Abstract

Restorative justice, as a manifestation of the Prosecutor's authority and discretion in controlling criminal cases, is vulnerable to abuse of authority if it is not supported by the principle of accountability and a robust supervision system. This research aims to strengthen the authority of prosecutors in applying restorative justice by strengthening regulations at the legal level and proposing stricter criteria for crimes that fall into this category. The research method used is normative legal research, which aims to find coherence between the Prosecutor's authority and legal norms, legal concepts, and legal principles through a legislative and conceptual approach. This study finds that implementing restorative justice by prosecutors requires strengthening regulations and a more muscular supervision system to prevent abuse of authority and ensure legal certainty and justice for all parties. This study implies the need for more transparent regulations and a strict monitoring system to avoid abuse of authority in the application of restorative justice by prosecutors, ensure an accountable law enforcement system, and protect human rights.

Abstract

This research aims to determine the communication strategy used by the Dispute Control and Handling Section of the Lhokseumawe City Land Office in managing land boundary disputes. The main theories and concepts used are communication strategy, organizational communication, and persuasive communication. This research uses a qualitative approach with a case study method, data collected through observation and interviews with employees involved in handling land boundary disputes. The results of this study found that the Lhokseumawe City Land Office uses a caucus process in its communication strategy in handling disputes, in contrast to the more commonly used direct mediation approach. The stages of dispute handling are in accordance with Hafied Cangara's five-step communication planning model. Analysis of the communication dimensions shows that internal communication occurs both vertically and horizontally through meetings, phone calls, and WhatsApp messages, involving reciprocal exchanges between leaders and employees and between employees. External communication involves the office acting as a facilitator during meetings. Persuasive techniques identified include integration, which involves negotiation, and fear induction, which highlights the potential consequences of unresolved disputes. The implications of this research underscore the importance of structured communication planning and strategy in effective dispute management. The findings suggest that other government agencies may benefit from adopting a similar approach. The use of effective persuasive techniques can improve the efficiency of dispute resolution.

Abstract

In the world of capital markets, the influence of investment is very influential. Mergers and acquisitions are considered one of the most efficient ways to gain access to new markets or enhance the capabilities necessary to face the world's challenges. The purpose of this study is to prove whether there is a difference in 9 financial ratios consisting of NPM, ROA, ROE, CR, QR, DR, TATO, EPS, and EVA before and after the merger or acquisition. This study is quantitative research; the assessment of the company's financial performance in this study uses financial statements 1 year before and 1 year after the merger or acquisition. The sample used in this study includes all companies that go public that carry out mergers or acquisitions on the Indonesia Stock Exchange for the 2019-2021 period. Sampling was conducted using the purposive sampling method so that 26 companies that carried out mergers or acquisitions were obtained. The analysis methods used were descriptive statistical tests, the One-Sample Kolmogorov Smirnov Test normality test, and the Wilcoxon Signed Rank Test differentiated tests. The results in this study showed that there was no difference in the variables NPM, ROA, ROE, CR, QR, DR, TATO, and EPS before and after the merger or acquisition, while there was a difference in EVA before and after the merger or acquisition.

Abstract

The designation of Bogor Regency as a National Activity Center encourages regional development, a very high population leads to rapid development and uncontrolled land use change. Therefore, spatial modeling based on land change prediction is needed that can be used as a basis for directing spatial utilization control policies. The purpose of this research is to know and analyze the pattern of land use change and analyze the direction of spatial use control strategies in Bogor Regency. The research was conducted in Bogor Regency. The analysis used ArcGIS 10.8 Overlay and IDRISI Selva Edition and ISM v. 2.3. The results of the analysis of land use change in between 1997 and 2010, 87.98% of land use remained unchanged, while 12.01% changed. From 2010 to 2023, 73.16% remained unchanged, and 26.84% changed. The predominant land change pattern was from Dry Land Agriculture to Dry Land Agriculture-Rice Fields, while the least common was Open Land to Dry Land Agriculture and back to Open Land. By 2036, expected increases include settlements, shrubs, and Open Land, with decreases anticipated in dryland agriculture, forests, and paddy fields. The alignment of land use with the RTRW spatial plan shows 58.68% aligned, 23.85% transitional, and 17.46% misaligned. It is recommended to maintain land use aligned with the spatial plan, utilize transitional areas, and revise the RTRW for areas that are permanently misaligned. Strategies to control spatial utilization include enhancing technical training, improving infrastructure, aligning staff with organizational needs, and refining spatial planning policies and dispute resolution.

