Andalas International Journal of Socio-Humanities (AIJOSH) is a peer-reviewed, open-access journal published by Lembaga Penelitian dan Pengabdian Masyarakat (LPPM) Universitas Andalas, Padang, West Sumatra, Indonesia. It invites original articles on various issues within marginal life in socio-humanities perspectives, which include but are not limited to the disciplines of philosophy, literature, archaeology, anthropology, linguistics, history, cultural studies, philology, the arts, and library and information science focusing on Indonesian studies and research. AIJOSH seeks to publish a balanced mix of high-quality theoretical or empirical research articles, case studies, review papers, comparative studies, exploratory papers, and book reviews. All accepted manuscripts will be published online. Abstract

This research paper explores the theme of desire and disability in director Shonali Bose’s film Margarita with a Straw. Through a close analysis of the film, the paper proposes to examine how the protagonist, Laila, a young woman with cerebral palsy, navigates her desires and relationships while dealing with the challenges posed by her disability. It is my contention that the film challenges the dominant narrative of disability as asexuality and incapable of experiencing love or sexual desire while portraying Laila's sexuality and desire as a normal and important part of her life. Additionally, the paper examines how Laila's intersectional identity as a disabled, bisexual woman complicates her desires and relationships. The film emphasises the value of recognising and addressing the sexuality and needs of handicapped people via Laila's character. Ultimately, the paper argues that Margarita with a Straw offers a nuanced and empowering portrayal of disability and desire that challenges ableist and heteronormative assumptions about sexuality and relationships. Overall, this study seeks to add to the expanding body of knowledge about the relationship between disability and sexuality and emphasises the need for change in the portrayal of disability in mainstream media.

Abstract

An understanding of the importance of regulating investment treaties and implementing measures in accordance with existing rules has been generally understood by States in foreign direct investment. However, the local government where the location of foreign investment activities is carried out has not received sufficient attention. As a result, various cases of international investment disputes have arisen caused by actions taken by local governments. This study discusses how the tribunal views and interprets actions taken by local governments in relation to violations of foreign investor rights. In the span of time over the past eight years, no less than six hundred cases of foreign investment disputes have been investigated. Of these, three available and final cases became the subject of discussion in research and became examples to link them with the legal skills of local government officials in mitigating the occurrence of foreign investment case disputes. The results of this study show that in terms of understanding the rules of international investment law, the government in the country can mitigate or handle the case better with foreign investment disputes.

Abstract

This paper explores the transformation of the traditional family system in Japanese society, known as the IE system, to a modern family structure influenced by Western ideologies. Historically, the Japanese state was conceptualized as a family state or kazokukokka, with the emperor as the head of the family, as seen in the Meiji Constitution. However, after Japan's defeat in World War II, the allied governments abolished this system, leading to gradual changes in the societal structure. The objective of this research is to investigate how Japanese people have adapted their family system from the traditional IE system to a modern one. The study utilizes a descriptive qualitative approach, employing field research reports and literature related to the contemporary Japanese family system. Data was collected and analyzed using descriptive methods to draw conclusions. The findings of the research highlight that while the IE system was officially removed from the Japanese Constitution, its influence persists in certain aspects of modern Japanese society. Scholars widely agree that remnants of the traditional family system still endure due to the lack of a viable replacement. Eradicating a deeply rooted cultural tradition developed over centuries proves to be a challenging task. This study sheds light on the coexistence of traditional and modern elements within the Japanese family system, presenting a nuanced understanding of how the IE system continues to partially shape family dynamics in contemporary Japanese society.

Abstract

The purpose of this study is to reveal the phenomenological and stylistic aspects of the Penunggu Makam (Grave Keeper) poetry anthology. The study in this study is based on the theory of phenomenology or stratum norms and stylistic theory. This study uses a qualitative approach. The method used is descriptive qualitative method, namely by describing and analyzing poetry from phenomenological aspects or normative and stylistic strata. The phenomenological aspect of the poems in the anthology of Penunggu Makam is thematically colored by the issue of death which is colored by sadness, sadness and loneliness. The problem of death is also a general concept of human life that all of them will surely die. In the stylistic aspect, there are several language explorations. Exploration of natural images appears in most of the poems. Figure of speech also appears in this poem with dominant personification figure of speech wrapped in natural images. At the level of diction, there is also an exploration of concrete dictions with their inherent characteristics. The words used in this poem are widely known by the public. Nevertheless, the diction used by the poet makes this poem have such a deep meaning and makes the reader immersed in the atmosphere and feelings felt by the poet in line after line of his poem or poem.

Abstract

This study aims to describe language taboos in the context of social activities within the Acehnese community. The research design employed is field research, utilizing a qualitative approach. The method employed is descriptive-analytical. The data for this research focus on language taboos within the Acehnese community in the Pidie Regency. The data sources are informants, comprising Acehnese individuals residing in the Pidie Regency, spanning three sub-districts, with a total of 21 informants. Data collection involves structured and unstructured interview techniques, supported by the participant observation method with face-to-face conversations and the baiting technique. The data analysis technique used is qualitative analysis with stages such as selection, description, grouping, and data analysis. The research findings reveal language taboos in the social activities of the Acehnese community as follows: (a) language taboos in hunting activities; (b) language taboos in farming activities; (c) language taboos in carpentry activities; (d) language taboos in trading activities; and (e) language taboos in courtship activities.

