Abstract

Sukuk ijarah is one of the Islamic financial instruments based on lease contracts (ijarah) on the benefits of assets. This instrument serves as a significant alternative source of financing in supporting infrastructure development and national economic growth, particularly in Indonesia, which has the largest Muslim population in the world. This study aims to examine the opportunities offered by sukuk ijarah as a sharia compliant financing instrument, identify the challenges in its implementation in Indonesia, and analyze how sharia compliance principles are applied in the issuance of sukuk ijarah. This research employs a qualitative approach using the library research method. The analysis is conducted descriptively and analytically by examining academic and regulatory substance related to these issues. The findings indicate that sukuk ijarah has promising prospects as a sharia investment instrument due to its fixed returns, asset-backed structure, and relatively stable design. To optimize its role, regulatory strengthening, enhanced inter-institutional synergy, and consistent public education are required to ensure the sustainability and integrity of the national Islamic financial market. Sukuk ijarah merupakan salah satu instrumen keuangan syariah yang berbasis akad sewa atas manfaat aset. Instrumen ini menjadi alternatif pembiayaan yang signifikan dalam mendukung pembangunan infrastruktur dan perekonomian nasional, khususnya di Indonesia sebagai negara dengan populasi Muslim terbesar di dunia. Penelitian ini bertujuan untuk mengkaji peluang yang ditawarkan oleh sukuk ijarah sebagai instrumen pembiayaan syariah, mengidentifikasi tantangan dalam penerapannya di Indonesia, serta menganalisis bagaimana prinsip kepatuhan syariah diterapkan dalam penerbitan sukuk ijarah. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi pustaka. Analisis dilakukan secara deskriptif-analitis dengan menelaah substansi akademik dan regulatif terkait isu-isu tersebut. Hasil penelitian menunjukkan bahwa sukuk ijarah memiliki prospek menjanjikan sebagai instrumen investasi syariah karena menawarkan imbal hasil tetap, berbasis aset nyata, dan memiliki struktur yang relatif stabil. Untuk mengoptimalkan perannya, diperlukan penguatan regulasi, peningkatan sinergi antar lembaga, serta edukasi publik yang konsisten untuk menjamin keberlanjutan dan integritas pasar keuangan syariah nasional.

Abstract

This study aims to empirically analyze the effect of taxation policy as stipulated in the State Sharia Securities Law (SBSNLaw) on the interest in corporate sharia sukuk issuance in Indonesia. With a quantitative approach and multiple linear regression method, this study uses secondary data from official publications of financial authorities and capital markets. The results of the analysis show that taxation policy has a significant influence on interest in sukuk issuance, with a coefficient of determination (R²) of 0.82, which means that 82% of the variation in interest in issuance can be explained by taxation variables. This finding indicates that tax incentives, final income tax exemptions, and fiscal treatment of sharia contracts are key factors in encouraging corporate decisions to issue sukuk. In addition, there is a seasonal pattern of sukuk issuance that stands out in the second and fourth quarters. This research provides practical implications for policymakers to strengthen the effectiveness of the SBSN Law through improving incentive schemes and paying attention to market momentum in encouraging the growth of Islamic sukuk as a sustainable financing instrument.

Abstract

This article presents a comprehensive legal analysis of the debt collection methods used by Shopee PayLater, one of the dominant Buy Now, Pay Later (BNPL) services in Indonesia. The study identifies a significant gap between the robust normative framework—including regulations from the Financial Services Authority (OJK), the Consumer Protection Act, and the Personal Data Protection Act—and the reality of debt collection practices reported by consumers. Using a legal-normative approach supported by secondary empirical data analysis, this article demonstrates how aggressive and unethical debt collection practices persist despite clear legal prohibitions. Key findings indicate that the issue is not caused by the absence of regulations, but rather by implementation deficits, reactive oversight, and the exploitation of legal loopholes and consumers' psycho-social vulnerabilities. The article concludes with policy recommendations focused on transitioning toward technology-based oversight (SupTech/ RegTech), strengthening industry internal compliance, and enhancing digital financial literacy as holistic solutions.  Artikel ini menyajikan analisis yuridis komprehensif tentang metode penagihan utang yang diterapkan Shopee PayLater, merupakan salah satu layanan Buy Now, Pay Later (BNPL) dominan di Indonesia. Penelitian ini mengidentifikasi adanya kesenjangan signifikan antara kerangka normatif yang kuat—mencakup regulasi Otoritas Jasa Keuangan (OJK), Undang-Undang Perlindungan Konsumen dan aturan Undang-Undang Pelindungan Data Pribadi—dengan realitas praktik penagihan yang dilaporkan oleh pihak konsumen. Dengan menggunakan pendekatan yuridis-normatif yang didukung oleh analisis data empiris sekunder, artikel ini menunjukkan bagaimana praktik penagihan yang agresif dan tidak etis terus berlanjut meskipun terdapat larangan hukum yang jelas dan tegas. Temuan utama mengindikasikan bahwa masalah ini bukan disebabkan oleh ketiadaan regulasi, melainkan mengenai defisit implementasi, pengawasan yang reaktif, dan eksploitasi celah hukum serta kerentanan psiko-sosial konsumen. Untuk itu dalam artikel ini diakhiri dengan rekomendasi kebijakan yang berfokus kepada transisi menuju pengawasan berbasis teknologi (SupTech/ RegTech), penguatan kepatuhan internal industri, kemudian peningkatan literasi keuangan digital sebagai solusi holistik.

