Abstract

Abstrak: Penelitian ini mengangkat permasalahan apa pertimbangan majelis hakim dalam putusan perkara Nomor 479/Pdt.G/2020/PA.Bn terhadap tanggung jawab ayah setelah ikrar talak di Pengadilan Agama Bengkulu Kelas IA dalam perspektif hukum Islam dan bagaimana kewajiban ayah terhadap nafkah anak pasca ikrar talak pada putusan perkara Nomor: 479/Pdt.G/2020/PA-Bn di Pengadilan Agama Bengkulu Kelas IA. Penelitian ini menggunakan jenis penelitian field research (lapangan) dan library research (kepustakaan), dengan pendekatan undang-undang, pendekatan kasus dan pendekatan konseptual. Untuk mengumpulkan data digunakan metode dokumenter yang didapat dari putusan pengadilan agama Bengkulu pada perkara Nomor : 479/Pdt.G/2020/PA.Bn  dan tinjauan pustaka merujuk pada pada buku-buku yang membicarakan masalah yang sesuai dengan permasalahan. Kemudian setelah data didapat dianalisis secara deskriptif normatif. Dari hasil penelitian menunjukan bahwa: 1) Pertimbangan majelis hakim bahwa tanggung jawab ayah setelah ikrar talak terhadap anak pasca perceraian yaitu lebih dibebankan kepada ayah dan seorang ibu tidak wajib memberikan nafkah kepada anaknya, baik itu ada suami di sisinya maupun tidak ada. Baik itu perempuannya kaya maupun miskin, seorang perempuan hanya punya kewajiban memberi nafkah kepada kedua orang tua dan budak yang dimilikinya. Hal ini ini dipertegas oleh mazhab syafi’i, Hanafi dan Hambali, apabila ayah tidak mampu menafkahi anak, maka kerabat terdekat bisa mengambil alih peran ayah untuk memberikan nafkah. 2) Kewajiban ayah terhadap nafkah anak pasca ikrar talak pada putusan perkara Nomor: 479/Pdt.G/2020/PA-Bn di Pengadilan Agama Bengkulu, yaitu menghukum Pemohon (ayah) untuk memberi nafkah anak diluar biaya pendidikan dan kesehatan. Jika ayah (Pemohon) ingkar dan tidak memenuhi kewajibannya sebagaimana dalam dictum empat amar putusan Termohon dapat mengajukan permohonan eksekusi pembayaran biaya nafkah anak ke Pengadilan Agama untuk memaksa orang tua laki-laki (ayah) tersebut untuk memberikan biaya nafkah.Kata Kunci: Nafkah Anak, Tanggungjawab Ayah, Hukum Islam Abstract: This research raises the problem of what the panel of judges considered in the decision of the case Number 479 / Pdt.G / 2020 / PA.Bn on the father's responsibility after the divorce pledge at the Bengkulu Religious Court Class IA in the perspective of Islamic law and how the father's obligation to support the child after pledge of divorce in the case decision Number: 479 / Pdt.G / 2020 / PA-Bn at the Bengkulu Class IA Religious Court. This research uses the type of field research (field) and library research (literature), with a statutory approach, a case approach and a conceptual approach. To collect data, the documentary method was used which was obtained from the Bengkulu religious court's decision on the case Number: 479 / Pdt.G / 2020 / PA.Bn and literature review refers to books that discuss issues that correspond to the problem. Then after the data obtained were analyzed descriptively normative. The research results show that: 1) The judges' consideration that the father's responsibility after the divorce vow to the child after the divorce is more burdened on the father and a mother is not obliged to provide for her child, whether there is a husband on her side or not. Whether the woman is rich or poor, a woman only has an obligation to provide for her parents and the slave she has. This is confirmed by the syafi'i, Hanafi and Hambali schools, if the father is unable to provide for the child, then the closest relatives can take over the role of the father to provide a living. 2) The obligation of the father to support the child after the divorce pledge in the decision of the case Number: 479 / Pdt.G / 2020 / PA-Bn at the Bengkulu Religious Court, namely punishing the Petitioner (father) to provide for the child outside the cost of education and health. If the Petitioner's father renounces and does not fulfill his obligations as stated in the dictum of four orders of the Respondent's decision, the Respondent may apply for the execution of the payment of child support to the Religious Court to force the male parent (father) to provide a living cost. Keywords: Child's Livelihood, Father's Responsibility, Islamic Law

