Abstract

This study aims to explain the implementation of weighing oil palm fruit in Nagari Talao Sungai Kunyit in terms of positive law and fiqh muamalah. This research is a field research. Data were obtained in two ways, namely secondary data and primary data. The primary data are toke (collectors), oil palm farmers and the Head of the Cooperative and Industry Office of South Solok Regency, while the secondary data sources are the profile of Nagari Talao Sungai Kunyit, Nagari year-end reports and Indonesian legislation. This study found that the implementation of weighing in the sale and purchase of oil palm fruit in Nagari Talao was carried out with containers made of wood that were rarely arranged, so that many “brondol” (small) palm fruit fell. Oil palm fruit that falls from the container is not counted in the scales, as a result of farmers' losses. In fact, the number of “brondol” (small) palm oil that has fallen is quite a lot. In positive law, the implementation of weighing selling oil palm fruit in Nagari Talao is not in accordance with the provisions of Article 25 and Article 28 of Law Number 2 of 1981 concerning Legal Metrology, Article 2 of the Minister of Home Affairs Number 68 of 2018 concerning UTTP Calibration and Re-calibration and Article 8 of Law -Law Number 8 of 1999 concerning Consumer Protection. In this explanation, it is explained that the weighing in buying and selling will not harm either party and the scales used must be recalibrated once a year. As for the implementation of fiqh muamalah muamalah in Islam, namely injustice to fellow humans, and there is no fraud (gharar) and elements of coercion (al-ikrah).

Abstract

The problem in this research is how the president's authority in determining government regulations to replace laws is reviewed from the fiqh siyasah, a form of urgency that forces the establishment of government regulations to substitute laws according to positive law. Abstract

This study discusses the review of Islamic Constitutional Law on presidential government systems in Indonesia. This type of research is library research in which materials are collected through books, laws and journals related to research. The method used is a normative legal research method. Theories used are power theory, authority theory, trias politica theory and tanfidziyyah sulthah theory. From the results of the research conducted by the author, it can be concluded that based on the Indonesian constitution namely the 1945 Constitution in Article 4 paragraph (1) the power of the President includes executive, legislative and judicial powers. In a presidential government system the President is not only the head of state but also the head of government. Based on the Sulfah tanfidziyyah review of the power of the head of state in the presidential system in Indonesia, namely the power of the head of state in the presidential government system does not conflict with Islamic governance and Islamic law because in the Fiqh Siyasah Dusturiyah or the Khalifah Islamic State Constitutional Law covers all power, both as head of state, head of state government, legislature, judiciary and head of religion. It's just that presidential power in the Presidential system does not include as head of religion.

Abstract

Studi ini membahas tentang Demonstrasi Dalam Tinjauan Maqashid Al-Syari’ah. Jenis penelitian adalah penelitian kepustakaan (library research) di mana bahan-bahan di kumpulkan melalui buku-buku, undang-undang serta jurnal yang berkaitan dengan penelitian. Metode yang digunakan adalah metode penelitian kualitatif yang merujuk kepada buku, jurnal, dan peraturan perundang-undangan yang berkaitan dengan pokok bahasan penelitian. Teori yang dipakai adalah toeri demonstrasi, teori maqashid al- syari’ah, teori amar ma’ruf nahi mungkar, dan toeri kaidah taghaiyyur al-ahkam. Dari hasil penelitian yang penulis lakukan dapat disimpulkan bahwa setiap warga negara dapat mengemukakan pendapatnya melalui demonstrasi. Tidak ada yang salah dengan aksi demonstrasi, jika dilakukan sesuai dengan aturan yang berlaku. Adapun tinjauan maqashid al-syari’ah tentang pelaksanaan demonstrasi adalah boleh dilakukan dalam rangka mengkritik penguasa atau pemerintah dengan cara yang baik dan dilakukan dengan niat menjalankan tugas amar ma’ruf nahi mungkar. Selama tidak melanggar aturan dan menimbulkan mudharat bagi orang lain. Akan tetapi, jika dilakukan dengan cara yang melanggar aturan, anarkis, dan menimbulkan mudharat bagi orang lain demonstrasi tidak diperbolehkan.

Abstract

This study examines the perception of culinary economists on letters of recommendation from the Indonesian Ulema Council (MUI) West Sumatra regarding the prohibition of culinary names that are not in accordance with Islamic law. The type of research used is field research, with exploratory qualitative methods. Sources of data in this study consisted of primary data and secondary data. The findings from this study are that the majority of producers and consumers of culinary businesses do not agree with the recommendation letter from the Indonesian Ulema Council (MUI) West Sumatra regarding the use of culinary business names and do not even care about the letter, because they consider the recommendation letter from the Indonesian Ulema Council (MUI) at the West Sumatra level. This is not a type of statutory regulation that has binding law.

