Al Hurriyah: Jurnal Hukum Islam is a journal which publishes the research results related to the Islamic law from various disciplines or interdisciplinary such as Sharia Economy Law or Islamic Economy Law/Muamalah, Islamic Constitutional Law/Siyasah, Islamic Family law/Ahwal Al-Shakhsiyah, Islamic Criminal Law/Jinayah, Islamic Law Methodology or Methodology of Islamic Law/Maqashid Sharia, and Sociology of Islamic Law. The editorial team invites the researchers, scholars, and Islamic studies and social observers to submit the research result article which has never been published in the media or other journals. Abstract

Di dalam perspektif pemikiran politik Islam, ada tiga wacana tentang paradigma hubungan antara agama dan negara: Paradigma integralistik (simbolistik formalistik) yaitu bahwa agama dan negara menyatu (integral), paradigma simbiotik, yaitu agama dan negara berhubungan secara simbiotik, suatu hubungan yang bersifat timbal balik dan saling memerlukan, dan paradigma sekularistik yang mengajukan pemisahan antara agama dan negara. Salah satu tokoh yang menganut paradigma sekularistik adalah Farag Fouda, seorang pemikir Mesir pada tahun 1980-an yang akibat pandangan-pandangannya tentang pemisahan agama dan Negara difatwakan murtad dan halal darahnya ditumpahkan. Penelitian ini adalah penelitian normatif atau dikenal dengan doctrinal research, bersifat deskriptif, yaitu jenis penelitian yang hanya menjelaskan (mendeskripsikan) variabel satu dengan variabel lainya. Dari penelitian ini dapat disimpulkan bahwa Farag Fouda menganut prinsip pemisahan politik dari agama, antara negara dan Islam. Menurutnya, pemisahan ini perlu dilakukan demi kebaikan agama dan negara. Agama terhindar dari manipulasi politisi, dan pemerintahan terlaksana tanpa beban partikularisme keagamaan. Fouda juga menolak anjuran sistem khilafah yang digaungkan kaum Islamis, menurutnya sistem ini tidak lebih dari salah satu sistem dalam sejarah Islam yang banyak terdapat sisi-sisi kelamnya. Belajar dari kasus Utsman, untuk menjamin kebaikan rakyat, menertibkan sistem kekuasaan, mewujudkan keadilan, dan menjamin keamanan tidak hanya dibutuhkan pemimpin yang baik, umat Islam yang luhur, dan syariat Islam yang diterapkan penuh. Namun semuanya harus diatur dengan sebuah sistem yang mengatur hubungan antara penguasa dan rakyat.

Abstract

The demand for a democratic system of government in Indonesia is not only the demands of society but also constitutional demands. Therefore, regional autonomy is expected to be able to provide answers to both needs. Because the essence of local independence itself is a tangible form of the practice of democracy in society, in the way of giving autonomy to the region to advance its society democratically in various aspects of life, politics, social economy and culture, to answer the challenges in the era of globalization. Community involvement by empowering local community values is one surefire strategy in the process of democratization. Besides, bureaucratic reform is a necessity; therefore, a combination of allowing the benefits of local communities with the government bureaucracy system is an appropriate strategy for accelerating democratic development.

Abstract

One of the topics of debate between the old and the young at the beginning of the 20th century was the question of talaffuzh intention. The discourse on talaffuzh intention does not only involve the scholars who are in the country, but also involves the Minangkabau cleric who lives in Mecca al Mukarramah, namely Sheikh Ahmad Khatib al-Minangkabawi. The thoughts he put forward often lead to polemics with scholars in the archipelago. One of them is about talaffuzh intention. In this article the author examines how Ahmad Khatib thinks about talaffuzh intentions and how the legal istinbâth method he uses. The purpose of this study is to explain Ahmad Khatib's thoughts about talaffuzh intentions and the legal istinbâth method he uses. This type of research is library research. The collected data were analyzed using content analysis method. Based on the research conducted, it can be concluded: according to Ahmad Khatib, the law of reciting intentions is sunnah. The legal istinbâth method he uses in this problem is the qiyâs method.Salah satu topik perdebatan antara kaum tua dan kaum muda pada awal abad ke-20 adalah persoalan talaffuzh niat. Diskursus tentang talaffuzh niat tidak hanya melibatkan para ulama yamg berada di tanah air, tapi juga melibatkan ulama Minangkabau yang bermukim di Mekah al Mukarramah yaitu Syekh Ahmad Khatib al-Minangkabawi. Pemikiran yang dikemukakannya tidak jarang menimbulkan polemik dengan ulama di Nusantara. Salah satunya adalah mengenai talaffuzh niat. Dalam artikel ini penulis meneliti bagaimana pemikiran Ahmad Khatib tentang talaffuzh niat dan bagaimana metode istinbâth hukum yang digunakannya. Adapun tujuan penelitian ini adalah untuk menjelaskan pemikiran Ahmad Khatib tentang talaffuzh niat dan metode istinbâth hukum yang digunakannya. Jenis penelitian ini adalah penelitian kepustakaan. Data yang terkumpul dianalisa dengan menggunakan metode content analysis. Berdasarkan penelitian yang dilakukan dapat disimpulkan: menurut Ahmad Khatib, hukum melafalkan niat adalah sunnah. Metode istinbâth hukum yang digunakannya dalam masalah ini adalan metode qiyâs.

