Abstract

The main problem in this paper is the provisions on the prohibition of marrying boru ninamboru and the view of Islamic law on the prohibition of marrying boru ninamboru in the village of Binubu Baru, Nagari Sontang Cubadak, Pasaman Regency. The purpose of this study is to find out how the provisions on the prohibition of marrying boru ninamboru and analyzing how Islamic law views the prohibition of marrying boru ninamboru in the village of Binubu Baru Nagari Sontang Cubadak, Pasaman Regency. This type of research is this research is field research (field research). Data collection was carried out through interviews with respondents, namely traditional leaders, religious scholars and people who would commit the customary violation. After the data is obtained, the writer analyzes it descriptively qualitatively so that the data is understood. The location of this research is in Binubu Baru Village, Padang Gelugur District, Pasaman Regency. From the results of the study, it was found that the rules regarding the prohibition of marrying boru ninamboru were believed to exist by the people of Kampung Binubu Baru Nagari Sontang Cubadak, Pasaman Regency. This customary prohibition against marrying boru ninamboru has never happened because of the strong belief of the community in the prevailing customs and the sanctions that are so strong and strict. The provisions on the prohibition of marrying boru ninamboru in Kampung Binubu Baru have become rules that have existed in ancient times originating from ancestors, followed until now from generation to generation, these rules are not written but are firmly held by traditional leaders accompanied by sanctions. In the view of Islamic law that marriage to boru ninamboru is allowed and not prohibited in religion which has been explained in surah An-Nisa verses 22-23, for that customs regarding the prohibition of marrying boru ninamboru are included in 'urf fasid.

Abstract

This study examines palepoh ambun money in marriage and the view of Islamic law on the implementation of palepoh ambun money in marriage in Nagari Tabek Patah, Tanah Datar Regency. This research is empirical qualitative research. The data was obtained through interviews with community leaders, Alim Ulama, Niniak mamak, the chairman of KAN, and the perpetrators of the ambun palepoh money. The findings of this study are that if there is a man outside or from another village who wants to marry a woman from the Tabek Patah village, the man must pay palepoh ambun money. The urgency of the palepoh ambun money is to support the smooth running of the marriage process because the money is to ease the transportation costs of ninik mamak in the marriage process, according to the term bajalan baaleh tapak, bakato baaleh lidah, because ninik mamak and tribal chiefs are not paid in Minangkabau customs so they are not paid may be using personal money, not only that the money is also used for the cost of entertaining the men's family. According to Islamic law, palepoh ambun money is not a requirement related to marriage. Therefore, palepoh ambun money does not conflict with syara' law. This tradition of palepoh ambun money contains beneficial values in the form of reducing the cost of ninik mamak, strengthening the friendship between mamak of both parties, and easing the cost of the kitchen, so that the payment of palepoh ambun money is permissible (permissible), meaning that it can be carried out by the community as long as it fulfills the elements of 'Urf sahih, which is beneficial and does not cause harm.

Abstract

This study examines the prohibition of the use of religious facilities as a place for political campaigns in accordance with Law Number 7 of 2017 According to Fiqh siyasah. The problem in this thesis is the prohibition on the use of religious facilities as a place for political campaigns in accordance with Law number 7 of 2017 concerning elections according to fiqh siyasah. Research Objectives The type of research that the author uses in this research is library research with the documentation method. This type of research is carried out by collecting and reviewing existing data information with the help of references in the library such as books, similar previous research materials, articles and various notes and various journals through reading related to the problem under study. The results of the study show Law number 7 of 2017 concerning elections article 521 this prohibition is caused because there will be many impacts that will arise if the campaign is carried out in mosques, fearing slander and hate speech that will arise if carried out, there will be more things negative things that will arise if the campaign is carried out in places of worship. So it can be concluded that using the media of worship facilities that are intended or intended are mosques in Law Number 7 of 2017 in accordance with the Shari'a which is based on Q.S An-Nur verse 36 From the results of the study, it can be concluded that the harm obtained is greater than the benefits obtained from the mosque being used as a place for political campaigns, because the mosque must be free from slander and hate speech, not used to seek names or for personal gain. because there is more harm than benefit it can be concluded that Law Number 7 of 2017 does not conflict with siyasa fiqh.

