Abstract

This study aims to analyze the legal framework governing the social reintegration of children in conflict with the law in Indonesia and to compare it with Norway’s community-based juvenile rehabilitation system. Using normative juridical methods with statutory, comparative, and conceptual approaches, this research examines primary legal materials including Indonesia’s Juvenile Justice System Law, Correctional Law, Government Regulations No. 31/1999 and No. 32/1999, as well as the Norwegian Penal Code 2005, Execution of Sentences Act, and Child Welfare Act. The analysis is conducted qualitatively by comparing the normative structure and reintegration mechanisms adopted by both countries. The findings reveal that Indonesia recognizes social reintegration as a core objective of its correctional system, yet its implementation remains largely institution-based and lacks a structured community-centered model to ensure effective transition back into society. In contrast, Norway applies a comprehensive community-based approach through limited imprisonment for minors, community service, progressive social supervision, and the Youth Punishment and Youth Follow-Up schemes that emphasize rehabilitation, mediation, and community involvement. The comparison highlights the necessity for Indonesia to strengthen community-based reintegration frameworks aligned with restorative justice principles and children’s developmental needs

Abstract

The development of industrial relations is directed toward achieving a coherent alignment of interests within the employment system. Nevertheless, termination of employment (dismissal) continues to generate significant tension, primarily due to legal uncertainty, differing normative interpretations, and inconsistent judicial rulings This study examines the regulatory disharmony of termination of employment from both vertical and horizontal dimensions, while also proposing a model of legal harmonization grounded in legal certainty and justice. The present study adopts a normative legal framework, employing statutory, conceptual, and case-based approaches as core analytical instruments. to explore legal issues in a structured and comprehensive manner The study further evaluates labor regulations alongside judicial practices, particularly decisions issued by the Industrial Relations Court, which serve not only as instruments of dispute settlement but also as manifestations of the practical realization of legal norms within the legal system. The findings reveal that regulatory inconsistency stems from overlapping provisions, unclear procedural frameworks, and variations in judicial interpretation, all of which contribute to inconsistent outcomes in court decisions. Accordingly, this research proposes an integrated legal harmonization model for termination of employment that combines legal certainty, justice, and a balanced configuration of interests within a unified legal system, in order to promote sustainable industrial relations

Abstract

Criminal law is often positioned as a state instrument to maintain social order and control deviant behavior. However, its effectiveness cannot be understood solely through normative legal analysis. This study examines criminal law from a sociology of law perspective to analyze the relationship between normative legal construction and social reality, as well as the gap between the objectives of criminal law and its enforcement practices. Using normative legal research with a qualitative approach, this study analyzes legislation, legal doctrines, and relevant literature through conceptual and sociological perspectives. The findings show that criminal law operates within complex social structures influenced by power relations, cultural values, and institutional practices. A legalistic and repressive enforcement approach often leads to social injustice, stigmatization, and declining public trust in the criminal justice system. The study argues that integrating a sociology of law perspective is essential to develop a more responsive, contextual, and humane criminal law system. Criminal law reform should shift from a purely punitive orientation toward a balanced approach that emphasizes proportionality, restorative justice, and social protection. Strengthening legal awareness through civic education is also crucial to enhance the legitimacy and effectiveness of criminal law in a pluralistic society

Abstract

This study analyzes the juridical position of waqf land claimed by heirs from the perspectives of Muamalah fiqh and Indonesia's Law No. 41/2004 on Waqf. Employing a normative juridical approach with statute and case methods, supported by library research, it examines waqf irrevocability (Article 3) and its exclusion from inheritance (tirkah). Findings reveal that heirs' acknowledgment serves as supplementary evidence for waqf legalization and dispute resolution, not a basis for revocation, thereby strengthening nazhir's permanent rights. Heirs' claims fail against registered waqf certificates, aligning fiqh principles (Syafii/Hanbali) with positive law. Recommendations include enhancing Akta Ikrar Wakaf (AIW), BWI mediation, and mandatory heirs' statements in Permen ATR/BPN No. 2/2017 to prevent litigation. Abstract

This study examines the potential failure of mediators in court-annexed civil mediation under Indonesia’s Supreme Court Regulation Number 1 of 2016. Judicial mediation aims to promote fair, efficient, and peaceful dispute resolution; however, the limitation of mediator authority to a purely facilitative role may undermine its effectiveness, particularly in disputes involving power imbalances. This research employs a normative legal research method using statutory, conceptual, and philosophical approaches. Qualitative analysis is conducted through hermeneutic interpretation of PERMA No. 1 of 2016 and relevant theories of procedural justice, communicative action, and restorative justice. The findings indicate that restricted mediator authority leads to a reduction of the mediator’s corrective role, procedural uniformity that neglects conflict complexity, and institutional challenges in mediation practice. The study concludes that mediation failure is not solely attributable to the parties’ conduct, but also to a rigid regulatory design that weakens the dialogical and transformative function of judicial mediation

