Abstract

This article aims to examine the thought of misyar marriage according to Yusuf Al-Qardhawi, and aims to prohibit the practice of misyar marriage in Indonesia. So this research examines the law of misyar marriage from Al-Qardawi's perspective and its contribution to the reform of family law in Indonesia.  This article includes library research. This research is descriptive analytical. The primary data in the research are the Qur'an, Hadith, Yusuf Al-Qardhawi's works, Law Number 1 of 1974 concerning National Marriage Law, and the Compilation of Islamic Law. The secondary data are scientific works, research, journals that are relevant to the research topic. Using Gustav Redbruch's theory of legal objectives and maslahah mursalah, the data analysis in this study uses inductive thinking techniques then the author makes data analysis with qualitative analysis. The result of this article is that misyar marriage according to Al-Qardhawi is a marriage that is not in accordance with the purpose of the ordinance of marriage, namely to form a family that is sakinah mawaddah and rahmah, but there is a gap in Law Number 1 of 1974, concerning Marriage in Article 2 Paragraph (1) "Marriage is valid, if it is carried out according to the laws of each religion and belief". When referring to this article, it can be said that it is valid, so that in order to provide assertiveness to prohibit the practice of misyar marriage and marriage practices that are not in line with the principles of marriage, it is necessary to provide a clear definition of marriage. Keyword: Misyar; Yusuf Al-Qardhawi; Family Law in Indonesia

Abstract

This paper analyzes the results of court decisions on the application of jurimetric formulations in the division of joint property as an effort of justice. Jurimetry can be used as an option when the division of joint property regulated in the Compilation of Islamic Law does not guarantee justice to the parties. Jurimetry emphasizes the division of joint property based on the implementation of the obligations and responsibilities of each party while bound by marriage, so that the use of jurimetry will provide a greater sense of justice. The focus of this article is how the jurimetry formulation of court decisions in cases of division of joint property and its relevance to the principles of justice. This article is a literature research with a normative approach. The source of data in writing this article is court decisions regarding joint property. The result is that the application of jurimetry in the division of joint property can provide more justice for the parties. Parties who do not carry out their obligations in full will have their rights to joint property reduced in accordance with their actions. Conversely, parties who carry out their obligations in full will get rights in accordance with their actions. If both parties carry out their obligations in full, then both are entitled to the same amount of joint property. The recommendation of the results of this writing is that the judge can use this jurimetric formulation as a consideration in handling joint property disputes. Keyword: Jurimetry, Joint Property, Justice and Legal Reform

Abstract

This article analyzes Government Regulation Number 45 of 1990, this regulation contains gaps in polygamy arrangements between men and women who are civil servants.  The focus of this article is to describe the construction of polygamy regulations for the State Civil Apparatus (ASN) which seems gender biased, then how efforts to reconstruct polygamy rules for the State Civil Apparatus (ASN) and then analyze its contribution to the reform of Islamic family law in Indonesia. This library research article is descriptive analytical. The primary data sources in writing this article are the Qur'an, Hadith, and positive laws in Indonesia that regulate marriage and divorce for Civil Servants. The analysis uses the theory of Mashlahah Mursalah, Gender and Feminist Amina Wadud and Gustav Redbruch's theory of legal objectives. The result of the analysis is Government Regulation Number 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants which regulates polygamy for Civil Servants, must be rejected because it contains legal content that is not fair to women as legal subjects. It should be reconstructed by providing equitable regulations, no discrimination, and equalizing the position of men and women before the law. Keyword: Reconstruction, Marriage and Divorce Law, Civil Servants

