Abstract

This research aims to evaluate the implementation of the School Operational Assistance (BOS) program in private Vocational High Schools (SMK) in the Rayon III area of Bekasi City, using a statutory approach and empirical juridical method. The study employs a descriptive method with qualitative analysis based on interviews and secondary data from primary and secondary legal materials. Results show that the implementation of the BOS fund program aligns with Law No. 20/2003 on the National Education System and its implementing regulations, with timely reporting on fund usage and no late fees incurred. Supervision by the Office Branch Office (KCD) of Sub Rayon III Bekasi also complies with relevant provisions. The empirical juridical analysis indicates that the implementation of BOS funds in this area fulfills the elements of legal certainty, justice, and community benefit. This study's implications highlight the importance of enhancing transparency and accountability in BOS fund management, as well as the need for increased supervision to more effectively support educational activities and ensure fair access to quality education.

Abstract

One of the alternative ways that people can use to invest is the use of online investment applications which are now widespread and easy for people to use. As a place to invest, a securities application is needed to make it easier for people to invest in the capital market. However, it cannot be denied that a company listed on the stock exchange experiences delisting for some reason. This could happen because the company goes bankrupt or other things. So it is necessary to review shareholder protection in online applications if there are problems that require the issuer to be dissolved and delisted from the stock exchange. This research uses a qualitative method with a type of normative juridical research which uses secondary legal sources originating from primary legal materials from statutory regulations and secondary legal materials originating from books, journals and other literature. The research results show that shareholder protection in online applications regarding the dissolution of issuers, custodian banks play an important role in maintaining the flow of transactions in the capital market. Based on Article 46 of Law no. Article 8 of 1995 concerning Custodian Banks in the Capital Market is responsible for all losses resulting from their actions and their form and value in more detail, so that if losses arise they can be immediately borne by the bank.

Abstract

Abuse is a willful and unlawful act of taking someone else's property. This crime is characterized by a breach of trust and often occurs at various social levels. By raising the legal issue of the crime of embezzlement committed by Dwi Zahrul Fitriana Binti Djumadi Hari Santoso (deceased) who was committed during her term of office as a result of employment, search, or receiving wages in case number 315/Pid.B/2023/PN Gsk. This study examines thoroughly the criminalization of fraud in the term of office of Dwi Zahrul Fitriana Binti Djumadi Hari Santoso (expired) so that later the local area will be more careful in acting. This research uses an empirical legal approach method. The examination used is a subjective examination. The verdict determined that the defendant had taken funds from PT Cipta Mandiri Nusantara Abadi and did not return them. The defendant was found guilty of the charges of the panel of judges and sentenced to two years and six months in prison for violating the Criminal Procedure Code and Article 374 of the Criminal Code. The Panel of Judges' considerations, including aggravating and mitigating circumstances, have met the principles of legal certainty, justice, and expediency, in accordance with empirical analysis.

Abstract

The development of mining activities without permits has also led to an increase in the trade of mining products on the black market, where natural resources are exploited illegally and mining products are distributed and sold illegally to avoid government taxes, which has reached a very worrying stage. This research method uses empirical juridical. Next, the topic of discussion was the enforcement of criminal law against coal mining without a permit in the Muara Enim police area. As a result, law enforcement carried out in the Muara Enim Police area against unlicensed miners has been carried out but has not been optimal, because there are no comprehensive regulations.

Abstract

The UN Peace Mission is a tool established by the UN to provide assistance and political support and facilitate peacebuilding for countries that are in conflict or are in transition from conflict to peace. Palestine is one of the regions in the Middle East and North Africa, where in this region there is inequality between men and women that still persists and is supported by patriarchy. Women and girls in Palestine continue to experience various forms of violence due to patriarchal norms and culture that are rooted in their society. This research will discuss the importance of gender equality issues in the international sphere, especially gender violence that occurs in Palestine, besides that this research will discuss the Importance of the Involvement of Women Peacekeepers in Overcoming Gender-Based Violence in Palestine, the discussion in this study includes the Urgency and impact of the Involvement of Women Peacekeepers on Gender-Based Violence in Palestine. Based on the results of the study, it shows that the involvement of female peacekeepers in the prevention of gender-based violence in Palestine can be a stimulus for other countries to participate in helping and reducing the number of gender-based violence, besides seeing that gender-based violence in Palestine is an urgent matter to be resolved, the involvement of Indonesian peacekeepers in the prevention of gender-based violence in Palestine will provide a new fighting direction for Palestine and other countries in conflict.