Abstract

Child is a surrogate of Allah, bud, potential, and the young generation, the successor of future goals of national struggle, has a strategic role, characteristics and special natures, so it must be protected from all forms of inhuman treatment. Among the forms of inhumane treatment is the sexual crimes, which resulted in violations of children's rights. In this case, for the perpetrators of sexual crimes on children, legal practitioners in Indonesia plan on giving emasculated punishment (as an additional punishment), in addition to the jail punishment. Observing the discourse (emasculated punishment), appears various respons, there are pros and cons. So that, before the law was enacted, the depth research would need to do, ensuring the pedofillia can be called a crime. What proposition is used. If no clear proposition found, what beneficiaries consideration is being used. If he devastating,what human element was ruined. If it is certain he is devastating and belived to be malicious it also necessary to know in which category of crime. After that, a suitable sanctions to the crime is set. To set it, a carefully, decompose and measurable data is a necessity

Abstract

House buying and selling is very vulnerable and problems often occur to cause disputes, This research was conducted in an empirical juridical way, the nature of descriptive analysis was by qualitative data analysis, The absence of consumer understanding of the buying and selling process in a contract carried out with the developer and there are still those who do not understand the contents of a contract and there are still developers with consumers making agreements under the hand that are not in accordance with the Laws and Regulations, Housing developers must be responsible for losses suffered by consumers, The legal effort that can be made by consumers is by taking a solution in a way outside the court of non-litigation and litigation through the general court, Consumer dispute resolution is first resolved by means of consensus agreement or peacefully if there is no further settlement, it can be done through a way of settlement outside the court (non litigation) or through a public court (litigation) either civil or criminal.

Abstract

This study discusses the philosophical dimensions of punishment in terms of Islamic criminal law. Islamic criminal law has a goal that everyone does not want to commit a crime. So that Islamic criminal law is both preventive (prevention) and curative (their crimes deter the perpetrators of crimes). The formulation of the problem in this study is why people who commit crimes must be punished according to Islamic criminal law? The method used is a type of normative legal research; normative legal research is research conducted to collect and analyze secondary data. This study concludes that the provisions of the punishment contained in the Qur'an and al-Sunnah are Shari'ah that must be carried out. With this punishment, it aims to make people aware of the wickedness of evil so that it is embedded in their souls that all misdeed must be avoided whether seen by others or not, because Allah is always watching him wherever he is. When this thought is embedded in everyone, it will repress the misdeed in daily life or reduce crime in society.Penelitian ini membahas tentang dimensi filosofis pemidanaan dilihat dari segi hukum pidana Islam. Hukum pidana Islam memiliki tujuan agar setiap orang tidak mau melakukan tindakan kejahatan. Sehingga hukum pidana Islam ini bersifat preventif (pencegahan) maupun bersifat kuratif (agar berpelaku kejahatan merasa jera dengan Tindakan kejahatannya). Rumusan masalah dalam penelitian ini adalah kenapa orang yang melakukan Tindakan kejahatan harus mendapatkan hukuman dilihat dari hukum pidana Islam? Metode yang digunakan adalah jenis penelitian hukum normatif. Penelitian hukum normatif adalah penelitian yang dilakukan untuk mengumpulkan dan menganalisis data sekunder. Kesimpulan dari penelitian ini adalah ketentuan hukuman yang terdapat dalam al-Qur’an dan al-Sunnah merupakan Syari’at yang harus dijalankan. Dengan hukuman itu bertujuan untuk menyadarkan masyarakat dari keburukan-keburukan kejahatan, sehingga tertanam di dalam jiwa bahwa semua kejahatan harus dihindari, baik dilihat oleh orang lain ataupun tidak, sebab Allah selalu mengawasinya di manapun dia berada. Apabila hal ini telah tertanam dalam diri semua orang, secara otomatis kejahatan tidak akan ada dipermukaan bumi, atau paling tidak bisa mengurangi kejahatan di tengah-tengah masyarakat.