Abstract

The right of the province of Aceh to use the Islamic law is the only province in Indonesia that has received the privilege to use the law in inheritance among others as enshrined in the constitution. Aceh Sharia Court is the leader in the cases of inheritance solution based on Law No. 11/2006, Aceh Qanun No. 8/2014 and Qanun No. 4/2015. In 2023, with the help of Syar’iyah, the solution to 312 cases related to inheritance was done, however, around 60% of the population of the North Aceh region adheres to the traditional decision-making, in other words, it influences the values of the family and the willingness to preserve the peace. The “patahtiti” and “hareutapeunulang” live even though at certain points they contradict the Islamic jurisprudence. This study is an exemplary juridical stance of a controlling and circumstantial style, which examines primary and secondary data. Tempenya discusses the dualism of customary law and sharia that are dangerous, however he leaves some room of toleration of the local values provided it does not contradict the sharia principles. The legal impacts are the Qanun legal certitude, greater social justice to women and children (40% of official cases are prosecuted to women) and its easy harmonization with the legal system of a country. Among important issues, it is possible to single the differences in interpretation of Islamic scholars, lack of legal literacy and lack of judicial infrastructures. The solutions suggested are to elevate the standard of the teaching of the level of the Islamic law of the mosques and the Islamic boarding schools (dayah), to train the judges in a way that will stabilize the interpretations and to further increase the practice of the Qanun rules in a way that the interaction of the custom and the sharia will provide substantive justice

Abstract

Violence against women is one of the most systemic and widespread forms of human rights violations in the world. This phenomenon not only damages the dignity and physical and psychological integrity of women, but also hinders broader social, economic and political development. Even though various countries, including Indonesia, have adopted various national and international legal instruments that guarantee the protection of women, social reality shows that violence against women still occurs massively and repeatedly. This research uses a doctrinal legal research approach with a case and positive law approach. It is hoped that this research can provide answers regarding the fulfillment of legal protection for women in Indonesia

Abstract

This study examines the responsibility of the state in cadastral mapping as a basis for strengthening civil rights over land in Indonesia. Cadastral mapping occupies a strategic position within the land law system, as it serves as the foundation for land registration and the issuance of land title certificates, which function as evidentiary instruments in civil legal relations. Inaccurate mapping has the potential to give rise to land disputes, weaken the evidentiary value of land certificates, and cause losses to rights holders, even when such errors originate from state administrative processes. This research employs a normative juridical method using statutory, conceptual, and relevant court decision approaches. The findings indicate that state responsibility in cadastral mapping encompasses the establishment of standardized technical norms, the implementation of accurate and integrated mapping, and the provision of correction mechanisms and legal accountability for mapping errors. The accuracy of cadastral mapping directly affects the evidentiary strength of civil land rights, legal certainty, and the protection of land rights holders. Therefore, the state must promote the adoption of high-precision cadastral mapping supported by regulatory reform, enhanced human resource competence, and the integration of national geospatial data, so that cadastral mapping can function optimally as an instrument for the protection of civil land rights and the equitable administration of land affairs

Abstract

Land is essential in the lives of Indonesians, impacting social, economic, and legal aspects, which frequently results in conflicts regarding its ownership. The growing incidence of land conflicts necessitates effective methods for resolution, with mediation being one such approach. This research intends to explore how mediation is applied to settle land disputes at the Madiun City Land Office and to pinpoint the challenges and potential solutions that emerge during this process. The research employs empirical legal methods alongside a sociological-juridical perspective. Data was gathered through observation, interviews, and analysis of documents, followed by qualitative descriptive analysis. Findings indicate that mediation at the Madiun City Land Office has been executed according to set procedures and offers benefits like relatively low costs, flexible scheduling, and the potential to preserve amicable relationships between the involved parties. However, its effectiveness has been limited by inadequate public awareness, conflicting interests, self-centered behaviors, lack of transparency, and insufficient goodwill among the parties. To address these challenges, mediators utilize a persuasive strategy that includes discussion, open communication, and emotional regulation. The success of mediation largely hinges on the willingness of all parties to find common ground

Abstract

The revision of national criminal law through the enactment of Law No. 1 of 2023 on the Criminal Code includes provisions on adultery and cohabitation in Articles 411 and 412 as absolute offences. This regulation is intended as a compromise between the protection of moral values and restrictions on state intervention in the private sphere. However, the criminalisation of personal relationships between adults has sparked debate about the limits of the state's legitimacy in interfering in private life, especially when criminal law ideally functions as an ultimum remedium and is only used to prevent real public harm. This study is a normative legal study with a legislative and conceptual approach. The results of the study show that although absolute complaint offences limit law enforcement initiatives to certain parties, criminal status still opens up the potential for state intervention after a complaint is filed. Within the framework of the harm principle, consensual cohabitation relationships are difficult to qualify as acts that cause concrete public harm. Furthermore, based on the principle of proportionality, criminalisation must have a legitimate, necessary and balanced purpose in relation to the restrictions on rights that it imposes. Without proof of a significant social impact, criminalisation has the potential to become a form of over-criminalisation that is not fully in line with the protection of the right to privacy in a democratic state governed by the rule of law