Abstract

Majelis hakim mengabulkan permohonan poligami karena hypersex tersebut. Padahal jelas di dalam Pasal 4 ayat (2) UU perkawinan dan  KHI Pasal 57 tidak menjelaskan syarat poligami karena hypersex. Bagaimana pertimbangan   hukum   hakim   dalam   menetapkan   perkara   Nomor 0256/Pdt.G/2016/PA.Mna dan bagaimana tinjauan hukum Islam dalam perkara pemberian izin poligami karena hypersex. Metode penelitian hukum yang digunakan adalah metode penelitian hukum normatif. Bahan hukum didapat melalui metode dokumenter dan tinjauan pustaka. Setelah bahan hukum didapat dilakukan penginventarisasian terhadap bahan hukum yang berhasil dikumpulkan tersebut berdasarkan relevansinya dengan pokok masalah dengan penelitian ini, kemudian dianalisis dengan content analisis. Hasil penelitian ini menunjukkan bahwa pertimbangan   hukum   hakim   dalam   menetapkan   perkara   Nomor 0256/Pdt.G/2016/PA.Mna tentang pemberian izin poligami karena hypersex ialah permohonan Pemohon telah memenuhi syarat kumulatif untuk beristeri lebih dari seorang sesuai ketentuan Pasal 5 ayat (1) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan jo, Pasal 55 ayat (2) dan Pasal 58 KHI. Di samping itu telah memenuhi syarat  alternatif  untuk  beristeri  lebih dari seorang sebagaimana diatur dalam Pasal 4 ayat  2 Undang-Undang Nomor 1 Tahun  1974 Tentang Perkawinan jo Pasal 57 Kompilasi Hukum Islam dan tinjauan hukum Islam terhadap pemberian izin poligami karena hypersex di Pengadilan Agama Manna pada Putusan nomor 0256/Pdt.G/2016/ PA.Mna, yaitu Islam membolehkan poligami sebagaimana Allah telah berfirman dalam Alquran surat Q.S al-Nisa ayat (3) yang memperbolehkan untuk seorang laki-laki (suami) memiliki istri lebih dari  satu  dengan  batasan  hingga empat isteri, dengan syarat yang ketat yaitu mampu berlaku adil terhadap isteri-isteri dan anak-anaknya.

Abstract

The formulation of this research  is: First, How is the existence  of evidence  in the judiciary according  to Islamic law? Second  What  is the existence  of evidence  in court  according  to positive  law in Indonesia? Third,  how  do  you compare the existence  of evidence  according  to Islamic law and  criminal procedural law? This type of research  is library research  (library research). Data collection uses reading techniques, citing information. This study concludes  that: First, according  to Islamic law, evidence  is anything  that has something  to do with an act, the evidence  can be used as evidence  to raise the confidence of the judge over the truth of a criminal act committed  by the defendant. Second, the evidence  according  to positive law is witness testimony,  expert  testimony,  letters, instructions  and  information from the defendant. Whereas  the positive law stipulates  that only legal evidence  instruments can be used  for verification.  Third, the position  of evidence  in Islamic law and  Positive Law is a tool to assist the process  of verification in criminal proceedings and  help the judge to obtain  confidence in an alleged act. Islamic law and positive law have several similarities, namely  the law governing  actions that are related to the soul or members of the body,  such as killing, injuring and so on

