Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Abstract

Mediation is a method of resolving disputes through a negotiation process with the assistance of either a judge or a non-judge mediator. The Supreme Court of Indonesia set a nationwide aim of 25% for settling disputes by mediation in 2023. However, the actual implementation in the jurisdiction of the Banten Religious High Court is only around 20,7% of the defined target, below the national success rate for religious courts, which has reached 39.85%. One of the main factors is the over-reliance on non-judge mediators and the mediator's ability to lead the mediation. Thus, mediation management must be improved, and the capacity of mediators, particularly non-judges, must be increased. This study seeks to discuss the effectiveness of dispute resolution by non-judge mediators and how to maximize the level of success in settling disputes by non-judge mediators. This article is a descriptive qualitative study using normative juridical and empirical approaches. According to the findings of this study, the mediation process in religious court institutions, particularly in the jurisdiction of the Banten Religious High Court, has not been effective because most of the process is directed by non-judge mediators who are less qualified than judge mediators. To increase the success rate of the mediation implementation process, the court must take the following steps: Rewarding non-judge mediators, organizing coaching and training programs for non-judge mediators, determining national mediation settlement targets by involving non-judge mediators, implementing hybrid mediation (between judge mediators and non-judge mediators); and conducting regular evaluations of a non-judge mediator.

Abstract

As a public institution in the field of justice, the Supreme Court is required to commit to apply the disclosure of information. Nowadays, transparency of information disclosure in the context of justice for the Supreme Court is not only the public needs but also the needs of all residents of the judiciary. With the judicial transparency, will slowly happen to strengthen accountability and professionalism and integrity of the judiciary residents. Commitment to provide disclosure of both the process and the end result is a concrete manifestation of public services as access to justice (access to justice) given by the Court at the lowest levels up to the Supreme Court.  Quality of excellent public services through the transparency of the judicial information disclosure is the estuary of execution Reform of Bureaucracy.Keywords : Information transparency, Judicial, Integrity and Legal Certainty

Abstract

The spirit of the rule of law against corruption which is considered as an extraordinary crime that resulted in the occurrence of social inequality , the economy , the loss of faith in government and a variety of other problems that led to the birth of Law No. 31 of 1999 in conjunction with the Law No. 20 Year 2001 About Follow Corruption. The interesting thing about the formation of the Anti- Corruption Act is a criminal provision in the formulation of minimum deliknya against perpetrators of corruption . It is certainly different from the general criminal provisions in the draft Criminal Law (Penal Code) which is more familiar maximum penal provision . The results showed that the minimum pinadana special provisions in the law of corruption can be breached so long as the judge has the legal resening or residenti proper ratio to a corruption case by looking at the size scale of the corruption case with consideration and interpretation of the patterns perspective, social - justice, moral justice and community justice decision was taken to drop the minimum punishment. Criminal punishment under the criminal provisions of the special minimum in some court decisions can be made by several criteria into consideration the provisions of the criminal judges deviate minimum, the criteria of the element of state assets or state economy as a result of the acts of corruption tiundak and criteria of the role and position of the defendant in acts of corruption. Abstract

Every citizen of Indonesia, of course longing for a fast, simple and low cost judicial process. This may be done everyone has an access to justice without any exception. These conditions have been realized by the Constitutional Court decision that had to cancel Article 31 of Law Number 18 Year 2003 on Advocates, because the article is considered contrary to the Constitution of 1945 and has no binding legal force. However, the implementation of the Constitutional Court ruling will not necessarily be implemented, because in practice there are still debates among law enforcer (police, prosecutors, judges, lawyers) even academics about the legal standing of the law lecturer who perform service in the form of assistance to disadvantaged communities who are dealing with legal issues. This condition is caused by a lack of positive response to the Constitutional Court, and the lack of response is due to the lack of legal resources by extracting the part of law enforcement and academics for a growing source of law. Abstract

Di Indonesia sesungguhnya banyak kasus yang terjadi berkaitan dengan pelecehan terhadap pengadilan dan aparat penegak hukum. Hal tersebut berpengaruh terhadap integritas dan kewibawaan lembaga peradilan sebagai benteng terakhir untuk mendapatkan keadilan. Namun, sampai saat ini di Indonesia belum ada ketentuan yang secara khusus mengatur tentang pranata Contempt of Court. Artikel ini merupakan bagian dari penelitian yang telah selesai dilakukan dengan metode yuridis normatif yang mengedepankan data sekunder dengan dilengkapi data primer berupa penelitian lapangan yang dilakukan pada beberapa pengadilan negeri yang ada di Indonesia. Pembahasan difokuskan pada permasalahan eksistensi pengaturan dan penegakan hukum Contempt of Court serta menentukan model pengaturannya di Indonesia.  Peraturan perundang-undangan yang mengatur tentang Contempt of Court secara khusus sampai saat ini masih belum ada. Akan tetapi, pengaturannya telah tersebar dalam  Kitab Undang-Undang Hukum Pidana (KUHP). Oleh karena itu, dari sekian kasus terkait dengan Contempt of Court baik berupa tindakan  maupun perbuatan yang sesungguhnya mengganggu keselamatan, ketenangan psikis maupun fisik, serta apa pun yang pada prinsipnya merupakan bentuk penghinaan terhadap pengadilan belum diberikan sanksi yang tegas tetapi hanya sekedar dikeluarkan dari ruang persidangan. Contempt of Court dapat terjadi baik di dalam ruang persidangan maupun di luar persidangan baik pada perkara pidana, perdata, maupun hubungan industrial.  Semakin meluaskan berbagai tindakan yang dapat dikategorikan sebagai contempt of court maka  perlu untuk mengatur Contempt of Court dalam bentuk aturan tersendiri.This crisis of public confidence greatly affects the integrity and authority of the judiciary as the last defence for justice. Many things happened related to the harassment of the courts and law enforcement agencies but until now in Indonesia there has been no provision specifically about contempt for the court. This article is a part of research that its used normative judicial method which gave priority to primary data with secondary and primary data. Therefore, field research was conducted by interviewing judge in some  district court in Indonesia. The purpose of this research is to know the existence of regulation and law enforcement of Contempt of Court in Indonesia and to determine the model of Contempt of Court arrangement that is in accordance with the judiciary in Indonesia, and  the summary is the laws and regulations governing the Contempt of Court in particular have so far not existed, but are scattered in the Criminal Code (Criminal Code), therefore in many cases both actions and deeds which in principle interfere with safety, psychic and physical calm which in principle is a form of humiliation to the court has not been given strict sanctions but only just removed from the courtroom. Contempt of Court can take place both within the courtroom and outside the court so that by extending the various actions that can be categorized as contempt of court, it is deemed necessary to regulate the Contempt of Court in the form of a separate rule.

