Abstract

This study aims to describe the “gaduh sapi” collaboration in terms of practice and review of mu’āmalah fiqh in Tanjung Kulon Village, Kajen Country, Pekalongan District. This research is using descriptive qualitative research. The sources used in this study are data from interviews, observations, documentation, and literature data. The subjects of this study were cattle managers and owners of capital. Data collection techniques used non-participant observation methods, structured interviews, and documentation. The data analysis used is qualitative by using the deductive method. The study results show that the practice of “gaduh sapi” in Tanjung Kulon Village follows the habits of the village community both in terms of how to manage, provide capital, and share profits. The model of rowdy practice is carried out with two events, namely fattening and breeding. The “gaduh sapi” collaboration carried out by the community as a means of helping. The practice of “gaduh sapi” cooperation carried out by the community is in accordance with the rules of fiqh mu’āmalah, namely using a muḍārabah contract. Because the capital owner gives the business manager the freedom to manage his business, develop it without limiting the type, time, and place. The capital used in this rowdy cooperation practice is goods, namely cows. This follows one of the conditions for muḍārabah capital: it can be in the form of money or goods that are valued (cows are included). So that at the end of time the distribution of results can be distinguished from profits. Where cattle capital remains the right of the owner of the capital, then the fattening and breeding results are shared. The provisions of the benefits carried out by the people of Tanjung Kulon Village are by the rules of al-ghunmu bi al- ghurmi (risks are balanced with benefits). This study also confirms that there are no contracts containing gharar in the “gaduh sapi” practice.Penelitian ini bertujuan untuk mendeskripsikan “gaduh sapi” dari segi praktik dan tinjauan fiqh mu’āmalah di Desa Tanjung Kulon, Kecamatan Kajen, Kabupaten Pekalongan. Penelitian ini termasuk penelitian kualitatif yang bersifat deskriptif. Sumber yang digunakan dalam penelitian ini yaitu data hasil wawancara, observasi, dokumentasi, dan data literatur. Subjek penelitian ini adalah pengelola sapi dan pemilik modal. Teknik pengumpulan data menggunakan metode observasi non-partisipan, wawancara terstruktur, dan dokumentasi. Analisis data yang digunakan adalah kualitatif dengan menggunakan metode deduktif. Hasil penelitian menunjukan bahwa praktik “gaduh sapi” di Desa Tanjung Kulon mengikuti  kebiasaan  masyarakat  desa baik  dari  segi  cara  pengelolaan,  penyediaan modal, dan pembagian keuntungan. Model praktik gaduh yang dilakukan dengan dua acara yaitu penggemukan dan pengembangbiakan. Kerjasama “gaduh sapi” yang dilakukan oleh masyarakat sebagai sarana tolong menolong. Praktik kerjasama “gaduh sapi” yang dilakukan masyarakat sudah sesuai dengan aturan fiqh mu’āmalah, yaitu menggunakan akad muḍārabah. Pengelola usaha diberi kebebasan oleh pemilik  modal  untuk  mengelola  usahanya,  mengembangkan  tanpa  memberi batasan  jenis,  waktu  serta  tempat. Modal yang digunakan dalam praktik kerjasama gaduh ini adalah barang yaitu sapi. Hal ini sudah sesuai dengan salah satu syarat modal muḍārabah yaitu dapat berbentuk uang atau barang yang dinilai (sapi termasuk di dalamnya). Pada waktu akhir pembagian hasil dapat dibedakan dari keuntungan. Dimana modal sapi tetap menjadi hak pemilik modal, selanjutnya hasil penggemukan dan pengembangbiakan yang dibagihasilkan. Ketentuan keuntungan yang dilakukan masyarakat Desa Tanjung Kulon telah sesuai dengan kaidah al-ghunmu bi al-ghurmi. Hasil penelitian ini juga menegaskan bahwa tidak ditemukan akad yang mengandung gharār dalam praktik “gaduh sapi” disana.

Abstract

The enactment of Small claims court mechanism that marked with the enactment of PERMA Number. 2 Year 2015 concerning Procedure for Simple Quarrel Settlement is a new breakthrough in the civil justice system in Indonesia. This breakthrough was reached by the Supreme Court in order to reduce the queues for settling of civil Quarrel in court that the value is under $ 200 million. Implementation of Quarrel resolution by Small claim court mechanisms is done by a single judge assisted by a Registrar and can be completed within 25 working days and the decision is final and binding so that it is unable filed an appeal or judicial review to the Supreme Court, the decision of which can be directly execute in accordance with the civil judicial mechanisms in general. Small claims court jurisdiction which is set in PERMA No. 2 2015 is the General Courts, considering the Religious Courts are also authorized to settle a civil case with the Shari'ah economic and legal mechanisms of the same event with the civil court of the General Courts, the judicial application of the Small claims court mechanism in Religion Court is also possible and prospective,so that regulatory support as well as PERMA No. 2 of 2015 applied to the Religious Courts is required, especially in the process of sharia economic quarrel resolution.

