Abstract

This study examines the position of paralegals in the provision of legal aid in Indonesia, especially in the context of changes regulated by Law Number 16 of 2011 concerning Legal Aid. Prior to this regulation, paralegals were not allowed to handle litigation or non-litigation cases. However, after the regulation is implemented, paralegals are permitted to provide non-litigation legal assistance. The purpose of this study is to analyze the legal position of paralegals in providing legal aid and the factors that influence them in carrying out this role. This research uses a normative juridical method with a descriptive approach based on laws and legal documents. The results of the study show that although the regulation has given authority to paralegals, there still needs to be resistance from various related parties. The main factors that affect this are the need for recognition of paralegals, the limitation of human resources, and the lack of budget and cooperation between legal stakeholders. This study concludes that further clarification is needed regarding the role of paralegals in creating equitable legal justice.

Abstract

This study aims to analyze the effect of the use of ADLX (Adaptive Learning Experience) on the mathematics learning outcomes of grade XI high school students by considering learning motivation. Using a quasi-experimental method with a non-equivalent control group design, this study involved several 11th grade high school students in X City who were divided into two groups: an experimental group using ADLX and a control group using conventional methods. The research instruments include mathematics learning outcome tests and learning motivation questionnaires validated by experts. The data were analyzed using the variance analysis technique (ANOVA) to test the hypothesis. The results showed significant differences in mathematics learning outcomes between the experimental and control groups, with the experimental group using ADLX showing better results. The data analysis also revealed that learning motivation interacted significantly with ADLX use, suggesting students with high learning motivation benefited more from ADLX use than students with low learning motivation. In general, students report that their learning motivation is influenced by the material's relevance to their daily lives and interactive and engaging teaching approaches. The use of ADLX, which involves hands-on experience and real-life examples, is considered effective in increasing understanding and motivation for learning math. This shows that the contextual learning approach is to improve students' understanding of mathematics. The conclusion of this study is that the use of ADLX can improve the mathematics learning outcomes of high school students in grade XI, especially for students with high learning motivation. These findings emphasize the importance of integrating adaptive technology in learning and the need for strategies to increase student learning motivation to achieve optimal learning outcomes.

Abstract

The success of the company in achieving its success is determined by human resources who are involved in the process of the company's activities. The high or low performance provided by employees can be influenced by the job satisfaction experienced by employees and the compensation provided by the company to employees. This study aims to analyze the effect of compensation and job satisfaction on employee performance at Optimate Holistic Kebo Iwa Branch. The study was conducted on Optimate Holistic employees of Kebo Iwa Branch, with a sample size of 46 individuals, using the probability sampling method. The data analysis approach used is Multiple Linear Regression Analysis. The findings of this study indicate that all hypotheses are acceptable. The compensation factor has a positive and significant impact on employee performance, while job satisfaction also has a positive and significant influence on employee performance. Together, compensation and job satisfaction have a positive and significant impact on employee performance. Good compensation can trigger a good relationship where employees feel safe and comfortable at work. The fulfillment of employee rights supported by employee job satisfaction can have a positive impact on improving employee performance. This research is able to make a practical contribution as a consideration for the leaders of Optimate Holistic Kebo Iwa Branch in improving the performance of its employees.

Abstract

The success of a business does not escape the attention of customer satisfaction factors. Customer dissatisfaction with a product will usually lead to complaints. One of the companies that received these complaints was Mie Gacoan in Denpasar City. Based on a total of 100 assessments of Mie Gacoan in Denpasar City, it can be seen that the majority of consumers gave one star. The meaning of giving one star is that consumers feel that the environment provided is very bad, two stars are not good, three stars are quite good, four stars are good, and five stars are very good. There are factors that need to be considered in overcoming customer dissatisfaction, one of which is servicescape. This research aims to explain the influence of servicescape on customer satisfaction which is mediated by brand image. The number of samples taken was 130 respondents, with a non-probability sampling technique and the method used was purposive sampling. The data collection method is a survey by distributing questionnaires. The analysis technique used is path analysis using the SPSS program. The research results show that servicescape has a positive and significant effect on customer satisfaction. These results show that a good and quality servicescape can increase the satisfaction felt by customers. Brand image also has a positive and significant effect on customer satisfaction, which means that the stronger the brand image, the higher the customer satisfaction. Brand image is also able to partially mediate the effect of servicescape on customer satisfaction.

Abstract

The summons and notification process in civil cases is a very important initial stage in resolving disputes in court. An illegal summons or inappropriate notification can result in the decision being annulled or even delaying the judicial process, which is certainly detrimental to the parties to the dispute. In Indonesia, especially at the Denpasar District Court, one of the methods used for summons and notification is by registered letter. This method was chosen because it is considered more formal and has reliable proof of delivery. However, the effectiveness of using registered letters as a means of summons and notification in civil cases needs to be evaluated. This is important to ensure that this method can actually achieve its objective, namely providing valid and timely notification to the parties to the dispute. The effectiveness of this method will have a direct impact on the smooth running of the judicial process and legal certainty for the parties involved. This research was conducted both empirically and normatively research to find the effectiveness of using registered letters as a way to summon litigants in civil cases at the Denpasar District Court. The facts obtained on the ground are that many court summons are not properly delivered to the litigants, and then court summons that failed to be sent will be returned to the Denpasar District Court without a stamp from the Village Chief as required by the provisions. In this case, evaluation is needed from both parties, the Denpasar District Court and PT Pos Indonesia, so that the summons and notification via registered letter can be carried out effectively and by applicable regulations.