Abstract

Ijtihad which has evolved since the era of Khulafa` al-Rasyidin has outlined positive values in determining the law at the time of the passage of al-Qur`an and Sunnah do not determine the law explicitly. In this condition rakyu is necessary to avoid a gap in legal when needed. The Prophet permission to use rakyu also identifies that the legal provisions explicitly limited while law events are always evolve following future developments. This is where ijtihad has a very important role in the development of Islamic law. The role of ijtihad here is looking for appropriate and relevant legal alternatives for the situation and the conditions in which ijtihad was done, especially when linked to the current condition that is far different from the situation at the time of the revelation (Wahyu) revealed. Nevertheless, the use of rakyu must be done by using the clear signs and do not follow the passions, such as the stance taken by the mujtahid from previous generations. The use of rakyu in performing law istibath undoubtedly has contributed significantly in the development of Islamic law.

Abstract

There are two major streams in Islam which up to now have a very significant influence in the Islamic community, namely the Shiite sect and the Ahlus Sunnah wa al-Jama'ah sect. Apart from differences in theological discourse, the differences between these two sects also touch the jurisdictions (fiqh). The most obvious differences in fiqh products, for example, appear in the permissibility of marriage if married (contract marriage). Some non-fundamental differences occur in other discourses, such as in prayer, azan, etc. This article intends to discuss legal theory that animates legal products in the Ja'fari school. The presence of Imam Ja'far in his capacity as a respected founder of the Ja'fari school, both Sunni and Shiite, will be discussed specifically in this paper. In addition, this article also discusses a number of fiqh Ja'fari products which may be fundamentally different from the Sunni fiqh products, including about khumus and mut'ah. The legal sources used in the Ja'fari school are not much different from the legal sources used in Sunni schools, which revolve around the Qur'an, Sunnah, Ijma', and Intellect. Although there is an understanding of the different definitions of the sources of the law, this does not indicate that Syi'ah and Sunni have different principles in determining the law.

Abstract

The formation of a sakinah mawaddah and rahmah family is a family that is desired by every married person. The purpose of a marriage and the application of the rights and obligations of husband and wife, because in this day and age we see many marriages that do not last long. This encourages the author to write an article that will discuss how to build a sakinah-mawaddah-warahmah family in accordance with the Marriage Law and Islamic Law Compilation (KHI). The writing method used a literature studies that take from existing books and writings. In this paper, there are efforts to establish a household, namely those contained in articles 30-34 of the Marrige Law and article 77 KHI and also solutions to the formation of the samawa household. The solution is to maintain communication relationships, biological needs, appearances and regulate the family economy. Pembentukan keluarga yang sakinah mawaddah dan rahmah merupakan sebuah keluarga yang diinginkan oleh setiap orang yang sudah menikah. Tujuan dari sebuah perkawinan dan penerapan hak dan kewajiban suami istri, karena di zaman sekarang banyak kita lihat pernikahan-pernikahan yang tidak berlangsung lama. Hal tersebut mendorong penulis untuk menulis sebuah tulisan yang akan membahas tentang bagaimana membangun keluarga yang sakinah-mawaddah-warahmah sesuai dengan Undang-undang perkawinan dan KHI. Metode penulisan menggunakan studi literatur yang mengambil dari buku dan tulisan yang sudah ada. Dalam tulisan ini terdapat upaya pembentukan rumahtangga yaitu yang terdapat pada pasal 30-34 UUP dan pasal 77 KHI dan juga solusi pembentukan rumah tangga yang samawa. Adapun solusinya yaitu menjaga hubungan komunikasi, kebutuhan biologis, menjaga penampilan dan mengatur ekonomi keluarga.

Abstract

Rokok pada awalnya berupa tembakau yang dibakar dan dihisap melalui sebuah pipa. Kegiatan ini awalnya dilakukan pada saat berkumpulnya beberapa suku untuk mempererat hubungan antar suku yang berbeda. Di Indonesia, merokok sudah menjadi hal yang biasa secara turun temurun. Pada artikel ini, penulis akan mencoba untuk mengkaji hukum tentang merokok. Karena fenomena yang kita saksikan saat ini dirasa sudah cukup untuk membuktikan bahwa rokok sudah menjadi kebutuhan sebagian masyarakat indonesia saat ini dan ada juga yang memakainya sebagai sampingan saja. Berangkat dari berbagai dalil yang telah dipaparkan sebelumnya baik dari Alquran maupun Hadis serta beberapa pendapat Ulama tentang dalil-dalil tersebut, maka penulis menyimpulkan bahwa hukum merokok bersifat kasuistis. Adakalanya dapat dikatakan haram dan adakalanya bersifat makruh tanzih.