Abstract

This article discusses the background of the birth of Regional Regulation Number 7 of 2018 concerning Nagari regarding Kerapatan Adat Nagari (KAN), duties and functions of Kerapatan Adat Nagari (KAN), and Fiqh Review of Siyasah Duturiyah on Regional Regulation No 7 of 2018 concerning Nagari regarding KAN. This research is a library research method. This study uses a normative legal research typology, namely examining legislation/theories and literature review of secondary data relating to the background of the birth of Regional Regulation No. 7 of 2018 concerning Nagari regarding KAN and a review of Fiqh Siyasah Duturiyah on Regional Regulation No. 7 the Year 2018. The results of this study conclude that the birth of the Regional Regulation has been initiated in Regional Regulation No. 2 of 2007 but has not covered all those related to the parts of the KAN. The issuance of Regional Regulation No. 7 of 2018 reaffirms the parts of the KAN which include Niniak Mamak, Alim Ulama, Cadiak pandai, Bundo kanduang, and Parik paga Nagari. Thus, Regional Regulation No. 7 of 2018 concerning Nagari provides an opportunity for regions to form villages (government) based on customs according to the rights of origin of the local customary law community unit. The view of Siyasah Duturiyah fiqh where the duties and functions of the KAN do not deviate from the Fiqh rules that have been set by Regional Regulations.

Abstract

In Islam, the validity of a marriage occurs when the marriage contract has fulfilled the pillars and conditions. If the pillars and conditions are fulfilled, then the marriage can be done this because there is no longer a barrier to realizing a marriage. However, in Nagari Lubuak Batingkok, Lima Puluh Kota Regency, there is a tradition before holding a marriage called the alek herbal tradition where this tradition is a series that must be taken before carrying out a marriage and carrying out walimahtul ursy activities. If the traditional procession is not carried out, the marriage cannot be carried out because it will cause someone to be prevented from getting married. If the marriage continues, the bride's family will be subject to customary sanctions in the form of not being brought again in traditional activities in the village. This research focuses on the implementation of the alek jamu marriage tradition, the impact and consequences of the alek jamu marriage tradition and how the alek jamu marriage tradition in the traditional environment of Nagari Lubuak Batingkok, Harau District, 50 City Regency according to the Islamic Law Perspective. The type of research carried out is field research which is processed descriptively. The results of this study indicate that in the implementation of this traditional herbal medicine, the traditional processions carried out are Manalisiak, manyuduik and ayam putiah tabang Siang. The impact of not carrying out this traditional herbal medicine is the obstruction of marriage, banishment as long as it is customary, paying fines, being ostracized in the community and becoming a disgrace and mental pressure for the family in the community. The traditional tradition of alek jamu marriage in Nagari Lubuak Batingkok according to the perspective of Islamic law is allowed because it is categorized as Urf sahih due to the element of benefit in its implementation, namely to get a good partner and establish closeness with niniak mamak. However, if the alek jamu tradition contains harm in the form of preventing marriage and causing elopement, then this tradition is not allowed because it is categorized as urf fasid.

Abstract

The main problem in this thesis is how to implement the main tasks and functions of the head of affairs in the Nagari Simawang government and how to review Islamic constitutional law on the implementation of the main tasks and functions of the head of affairs in the Nagari Simawang government. The purpose of this discussion is to find and describe the implementation of the main duties and functions of the head of affairs in the government of Nagari Simawang and to find out and describe the review of Islamic constitutional law on the implementation of the main tasks and functions of the head of affairs in the government of Nagari Simawang. The type of research that the author uses is field research (field research). Based on the research that the author did, it was found that, several functions carried out by the Head of Government Affairs in Tanah Datar Regency Number 4 of 2008 regarding Nagari had not run effectively because there were several functions that were less effective, namely the function of providing services to the community in the field of land / land. agrarian affairs in accordance with applicable laws and regulations and in the function of assisting tasks in the field of collecting land and building taxes.