Abstract

Marriage has terms and harmony that have been established both in the Qur'an and in the Hadith. One of the conditions in a marriage contract is the presence of a parent (guardian) and a representative. Trusteeship, which was originally an ancient Arab culture that eventually became the Prophet's Sunnah was an absolute requirement for women to be able to do a marriage. What is meant by guardian in marriage is someone who acts on behalf of the bride in a marriage contract. Indeed there is no single verse of the Koran that clearly (explicitly) explains the existence of a guardian in a marriage contract. But there are only verses that can be understood to require the existence of a guardian as in the letter Al-Baqarah verse 221. This article briefly describes the guardian of marriage contained in the Fath Qadir Ibn Himmam. The book of Fath al-Qadir by Ibn Himmam was chosen to be the main source of study because it was one of the monumental works of all times in the field of Islamic Sciences especially for the study of Islamic law and was born from one of the famous Jurists to the present. The story of the Fath Qadir book is explained that according to Ibn Himmam guardianship in marriage is divided into two types, namely nadab / musthab and ijbar guardianship

Abstract

National Sharia council fatwa is a reference by every sharia financial institution in Indonesia in carrying out its operations. To implement sharia compliance by sharia financial institutions as formed as an extension of the DSN to oversee every financial institution to be in line with sharia principles. A problem that often arises in Islamic financial institutions is that the fatwa issued by DSN requires studies and opinions from DPS in operational techniques in Islamic financial institutions. the existing fatwas have not yet been represented in technical transactions at financial institutions. This research is a sociological juridical study, which examines the existence of MUI fatwas and the development of sharia economy and how the legal relationship between the MUI fatwa and the implementation of sharia economy in Indonesia with applicable laws and regulations. The results of this study see that the position of the fatwa in the perspective of banking law in Indonesia as a juridical reason for the legislature to set in the legislation. Besides that, the DSN fatwa as a technical basis for supervision is regulated in the laws and regulations on Islamic banking. From the data obtained that the position of fatwa in sharia banking has become a reference in every transaction for the future, each DPS in sharia financial institution is expected to not only be an independent board that is complementary but has a special position and staff in charge of each transaction carried out in the hope of implementing Sharia principles are maximally implemented. Fatwa dewan syariah nasional merupakan rujukan oleh setiap lembaga keuangan syariah di Indonesia dalam menjalankan opersionalnnya. Untuk menjalankan kepatuhan syariah oleh lembaga keuangan syariah maka dibentuklah Dewan Pengawas Syariah (DPS) sebagai perpanjangan tangan dari Dewan Syariah Nasional (DSN) untuk mengawasi setiap lembaga keuangan untuk sejalan dengan prinsip syariah. Problem yang sering muncul di lembaga keuangan syariah adalah fatwa yang dikeluarkan oleh DSN membutuhkan kajian dan opini dari DPS dalam teknis operasional di lembaga keuangan syariah. Fatwa yang sudah ada belum semuannya terwakili dalam teknis transaksi pada lembaga keuangan. Penelitian ini merupakan suatu penelitian yuridis sosiologis, yaitu meneliti tentang keberadaan Fatwa-fatwa MUI dan perkembangan ekonomi syariah dan bagaimana hubungan hukum antara fatwa MUI dan pelaksanaan ekonomi syariah di Indonesia dengan peraturan perundang-undangan yang berlaku. Hasil penelitian ini melihat bahwa kedudukan fatwa dalam prespektif hukum perbankan di Indonesia sebagai alasan yuridis bagi lembaga legislasi untuk menetapkan dalam aturan perundang-undangan. Disamping itu juga fatwa DSN sebagai dasar teknis pengawasan yang diatur dalam aturan perundang-undangan tentang perbankan syariah. Dari data yang diperoleh bahwa kedudukan fatwa pada perbankan syariah sudah menjadi rujukan dalam setiap transaksi untuk kedepannya setiap DPS yang ada dilembaga keuangan syariah diharapkan tidak hanya sebagai dewan independen yang besifat sebagai pelengkap tetapi memiliki kedudukan dan staf khusus yang membidangi setiap transaksi yang dijalankan dengan harapan pelaksanaan prinsip syariah maksimal dilaksanakan.

Abstract

Instruments such as working, living cost, waqf, kaffarat, and others that protect societal economy could be included as social security in Islamic view. Yet, zakat is the main instrument and has most significant role in giving Islamic social security for human besides conventional social security. Furthermore, zakat might be the main instrument in national social security if it manged well due to its superiority than conventional social security instruments. Semua instrumen yang memberikan perlindungan terhadap ekonomi masyarakat, dapat dikatakan sebagai instrumen jaminan sosial dalam Islam, seperti bekerja, nafkah, wakaf, kaffarat, dan lain-lain. Namun dari berbagai instrumen tersebut zakat menjadi instrumen yang paling utama dan memainkan peranan yang paling signifikan memberikan jaminan sosial atas masyarakat muslim yang bergerak seiring sejalan dengan instrumen jaminan sosial moderen lainnya. Bahkan zakat bisa menjadi instrumen utama dalam sistem jaminan sosial negara dengan pertimbangan bahwa dari berbagai sudut insitusi zakat mempunyai persamaan bahkan kelebihan dibanding instrumen jaminan sosial konvensional.

