi), cooperation, and charity (sadaqah), all of which are reflected in each stage of the ritual. These results imply that local traditions can serve as a medium for contextualizing and preserving Islamic values within society. Abstrak: Tradisi Mappatende merupakan ritual tahunan masyarakat agraris di Desa Panggalo sebagai bentuk ungkapan syukur atas hasil panen. Namun, tradisi ini mendapat beragam pandangan di tengah masyarakat, termasuk anggapan sebagai praktik bid‘ah oleh sebagian kelompok. Penelitian ini bertujuan untuk menganalisis nilai-nilai al-Qur’an yang terkandung dalam pelaksanaan tradisi Mappatende serta bagaimana implementasinya dalam kehidupan sosial masyarakat. Penelitian ini menggunakan pendekatan kualitatif dengan metode observasi, wawancara mendalam, dan dokumentasi. Analisis dilakukan dengan pendekatan Living Qur’an, yaitu menelaah makna dan praktik nilai-nilai Qur’ani dalam budaya lokal. Hasil penelitian menunjukkan bahwa tradisi Mappatende mengandung dan merepresentasikan nilai-nilai al-Qur’an seperti syukur, silaturahmi, kerjasama, dan sedekah, yang diimplementasikan dalam seluruh tahapan pelaksanaannya. Implikasi dari temuan ini menunjukkan bahwa tradisi lokal seperti Mappatende dapat menjadi media aktualisasi ajaran Islam secara kontekstual dan menjadi sarana pelestarian nilai-nilai Qur’ani dalam budaya masyarakat. Abstract

Oral practice can be principally viewed as text because it is classified as meaningful action. Often occurring in religious traditions, meaningful action can take the form of delivering oral exegesis both in everyday life and in the virtual world, as Hamza Yusuf did. Employing an interdisciplinary approach, namely communication, orality and contextuality, I attempt to analyze the phenomenon of the contemporary Quran. The result unveils that inquiry as a text appears to produce a clear construction of understanding. From a communication point of view, Yusuf's oral exegesis, especially the interpretation of QS. al-H{ujura>t (49) verse 13, tries to convey the basic concepts of humanity which are really needed in the contemporary era prioritizing collective and behavioral ideas. Furthermore, Yusuf's practice of oral exegesis also fulfills all the characteristics of orality with interpretive contextual material that comes from the history of his life with intercultural communication nuance.

Abstract

Digital technological development has had a significant impact on various aspects of life, including in the realm of spirituality and religious experience. Algorithms, as the core of modern digital systems, now play a central role in shaping the way individuals access, understand, and express spiritual values. More than just technical devices, algorithms function as cultural mechanisms that actively construct and represent religious subjects according to platform logic and market interests. This article aims to analyze how religious subjects are constructed and determined by algorithmic logic using philosophy of existentialism as approach. The focus of the discussion includes the crisis of authenticity, the commodification of religiosity, and the emergence of the possibility of ethical resistance to algorithmic determination. In this context, digital space often traps spirituality in a shallow and easily consumed format, obscuring the depth of authentic religious meaning. However, this study also reveals that there is still potential for religious subjects to reclaim the space of reflection and spiritual meaning through conscious and ethical actions. Thus, digital space can be read not only as a field of technological domination, but also as an arena for contestation of meaning and spiritual liberation that allows for a more authentic religious subjectivity Perkembangan teknologi digital telah membawa dampak signifikan terhadap berbagai aspek kehidupan, termasuk dalam ranah spiritualitas dan pengalaman religius. Algoritma, sebagai inti dari sistem digital modern, kini memainkan peran sentral dalam membentuk cara individu mengakses, memahami, dan mengekspresikan nilai-nilai spiritual. Lebih dari sekadar perangkat teknis, algoritma berfungsi sebagai mekanisme kultural yang secara aktif mengonstruksi dan merepresentasikan subjek religius sesuai dengan logika platform dan kepentingan pasar. Artikel ini bertujuan untuk menganalisis bagaimana subjek religius dikonstruksi dan ditentukan oleh logika algoritmis dengan menggunakan pendekatan filsafat eksistensialisme. Fokus pembahasan mencakup krisis otentisitas, komodifikasi religiusitas, serta kemungkinan lahirnya resistensi etis terhadap determinasi algoritmik. Dalam konteks ini, ruang digital kerap menjebak spiritualitas dalam format yang dangkal dan mudah dikonsumsi, mengaburkan kedalaman makna religius yang autentik. Namun demikian, kajian ini juga mengungkap bahwa masih terdapat potensi bagi subjek religius untuk merebut kembali ruang refleksi dan pemaknaan spiritual melalui tindakan sadar dan etis. Dengan demikian, ruang digital dapat dibaca tidak hanya sebagai medan dominasi teknologi, tetapi juga sebagai arena kontestasi makna dan pembebasan spiritual yang memungkinkan subjektivitas religius yang lebih otentik.

Abstract

This study examines the integration of hadith with the local cultures of the Bugis, Makassar, and Mandar communities in the Islamization of South Sulawesi. Unlike previous research that predominantly focuses on the historical or political dimensions of Islamization, this study highlights how the core principles of the Prophet Muhammad’s da‘wah—particularly gentleness (rifq), ease (taysīr), wisdom (ḥikmah), and gradualism (tadarruj)—were translated by early scholars into culturally resonant practices. Employing a qualitative descriptive approach, this research analyzes hadith texts, historical sources, ethnographic studies, and empirical data from the da‘wah practices of influential figures : Datuk ri Bandang, Datuk Patimang and Datuk ri Tiro. The findings reveal that Islam was embraced peacefully due to the deep compatibility between Prophetic ethical principles and local cultural values such as siri’ (honor), pacce (solidarity), and sipakatau (human dignity). This harmony is reflected in the Islamized forms of communal traditions, including mabbarazanji, sayyang pattu’du, and other ritual expressions. The study concludes that the success of Islamization in South Sulawesi resulted from adaptive, persuasive, and context-sensitive da‘wah strategies rooted in the Sunnah. These findings offer a compelling model of hadith-based cultural da‘wah that remains highly relevant for contemporary multicultural societies.