Abstract

While marriage is an Islamic law and essentially a necessity, there are contradictions between the term and the application of marriage in society. One of them is nikah 'urfi, which is seen as invalid based on the rules of a country but is valid in the view of sharia. This article aims to reveal Muhammad 'Ali Jum'ah's thoughts on nikah 'urfi, furthermore the relevance of nikah 'urfi in the modern era. This article uses a descriptive qualitative approach and literature type by examining writings to solve a problem in a critical and in-depth manner. The approach in this article is to examine the thoughts of Muhammad 'Ali Jum'ah. The results of writing the article found that nikah'urfi is a marriage that fulfills all the pillars and conditions, but is not recorded at the marriage registration institution. Nikah 'urfi is a marriage with complete terms and conditions, this marriage is valid and has been legalized by the Fatwa Institute of Dār al-Ifta' Egypt, through the Fatwa of Mufti Diyar of the Arab Republic of Egypt Muhammad 'Ali Jum'ah. This fatwa was issued due to the prevalence of 'urfi marriage and the high cost of marriage. Abstract

Women's rights in divorce cases are not regulated explicitly in the Compilation of Islamic Law. This, however, has an impact on the inequality that is adhered to in the principle of marriage law. The purpose of this article is how the ijtihad of judges regarding women's rights after divorce is contested and their contribution to family law reform in Indonesia. The method of analysis is carried out qualitatively, with a normative approach. Data analysis techniques use the theory of mubilah and mashlahat. The results of the study show that the consideration of the Panel of Judges ex officio punishing husbands for providing iddah and mut'ah maintenance, or other rights, departs from a new interpretation of the nusyuz concept which applies to both parties (men and women). Another consideration is based on Supreme Court Jurisprudence Number 137 K/AG/2007. The Panel of Judges is also based on the Supreme Court Circular Number 3 of 2017. Such a decision is a legal breakthrough. In the reading of mubilah, such a decision is in accordance with the principles of interdependence, especially in the concept of nusyuz. Such a decision is also in accordance with the principle of benefit. In the end, the renewal of Islamic family law in Indonesia is a necessity.

Abstract

Artikel ini mencoba menguraikan paradigma keadilan hukum progresif dalam mengkaji persoalant pembagian harta bersama. Tema ini penting untuk dikaji mengingat tradisi civil law yang dianut sebagai sistem hukum di Indonesia sangat rentan menghadirkan wajah hukum yang cenderung positivistik yang seringkali lupa menyapa rasa keadilan masyarakat. Konsep pembagian harta bersama yang tidak harus memberikan separuh dari harta kepada masing-masing pihak, seharusnya membuat hakim harus berfikir keras dalam menggali informasi yang menyeluruh sebagai bahan pertimbangan dalam memberikan putusan pembagian harta bersama yang berkeadilan. Menggunakan metode kualitatif-deskriptif inferensial dan dengan memanfaatkan pendekatan filsafat hukum kajian ini menyimpulkan bahwa untuk sampai pada sebuah putusan hukum yang berkeadilan, tidak cukup dengan keahlian hakim dalam penguasaan metodologi penemuan hukum, melainkan harus ditopang dengan moralitas intelektual hakim. Memotret diskurus pembagian harta bersama melalui lensa keadilan progresif, berarti hakim tidak hanya mengacu pada ketentuan hak atas separuh bagian bagi masing-masing mantan suami istri sebagaimana ditetapkan dalam peraturan hukum tertulis, melainkan harus mengelaborasi secara mendalam dan komprehensif pelaksanaan peran mantan suami-istri selama hidup berumah tangga. Keyword: Justice, Progressive Law, Joint Property

Abstract

In li'an cases, children often become victims of serious adverse effects after li'an itself, including emotional trauma and legal uncertainty. Starting from this problem, this paper will explain how Sheikh Yusuf Al-Qaraḍawi's opinion on determining the child's lineage through DNA testing in the context of Islamic law to provide legal clarity for children after li'an. This research is a desk research using analytical descriptive method and content analysis, by collecting and analyzing the views of Sheikh Yusuf Al-Qaraḍawi from various reliable sources, including his fatwas and relevant writings. The article includes a brief overview of the concept of li'an and the importance of establishing correct parentage in Islamic law to serve as a benchmark in analyzing the establishment of parentage through DNA testing. The analysis shows that Sheikh Yusuf al-Qaraḍawi supports the use of DNA testing in Li'an cases to establish the child's parentage, provided that the request comes from the wife. This approach protects the wife's right to privacy while utilizing modern technology to achieve justice. The contribution of his thoughts in the reform of Islamic family law in Indonesia is significant, allowing sharia courts to adopt DNA testing, improving accuracy and fairness, and paying attention to the protection of individual rights and family welfare in the contemporary context.Keywords: Li'an, Child's Nasab, DNA Test, Sheikh Yusuf Al-Qaraḍawi, Islamic Law