Abstract

The purpose of the discussion of this article is to find out the use of cagak hutang and a review of fiqh muamalah in Nagari Simpang Sugiran, Guguak District, Lima Puluh Kota Regency. The type of research that the author uses is field research, namely field research that is qualitative in nature. Sampling technique the author uses a snowball sampling technique. The data collection technique that the author uses is interviews, documentation and observations related to the agreement on cagak hutang in Nagari Simpang Sugiran, Guguak District, Lima Puluh Kota Regency. From the research that the author has done, it shows that the debt reserve in Nagari Simpang Sugiran, Guguak District. People use cagak hutang in the form of living (moving) goods and inanimate (immovable) goods. Cagak hutang is used because they have no other choice, what is used as cagak hutang is the only thing that can be given by the debtor as collateral or foreclosure on his debt. In practice, most of the use of forked debt is in the control of the murtahin, he enjoys the results and uses the benefits of debt fork for his own benefit. The implementation of cagak hutang in Nagari Simpang Sugiran, Guguak District, Lima Puluh Kota Regency has become a habit and has raised social aspects in society that can overcome economic problems. This activity has become an alternative for the community to avoid hunger and poverty because it has helped the community's economy. In Islam, habits that have been carried out continuously and repeatedly in a society can be used as a source of law. However, in practice, the habit of using cagak hutang in Nagari Simpang Sugiran, Guguak District, Lima Puluh Kota Regency is included in a fasid habit or is contrary to the arguments of the Qur'an and Hadith.

Abstract

Studi ini mengkaji tentang Kontradiksi Peraturan Pemerintah  Nomor 34 Tahun 2021 tentang Penggunaan Tenaga Kerja Asing ditinjau dari siyasah dusturiyah . Permasalahannya adalah dalam Peraturan Pemerintah Nomor 34 Tahun 2021 terdapat beberapa pasal yang kontradiktif dengan Peraturan yang berada diatasnya sehingga mempermudah TKA bekerja di Indonesia sementara Tenaga Kerja Indonesia masih banyak yang membutuhkan pekerjaan . Penelitian ini menggunakan penelitian hukum normatif atau penelitian kepustakaan (Library Research) bahan diperoleh melalui penelitian setelah bahan yang terkumpul diolah dengan cara deduktif dan dianalisi dengan kualitatif. Hasil yang dicapai adalah beberapa pasal dalam Peraturan Pemerintah Nomor 34 tahun 2021 yang menimbulkan Kontradiktif dengan peraturan yang berada diatasnya, diantaranya: (a) Pasal 5 ayat (1) tentang bekerja rangkap jabatan bagi TKA  kontradiktif dengan pasal 26 Undang-Undang Nomor 5 tahun 1999 tentang Praktek Monopoli Dagang. (b) Pasal 6 tentang Penghapusan Izin Menggunakan Tenaga Kerja Asing (IMTA)  kontradiktif dengan Pasal 43 ayat (1) Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. dan (c)  Pasal 19 tentang dispensasi Rencana Menggunakan Tenaga Kerja Asing (RPTKA) kontradiktif dengan Pasal 43 ayat (3) Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan.  Berbagai kelonggaran tersebut mempermudah Tenaga Kerja Asing bekerja di Indonesia sehingga mengakibatkan berkurangnya kesempatan kerja bagi tenaga kerja dalam negeri. Secara keseluruhan kelonggaran bagi TKA bekerja di Indonesia juga menimbulkan kontradiktif dengan UUD 1945 Pasal 27 ayat (2) yang menjamin setiap hak warga negara atas pekerjaan dan penghidupan yang layak. Peraturan ini juga tidak sejalan dengan teori tujuan hukum yakni teori keadilan, teori kebermanfaatan dan teori kepastian hukum. Menurut perspektif Fikih Siyasah Dusturiyah bahwa Peraturan Pemerintah perihal Penggunaan Tenaga Kerja Asing di Indonesia belum memenuhi kriteria dalam pembentukan peraturan perundang-undangan dalam siyasah Sar’iyyah, yakni : (1) bertentangan dengan tujuan syaiat yang mana kebijakan seorang pemimpin terhadap rakyatnya bergantung kepada kemaslahatan, namun dengan adanya kelonggaran dalam peraturan ini tidaklah menciptakan kemaslahatan melainkan kemudharatan yakni semakin berpeluang menambah pengangguran karena lapangan pekerjaan diambil oleh TKA.  (2) tidak meletakan persamaan kedudukan manusia didepan hukum dimana Peraturan Pemerintah Nomor 34 Tahun 2021 dibuat hanya untuk kepentingan-kepentingan golongan tertentu. (3) Akan memberatkan masyarakat terutama yang sedang mencari pekerjaan. (4) Tidak tercapainya keadilan dalam masyarakat karena haknya sebagai warga negara tidak terpenuhi yakni hak untuk mendapatkan pekejaan yang layak.

