Abstract

This study examines the regulation and authority of the Medical Profession Disciplinary Council (MDPK) in enforcing professional discipline after the enactment of Law Number 17 of 2023 on Health, which repealed Law Number 29 of 2004 on Medical Practice. The research aims to analyze the legal framework governing MDPK, identify weaknesses in the regulation, and explore the urgency of reconstructing its authority to improve effectiveness in protecting patients and ensuring legal certainty for medical professionals. Using a normative juridical method with a statute, case, and conceptual approach, the study reveals that although the new regulation strengthens MDPK’s role in preventing over-criminalization of medical practitioners, it still suffers from regulatory gaps, overlapping authority, and implementation challenges. These include limited resources, lack of integrated information systems, and weak enforcement mechanisms. The findings propose a reconstruction model through the formulation of detailed technical regulations, granting semi-judicial status to MDPK, integrating it into a special medical court system, and developing an integrated case management system. Strengthening MDPK’s authority is essential to create a disciplinary enforcement system that is effective, transparent, and balanced between patient protection and the rights of medical practitioners

Abstract

This study discusses legal issues in buying and selling through e-commerce, particularly the challenges in fulfilling the valid agreement requirements, especially regarding consent. The absence of face-to-face interaction between sellers and buyers makes it difficult to determine the timing and form of legal consent. The purpose of this research is to understand the legal relationship between sellers and buyers in e-commerce transactions and to analyze legal responsibilities in case of violations or disputes. This study uses a normative legal method with a statutory approach, and data is collected through literature review of regulations, legal doctrines, previous research, journals, and relevant articles. Data analysis is conducted qualitatively by systematically reviewing and organizing the data. The results show that sales agreements through e-commerce have the same legal force as conventional agreements as long as they meet the valid agreement requirements. Consent is considered to occur when the consumer takes an affirmative action, such as clicking approval within the system. These agreements are legally valid and binding according to Article 18 Paragraph (1) of the Electronic Information and Transactions Law (UU ITE). However, if the element of consent is unclear, the agreement remains valid but may be canceled if it does not meet the subjective or objective requirements as regulated in Article 1320 of the Civil Code

Abstract

Land grabbing is an unlawful act that harms legitimate landowners and creates legal uncertainty within society. This study examines law enforcement in cases of land grabbing in Gunung Sitoli, North Sumatra, which faces various structural and cultural challenges. One of the main obstacles is the weak formal ownership documentation, as many local residents do not possess land certificates despite having occupied the land for generations. Additionally, the limited capacity of agrarian investigators, restricted access to land information, and conflicts between customary law and positive law further complicate the issue. The presence of land mafia practices, collusion with officials, and weak criminal sanctions worsen the situation. Although restorative justice has been applied in minor cases, this approach is considered inadequate for serious offenses involving intimidation and violence. To effectively enforce the law, there needs to be better teamwork between different agencies, training for investigators, faster progress on the Systematic Land Registration Program (PTSL), and changes in regulations that officially acknowledge the rights of indigenous communities

Abstract

The phenomenon of copyright often becomes problematic for both songwriters and users. This occurs because the rights of songwriters are used arbitrarily without their permission. The government, through the LMKN (National Institute for Musical Research and Community Empowerment) and LMK (National Institute for Musical Research and Community Empowerment), which have played roles according to their respective competencies, needs to reorganize and accommodate the parties involved, namely songwriters and users. Law No. 28 of 2014 concerning Copyright has regulated how the regulation and licensing process for the use of songs owned by a songwriter. This research is a normative juridical study using primary legal materials, namely Law No. 28 of 2014 concerning Copyright and Government Regulation No. 56 of 2021 concerning Management of Song and Music Copyright Royalties. In addition, the author also used secondary legal materials, namely books and several journals related to this research. The results of this study indicate that the role of LMKN and LMK has not fulfilled and accommodated the rights of songwriters and users. This problem becomes even more pronounced when song users lack legal permission from the songwriters. Therefore, changes or revisions to the regulations governing song creation and use are needed to ensure fairness for both parties