Abstract

This study analyzes the construction of religious authorities and religious leaders' agencies in the resolution of social conflicts through the perspective of living sunnah, with a case study of the role of Habib Rotan in the conflict of the Manunda Presidential Market, Palu City. This study criticizes the dominant perspective that positions religion as a trigger for conflict by affirming its role as a source of religious peacebuilding. The research employs a qualitative approach that includes case studies within the framework of religious authority theory, structuring theory, and living sunnah. Data were obtained through observation, interviews, documentation, and literature studies and then analyzed using the Miles and Huberman model. The results of the study show that religious authority is formed through the dialectic of genealogical capital, scientific legitimacy, social charisma, and the institution of the dhikr assembly. Religious agencies are carried out through soft power strategies, collaborative mediation, and internalization of the values of ishlah, tasamuh, and rahmah, thereby strengthening the social cohesion of multicultural communities.

Abstract

Krisis lingkungan modern mencerminkan renggangnya relasi harmonis manusia dan alam. Dalam Islam, persoalan lingkungan tidak hanya bersifat ekologis, tetapi juga teologis dan etis. Hadis Nabi saw. memuat prinsip-prinsip pemeliharaan lingkungan, seperti larangan merusak, anjuran menjaga kebersihan, perlakuan etis terhadap makhluk hidup, dan perintah memakmurkan bumi. Namun, pemahaman dan implementasi hadis-hadis tersebut di masyarakat masih parsial dan belum sepenuhnya merespons problem lingkungan kontemporer. Artikel ini menganalisis konstruksi pemahaman hadis ekologis dalam pemikiran Yusuf al-Qaradawi serta relevansi dan implementasinya pada masyarakat pesisir Campalagian. Penelitian ini menggunakan pendekatan kualitatif melalui studi kepustakaan yang dipadukan dengan analisis kontekstual realitas sosial-ekologis masyarakat pesisir. Data primer bersumber dari karya al-Qaradawi, khususnya Kaifa Nata’a>mal ma‘a al-Sunnah al-Nabawiyyah dan Ri’a>yah al-Bi>’ah fi> Syari>‘ah al-Isla>m, didukung literatur ekologi Islam dan data kondisi lingkungan setempat. Hasil penelitian menunjukkan bahwa al-Qaradawi menawarkan metodologi pemahaman hadis ekologis yang komprehensif melalui keselarasan hadis dengan al-Qur’an, pendekatan tematik, analisis konteks historis dan kebahasaan, pembedaan tujuan dan sarana, serta integrasi maqāṣid al-syarī‘ah. Prinsip-prinsip ini relevan bagi masyarakat pesisir Campalagian, namun implementasinya masih terkendala rendahnya kesadaran ekologis, keterbatasan infrastruktur, dan kebiasaan sosial yang belum sejalan dengan etika lingkungan Islam. Penelitian ini menegaskan bahwa pemikiran Yusuf al-Qaradawi memberikan landasan metodologis dan normatif penting bagi pengembangan etika lingkungan Islam serta penguatan implementasi hadis ekologis dalam kehidupan masyarakat pesisir.

Abstract

This article examines the concept of qiwa>mah in QS. al-Nisa>‘/4:34 by going beyond interpretations that limit it to domestic ethics in husband-wife relationships. Through a qualitative approach based on literature study and semantic-relational analysis, this article shows that qiwa>mah not only functions as a normative status or legitimization of gender hierarchy, but also as an ethical function that arises from certain excess (fad}l) and is manifested through concrete responsibility (anfaq). By placing the family as the smallest social unit, QS. al-Nisa>‘/4:34 can be read as a pedagogical medium of the Qur’an to explain the principles of managing asymmetrical relationships ethically. This reading places qiwa>mah as a framework of the ethics of power that emphasizes protection, justice, and the prevention of injustice, and is relevant to broader social and political relations. Artikel ini mengkaji konsep qiwa>mah dalam QS. al-Nisa>‘/4:34 dengan melampaui pembacaan yang membatasinya sebagai etika domestik dalam relasi suami-istri. Melalui pendekatan kualitatif berbasis studi kepustakaan dan analisis semantik-relasional, artikel ini menunjukkan bahwa qiwa>mah tidak hanya berfungsi sebagai status normatif atau legitimasi hierarki gender, melainkan juga sebagai fungsi etis yang lahir dari kelebihan (fad}l) tertentu dan diwujudkan melalui tanggung jawab konkret (anfaq). Dengan menempatkan keluarga sebagai unit sosial terkecil, QS. al-Nisa>‘/4:34 dapat dibaca sebagai medium pedagogis Al-Qur’an untuk menjelaskan prinsip pengelolaan relasi asimetris secara etis. Pembacaan ini menempatkan qiwa>mah sebagai kerangka etika kekuasaan yang menekankan perlindungan, keadilan, dan pencegahan kezaliman, serta relevan bagi relasi sosial dan politik yang lebih luas
