Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Abstract

Loan resolution through the execution of a security interest by title guarantee executorial implemented by involving the courts. The process of settlement is done by banks as creditors without filing a lawsuit first. Banking immediately submit the petition to the Chairman of the local District Court. In the petition Execution Mortgage, the petitioner (creditors) must attach the documents as a condition of submission of application execution. The execution of the object Mortgage guarantee in practice often fought on the basis of unclear legal status object ownership guarantees, or the amount of debt that is uncertain (fix). In some cases it was found that the resolution of bad loans through the execution of the object of the guarantee Encumbrance by title executorial obstacles and takes a long time. In Decision No. 383/Pdt.G/2008/PN.Jkt.Bar. found that it takes approximately four (4) years (October 1, 2007 to 10 November 2011) for the creditor to execute a guarantee Encumbrance. Abstract

Willful blindness, a legal doctrine in which individuals deliberately avoid knowledge to escape accountability, plays a significant role in the adjudication of crimes such as corporate fraud, financial misconduct, and sexual assault. However, current research has not fully examined its strategic misuse or provided a comprehensive analysis of its application across different legal contexts. This study bridges these gaps by introducing a Multi-Domain Analytical Framework to evaluate the concept's impact, strategic use, and broader implications in both criminal and civil cases. Empirical findings reveal that willful blindness is often employed to evade legal responsibility, undermining justice and compromising the fairness of legal outcomes. The study further demonstrates the inadequacy of existing legal standards and evidentiary requirements in addressing this issue. To counter these challenges, the research proposes targeted policy reforms designed to strengthen accountability, enhance evidentiary clarity, and improve the overall fairness and effectiveness of the legal system. In conclusion, willful blindness remains a critical and manipulative tool with profound implications for justice and accountability. This study highlights the necessity of reforming legal frameworks to mitigate the strategic exploitation of willful blindness. By setting the stage for further research and policy development, the findings contribute to the ongoing evolution of a more just and equitable legal system capable of addressing the complexities of modern legal challenges.

Abstract

Implementing jinayat law enforcement in Sabang of Aceh Province experiences a dualism of settlement, which causes legal uncertainty. This can be observed in practice where the Sabang District Court instead adjudicates cases that should be under the jurisdiction of the Sabang Sharia Court. This article elaborates on the dualism in the settlement that occurs and identifies the causes of the dualism in the settlement of criminal cases using Soerjono Soekanto's law enforcement factor theory. Based on that, efforts were found that could be made to overcome this dualism. The analysis results indicate that the dualism of settlement can be observed through 6 (six) cases that should be under the jurisdiction of the Sabang Sharia Court but were adjudicated by the Sabang District Court, the majority of which are minor-related cases. There are cases where the same defendant is tried in close succession in both judicial institutions for similar acts with different victims. It happens due to various factors, such as the legal factor: inadequate provisions regarding minors at Qanun Jinayat. Law enforcer factor: other views on minor-related cases and a lack of precision in implementing existing law. Facilitating factor: unavailability of detention rooms at Sabang Sharia Court and budget for executions. Society factors: public lack of legal knowledge. Based on the results of this identification, efforts can be made to include professional law enforcement, harmonization of judicial authority through internal agency regulations, and evaluation of moral offenses in the Qanun Jinayat.

Abstract

Family-owned companies have a significant role in enhancing national competitiveness. However, conflicts that lead to court disputes threaten the sustainability of family-owned companies. It has happened because some decisions still need to provide legal certainty. This research analyzes the legal aspect of family-owned companies in Indonesia, as reflected in several court decisions in Indonesia. The research method employs a qualitative case study approach. The research findings identify the existence of family-owned companies in court decisions; however, there are some difficulties, such as in determining the legal standing of disputing parties, potentially detrimental provisional decisions, and complexities in understanding corporate law, especially regarding General Meetings of Shareholders (GMS), dividends, and inter-organizational relationships as well as internal family disputes. The findings highlight the need for courts to consider the unique characteristics of family-owned companies, which could improve the consistency of court decisions, enhance legal certainty in the business sector, and promote sustainable economic activities.

Abstract

This research uses the normative juridical method, and it aims to determine the amicus curiae mechanism in the Indonesian legal system. The research results show that the implementation of amicus curiae in the judicial system in Indonesia still needs a common perspective among judges, where there are still judges who accept or reject this concept or do not even consider it at all. The concept of amicus curiae in the Indonesian legal system has yet to be a significant consideration because no explicit regulations accommodate it. Still, it is often stated that the position of amicus curiae is embodied through Article 5 of Act Number 48 of 2009 on Judicial Power, which mandates judges to explore, follow, and understand legal values and a sense of justice that lives in society. In line with these provisions, the judge has the authority to provide space and open up the broadest possible information and opinions from various groups who pay special attention to a case being examined.  Judges using amicus curiae in their considerations, both from a philosophical, sociological, and juridical perspective, aim to prioritize legal certainty and provide justice with the participation of society. The research then provides a suggestion that the Supreme Court of the Republic of Indonesia can issue a Policy Circular or through a Decree of the Chief Justice of the Supreme Court regarding guidelines that judges can use to implement amicus curiae and how to assess the quality of information in amicus curiae.

