Abstract

Beschikking sebagai instrumen pemerintahan yang bersifat individual konkrit dan final pada pengejawantahannya seringkali menimbulkan problem hingga berujung pada konflik yang harus diselesaikan di Peradilan Tata Usaha Negara (PTUN).  Problem perbedaan pemaknaan mengenai Keputusan Tata Usaha Negara (KTUN) baik KTUN yang bersifat konstitutif maupun deklaratif telah terjadi dalam suatu kasus nyata yang kita kenal dengan kisruh internal partai politik Golongan Karya (Golkar) pada tahun 2015, saling tuding klaim kepengurusan yang sah hingga berujung penyelesaian konflik di Pengadilan Tata Usaha Negara Jakarta, klaim keabsahan Keputusan Tata Usaha Negara ini sudah semestinya menyangkut Menteri Hukum dan HAM (Menkumham) sebagai pejabat yang berwenang mengeluarkan Surat Keputusan tersebut.Penelitian yang berjudul “Pemaknaan Surat Keputusan yang Bersifat Deklaratif dan Konstitusif (Implikasi Surat Keputusan Menteri Hukum dan HAM tentang Pengesahan Anggaran Dasar Rumah Tangga serta Komposisi dan Personalia Dewan Pimpinan Pusat dan Golongan Karya)” ini bertujuan untuk merumuskan, menganalisis dan menjelaskan mengenai pemaknaan terhadap Keputusan Tata Usaha Negara yang berakibat hukum. Tujuan selanjutnya adalah merumuskan, menganalisis dan menjelaskan mengenai implikasi hukum kepengurusan Partai Golongan Karya pasca Putusan Mahkamah Agung Nomor 490/K/TUN/2015. Tipe penelitian yang digunakan adalah penelitian yuridis normatif. Penelitian ini dilakukan di kota Jakarta dan Semarang (Jawa Tengah) dengan melakukan studi pustaka dan kasus-kasus yang berhubungan dengan pemaknaan surat keputusan yang bersifat konstitutif dan deklaratif. Lokasi kongkrit yang dianggap relevan dengan substansi penelitian adalah di Mahkamah Agung, Peradilan Tata Usaha Negara Jakarta, DPP Partai Golkar DKI Jakarta, DPD Partai Golkar Jawa Tengah dengan melakukan wawancara dan interview mengenai masalah yang dikaji secara mendalam.Menkumham sebagai pihak pemerintah yang semestinya mempertanggungjawabkan tindakan hukumnya ketika mengeluarkan suatu surat keputusan untuk salah satu pihak, semestinya memperhatikan fakta yang terjadi pada permasalahan internal partai tersebut, kekurang hati-hatian tindakan hukum Menkumham pun akan berakibat hukum. Kekurangcermatan nampak ketika Menkumham kurang hati-hati menetapkan kepengurusan yang sah tanpa memperhatikan forum keputusan tertinngi dari parpol Golkar yakni Munaslub (Bali), Kewenangan yang melekat pada jabatan Menkumham ketika megeluarkan surat keputusan yang bersifat deklaratif menimbulkan spekulasi pertanyaan mengenai kelayakan Surat Keputusan tersebut sebagai objek sengketa TUN untuk dapat diuji di PTUN, ditambah makin pelik dengan ketidakpastian hukum dari Menkumham yang enggan menetapkan pihak yang dianggap sebagai pengurus partai Golkar yang sah pasca putusan Mahkamah Agung (MA).

AbstrakLembaga pengawasan pengelolaan keuangan negara yang dilakukan oleh seperti BPKP, DPR/DPRD, BPK dan KPK bertujuan agar implementasi asas-asas pengelolaan keuangan negara berjalan dengan seharusnya dan sesuai tujuan pengelolaan keuangan negara yaitu untuk menjamin negara dalam rangka menciptakan kesejahteraan, menjamin pemenuhan hak-hak masyarakat dan membiayai pelayanan kepada masyarakat.Kata Kunci: Pengawasan, pengelolaan keuangan, menciptakan kesejahteraan

Abstract

Penelitian dengan judul Investigasi Pelaksanaan Diversi di Kepolisian Resor Magelang dilaksanakan untuk memperoleh informasi tentang bagaimana pelaksanaan musyawarah Diversi yang dilakukan oleh Penyidik Anak selaku Fasilitator Diversi. Berpedoman pada Pasal 26 Undang-undang No.11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak, Fasilitator Diversi sering tidak mampu menemukan titik temu antara keinginan pelaku/keluarganya dengan korban/keluarganya, dengan kata lain gagal Diversi.Untuk itu peneliti melakukan socio legal reseach dengan cara melakukan penelusuran informasi (depth interview) dari informan (Penyidik Anak selaku Fasilitator Diversi) sehingga diperoleh penjelasan yang akurat mengenai teknis pelaksanaan Diversi. Data yang diperoleh dari informan itulah yang kemudian dianalisis dengan menggunakan metode deduktif dan disajikan dalam bentuk deskriptif. Guna meningkatkan keberhasilan Diversi di tingkat Kepolisian peneliti menciptakan model pelaksanaan Diversi dengan cara mengkombinasikan teknis pelaksaan Diversi yang diatur dalam Pasal 26 Undang-undang No.11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak dengan nilai-nilai dalam Pedoman Hidup Islami Warga Muhammadiyah (butir kehidupan pribadi dan kehidupan dalam mengembangkan profesi).

