Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Jurnal Hukum dan Peradilan comes out three times a year in March, July, and November.

Abstract

The enactment of Law No. 30 of 2014 concerning Government Administration very much changes the paradigm of the proceedings in the State Administrative Court. One of the fundamental things is about administrative proceedings as pre-litigation proceedings. Under Article 75 of Law No. 30 of 2014 concerning Government Administration, citizens who feel disadvantaged by a Government’s Decision or Action can file an administrative proceedings, and then file a lawsuit in the Administrative Court. Regarding this regulation, two interpretations arise regarding the obligation of administrative proceedings as pre-litigation proceedings. One party argues that the administrative proceedings as pre-litigation proceedings must be carried out before filing a lawsuit in the Court, and the other argues this is not mandatory. For a period of four years, the interpretation of the obligation of administrative proceedings as a pre-litigation proceedings in Law No. 30 of 2014 concerning Government Administration is floating in the realm of discourse. It was only on December 4th, 2018 that the Supreme Court issued a Supreme Court Regulation (PERMA) No. 6 of 2018 concerning Guidelines for Resolving Disputes Regarding Government Administration After Administrative Proceedings, finally the Supreme Court dictates that administrative proceedings as a pre-litigation proceedings is a must. However, the PERMA does not regulate fundamental things regarding lawsuit after administrative proceedings, namely, who will be seated as the defendant, and what is the object of the lawsuit. In addition, there are also a number of things that needed to be reviewed regarding the arrangements in the PERMA, such as regarding the deadline for a lawsuit in the Court.

Abstract

AbstrakKompilasi Hukum Islam (KHI) tidak mengatur waris beda agama secara jelas, KHI hanya mensyaratkan pewaris dan ahli waris memiliki agama yang sama. Di pengadilan, hakim-hakim Pengadilan Agama menggunakan wasiat wajibah untuk membagi harta warisan dengan ahli waris non-Muslim, berdasarkan yurisprudensi Mahkamah Agung Nomor 368 K/AG/1995. Sebagai hasilnya, perbedaan agama masih menjadi halangan bagi Muslim dan non-Muslim untuk saling mewarisi karena penerapan hukum tanpa mempertimbangkan illat hukum larangan waris beda agama. Dalam hal ini, penting untuk meneliti illat hukum hadis yang melarang waris beda agama sebagaimana yang dicoba dilakukan oleh artikel ini. Untuk melakukan penelitian tersebut, penulis menggunakan pendekatan usul fikih dan hermeneutika. Hasilnya, penulis sampai pada kesimpulan bahwa illat hukum hadis yang melarang waris beda agama adalah karena unsur permusuhan dan kejahatan, dan bukan karena perbedaan agama. AbstractKompilasi Hukum Islam does not regulate interfaith inheritance distinctly, it only requires the testator and the heirs have the same religion. At court, judges of religious courts employ obligatory bequest (wasiat wajibah) to share inheritance with non-Muslim heirs, based on jurisprudence of the Supreme Court Number 368 K/AG/1995. As the result, different faith still become hindrance for Muslim and non-Muslim to inherit each other due to law enforcement without considering the legal reason (ratio legis) of the law. In this case, it is important to investigate the legal reason (ratio legis) of the hadith that prohibits the interfaith inheritance as this article tries to do. To do the investigation, the author employs Islamic legal theories (usul fikih) and hermeneutics approach. As the result, the author comes to the conclusion that the ratio legis of the hadith that prohibits the interfaith inheritance is due to hostility and crime elements, and not due to different faith.

Abstract

Indonesia’s has control over vast seas potential to support the country's economy. However, the potential was not optimal because of fishery crime and the lacking of law enforcement in the field of fisheries. This matter becomes very important and strategic in order to support the fishery development in a controlled manner and in accordance with the principles of sustainable fishery management. However, in practice, law enforcement in fisheries shows weaknesses. It is evident from the very complex problems of criminal offenses fisheries, interagency coordination mechanism problems and the establishment of a fishery court to enforce the law that is not evenly distributed throughout the territory of the district court. In resolving these problems, reforms in law enforcement is the key factor that is focused on the legal and human resources. With this support of fishery law enforcement, it is hoped that fisheries development can be carried out in a sustainable manner.Keywords: fisheries crimes, law enforcement, fishery court

Abstract

In the context of Law Number 30 of 2014 concerning Government Administration the competence of administrative court was not only the decision of the Administration but also has the competence to judge the actions of Administration. In addition administrative court also have competence to decide an application for assessment to determine whether there are elements of authority abuse as well as the application for a fictitious positive decision. However to determine the application for approval of a person or body of civil law are not automatically, but must first be tested through administrative courts. The Government's Administration Law regulates the material law and formal law. For the Government's Administration Law should be amended to load any material law and the need for changes to the Administrative Law to accommodate the enforcement of material law.Keywords: administrative court, competence, material law, formal law.