Abstract

In relation to fulfilling their daily needs, the position and existence of consumers in a dominant society are under businessmen. This has caused the potential loss of customers due to the actions of businessmen. It is not unusual for businessmen to exploit consumers for their interests and advantages without thinking and often neglecting the rights of consumers. This has given rise to disputes between consumers and businessmen that need to be resolved thoroughly and fairly, with legal certainty. The Act No. 8 of 1999 concerning consumer protection has regulated the resolution of consumer disputes which can be carried out outside the court through the Consumer Dispute Settlement Agency (BPSK). The existence of BPSK as a consumer dispute resolution institution does not seem to provide maximum protection to consumers because there are many problems, including the process and procedures for resolving disputes at BPSK. Based on the results of the research and analysis carried out, it is concluded that the resolution of consumer disputes through BPSK in terms of time is relatively faster because it has to be decided within a maximum of 21 working days compared to resolving consumer disputes through general courts which take years. But on the other hand, many problems exist related to the existence of BPSK as a consumer dispute resolution institution, including in the institutional sector, BPSK human resources, inconsistent laws, and so on.

Abstract

The position and function of Administrative Court so weak that the verdict is much neglected. Referring to the approach of the legal system, where the Administrative Court and Ombudsmen of Republic of Indonesia (ORI) equally aims to promote good governance and ensure the legal protection of the public from the actions of public administration law, the ORI is possible to be handed the duties and responsibilities as independent executor PERATUN decision. In the meantime, the Ombudsmen should be given the authority to promote, supervise and impose sanctions against the defendant who is not willing to implement the decision PERATUN or against other parties who obstruct the implementation of the decision PERATUN. Abstract

During the 32 years of the New Order government certainly has its advantages and disadvantages, in terms of the development of infrastructure and supra-structure growing rapidly, but the journey has decreased function of government and its role even stagnant. Therefore, there was the Reform of 1998 in a variety of fields. In reply funsgi decline and the role of government under the Constitution of 1945, there was an opinion with the formation of a new organization outside the government. Gagsan ideas are realized with the establishment of committees that do not require the State budget a little, sometimes a clash of authority between committees also with government agencies. Abstract

Selain masih tersebar dalam berbagai peraturan perundang-undangan, kebijakan kriminalisasi yang ada saat ini masih belum mampu menjawab permasalahan pokok, yakni dampak negatif dari pengonsumsian minuman beralkohol. Dalam hal ini, tujuan pembangunan nasional berdasarkan Pancasila belum terwujud dengan baik. Studi konseptual ini fokus terhadap 2 (dua) permasalahan pokok. Pertama, kebijakan kriminalisasi konsumsi minuman beralkohol di Indonesia. Di tingkat undang-undang, yakni KUHP, kebijakan kriminalisasi terhadap subjek hukum yang mengonsumsi minuman beralkohol diharuskan merugikan kepentingan hukum orang lain atau umum, yakni sebagaimana ditentukan dalam Pasal 300, Pasal 492 ayat (1), dan Pasal 536 KUHP. Di tingkat yang lain, yakni peraturan daerah, baik di tingkat provinsi maupun kabupaten/kota, beberapa telah secara tegas memuat kebijakan kriminalisasi konsumsi minuman beralkohol tanpa mempertimbangkan apakah perbuatan tersebut merugikan orang lain atau tidak. Kedua, kebijakan kriminalisasi konsumsi minuman beralkohol di Indonesia pada masa yang akan datang. Berdasar pada pertimbangan filosofis, yuridis, dan sosiologis, perlu diadakan pembaruan hukum terkait kebijakan kriminalisasi konsumsi minuman beralkohol di Indonesia. Adanya pembaruan kebijakan kriminalisasi mengonsumsi minuman beralkohol di Indonesia menunjukkan bahwa negara telah menjamin hidup sejahtera lahir batin, tempat tinggal, serta lingkungan hidup yang baik dan sehat. Semua itu merupakan kebutuhan manusia yang menjadi hak asasi yang harus dihormati dan dipenuhi oleh negara atau pemerintah dalam konteks melindungi kehidupan segenap bangsa Indonesia.Besides still scattered in several laws and regulations, the existing criminalization policy is still not able to answer the main issue, namely the negative impact of consuming alcoholic beverages. In this case, the national development objectives based on Pancasila have not been properly achieved. This conceptual study focuses on 2 (two) key issues. First, the scattered criminalization policies on consuming alcohol in Indonesia. At the law’s level, the Criminal Code, the criminalization policies of legal subjects consuming alcoholic beverages is required to impair the legal or other public interest, as provided in Article 300, Article 492 paragraph (1) and Article 536. At another level, namely the regional regulations, both at the provincial and district/city levels, some have explicitly contained the criminalization policy of consuming alcoholic beverages without considering whether the act is harming others or not. Second, the policy of criminalization to consume alcoholic beverages in Indonesia in the future. Based on philosophical, juridical, and sociological considerations, it is necessary to reform law related to criminalization policy of consuming alcoholic beverages in Indonesia. In the future, with the renewal of the criminalization policy of consuming alcoholic beverages in Indonesia, the state has guaranteed a well-born and inner life, a place to live, and a good and healthy environment which is a human need that becomes a human right that must be respected and fulfilled by the state or government in the context of protecting the lives of all people.