Abstract

This article aims to explore the profound philosophy of life held by the Mandailing ethnic group in maintaining the relationship between humans and the environment from a cultural ecological perspective. Employing an ethnohistorical approach, this research analyzes and synthesizes relevant ethnographic literature along with field research data. The focus of this study is on the philosophies "Poda Na Lima" and "Holong do Maroban Domu, Domu Maroban Parsaulian" as locally inherited wisdom passed down through generations by the Mandailing ethnic group to foster a harmonious relationship with nature. Key figures such as village chiefs, traditional leaders, religious figures, and community elders from Mandailing Natal Regency serve as research subjects and informants. The research findings conclude that "Poda Na Lima" and "Holong do Maroban Domu, Domu Maroban Parsaulian" impart local wisdom values such as compassion, cleanliness, and health in maintaining the harmonization of the relationship between humans and nature. These philosophies continue to be inherited and practiced in the daily lives of the Mandailing community, particularly among agrarian populations in rural areas. In practice, nature is positioned as a source of wisdom, not an object of exploitation, and is internalized to preserve ecological balance.

Abstract

The Shari'a Regional Regulation legitimizes the implementation of Islamic cultural values and Minangkabau culture in West Sumatra. Knowledge of the reality of regional regulation practice is important for harmonizing social and state life in a pluralistic society. This research aims to explain the relationship between the emergence of the Sharia Regional Regulation in West Sumatra and its implementation in city districts in West Sumatra. This research used historical methods, namely heuristics, criticism, interpretation, and historiography. The final results of the research reveal the positive phenomenon of the implementation of Shari'a regulations in West Sumatra. The appearance of school children they dressed as Muslim. Before studying, students were accustomed to praying and memorizing several verses in the Al-Qur'an, attending a Ramadhan Islamic boarding school during the holy month of Ramadhan, and participating in Youth Wirid activities after Ramadhan. State Civil Servants (ASN) wore Muslim clothing during official hours. In certain areas, being able to read the Al-Qur’an was a condition for getting married. Regional regulations with Islamic nuances also showed the political content of the figures, social organizations and parties, legislative members (DPRD), and power politics. This study contributes to the importance of awareness and tolerance in social practices between religious communities in various community organizations and government agencies.

Abstract

Discrimination and violence against indigenous communities have persisted for decades, with many individuals sacrificing their lives to preserve cultural values and languages. Tara June Winch, in her novel The Yield, artfully captures the love and honor for language, portraying the history of Wiradjuri culture and the indigenous people's enduring struggle for survival. The characters are meticulously crafted, allowing readers to grasp the context and empathize with their emotions. August, the central character, returns after decades for her grandfather's funeral, revealing the stagnation in the community's living conditions. As the narrative unfolds, August's memories, intertwined with her grandfather's dictionary, provide a poignant journey through time, shedding light on the harsh realities faced by the indigenous community. Winch masterfully weaves together elements of love, culture, and resilience, delivering a powerful narrative that resonates with the ongoing battle against discrimination and violence.

Abstract

Local democracy in the village is essentially based on these rights of origin and traditional rights. This paper aims to discuss the problems of villages in exercising their rights of origin in Indonesia. To understand how these rights of origin are implemented, this article refers to the practice of Nagari as a customary legal community unit in West Sumatra Province. Not only that, enrichment related to implementing rights of origin also refers to Desa Pakraman in Bali Province. This article uses a literature study derived from documents that have been published from various sources such as articles in scientific journal, mass media news, and official government documents. This article finds that problems in the application of origin and traditional village rights arise because of strict government regulations that encourage village governments to focus on carrying out governance functions in their area. Using the principles of recognition and subsidiarity in the administration of village government results in an attitude of ambiguity in the administration of village government. As a result, the village government prefers to implement the household authority handed over to it accompanied by a budget through Village Fund transfers rather than developing the original rights that have become the identity of pre-existing local democracy.

Abstract

Fansubs are very popular these days in China because of the general public's expanding cultural need. However, the behavior of producing fansubs constitutes a violation of copyright law in essence both in China and in the world since all the audiovisual materials translated and distributed in China have not obtained authorization from copyright owners of foreign movies and television shows. The aim of this study is to explore the reasons why fansub groups in China would keep distributing foreign films and TV shows online with subtitles translated by them despite concern over piracy and copyright. This paper would adopt a method of qualitative research with a focus on content-analysis by observing and analyzing highly relevant discussions on Zhihu, Weibo and Douban, which are Chinese online platforms where users can engage in discussions on various topics. Based on observation and analysis, the paper would discuss the phenomenon of fansubbing in terms of three aspects: awareness of copyright infringement, intrinsic motivation for participation and material considerations. By examining the reasons for fansubber participation and the operation mechanism for this practice situated in a copyright environment, the paper hopes to come up with possible suggestions for protecting the intrinsic motivation for fansubbers while enhancing legal justice, order of the market and creativity of the society.