Abstract

The marriage misyar is a marriage contract conducted by husband and wife in syar'i and meet all the terms of marriage in islamic law. But the wife sincerely gave up her right not to be fulfilled by her husband, such as living in the house and the material right as usual of marriage. This marriage has been widely studied by Muslim intellectuals from various aspects such as, such as sociological, legal, and maqashid asy-syari'ah. Among the studies of the highlights maqashid ay-syari'ah concluded that marriage misyar in line with maqashid shari'ah at the level of dharuriyah, hajjiyah and tahsiniyah. The marriage misyar just to meet the biological needs, what can be said that this marriage is compatible with maqashid asy-syari'ah especially at the level of dharuriyah? At last it can be concluded marriage misyar irrelevant to maqashid asy-syari'ah padal level dharuriyah.

Abstract

In the routine inspection of the Padang Notary Regional Supervisory Council in 2019, according to his authority in Article 70 letter b UUJN 5 (five) findings of violations were found in the routine inspection of the Notary protocol where there was a violation in the form of incomplete signature of the notary deed. The formulation of this research is why in practice there was a giving of a copy of an act by a notary whose minutes of the deed had not been signed entirely and how the legal consequences of granting a copy of the deed by a notary whose minutes of the act had not been approved in full. This research is analytical descriptive research. Notary Deed has perfect proof of strength in a civil lawsuit, but if it violates specific provisions, the value of the evidence will be degraded to the strength of evidence as a deed under the hand. A notary who is proven to have made a mistake resulting in the act he made only has the power of proof as a deed under the side or even the deed is null and void by law, it will cause harm to the parties.

Abstract

In the business world, entrepreneurs have used the Internet to promote their products. This marks the start of the growth of online commerce. Many people prefer online transaction as it does not need a large investment or a physical location. The online transaction requires only a few electronic tools that are linked to the Internet. Resellers and drop shipping are two online trade systems that are popular among business actors today. This library research examined the classic fiqih books and the constitution regarding the buyer and the sale, the Fatwa of the Indonesian Council of Ulama National Sharia Board (DSN MUI) regarding gold trade, previous related research, and the reality of the current events. The researcher determined that the contract between the dropshipper and the customer was a salam contract because the transactions system is the ordering system, where payment is made in cash and the goods are delivered later. The dropshipping system used in the sample case fulfilled the salam trade regulation; however, it did not fulfill the goods for sale because the goods were still in the agents/distributors' possession (suppliers).Dalam dunia perdagangan, para pebisnis sudah menggunakan internet sebagai alat untuk memasarkan produknya.Dari sinilah muncul bisnis online. Jual beli online banyak diminati orang dikarenakan jual beli online tidak memerlukan modal yang besar dan tidak memerlukan tempat usaha. Jual beli online hanya memerlukan seperangkat alat elektronik yang tersambung internet. Sistem jual beli online yang marak oleh pelaku usaha pada masa kini adalah reseller dan dropshipping. Penelitian kepustakaan (library research), ini akan mengkaji buku-buku fiqih klasik dan perundangan-undangan tentang jual beli emas, Fatwa DSN MUI tentang jual beli emas, penelitian terdahulu yang terkait serta melihat fakta realita dari kejadian yang ada. Menurut analisa penulis, akad yang diterapkan antara Dropshipper dan Customer adalah akad salam dengan alasan sistem ini merupakan sistem jual beli dengan cara pemesanan dimana pembayaran diberikan secara tunai dan kemudian barang akan dikirim dikemudian hari. Praktik jual beli sistem dropshipping yang diterapkan pada contoh kasus dilihat dari rukun jual beli salam sudah terpenuhi namun pada syarat ketentuan tentang barang yang dijual belum terpenuhi karena barang masih berada di tangan Agen/ distributor (supplier).

Abstract

awal waktu shalat yang telah disebutkan dalam nash al-Quran dan al-Hadits ternyata masih bersifat ijtihadi. Di era sekarang yang sudah canggih, berbagai pendekatan keilmuan diikutsertakan menjadi pisau analisis dalam menafsirkan fenomena yang telah disebutkan oleh Al-Quran. Selain penafsiran fiqh para imam madzhab yang memberi penafsiran tentang tanda awal waktu shalat khususnya shalat subuh. Waktu sholat subuh di Indonesia didasarkan paradigma fajar shadiq terjadi apabila matahari berada pada ketinggian -20º. Namun pada tahun 2010 yang lalu adanya sebuah majalah Qiblati cetakan kota Malang, awal waktu shalat subuh dipersoalkan terkait dengan waktunya yang dikatakan terlalu cepat.

Abstract

This article would explain the testament of the testamentary gift Number: 69/Pdt.G/2009/PN.Pdg., in the Padang District Court. As for the background of this research is the settlement of the will between the people of Islam, but decided by the district court, so there are some irregularities, both in terms of formal law and Islamic law. This research is a normative legal research with data analysis method in the form of content analysis. Based on the results of the decision are considered appropriate by the panel of judges who completed the case. Although there are no legal remedies from the parties against the decision of the district court judge, from the perspective of Islamic law the decision is still contrary to what should apply to people of Islam.
