Abstract

This study discusses the factors that influence and constrain officers in preventing electricity theft in the PLN UP3 Kendari area. In this era, electricity has become a basic necessity for human life, resulting in electricity abuse by PLN customers. This study uses an empirical juridical research method that examines the laws that operate and are applied in society. The results of this study found that the factors causing electricity theft at PLN UP3 Kendari are insufficient electricity supply, electricity payments that are considered too expensive by customers, and the installation of illegal Kwh meters by the installation party. Meanwhile, the obstacles faced by officers in preventing electricity theft are customer resistance and officers who deny their actions, and requests for security from the police with the aim of making activities conducive and effective.

Abstract

Restorative justice emerges as a sentencing paradigm that shifts orientation from retribution to the restoration of victims’ losses, offenders’ accountability, and social balance. Nevertheless, its implementation in the Indonesian criminal law system still faces fundamental challenges, particularly regarding legal certainty. The fragmentation of sectoral regulations, normative ambiguity, and the contradiction with the retributive paradigm in the old Criminal Code (KUHP) create inconsistencies in practice and weaken legal predictability. This research aims to analyze the gap between the principle of legal certainty (das sollen) and the practice of restorative justice (das sein), as well as to examine the urgency of integrating this concept into the structural sentencing system as part of Indonesian criminal law reform. The study applies a normative juridical method with statutory, conceptual, and case approaches, combined with qualitative analysis of primary and secondary legal materials and selected empirical case studies. The findings reveal that restorative justice has obtained normative legitimacy through several sectoral regulations (Perpol No. 8/2021, Perja No. 15/2020, Perma No. 1/2024), and explicit recognition in the new Criminal Code (Law No. 1/2023). However, its implementation still encounters challenges such as institutional ego, lack of professionalism among law enforcers, and the persistent gap between normative ideals and practical realities. Therefore, integrating restorative justice into the structural sentencing system is an urgent necessity to ensure harmony between justice, legal certainty, and legal utility in the reform of Indonesian criminal law

Abstract

The phenomenon of transnational corruption involving foreign corporate entities poses significant challenges to the national criminal justice system, particularly in asserting jurisdiction and enforcing sanctions. Although legal frameworks such as the 2023 Indonesian Penal Code, the Law on the Eradication of Corruption, the Law on the Corruption Eradication Commission, and the Law on Mutual Legal Assistance in Criminal Matters are already in place, the prosecution of multinational corporations remains hindered by structural barriers and implementation gaps. This research aims to analyze the legal challenges faced by Indonesia in prosecuting foreign corporations engaged in corruption and to formulate appropriate legal strategies to address these obstacles. The research method employed is normative legal research using statute and conceptual approaches, drawing on primary legal materials (statutory regulations), as well as secondary and tertiary legal sources. The findings reveal the urgent need for enforcement reforms through jurisdictional innovation, strengthened international cooperation, and the adoption of progressive legal theory and developmental law approaches to ensure legal certainty and effectiveness in addressing global corporate crime.

Abstract

Perkembangan teknologi informasi dan komunikasi memunculkan fenomena baru dalam Masyarakat, misalnya saja terkait dengan pengambilan dan pemanfaatan potret seseorang tanpa izin yang kemudian dikomersialisasikan melalui media digital. Tujuan penelitian ini untuk mengetahui dan menganalisa terkait dengan akibat hukum bagi pihak yang melakukan pengambilan dan komersialisasi foto tanpa izin terhadap pemilik potret, serta efektivitas instrument hukum di indonesia dalam memberikan perlindungan terhadap hak atas potret dan hak privasi. Penelitian ini menggunakan penelitian yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Hasil penelitian menunjukkan bahwa yang pertama pengambilan dan komersialisasi foto seseorang tanpa izin merupakan pelanggaran terhadap hak atas potret yang mencakup aspek moral serta aspek ekonomi. Indonesia belum memiliki pengaturan khusus mengenai hak atas potret, perlindungan hukum tetap dapat ditegakkan melalui jalur perdata, pidana, dan administrative. Perdata berdasarkan dengan Pasal 1365 KUHPerdata mengenai perbuatan melanggar hukum, pidana melalui ketentuan UU ITE, UU PDP, dan KUHAP, dan secara administrative dapat dikenai sanksi berupa teguran, denda, hingga penghentian kegiatan berdasarkan UU PDP. Kedua instrumen hukum di Indonesia telah mengalami perkembangan dalam memberikan perlindungan terhadap hak atas potret dan hak privasi, terutama setelah diberlakukannya UU PDP, akan tetapi, efektivitas regulasi tersebut dalam praktik masih terbatas dan belum optimal.