Abstract

Indonesia is the second highest country in ASEAN in the prevalence of underage marriage after Cambodia and ranks 7th highest in the world for the absolute number of child brides. The tangent point of child marriage with the Religious Court enters through the case of marriage dispensation. As the authority of the Religious Courts, marriage dispensation is very dilemmatic and debatable because simultaneously the case is biased in value, between benefit, harmness, and community behavior. In sociology, society always changes and the difference is only in the nature or level of change. One of the fundamental aspects of the reflection of the Religious Court decisions that put forward efforts to prevent child marriages is to narrow the space for filing child marriage cases, examine the case more carefully by adding to the burden of proof, and the commitment of the parties to respond to the negative consequences of child marriages.

Abstract

Public Service is the embodiment of the main tasks of a governance. But in its implementation sometimes it also causes disputes due to losses experienced by community members due to a bad public service. Therefore Law No. 25 of 2009 concerning Public Services regulates dispute resolution in the implementation of public services. At least there are two types of ways to resolve compensation in public service dispute that caused by Tort in the Public Service, namely the Non-Litigation settlement through the Ombudsman, and the Litigation settlement through the Court. However, in further studies it was found that there was an overlap of authority between the Ombudsman and the Court in resolving public service disputes. This paper will try to discuss this in depth in terms of the philosophy of the existence of the Ombudsman, and its implications for its Special Adjudication authority. Aside from that, this paper will also discusses about the procedure of proceedings in the Administrative Court regarding public service disputes.

Abstract

National development and improving standards of living will be increasingly difficult to achieve if the level of corruption is high. Therefore, it is necessary seriousness in its eradication, either through criminal law as well as through the civil law against the perpetrators of corruption and to the heirs. For that we need strict laws governing asset recovery corruption of the perpetrators and their heirs as part of participating jointly responsible for restoring the proceeds of corruption to the state. The main problem in this dissertation research is about the law of return on assets How does the conception of corruption by the offender and his heirs? The method used in this research is normative juridical method using qualitative data analysis with content analysis techniques. Based on the results, it can be concluded: First, the laws of corruption in recovering assets from corruption cases at this time is not perfect because only put money substitute against corruption proceeds of crime from the perpetrator. Meanwhile, the civil law norms materilnya against the heirs of the perpetrators of corruption has not been set. Second, the existence of Article 33 and Article 34 of Law No. 31 of 1999 just a gate that the heirs of the perpetrators of corruption can be sued if the perpetrator as the heir of the heir died while either not return the results to the state of corruption. It is necessary to formulate norms for about an unlawful act which can be used as a legal basis to sue the heirs of the offender. Third, the legal concepts in asset recovery corruption perpetrators and the survivors of the Indonesian legal system should be directed to the improvement of legislation to prosecute not only the perpetrators but also heirs of the perpetrators of corruption.Keyword: corruption, aset recovery, heir

Abstract

Indonesia is the fourth largest country in the capacity of the population number in the world. As the country with the largest population, various problems often plague the nation of Indonesia. One such problem is the problem of law enforcement and narcotics and drugs cases. Up to now Indonesia is confronted with drug trafficking that is very alarming. Drug crimes are so uncontrolled in social life. It is undeniable that narcotics have been threatening the future of the nation. There have been already many victims even until some of them dies. Drug abuse has reached very dangerous phase. There is no other way, government and officials must immediately take a serious and earnest step. It is a pity that the nation's children must always be the victims of drug distribution by the syndicate. Laws must be enforced as fairly as possible. Abstract

Pengadilan Pajak merupakan pengadilan pajak murni (administratief rechtspraak) yang memenuhi unsur-unsur sebagai lembaga peradilan, bukan pengadilan internal administrasi murni (administratif beroep) di bidang perpajakan. Pengadilan pajak merupakan pengadilan khusus dalam lingkungan peradilan tata usaha negara di Mahkamah Agung.7 Dengan demikian secara kelembagaan Pengadilan Pajak berkedudukan sebagai bagian dari Mahkamah Agung sebagai pelaku kekuasaan kehakiman sebagaimana dimaksud dalam Pasal 24 Ayat (2) UUD 1945.