Abstract

Studi ini mengkaji tentang pelaksanaan nikah baru pada pelaku nikah siri di KUA Lintau Buo Utara. Rumusan masalah penelitian ini adalah bagaimana pelaksanaan nikah baru pada pelaku nikah siri dan Apa faktor penyebabnya serta bagaimana pandangan Hukum Keluarga Islam terhadap pelaksanaan nikah baru tersebut. Tujuan penelitian ini untuk mengetahui proses pelaksanaan  nikah baru pada pelaku nikah siri di KUA Lintau Buo Utara, dan mengetahui faktor penyebabnya serta untuk menganalisis pandangan Hukum Keluarga Islam terhadap pelaksanaan  akad nikah baru tersebut. Jenis penelitian yang penulis gunakan adalah penelitian lapangan dengan metode kualitatif. Sumber data penelitian ini dari pasutri yang melakukan nikah baru, ninik mamak dan kepala KUA Lintau Buo Utara. Hasil penelitian ini adalah pelaksanaan nikah baru di KUA Lintau Buo Utara terdiri dari 3 tahap, yaitu perdaftaran, screening pra nikah dan akad nikah. Faktor penyebab nikah baru ini dikarenakan faktor legalitas yaitu untuk mengurus kartu keluarga, dan akta kelahiran anak serta adanya anggapan belum menikah dari orang lain.

Abstract

Studi ini mengkaji tentang efektivitas Peraturan Menteri Desa Pembangunan Daerah Tertinggal dan Transmigrasi Nomor 13 Tahun 2020 tentang Prioritas Penggunaan Dana Desa Tahun 2021 dalam bidang pembangunan di Nagari Sungai Duo Kabupaten Dharmasraya perspektif Siyasah Dusturiyah. Permamasalah yang terjadi yaitu singkronisasi hukum pasca penetapan Permendes PDTT nomor 13 Tahun 2021. Terdapat kerancuan mengenai penetapan Permendes PDTT Nomor 13 Tahun 2020 tentang prioritas penggunaan dana desa tahun 2021, pada pasal 5 ayat (2) yang mewajibakan semua desa harus menerapkan Sustainable Development Goals (SDGs) Desa yang merupakan suatu kewajiban desa harus melaksanakan pembangunan berkelanjutan desa dan dilakukan melalui swakelola dengan mendayagunakan sumber daya lokal desa. Penelitian ini merupakan penelitian lapangan. Data diperoleh melalui wawancara dan obeservasi setelah data terkumpul kemudian dinarasikan secara deskriptif. Hasil yang dicapai adalah penetapan permendes PDTT Nomor 13 Tahun 2020 dilihat dari teori efektivitas hukum dinilai sebagai aturan yang gagal untuk dilakukan karena adanya ketentuan dalam aturan tersebut yang sukar untuk dilaksanakan di beberapan daerah sehinggal aturan tersebut dihukum belum efektif dan dalam islam belum mengandung prinsip keadilan dan kemaslahatan.