Abstract

Rapid population growth and economic progress have increased the need for public facilities such as shopping malls, hospitals, and office buildings. Cirebon Super Block (CSB) is one of the shopping centers in Cirebon City that adopts the 4-in-1 concept. However, CSB faced problems in providing adequate parking facilities, causing vehicle congestion at the mall entrance and traffic jams. This study aims to identify existing parking conditions, analyze the need for parking spaces, and provide technical recommendations to increase the availability of parking spaces in CSB. This study uses quantitative methods with primary and secondary data collection. The results of the study show that CSB has an off-street parking capacity of 808 SRP (standard parking spaces) for cars and 1188 SRP for motorcycles. The analysis shows that the highest parking index for cars occurred on Saturday reaching 101%, with the highest accumulation of 750 vehicles, the volume of 1011 vehicles, and the average parking duration of 1.75 hours. The highest parking index for motorcycles also occurred on Saturday reaching 91.1%, with the highest accumulation of 1082 vehicles, the volume of 1855 vehicles, and the average parking duration of 2,088hours. The implication of this study is to plan the construction of a parking building on the west side using Civil 3D software and convert an area of 720m² from 26 SRP to 111 SRP. This recommendation is expected to increase the parking capacity from 818 SRP to 918 SRP, so that it can reduce congestion and improve the comfort of CSB visitors.

Abstract

Australia Zoo, a privately owned establishment in Beerwah, Queensland, Australia, initially founded in 1970 as the 'Beerwah Reptile Park' by the family of Steve Irwin, a renowned Australian Wildlife Conservationist, serves as the focus of this research. The study aims to explore the communication strategies employed by Australia Zoo from 2020 to 2023. The primary objective is to examine these strategies with a particular emphasis on the involvement of The Irwins family. This research utilizes analysis and evaluation methods to identify the communication tactics implemented by the zoo, assess the impact and effectiveness of The Irwins' participation, and appraise the utilization of The Irwins family branding in attracting and retaining visitors. The research findings reveal the significant role of The Irwins family in enhancing the zoo's public image and visitor engagement. The study also highlights the effectiveness of various communication strategies in reinforcing Australia Zoo's unique identity. The outcomes of this evaluation furnish recommendations to enhance future communication strategies, thereby reinforcing Australia Zoo's image and allure as a distinctive tourist destination influenced by the enduring legacy of Steve Irwin and his family. These implications underscore the importance of strategic communication in maintaining and growing a wildlife conservation establishment's public profile and visitor base.

Abstract

Regional inequality in Bengkulu Province is getting higher with regional expansion. This regional inequality is visible in Seluma Regency. Therefore, Seluma Regency must maximize its economic potential by optimizing the agricultural sector. This can be done by developing land-based areas through appropriate land use according to the potential of land for agriculture. The objectives of this research are 1) to analyze land use changes, 2) to analyze the suitability of land use to capability land for agricultural commodities, 3) to analyze the suitability of land use to the spatial patterns, and 4) to prepare land use plans to support regional development plans. This research uses quantitative data consisting of primary data and secondary data. The research was conducted using spatial analysis in Seluma Regency, Bengkulu Province. The research results show that 1) land use changes are dominated by an increase of rice fields, dry/wetland forests, and open land area, 2) suitability of land use to capability land for agricultural commodities is 39.77%, and 4.02% is still possible to adjust to capability land for agricultural commodities, 3) suitability of land use to the spatial pattern is 55.10% and 5.65% is still possible to be adjusted to spatial pattern (transition), and 4) land use plans to support regional development are directed as an agricultural area with an area of 45.11% of Seluma Regency total area.