Abstract

This article examines the form of guaranteeing the protection of women's and children's rights after divorce by implementing an application called E-Mosi Caper, namely Electronic Monitoring of the Execution of Financing the Rights of Women and Children after Divorce which is implemented at the Bengkulu Religious Court as a follow-up to the memorandum of agreement between the Religious Courts. Bengkulu with the Bengkulu Bank and the Bengkulu City Government because the ex-husband did not voluntarily implement the decision of the Bengkulu Religious Court regarding these rights, while the ex-wife, due to several obstacles, did not submit an attempt to execute the rights regarding herself and her children. This paper uses a mixed method with a normative juridical and empirical juridical approach. The object of this research is the decision of the Bengkulu Religious Court which has permanent legal force. The primary data sources for this research are the litigants and Bengkulu Religious Court officials. Data collection techniques through observation, interviews and documentation. Inductive data analysis using Maqashid as-Shari'ah theory. The results of the analysis include cases that were decided in 2013, one of the cases was divorce divorce by a husband who worked as an ASN in Bengkulu Province, the ex-wife used this application in February 2023, the result was that as of April 2023, the ex-husband's account was debited in the amount of Rp. 1,000,000/month for his children through his ex-wife's account. The E Mosi Caper application implemented by the Bengkulu Religious Court is an effort to provide excellent service to justice seekers.Keyword: Protection, Rights of Women and Children, Interconnection System.

Abstract

This article examines the problem of the judge's granting of a divorce suit filed by the wife on the grounds that the husband committed polygamy in the Religious Court of Lampung Province. The focus of the research is to understand the legal basis used by the judge in deciding the divorce suit, as well as the mubadalah values contained in the decision and its contribution to the development of Indonesian family law. The research method used is a qualitative approach with an in-depth analysis of the case, involving interviews with judges as participants and data collection through the study of decision documents. Primary data was obtained from direct interviews, while secondary data was collected from relevant literature on polygamy and Islamic family law. The results showed that mubadalah values, which emphasize gender equality, play an important role in judges' decisions, where the application of the principles of mutual respect and justice for wives is prioritized. In addition, the contribution of these values is seen in the development of Indonesian family law that is more inclusive and responsive to gender issues. Thus, this study explains that the mubadalah theory is not only a legal basis for decision-making but also contributes to positive changes in family law in Indonesia.Keywords: Divorce Lawsuit, Family Law, Mubadalah, Religious Court, Polygamy

Abstract

This research examines the transformation of new men in realizing a sakinah family. The new men's alliance has recently shown the existence of the struggle for gender justice, against patriarchal culture. This new male transformation places women as equal partners, supporting each other and taking roles in family life so that they can realize a sakinah family. This research is a field research or filed research, conducting interviews with new male alliances in Indonesia, analyzed qualitatively using the theory of mubadalah. The findings of this study are that the new men's alliance is a form of male community that has the awareness that women are a subject that is equal to men. The formation of a sakinah family, new men argue that a sakinah family can be achieved by cooperating with mubadalah between husband and wife. New men realize that in the family is a shared responsibility. Regulations in Indonesia as in the Marriage Law and KHI provide rules that women are only responsible as housewives, with the struggle of the new male alliance providing recommendations that in this modern era the need for regulatory changes that accommodate the equal role of husbands and wives in the formation of a sakinah family.Keywords: Transformation, New Men's Alliance, Sakinah Family