Abstract

The Metaverse provides a prospective opportunity for medical practitioners to improve patient engagement, training of medical personnel, and simulation-based learning. It allows for immersive telemedicine medical practice, enabling medical practitioners to render medical services to patients in remote areas through realistic virtual consultation and training of medical personnel and students through a lifelike simulation. However, despite the potential of the Metaverse concept in medical practice, certain legal and medical issues could mitigate its usefulness. In this regard, this study adopts a hybrid method of research in ascertaining the prospect, legal, and health risks of utilizing the metaverse in medical practice. 256 questionnaires were distributed, and the result obtained was analysed using descriptive and analytical methods. The study found that there are several potentials for utilizing the metaverse in medical practice. However, there are legal and medical risks in utlising the metaverse in medical practice and they include; patient data privacy, regulation, licensing, patient consenting to virtual medical treatment, and accountability for medical errors in the metaverse. Furthermore, the study also found that spending longer hours in the metaverse could result in sedentary behavior, associated with medical issues like obesity, musculoskeletal disorders, and cardiovascular problems. It was therefore concluded and recommended that the metaverse holds significant promise for the future of medical practice in Nigeria, offering innovative solutions that can transform healthcare delivery and education. However, to avoid legal and medical issues that may occur, there is a need for regulatory compliance with healthcare regulations.

Abstract

This Article entitled " the State law of Indonesian" is the result of a study on the conception of characteristic of law states of Indonesian that distinguish the conception of the state laws in other countries. Based on the research results, can be explained even get the effect of various thoughts, but conception of law state of Indonesian different with conception the rule of law and rechtsstaat. This can be search from basic of philosophy, the nature of sovereignty, the powers of state organs, and human rights. There are six main elements of Indonesian law states, namely: 1) Pancasila; 2) supremacy of law;; 3) democratic 4) restrictions and dispersal of state power; 4) independent judiciary; 6) protection of human rights. the statement of Indonesia as a democratic rule of law based on Pancasila then should all forms of civic and social action must be based on the law.Keywords: Pancasila, State of law (the rule of law, rechtsstaat), Democracy, Human Rights

Abstract

The implementation of court in Indonesia has not fulfilled as expected because any parties involving in court has a lack of capacity, consistency, and integrity to provide legal service seriously. Some people assume that court services are not still optimal. To settle the problems, the Supreme Court just has officially issued Regulation No. 1 of 2019 regarding the Administration of Cases and Legal Proceedings in Courts via Electronic Means on 8 August 2019. This regulation is believed as an appropriate solution to face those problems. To elaborate more, this study illustrates a judicial reform in Indonesia, e-court, and access to justice, the conception of e-court including the performance of e-court and its drawbacks and challenges in the digital era. The research method uses normative research by approaching legal review and literature study. The technique of primary data collection applies Supreme Court regulation while means of secondary data are collected from concept or theory as set out under bibliography. Judicial reform in Indonesia is indicated by issuing new regulation regarding e-Court and e-Litigation, the implementation e-Court itself has been attributed to 32 courts consisting of general religious, and state administrative courts. Through e-Court, access to justice more transparent and accessible. Besides, justice seekers have no worries regarding distance issues as of e-Court may allow them to fight in court without face to face. Parties have no doubt relating to the acceleration of court to settle any dispute in Indonesia.

Abstract

There are many domestic violence settlement that do not satisfy the sense of justice, especially for the victims and subordinate in the household. The dissertation results: first, the settlement of domestic violence in fact settled by Act No. 23 of 2004 as lex specialis. The setlements of domestic violence cases based on that rule, empirically emphasis on the criminal sanction, so that the purpose of preventive, protective and consolidative was not rise. Second, the research concluded that domestic violence is a case with multi-dimensional settlement because there is the scope of the civil and criminal sphere on the other side. Therefore, it needs a medium in the system that can accommodate the completion of the case, which one of them is restorative justice approach.Keywords: crime, domestic violence, criminal justice system, restorative justice