Abstract

Al-Shatibi's thoughts in Al-Muwafaqat discuss the maqashid syari'ah (objectives of Sharia law) which are integrated with the values and wisdom underlying these objectives. This study aims to analyze the concept of axiology in Abu Ishaq Al-Shatibi's thought as presented in Al-Muwafaqat, with a focus on the application of the ijarah contract in the practice of buying and selling luggage among Egyptian students. Al-Shatibi is known as a figure who emphasizes the maqasid of Sharia as the primary approach to understanding Islamic law. In this context, the ijarah contract carried out by Egyptian students demonstrates the flexibility of fiqh in meeting daily economic needs. This study uses a qualitative approach with a method of analyzing Al-Shatibi's thoughts on the phenomenon of the practice of buying and selling luggage by Egyptian students. The results of the study show that the practice of ijarah contracts in the sale and purchase of luggage reflects the essence of maqashid sharia, namely benefit and justice for both parties to the transaction. Pemikiran Al-shatibi dalam Al-Muwafaqat membahas tentang maqashid syari’ah yang berpadu dengan nilai-nilai dan hikmah yang mendasari dalam maqashid tersebut. Penelitian ini bertujuan untuk menganalisis konsep aksiologi dalam pemikiran Abu Ishaq Al-Shatibi yang terdapat dalam Al-Muwafaqat dengan fokus pada penerapan akad ijarah dalam praktik jual beli bagasi mahasiswa Mesir. Al-Shatibi dikenal sebagai tokoh yang menekankan maqashid syariah sebagai pendekatan utama dalam memahami hukum Islam. Dalam konteks ini, akad ijarah yang dilakukan mahasiswa Mesir menunjukkan fleksibilitas fiqh dalam memenuhi kebutuhan ekonomi sehari-hari. Penelitian ini menggunakan pendekatan kualitatif dengan metode analisis pemikiran Al-Shatibi terhadap fenomena praktik jual beli bagasi mahasiswa Mesir. Hasil penelitian menunjukkan bahwa praktik akad ijarah dalam jual beli bagasi mencerminkan esensi maqashid syariah, yaitu kemaslahatan dan keadilan bagi kedua pihak yang bertransaksi

Abstract

Halal certification bodies play a crucial role in building consumer confidence in halal products in Indonesia. This study, conducted in several locations, examined the views of Muslim consumers, producers, and certification bodies, particularly the Indonesian Ulema Council (MUI) and the Halal Product Guarantee Agency (BPJPH) in three different cities: Jakarta, Surabaya, and Makassar. Data collection was conducted through in-depth interviews, group discussions, and observations. The findings show that the reputation of the institution, clarity regarding halal standards, and transparency in certification information play an important role in strengthening consumer confidence. The various views of consumers in each city are influenced by the socio-cultural context and varying access to information. This research provides a meaningful contribution to the development of halal certification agency policies and practices, with the aim of improving certification effectiveness and supporting the sustainable growth of the national halal industry. Lembaga yang memberikan sertifikasi halal memiliki peran krusial dalam membangun kepercayaan konsumen terhadap produk halal di tanah air. Penelitian yang dilakukan di beberapa lokasi ini menyelidiki pandangan konsumen Muslim, produsen, serta lembaga sertifikasi, terutama Majelis Ulama Indonesia (MUI) dan Badan Penyelenggara Jaminan Produk Halal (BPJPH) di tiga kota yang berbeda: Jakarta, Surabaya, dan Makassar. Pengumpulan data dilakukan melalui wawancara mendalam, diskusi kelompok, dan observasi. Temuan penelitian menunjukkan bahwa reputasi lembaga, kejelasan mengenai standar halal, dan transparansi dalam informasi sertifikasi mempunyai peranan penting dalam memperkuat kepercayaan konsumen. Berbagai pandangan konsumen di setiap kota dipengaruhi oleh konteks sosial budaya serta akses informasi yang bervariasi. Penelitian ini memberikan sumbangsih yang berarti bagi pengembangan kebijakan dan praktik lembaga sertifikasi halal, dengan tujuan untuk meningkatkan efektivitas sertifikasi dan mendukung pertumbuhan industri halal nasional secara berkelanjutan.

Abstract

This research is to determine the effect of content marketing and halal certification on the decision to purchase Dubai chocolate. Quantitative research. The research uses a population of people who have purchased Dubai chocolate at least once. The sample used in the research is non-probability sampling and uses purposive sampling techniques. The primary data source was collected through an online questionnaire/Google form. Data analysis methods included validity testing, reliability testing, multicollinearity testing, coefficient of determination (R2), hypothesis testing, and path coefficient analysis. The results of the study show that content marketing and halal certification can explain 55.3% of purchasing decisions, while the remaining 44.7% is explained by other variables that were not studied. Based on the results of the study, it was found that (1) content marketing has a positive and significant effect on purchasing decisions and (2) halal certification has a positive and significant effect on purchasing decisions. Penelitian ini dilakukan untuk mengetahui pengaruh content marketing dan sertifikasi halal terhadap keputusan pembelian coklat dubai. Jenis penelitian kuantitatif. Penelitian menggunakan populasi dengan masyarakat yang pernah membeli coklat dubai minimal 1 kali pembelian. Sampel yang di pakai pada penelitian dengan metode non probability sampling dan menggunakan teknik purposive sampling. Sumber data primer dengan pengumpulan data dalam penelitian melalui kuesioner online / google form. Metode analisis data mencakup uji validitas, uji reliabilitas,uji multikolinieritas, koefisien determinan (R2), uji hipotesis dan analisis jalur (path coefecient). Hasil penelitian content marketing dan sertifikasi halal bisa menjelaskan keputusan pembelian sebesar 55,3%, sementara sisanya 44,7% dijelaskan oleh variabel lain yang tidak diteliti. Berdasarkan hasil penelitian diperoleh (1) content marketing bengaruh positif dan signifikan terhadap keputusan pembelian dan (2) sertifikasi halal bengaruh positif dan signifikan terhadap keputusan pembelian.