Abstract

This study aims to analyze the legal protection of women workers in employment contracts within the palm oil plantation sector in North Aceh Regency, with particular emphasis on the gap between normative regulations and their implementation in practice. The research employed a normative-empirical legal approach by combining statutory analysis with field data collected through interviews and observations with women workers, company representatives, and local labor authorities. The analysis was conducted qualitatively to compare the provisions of labor laws regarding maternity leave, menstrual leave, reproductive health rights, and social security with actual conditions experienced by women workers, most of whom are employed under daily or short-term contracts. The findings show that written contracts often fail to guarantee fundamental rights, while weak government oversight and persistent gender discrimination exacerbate the precarious position of women workers. The study concludes that an integrative model of legal protection is needed, which combines clear and fair contractual arrangements, effective state supervision, active participation of labor unions, and continuous gender-based legal education. Such a model is expected to ensure more equitable and humane working conditions for women workers in the palm oil plantation sector

Abstract

Terrorism has been a serious threat to national and global security for decades. In Indonesia, the phenomenon of terrorism exhibits a dynamic pattern of development, both in terms of ideology, modus operandi, and attack targets. This evolution is inseparable from ongoing social, political, and technological changes. In recent years, advances in information and communication technology have created a new chapter in the threat of terrorism. The internet and social media are widely used by terrorist groups to spread radical propaganda, recruit new members, communicate, and raise funds online. This development presents a significant challenge for law enforcement. Terrorist modus operandi has become more decentralized, no longer dependent on conventional structured networks. The research method used in this study is a normative juridical research method. The materials reviewed include primary, secondary, and tertiary legal materials. The results show that the development of counterterrorism efforts in Indonesia shows a shift from a militaristic approach to a more comprehensive criminal approach. These developments involved strengthening the rule of law (from Law No. 15/2003 to Law No. 5/2018), the establishment of specialized institutions (Densus 88 and BNPT), and the adoption of more progressive legal theories. While these efforts have yielded significant results, challenges persist, requiring ongoing strategic adaptation

Abstract

Psychopaths as perpetrators of criminal acts, particularly in murder cases, pose complex problems in the field of criminal law due to their antisocial, manipulative, and unchangeable personality traits, which often render conventional punishment ineffective. This study aims to analyze the comparison of punishment for psychopathic perpetrators in murder cases between the Indonesian criminal justice system and the Danish criminal justice system. The research method used is socio-legal studies with a comparative approach, thereby enabling a description of the fundamental differences in the orientation of punishment in both countries. The results show that the Indonesian criminal justice system is still dominated by a punitive and general rehabilitation paradigm, without a specific design for prisoners with psychopathic disorders. This raises doubts about the effectiveness of punishment, particularly in relation to the prevention of recidivism, the limited number of experts, and the potential for abuse of the parole mechanism. In contrast, Danish criminal law recognizes the mechanism of forvaring, which emphasizes psychiatric rehabilitation and resocialization, reflecting a balance between protecting society and restoring individuals. This comparison shows that Indonesia places more emphasis on certainty and firmness in punishment, while Denmark prioritizes a long-term humanistic approach

Abstract

This study aims to analyze the enforcement of criminal law against illegal micro-mining crimes committed through Internet of Things (IoT) devices, which represent a new form of cybercrime utilizing computing power without authorization. The research employs a normative juridical method with a statute, conceptual, and comparative approach, analyzing Indonesian criminal law provisions, particularly the Electronic Information and Transactions Law (UU ITE), the new Criminal Code (KUHP 2023), and the Personal Data Protection Law. The study finds that illegal micro-mining using IoT devices constitutes an unlawful exploitation of digital energy resources, yet remains unregulated explicitly in Indonesia’s positive law. The absence of clear norms regarding the unauthorized use of computing power creates obstacles in determining criminal responsibility and digital evidence admissibility. Therefore, the study concludes that a legal reform is needed to classify unauthorized cryptomining as a cybercrime, accompanied by the establishment of digital forensic standards specific to IoT environments to strengthen law enforcement capacity

Abstract

The development of information technology has truly changed many things in Indonesia. In fact, in many countries, the business and trade sectors are the most impacted by the development of information and telecommunications technology and the fastest growing. The concept of the right to privacy and personal data is actually a new concept along with the development of technology and information. In its development, personal data protection in Indonesia is regulated by Law Number 27 of 2022 concerning Personal Data Protection (PDP Law), which came into effect on October 17, 2024. However, despite the aforementioned regulations, there are still quite a lot of crimes and violations of personal data experienced by the public, both by individuals and by business entities. On the one hand, the theft of personal data, whether due to intentional or negligent actions by personal data managers, especially by e-commerce businesses such as Tokopedia, and official government legal entities such as BPJS, certainly requires concrete legal accountability. The research method used in this study is a normative juridical research method. The materials reviewed are primary, secondary, and tertiary legal materials. The research results show that Law Number 27 of 2022 still has several shortcomings, and these weaknesses still require attention. Issues such as the lack of independence of the supervisory institution, sanctions that are potentially less stringent than international standards, implementation issues, and suboptimal protection of vulnerable groups remain challenges. Furthermore, the issue of legal accountability by business actors or legal entities managing personal data that is biased and only benefits the government remains a major weakness of Law Number 27 of 2022. Therefore, further efforts are needed to refine regulations, strengthen institutions, and ensure effective law enforcement to achieve maximum personal data protection for all citizens

Abstract

This study aims to identify the most appropriate form of legal protection for online drivers. It adopts a normative legal research approach (c), focusing on the application of law and conceptual frameworks, particularly in relation to partnership agreements. This research does not involve hypothesis testing, as normative legal research does not employ hypotheses or empirical data, but rather relies on legal materials.The findings reveal fundamental differences between partnership agreements and employment contracts. The partnership relationship between online drivers and application service providers is unique, as both parties are formally considered equal under Article 36 of Law Number 20 of 2008. However, in social and economic practice, online drivers are often in a weaker position. Therefore, the government, as the sovereign authority, should intervene by providing legal protection through legislation and public policy. Such protection is essential to uphold the rights of online drivers and aligns with John Rawls’ theory of distributive justice
