Abstract

This study examines the reconstruction of legal protection for the ecological rights of coastal Indigenous communities within Indonesia’s National Strategic Projects (NSP), using the Sea People (Suku Laut) of Bintan as a case study. The displacement of traditional settlements and coastal ecosystem degradation reveal the weakness of ecological rights enforcement and Indigenous participation in environmental licensing. Employing a normative legal method with statutory, conceptual, and case approaches, this research explores the gap between constitutional norms and administrative practice. The analysis applies ecological justice and good environmental governance theories to evaluate constitutional, administrative, and participatory dimensions of Indigenous environmental protection. Findings indicate a persistent legal vacuum and overlapping authority obstructing the recognition of marine customary rights and the enforcement of Free, Prior, and Informed Consent (FPIC) principles. A collaborative legal model is proposed, integrating ecological justice, independent coastal oversight institutions, and collective-rights-based regulations. This research recommends comprehensive legal reform toward an ecologically just and participatory coastal governance framework

Abstract

A justice collaborator (JC) in Indonesia is a term for a criminal who is willing to cooperate with law enforcement to uncover larger, more organized criminal cases. JC status is regulated by Indonesian law and provides protection and rewards for those who qualify. The implementation of the role of justice collaborator (JC) in specific crimes, such as corruption, terrorism, and narcotics, has a deep background and rationale. This concept was born from the awareness that these crimes are often complex and organized, making them difficult to uncover using conventional law enforcement methods. On the one hand, in Indonesia, although the concept of justice collaborator has been adopted, several shortcomings are known, such as the lack of an assessment system for submitting witnesses who wish to cooperate with law enforcement, an assessment of the evidence and statements to be presented by witnesses, and an assessment of the rewards that witnesses deserve for their assistance and cooperation. The research method used in this study is a normative juridical research method. The materials reviewed are primary, secondary, and tertiary legal materials. The results of the study show that the concept of justice collaborator still has several shortcomings, including the lack of regulation of which institution has the authority to submit and determine the status of Justice Collaborator, the absence of regulations on cross-examination of witnesses in cases involving justice collaborators, the absence of a clear assessment system for the Justice Collaborator submission process, the evidence presented by Justice Collaborators, and the assessment of awards that Justice Collaborators deserve for their contribution in revealing cases, as well as the absence of regulations on contractual relations between law enforcement and Justice Collaborators

Abstract

Restorative Justice in the criminal justice system at the court level after the issuance of Supreme Court Regulation (PERMA) Number 1 of 2024 concerning Guidelines for Adjudicating Criminal Cases Based on Restorative Justice. This approach shifts the focus from retribution (retributive justice) to victim loss recovery, offender accountability, and social relationship restoration. This study uses the perspective of the Developmental Law Theory (Teori Hukum Pembangunan) by Mochtar Kusumaatmadja, which views law as a tool of social engineering to achieve national development goals, including legal reform that is aligned with Pancasila values. PERMA No. 1 of 2024 is consistent with the spirit of the Developmental Law Theory because it aims to realize humane, benefit-oriented law enforcement, and prioritizes conflict resolution that accommodates the interests of all parties, in accordance with the values of justice and balance existing in the community. The implementation of this PERMA is a concrete effort to reform Indonesian criminal law to build a justice system that is more responsive to the real needs of the community

Abstract

This study aims to analyze the legal status of anonymous breast milk donors in the perspective of Islamic law and Indonesian positive law in the modern era. The main focus of this study is to understand how the practice of breast milk donation carried out without the identity of the donor can raise legal issues related to nasab, mahram relationships, and legal protection for recipients and donors. The type of research used is library research with a normative legal approach. This approach is used to examine various legal sources and relevant literature, such as shar'i texts, classical and contemporary fiqh books, laws and regulations, as well as the results of previous studies that discuss anonymous donor ASI and the concept of raḍa'ah in Islamic law. This research is descriptive-analytical in nature, with the aim of systematically describing phenomena and critically analyzing rational and contextual legal arguments. The results show that the practice of anonymous breast milk donation has humanitarian value and health benefits, but has the potential to cause nasab confusion and a vacuum of legal norms in Indonesian positive law. From the perspective of Maqashid Sharia, this practice can be seen as a form of tahqiq al-maslahah in the health sector, but still requires strict and transparent regulation to be in line with the principles of benefit, legal certainty, and family protection in Islamic law

Abstract

Abuse of position through extortion constitutes a form of power misuse that significantly undermines public integrity and trust in government. This study aims to analyze the regulation of extortion in office within the legal systems of Indonesia and Singapore, and to compare the criminal policies of both countries. The research employs a normative legal approach with doctrinal and comparative methods, examining legislation, jurisprudence, and relevant legal literature. The findings indicate that Indonesia emphasizes the elements of abuse of power and coercion as a formal offense under Article 12 letter e of the Corruption Eradication Law (UU Tipikor), whereas Singapore focuses on corrupt intent and the receipt of gratification under the Prevention of Corruption Act (PCA) 1960, without requiring coercion. In terms of criminal policy, Indonesia predominantly applies a repressive penal approach, while Singapore implements an integrated penal and non-penal strategy, emphasizing prevention, integrity development, and transparency in public administration. These findings highlight the necessity for legal and criminal policy reform in Indonesia through the strengthening of non-penal mechanisms, regulatory harmonization, and enhanced anti-corruption institutions, so that criminal law can function as ultimum remedium in safeguarding the integrity of public office

Abstract

Abuse of position through extortion constitutes a form of power misuse that significantly The purpose of this study is to determine and analyze the regulation and application of the prosecutor's authority in implementing diversion for children in conflict with the law in Cirebon Regency and Kuningan Regency. The analytical method used in this study is empirical juridical, namely a type of legal research that examines applicable legal provisions and what happens in reality in society. The con-clusion of this study is that the prosecutor's authority has been regulated in Article 7 and Article 42 of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System along with other relevant regulations, and regulates limitations on the types of cases that can be diverted, which actually becomes an obstacle, because it shows that not all children who are perpetrators of crimes can be diverted. In addition, in its implementation, diversion is still faced with technical and cultural obstacles. Thus, the suggestions that can be recommended in this study are that policy makers need to revise or improve regu-lations governing diversion so that limitations that hinder the implementation of diversion efforts can be reviewed, and there is a need for increased socialization and education to the community and victims regarding the importance of diversion in protecting children's rights, as well as strengthening synergy between law enforcement agencies and social service providers to support the effectiveness of diversion im-plementation in the field

Abstract

This study aims to analyze the influence of economic factors as a dominant cause of divorce within the jurisdiction of the Surabaya Religious High Court (PTA) from 2023–2024. The research findings indicate that economic factors play a significant role in disrupting domestic harmony, whether through the husband's inability to meet family needs, the increasing economic independence of women, or lifestyle pressures that exceed financial capabilities. This financial pressure often leads to stress, prolonged conflict, and unhealthy communication between spouses. Furthermore, shifting gender roles and weak family financial management also accelerate the breakdown of the marital relationship. This study concludes that economic stability is a primary pillar in maintaining domestic harmony. The results of this study are expected to serve as a basis for the Religious Courts and related institutions in formulating preventive and educational policies to reduce divorce rates attributed to economic factors
