Abstract

This research aims to provide knowledge to the community regarding the importance of marriage registration in state administration. The method used by the researcher is the empirical juridical method, which is located in Sukatani District, Bekasi Regency. The community often states that marriage does not need to be registered because in the past, there was no marriage registration, whereas if traced, unregistered marriages will result in legal consequences that are detrimental to the parties involved in the marriage, especially the wife and children. Marriage registration is often considered one of the troublesome matters because it requires submitting time-consuming documents. In Article 2 paragraph 2 of Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 on Marriage, it is clearly stated that every marriage must be registered in accordance with the applicable laws and regulations, as well as in the Compilation of Islamic Law, thus making marriage registration an obligation as the basis for creating welfare and legal certainty

Abstract

One of the key sources of governmental funding for the construction of infrastructure and public amenities to enhance community welfare is the Land and Building Tax (PBB). The purpose of this research is to evaluate the government of Puspan Village, Maron District, Probolinggo Regency's attempts to raise public knowledge and compliance with the Land and Building Tax (PBB) duty and to pinpoint the challenges faced. Empirical legal research using a socio-legal perspective is the research methodology used. Field observations, documentation studies of PBB payment data and pertinent rules, and interviews with village authorities and community people were used to gather data. The findings show that the Puspan Village Government has made a number of initiatives to raise public knowledge and compliance. Nonetheless, a number of challenges still exist, such as the community's lack of legal knowledge, financial constraints, a lack of comprehension of PBB's advantages, and the inadequate application of punishments. Therefore, in order to increase public knowledge and compliance in paying PBB, the village government's role must be strengthened in a sustainable way through improved legal education, better coordination with the regional government, and optimization of public services

Abstract

Para-Para Adat is one of the peace justice institutions in resolving customary crimes of the Indigenous community at the Port Numbay-Jayapura City. This customary institution still exists. However, the existence of Para-Para Adat has not yet carried out its function as expected. The purpose of this study is to analyze the legal regulations that exist in society, as regulated in Article 2 paragraph (1) of the National Criminal Code, along with its implementing regulations as regulated in Government Regulation of the Republic of Indonesia Number: 55 of 2025 concerning Procedures and Criteria for Determining Living Laws in Society, related to the revitalization of Para-Para Adat. The research method is a normative juridical, with a statutory and conceptual approach. The results of the study show that, normatively, the regulation of Article 2 paragraph (1) of the National Criminal Code is a breakthrough in Indonesian criminal law policy, which accommodates the existence of living law in society while providing a place for Para-Para Adat in resolving customary criminal cases within the Port Numbay Indigenous community. However, issues arose after the enactment of Government Regulation No. 55 of 2025, concerning procedures for resolving customary crimes involving the Civil Service Police Unit.

Abstract

This study examines the effectiveness of Batam City Regional Regulation Number 2 of 2024 concerning Manpower Placement in the Batamindo Industrial Area in supporting the achievement of Sustainable Development Goal (SDG) 8, which focuses on decent work and inclusive economic growth. The objective of this research is to evaluate the implementation of the regulation in the field and to identify the challenges encountered, as well as possible solutions to overcome these challenges. The research method used is an empirical juridical approach with a sociological perspective, conducted through interviews with relevant stakeholders and the distribution of questionnaires to HR personnel in several companies within the Batamindo Industrial Area using random sampling. The results show that although there has been a decrease in the unemployment rate, the implementation of this regulation is still limited by a lack of coordination among relevant stakeholders, low levels of socialization, and a mismatch between the competencies of the local workforce and the needs of the industry. This study suggests the need for improved coordination, more intensive socialization, and the provision of training facilities aligned with industry needs in order to support the achievement of SDG 8

Abstract

The shift in criminal law policy regarding the regulation of corruption has become a crucial issue following the enactment of Law Number 1 of 2023 concerning the Criminal Code (KUHP 2023). This study aims to analyze the paradigm of punishment in the 2023 Criminal Code and examine the direction of legal policy changes from the Corruption Crime Law (UU Tipikor) regime. Using a qualitative normative research method through a comparative regulatory and legal theory approach, this study found a significant conceptual shift from the orientation of punishment that previously positioned corruption as an extraordinary crime to a more general and humanistic perspective. The 2023 Criminal Code prioritizes the principles of proportionality, reintegration, and social recovery over the repressive approach that has characterized the Corruption Law. Although normatively, the Tipikor Law still applies as lex specialis, changes to several articles and recodifications within the Criminal Code indicate signs of normalizing corruption into a general crime regime. Consequently, the potential for a reduced deterrent effect, regulatory loopholes, and obstacles to proving state losses pose serious challenges to eradicating corruption. This research confirms that changing the direction of criminal law policy requires vigilance to prevent institutional and substantive weakening of the anti-corruption agenda in Indonesia

Abstract

Regulations regarding land rights for foreign citizens in Law Number 5 of 1960 concerning Agrarian Principles (UUPA) are contained in Article 42 which states that subjects entitled to use rights include foreign citizens residing in Indonesia. Based on the UUPA, property rights, business use rights and building use rights cannot be granted to foreign individuals or legal entities. However, foreign citizens and legal entities residing in Indonesia can obtain usage rights. The history of the regulation of use rights for foreigners in Indonesia is contained in several implementing regulations of the UUPA, including Government Regulation Number 41 of 1996 concerning Residential Ownership by Foreign Citizens and amended by Government Regulation Number 103 of 2015 regarding residential ownership by foreigners in Indonesia. Foreign residents in Indonesia need land to use as a place to live while in this country. The government seems to be making the rules simpler by issuing Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Flat Units, and Land Registration. In Article 103 of Government Regulation Number 18 of 2021, it is stated that Government Regulation Number 41 of 1996 and Government Regulation Number 103 of 2015 have been revoked and are no longer valid. The function of land use rights for foreigners is not only for residence, but also as a means of investment