Abstract

Highlighting significant issues within the Indonesian legal system, particularly concerning the profession of advocates. After the enactment of Law Number 18 of 2003 concerning Advocates (the Advocate Law), the Indonesian Advocates Association (PERADI) was initially mandated as the sole organization authorized to appoint and swear in advocates. This was intended to create legal certainty and establish uniform standards for the legal profession. This situation has been complicated by varying court rulings, with some decisions recognizing the authority of organizations other than PERADI to appoint and swear in advocates, while others adhere to the Advocate Law, which exclusively grants this authority to PERADI. The diversity of court rulings reveals sharp differences in legal interpretation, leading to doubts about legal validity. This research aims to examine and analyze the legal certainty regarding which advocate organizations are authorized to carry out the appointment and swearing-in of advocates. The research employs a normative juridical approach. The findings suggest that any actions taken by advocate organizations other than PERADI, which appear to utilize one of the eight powers granted to PERADI by the Advocate Law, including proposing the Advocate Oath to the High Court, constitute unlawful acts that harm PERADI as the sole entity entitled to such authority. These actions can be subject to legal accountability in both criminal and civil domains. This research is expected to provide comprehensive recommendations for improving the advocate legal system in Indonesia.

Abstract

The culinary industry is currently growing rapidly in Indonesia, especially in restaurants that are easily found with a variety of dishes. One of them is Bendega Restaurant, which emerged along with the growth of the culinary business in the city of Denpasar. The existence of Bendega Restaurant stalls continues to survive amid the onslaught of the emergence of many restaurants. This study aims to determine whether work motivation can affect organizational commitment at Bendega Restaurant. The sample in this study was 54 respondents obtained based on the total employees of Bendega restaurant as many as 54 employees. Data was collected through interviews and surveys. The collected data were analyzed by classical assumption test, multiple linear regression analysis, coefficient of determination, simultaneous test, and partial test. The results of this study indicate that transformational leadership has a positive and significant effect on organizational commitment in Bendega Restaurant employees, job satisfaction has a positive and significant effect on organizational commitment in Bendega Restaurant employees, and work motivation has a positive and insignificant effect on organizational commitment in Bendega Restaurant employees. The implications of this research are divided into two, namely theoretical and practical. The theoretical implications of this study support the theory of organizational commitment. Practical implications support that transformational leadership can increase employee organizational commitment.

Abstract

The era of globalization and advances in information technology have changed people's consumptive behavior in entertainment and music. Music is an important component in everyday life as a medium of self-expression. Research (Qadri, 2008),  (Asriyani, 2019) , and Raharjo (2018) highlights the importance of music concerts in maintaining cultural heritage and enculturation, as well as strengthening audience bonds with modern and popular attitudes while maintaining authenticity. The objective of this research is to identify and analyze how the phenomenon of Fear of Missing Out (FoMO) related to the Coldplay concert in Jakarta is presented and disseminated through the TikTok platform. Additionally, this study aims to explore the role of TikTok as a social media platform in triggering and amplifying feelings of FoMO among users in this context. Furthermore, the research seeks to assess the impact of TikTok content about the Coldplay concert on user behavior, identify the demographic groups most vulnerable to FoMO through TikTok usage, and determine the influencing factors. This theory, developed by Katz and Gurevitch, was used from a concert-goer perspective, specifically the phenomenon of TikTok fear of missing out on the Coldplay concert in Jakarta. This research recorded details and collected data from five informants aged 20-29 who are fans of music concerts and Coldplay, using purposive sampling method. The interviews revealed that FoMO (Fear of Missing Out) plays an important role in individuals' motivation to follow music trends and entertainment events. FoMO negatively impacts mental and emotional health, as well as finances, and leading to consumptive behavior.

Abstract

The purpose of this study is to conduct an in-depth examination of the implementation of the problem-based learning (PBL) process through SAR (Search and Rescue education and training) experienced by Basarnas Yogyakarta members. The PBL model, which is relevant to the needs of SAR personnel, helps them face emergency situations and prepares them through realistic and learner-centered education. This research used a qualitative method with a narrative approach. The subjects of this study are 10 SAR personnel. Data were collected using observation techniques, in-depth interviews, documentation, and triangulation. The data analysis technique follows the qualitative descriptive analysis model of Matthew B. Miles, A. Michael Huberman, & Johnny Saldana, which includes data condensation, data presentation, and conclusion drawing. The findings indicate that the learning process using the PBL model through SAR training is oriented toward student-centered learning. The extensive opportunities provided by the PBL model offer direct experience that aligns with the goals of SAR training, fostering the development of problem-solving skills, teamwork, motivation, and independent learning among SAR personnel. The results of this study are expected to make a significant contribution to SAR education literature, offer practical recommendations for developing more effective and responsive SAR training curricula, and provide practical guidelines for other training institutions. The results of this research can be a basis for developing SAR training policies and curricula that are more problem-solving oriented. Basarnas may consider adopting PBL as the main approach in SAR education and training across their units.

Abstract

The Indonesian government signed a declaration on the Elimination of Violence Against Women (1993) in 2014. However, at a technical level, violence against women still often occurs due to Domestic Violence (KDRT) in Indonesia. The purpose of this writing is to understand the implementation of laws and the protection of women's human rights against domestic violence from the perspective of international law. The research results show that the entry of the public law system into the domestic realm, namely domestic life, is one of the new developments in the field of human rights, especially in Indonesia. Domestic Violence (KDRT) has become a common agenda in the last few decades. The facts show that domestic violence has quite a negative effect on women as victims. The research that has been carried out is normative legal research which is focused on norms and also legal objects as the main data, and a book consisting of rules, and the truth of the research that has been carried out. All forms of violence have violated human rights as regulated in Law No. 23 of 2004 concerning the elimination of domestic.