Abstract

Indonesia's diving tourism ranks second among the World's Best Diving Destinations, according to Scuba Diving magazine readers' choices in 2019. Weh Island, in particular, is noted for its significant potential in diving tourism. This study aims to empirically evaluate the impact of attraction, facilities, and accessibility on diving interest at Weh Island. The research targeted individuals with diving certifications, using purposive sampling to gather responses from 97 participants. A quantitative approach was employed, utilizing SmartPLS software for analysis. The results indicate that attraction has a direct positive effect on diving interest, with a significance value of 0.001 (<0.05), suggesting that an increase in attraction leads to a 42.4% rise in visiting interest. Similarly, facilities also have a direct positive effect on diving interest, with a significance value of 0.000 (<0.05), implying that improved facilities result in a 35.3% increase in visiting interest. The implications of this study highlight the important role of attractions and facilities in increasing diving interest. This implies that improving these factors can significantly increase tourist interest in Weh Island. Stakeholders in the dive tourism sector should focus on improving attractions and facilities to increase this potential and attract more divers. Further research could explore the impact of accessibility and other factors on dive tourism to provide a more comprehensive understanding of tourist interest.

Abstract

The development of digital technology has brought significant changes in the agricultural sector, including through the peTani Apps digital application that is expected to help farmers. However, adopting this technology is not always easy, especially for farmers in the digital immigrant group. This study aims to identify and examine the process of forming a communication identity of corn farmers in the digital immigrant group who accept innovations through digital peTani Apps. The research method used is descriptive qualitative with a case study approach processed and analyzed using NVivo. The research applied Michael Hecht's Communication Theory of Identity (CTI) in farmers' interaction with new technology. The results showed that farmers' communication identity levels, including personal identity, enactment identity, relational identity, and communal identity, play a significant role in technology adoption. Personal identity resulted in the finding that many farmers felt insecure and inexperienced in using advanced technology, which led to discomfort in using the application. Enactment identity shows that peTani Apps' digital technology innovation has not become part of farmers' daily routine due to difficulties in navigation and understanding functions. Relational identity reveals that community support and social relationships are crucial in adoption. Communal identity reflects resistance to change in communities with strong traditional norms. Overall, the app has not been widely adopted by digital immigrant groups. Social, cultural, and economic factors influence the adoption rate of these technologies, so more targeted strategies and greater support are needed to encourage equitable adoption among farmers.

Abstract

The modern era of globalization has brought significant changes in various aspects of life, including in the legal field. Rapid technological developments and increasingly close interconnections between nations have created various new challenges for law enforcement. One of the challenges that arises is the criminalization of actions that violate legal sociology. The aim of this research is to conduct an analysis of the criminalization of unlawful behavior within the framework of legal sociology in the era of modern globalization. This research uses non-doctrinal research methods. The data collection technique in this research is literature study. The data that has been collected is then analyzed in three stages, namely data reduction, data presentation and drawing conclusions. The research results show that forms of criminalization that violate legal sociological norms in the era of modern globalization include drugs, prostitution, pornography, vandalism, religious blasphemy and white collar crime. Criminalization of acts that violate legal sociology in the era of modern globalization is a complex issue that has a significant impact on human rights, social justice and social interaction. Efforts to prevent these acts require multi-faceted efforts involving various stakeholders, such as government, law enforcement, civil society and academics. Implications of the research, the findings of this research underscore the necessity for a holistic approach in addressing the criminalization of actions that violate legal sociology. Policymakers must consider the social and cultural contexts of criminal behavior to develop effective laws and regulations.