Abstract

In criminal justice, forensic autopsies play a critical role in determining the cause and manner of death. Current provisions are unclear, leading to inconsistencies in the criminal investigation process. This study examines weaknesses in Indonesian law, particularly the ambiguity in regulating forensic autopsies, the obligation to conduct autopsies in suspected criminal deaths, and the procedures for notifying the victim's family. This study aims to provide an interpretation of the legal regulations concerning autopsies and to formulate regulatory reforms related to the conduct of autopsies in criminal investigation processes. The results of this study indicate that in criminal investigations, autopsies are crucial for determining the cause and manner of death, as well as providing scientific evidence linking the perpetrator's actions to the victim's death. However, ambiguity in interpreting the obligation to conduct autopsies under Article 134 of the Criminal Procedure Code (KUHAP) leads to inconsistencies. To address this, clear regulations are needed to define when an autopsy is considered "very necessary," providing consistent guidance to investigators. Mandatory autopsies for all unnatural deaths would ensure thorough examinations. While families must be informed, their consent is not required, and obstructing an autopsy is a criminal offence, supported by Article 222 of the Criminal Code, as amended by Article 283 of Law No. 1 of 2023 concerning the Criminal Code.

Abstract

The increasing population density often leads to differences in views that can eventually trigger disputes, including disputes related to land. Based on the increasing population level, of course the need for land as a place to live and make a business is getting narrower because the land has been controlled by other communities, while other communities also need land to carry out the same activities, this is where the dispute occurs. The method used in this research is empirical juridical research. The results show that the characteristics of dispute cases that occur in Oel'ekam Village include inherited land disputes, customary land disputes and land boundary disputes. The form of local wisdom in the Oel'ekam Village community is oko mama and the advantages of this alternative resolution are that the settlement is quickly realized, low cost, confidential and unemotional while there are also weaknesses, namely the execution mechanism which is difficult because the way to execute the decision, depends on the good faith of the parties to resolve the dispute to completion and the mediator will not bring good results especially if insufficient information and authority is given to him.

Abstract

The proliferation of electronic government (E-Government) initiatives has played a crucial role in transforming public services, particularly in enhancing effectiveness, efficiency, and accessibility. This study specifically analyses the Jaket Boat application in Thousand Island, assessing the extent to which it influences and improves public transport services. Faced with the unique geographical challenges and complex transportation needs, Thousand Island provides an ideal context for examining the application of technology in meeting and exceeding public service expectations. The Jaket Boat application, as an E-Government initiative, has been examined to assess its contribution to facilitating easier access, speeding up service processes, and enhancing the overall efficiency of the public transport system. The findings of this research are vital in informing further development of E-Government systems aimed at creating more integrated and accessible transportation services for all segments of society in Thousand Island.

Abstract

Limited Liability Companies (LLCs) are crucial for driving and directing economic progress. Limited liability companies are crucial in driving and driving economic progress, particularly in the middle of globalization and liberalization of the increasingly complicated global economy. A company takeover is a legal action designed to increase a firm's viability and effectiveness by purchasing or disposing of shares of the target company. The law governing the selling and acquisition of shares that transfer rights are the main topic of this study. The research method used in writing this scientific paper was a normative research method with an analytical and conceptual approach which is carried out by analyzing legal concepts related to the legal issues faced. It is crucial to pay close attention to whether buying and selling shares in the legal transaction results in a change of ownership. The position of employees of the company whose shares were purchased does not, however, immediately end as a result of the transfer of rights to the company, unless there is an extra agreement in the company transfer agreement

Abstract

This study aims to analyze the impact of The Hu's music diplomacy on Mongolia's nation branding program. The study employs a descriptive qualitative method with secondary data analysis from journal articles, books, relevant reports, and media covering The Hu's activities. The results indicate that The Hu, with their unique approach of combining traditional Mongolian music elements with modern rock, have successfully raised global awareness of Mongolian culture and enhanced the country's positive image. Their international performances, received awards, and collaborations with renowned musicians have introduced Mongolian cultural elements to a wider audience, creating curiosity and appreciation for Mongolia's cultural heritage. Strategic recommendations include greater government support, enhanced collaboration with digital platforms, and educational and cultural exchange programs.