Abstract

This study examines the implementation of the debt agreement of sweet potato farmers with toke yam, the mechanism for payment of money owed by sweet potato farmers to toke yam and a review of muamalah fiqh on the implementation of conditional debt and debt payment mechanisms according to muamalah fiqh. The type of research used is field research (field research). The findings of this research are, first, the implementation of debt between sweet potato farmers and sweet potato farmers, namely Toke gives debt to farmers on the condition that farmers must sell their sweet potato harvests to Toke and Toke buys the sweet potatoes at a price set by Toke himself. Second, the mechanism for payment of debt between farmers and toke ubi is through the sale of sweet potatoes which are cut directly by toke ubi as a form of debt payment. Third, the implementation of debts between farmers and tokens is contrary to the tabarru contract and in buying and selling there is an element of coercion or lack of willingness and toke to take profits that are not their rights.

Abstract

This paper aims to explain the fiqh muamalah review of the contract agreement and the pattern of the profit sharing agreement system for gold mining vessels in Nagari Koto Tuo, Sijunjung Regency. This research is a qualitative research. Data collection techniques through interviews and observation. Primary data sources consist of land owners, ship owners and workers, as well as supporting data consisting of library data related to profit sharing. The data analysis technique used is descriptive qualitative analysis. This study found that the contract made in the gold mining ship business is a cooperation agreement. The contract takes place orally and in writing. First, the form of the contract in the gold mining ship business, the land owner and the ship owner are called syirkah and the ship owner with other investors is called syirkah mufawadah. Second, the form or method of managing the gold mining ship business, ship owners and workers, is called syirkah. Third, profit sharing in the gold mining ship business of land owners, ship owners, and workers is called syirkah mudharabah. However, their profit sharing system is a new profit sharing system, namely a profit sharing system based on their knowledge alone. Therefore, there is an element of ambiguity or gharar in the profit-sharing system that they do. However, this can still be done as long as there is an agreement.

Abstract

The constitutional rights of citizens are protected in Articles 27 to 34, the right to work, the right to freedom of opinion, the right to religion, the right to education, and the right to social welfare. Meanwhile, in the siyasah dusturiyyah, there is an institution that cooperates with the constitutional complaint, namely the al-madzalim institution which is an institution tasked with adjudicating the arbitrariness of the rulers against their people as well as rulers who injure the rights of citizens. Therefore, it is very important to be given the authority in the form of constitutional complaint at the Indonesian Constitutional Court.

Abstract

The purpose of this study was to analyze the considerations of the Solok Religious Court for ratifying the peace agreement letter from the plaintiffs and defendants in order to end the process against case number 213/Pdt.G/2018/PA.Slk which was decided verstek even though the decision was not yet legally binding and Verzet legal action should be taken by the Religious Court. The type of research in this writing is field research and analyzed descriptively qualitatively. The results in the study are first, the process of making a peace agreement between the parties in case number 213/Pdt.G/2018/PA.Slk is that the parties came to the Solok Religious Court by stating their desire to make things better and not wanting to divorce. Second, the consideration of the Solok Religious Court to accept the peace agreement letter is that the amicable certificates of the plaintiffs and defendants can be accepted on the grounds that the case has not yet been legally binding (BHT so that the defendant does not need to take legal action against verzet by keeping in mind the principles of simple, fast and low cost). Third, the review of the civil procedural law on the peace statement made by the parties is that the peace that occurs outside the trial is binding on the two parties who make peace.

Abstract

The configuration of law enforcement in the religious courts has simply been implemented. When he has to deal with the law as a product of politics and the law as a product of fiqih studies, the choice is quite delegative. On the one hand, it meets the demands of empirical reality from the institutionalized wheel of life, while on the other hand, it goes hand in hand with the signalization text of the muqasid sharia. Although the work of the scholars as stated in the Compilation of Islamic Law (KHI) can be said to be a monumental work, it is still an outline that is impossible to complete in deciding every case faced. Therefore, this article discusses the implementation of Islamic civil law in Indonesia which is considered very appropriate to be applied to Muslims, without disturbing the national legal system and disturbing other people. This article aims to highlight the importance of implementing Islamic civil law in Indonesia with juridical arguments. The results of the analysis show that juridically in the current reform era, the implementation of Islamic civil law in Indonesia has shown a bright spot where many products of legislation related to it have been produced and practiced by Muslims. Based on MPR RI Decree Number IV/MPR/1999 concerning GBHN 1999-2004, Chapter IV, letter A, point 2, the implementation of Islamic civil law in Indonesia is the state’s obligation to uphold the rule of law (law enforcement). In practicing Islamic civil law by Muslims in Indonesia, there are still many obstacles and obstacles. Even though the rule of law has become a state decree, some individuals are not happy with Islam using this issue as one of their political motives.