Abstract

Resreach discusses providing Restitution through Forced Efforts to Seize Assets from Defendant Mario Dandi which went viral in the mass media, the fraudster was subjected to Forced Efforts to Seize Assets in the form of a Rubicon car to fulfill his obligation to pay Restitution to the victim's child, Davit Ozora. The defendant was charged with the article on Serious Assault as regulated in the Criminal Code (KUHP). Restitution is the right of every victim of a crime who experiences material or immaterial losses as regulated in Article 7A of Law Number 31 of 2014 concerning the Protection of Witnesses and Victims. Restitution is the responsibility of the perpetrator or a third party who must be redeemed by the perpetrator for criminal acts that cause losses to the victim. For example, in the District Court Decision No.297 / Pid.B / 2023 / PN Jkt.Sel with the fraud of Mario Dandi, which by the court decision was imposed a Criminal in the form of Forced Efforts to Seize Assets. This study aims to describe several errors in the implementation of Restitution. The method used in this research is Juridical-Normative using secondary data or library data (library research) with a Statute Approach and Case Study

Abstract

This paper examines the digital disruption brought by Artificial Intelligence (AI) and its transformative impact on legal practice in Indonesia. The objective is to analyze how AI is reshaping traditional legal workflows, from legal research and contract drafting to judicial decision support and predictive justice. Using a normative-juridical method with a qualitative approach, this study explores legal, ethical, and institutional implications related to the use of AI in the legal profession. The analysis is based on primary legal sources (statutory regulations) and secondary sources (scientific journals, reports, and expert opinions). Findings show that while AI offers efficiency and accessibility in legal services, it also raises significant challenges including accountability gaps, potential bias in algorithmic processes, and the weakening of human judgment in judicial procedures. The study concludes that Indonesia's legal system must establish clear regulatory frameworks and ethical guidelines to govern the use of AI in law. Such measures are essential to ensure that AI enhances, rather than undermines, justice and legal certainty

Abstract

Managing violent protests in Indonesia is a complex challenge for the Indonesian National Police (Polri): ensuring public order while safeguarding citizens' rights to free expression. The current legal framework is insufficiently clear to offer appropriate legal protection for Polri personnel operating in emergency and high-risk scenarios. This elevates the danger of criminal liability for the discretionary use of force by Polri officers. This study seeks to examine the legal protections available to Polri officers in managing violent demonstrations and to provide an improved legislative framework that addresses the operational requirements of the police force. This study uses a normative legal methodology to examine rules, judicial rulings, international standards, and pertinent examples. The results show that legal protection is still partial and not specific. A reformulation of legal protection is necessary, emphasizing three aspects: first, the establishment of more specific and clear regulations, including updated standard operating procedures, discretionary protection clauses, and guidance on the principle of proportionality grounded in law; second, the implementation of an internal legal support mechanism for Polri members; and third, the enhancement of accountability that consistently safeguards Polri members.

Abstract

This study aims to analyze the legal protection of community rights to land due to land conversion for National Strategic Projects (PSN) and mining in East Halmahera Regency, North Maluku, from the perspective of agrarian reform. The method used is empirical law (non-doctrinal legal research) qualitative-descriptive approach. Data through interviews with communities, traditional leaders, local governments, and literature studies on primary, secondary, and tertiary legal materials. Research shows that land conversion for PSN and mining causes agrarian conflicts, inequality in land distribution, and threats to local food security. Although spatial planning policies include the principles of justice and ecological sustainability, their implementation has not optimally protected people's rights. Agrarian reform as an instrument of land redistribution and legal protection has not been fully implemented, as can be seen from the low level of land certification and the lack of community participation in decision-making. This research underlines the need for preventive and repressive legal protection, policy synchronization, and increasing the role of the state in ensuring agrarian justice

Abstract

Penelitian ini bertujuan mengetahui pelaksanaan kewenangan pemerintah daerah dalam pengembangan pariwisata maritim memenuhi prinsip perlindungan hak masyarakat pesisir dan mengidentifikasi serta memahami arah kebijakan hukum yang responsif terhadap hak masyarakat pesisir dalam pengembangan pariwisata maritim yang berkelanjutan di Kabupaten Halmahera Selatan. Penelitian ini yang menggunakan pendekatan hukum sosio-legal, pendekatan perundang-undangan (statute approach) dan pendekatan konseptual. Penelitian menunjukkan peran dan tanggung jawab negara dalam sistem negara hukum kesejahteraan sangat luas. Negara tidak hanya berfungsi sebagai pelindung hak-hak individu, tetapi juga sebagai agen aktif menciptakan masyarakat yang adil, sejahtera, dan merata. Tiga aspek negara hukum untuk kesejahteraan melalui tiga aspek penting yaitu aspek politik, hukum, dan sosial ekonomi serta perlindungan hukum terhadap masyarakat pesisir dalam kerangka negara hukum kesejahteraan diatur berbagai peraturan perundang-undangan di Indonesia. Sebagaimana UUD NRI 1945 jelas memberi jaminan hak-hak dasar yang relevan bagi masyarakat pesisir.