Abstract

The research under the title "The Development of Cultural Tourism Under the Provisions of Regulation No. 10 Year 2009 In Sleman " will discuss the efforts of the local government of Sleman in tourism development based on culture and the extent of community involvement in the development of culture-based tourism in Sleman. The research method used in discussing the results of this research is qualitative descriptive method.There are various efforts made by the local government of Sleman in developing culture-based tourism, those efforts include the increasing of promotional activities through various ways such as through local-printed media / newspapers, through electronic media, the distribution of brochures / leaflet, banners in strategic places. As much as possible try to facilitate a group of people who want cultural activities that they have been reappointed as a local cultural activities that can be used as a tourist attraction. Immediately draft of the Master Plan for Tourism Development (Rencana Induk Pengembangan Kepariwisataan (RIPP)) can be endorsed so that the local government of Sleman District will have a clear direction on development plans for tourism in the area until 2025, which will come. Soon, the draft Regulation (draft) (Rancangan Peraturan Daerah (RAPERDA)) regarding the conduct of tourism, fiscal year 2017, planned to be proposed in the incensement of the promotion budget as an effort to increase the number of tourist visits to Sleman.The community is involved in planning activities of Sleman tourism calendar. The community is involved also in the promotion of tourism and sustainable development conducted against groups in society that has the cultural potential of which is used as a tourist attraction.

Abstract

The purpose of this study is to investigate the implementation of the Indonesian Government Regulation No. 54 Year 2007 in Bantul, and also to find out the problems that occur in the practice of adoption in Bantul.This research was conducted by library research and field research. In the literature research to use the means of documents study for secondary data, while the field research was conducted to obtain primary data with qualitative approach with interviews. Data obtained from the literature research and field research analyzed qualitatively. The data is further described by the descriptive method of analysis, that in discussing the problems done by identifying, analyzing and interpreting the data that has been acquired to be concluded.Based on the survey results revealed that the Indonesian Government Regulation No. 54 Year 2007 on the Implementation of Child Adoption basically been implemented in practice the implementation of child adoption either through Decision of District Court and Religious Courts In Bantul District, in fact not all applications for adoption for Muslim proposed through the Religious Courts, but some also proposed through the District Court. The Determination of Adoption in the Religious Court, firstly, based on the Indonesian Government Regulation No. 54 Year 2007 on the Implementation of Child Adoption, secondly, is also based on Presidential Decree No. 1 Year 1991 About the Compilation of Islamic Law.Problems that occur in the practice of adoption in Bantul district which are the practice of adoption which is done by custom only and not applied for court determination that can cause problems, especially a civil matter after his adoptive parents died. Another example is the practice of deviating adoption from the existing provisions; especially adoptions are taken directly from the biological parents of the child since birth, then the birth of the child is registered in the name of his adoptive parents to obtain a birth certificate of the child. Abstract

Indonesia has a strategic position in international life, both from the geographical aspect and the potential of natural resources and human resources, resulting in increased traffic flow of people into and out of Indonesia. Foreigners who come to Indonesia and have an immigration permit, can only stay in Indonesia for the time specified in the immigration permit. If a foreigner comes to Indonesia, his immigration permit expires and is still within the territory of Indonesia beyond no more than 60 (sixty) days from the immigration permit granted, is subject to a load, while Foreigners who come to Indonesia, the immigration permit expires and is still within the territory of Indonesia beyond 60 (sixty) days from the deadline then the foreigner will be subject to criminal Article 124 of the Immigration Act Number 6 of 2011, with a maximum imprisonment of 2 (two) years or a maximum fine of Rp. 25,000,000- (twenty five million rupiah). The existence of a foreigner in the territory of Indonesia that exceeds the time limit for a residence permit, which is also known in the immigration field as overstay.Services and supervision in the immigration sector are carried out based on the principle of selective policy. Based on this principle, only foreigners can benefit the welfare of the people, nation and State of the Republic of Indonesia and do not endanger security and order and are not hostile towards the people, nation and the Unitary State of the Republic of Indonesia based on Pancasila and the 1945 Constitution which is permitted in and out of Indonesia.Sanctions imposed on foreign nationals who commit immigration violations are Immigration sanctions and law enforcement through Administrative sanctions and Criminal sanctions with the Criminal Justice System. Abstract

The rapid development of the business world in the era of globalization resulted in increased disputes between business people. Efforts to resolve the dispute can be done through two ways, namely litigation and non-litigation. The Sharia banking law also stipulates that the settlement of disputes between banks and customers can be resolved in litigation and non litigation. Non litigation can use the Sharia Arbitration model which in Indonesia is run by BASYARNAS. This paper will discuss how is the position and authority of Sharia Arbitration as a settlement institution for Islamic banking disputes and how are the obstacles in the implementation of sharia arbitration in Indonesia. This study uses normative legal research methods, with the aim to solve legal issues and provide a description of what is supposed to be prescription. The results of the discussion show that Sharia Arbitration in resolving Islamic banking disputes is institutionally carried out by BASYARNAS by using sharia principles that are constitutionally based on Article 29 of the 1945 Constitution of the Republic of Indonesia and the principle of freedom of contracting Article 1338 of the Civil Code can be implemented and not contrary to positive law in Indonesia. Constraints in the implementation of sharia arbitration, especially in terms of the execution / execution of the decision because it must be appealed to the Chairperson of the local District Court with the possibility of being rejected if considered by the judge to violate the provisions of UUAAPS.