Abstract

Abstrak: Implementasi Peraturan Bupati Empat Lawang Nomor 47 Tahun 2018 tentang Pesta Rakyat di Kecamatan Sikap Dalam Kabupaten Empat Lawang sudah berjalan dengan baik walaupun diawal pemberlakuan larangan pesta dimalam hari ada sebagian golongan masyarakat yang menantang diberlakukannya larangan pesta dimalam hari. Faktor Pendukung dalam Peraturan Bupati Nomor 47 Tahun 2018 tentang Pesta Rakyat adalah, adanya koordinasi melalui kegiatan rapat rutin yang dilakukan oleh tim penegak larangan pesta dimalam hari. Adanya partisipasi masyarakat melalui kegiatan laporan apabila terjadi pelanggaran pesta dimalam hari. Adanya komitmen melalui Penandatanganan Fakta Integritas yang dilakukan oleh tim penegak larangan pesta dimalam hari. Bahwa implementasi Peraturan Bupati Empat Lawang Nomor 47 Tahun 2018 tentang Pesta Rakyat di Kecamatan Sikap Dalam Kabupaten Empat Lawang perspektif Politik Islam sudah mengikuti anjuran Agama Islam, telah mengandung 4 tuntunan dalam melaksanakan kepemimpinan politik.Kata Kunci: Implementasi, Peraturan Bupati, Pesta Rakyat. Abstract: The implementation of the Empat Lawang Regent Regulation Number 47 of 2018 concerning the People's Party in the Attitude District of Empat Lawang Regency has gone well even though at the beginning of the implementation of the ban on parties at night there were some groups of people who challenged the implementation of the ban on parties at night. The supporting factor in the Regent's Regulation Number 47 of 2018 concerning the People's Party is the coordination through routine meeting activities carried out by the enforcement team for banning parties at night. There is community participation through reporting activities in case of party violations at night. There is a commitment through the Integrity Fact Signing carried out by the party ban enforcement team at night. Whereas the implementation of the Empat Lawang Regent Regulation Number 47 of 2018 concerning the People's Party in the Attitude District of Empat Lawang Regency, the Islamic Political perspective has followed the recommendations of the Islamic Religion, contains 4 guidelines in carrying out political leadership.Keywords: Implementation, Regent Regulation, People's Party.

Abstract

Penelitian ini bertujuan untuk mengetahui pelaksanaan Kebijakan Nasional Tentang Pengelolaan Hutan Berbasis Perubahan Iklim (Studi Kasus di Kabupaten Mukomuko).  Bagaimana model keterpaduan pengaturan Kebijakan Nasional Tentang Pengelolaan Hutan Berbasis Perubahan Iklim (Studi Kasus di Kabupaten Mukomuko)? Penelitian ini menggunakan metode pendekatan yuridis empiris. Metode pendekatan kualitatif, dimana penelitian diharapkan menghasilkan data deskreptif berupa data-data tertulis atau lisan  dari orang-orang dan perilaku yang dapat diamati. Penelitian ini menyimpulkan bahwaPengaturan kebijakan nasional terhadap pengelolaaan  hutan kurang sejalan dengan Peraturan pemerintah  Daerah mukomuko yang masih jauh dari sinergi dalam upaya melaksanakan kebijakan perubahan yang lebih baik lagi.Hambatan pengaturan kebijakan nasional terhadap pengelolaaan  hutan berbasis  perubahan  iklim antara lain: Proses komunikasi berjalan kurang optimal,  kegiatan  Forkom  di  tingkat  Kabupaten juga  belum  mampu  menampung  aspirasi masyarakat. Ditingkat Dasar masih ada miskomunikasi dari beberapa stacholder dan Sumberdaya Manusia yang digunakan dalam pelaksanaan kebijakan dapat dikatakan belum mencukupi.Pada keterpaduan kebijakan nasional dan  aspek struktur birokrasi, mekanisme pelaksanaan  masih   terkesan   top-down dikarenaka kurangnya sinergi antara pemerintahan provinsi dan kabupaten.

Abstract

The purpose of the research  is to know the judge’s consideration, the impact of the judge’s decision and the review of Islamic law against  the marriage  of the fakid in the Religious Court of Bengkulu.  Research  type is normative. The research approach is the  case  approach. Data  collection  techniques used  are  literature  techniques from primary  legal materials  and secondary legal materials.  The analysis used  is qualitative  analysis. The result of the research  is that the judge in deciding  the case of marriage  cancellation  has been  in accordance with the Laws Regulation,  because the judge in this case is guided  by the Compilation of Islamic Law and Positive Law. In addition, the impact of the decision of the cancellation  of marriage  is; since the issuance  of the Decision of the Religious Courts that the marital relationship is abolished and  is considered never to carry out the contract of marriage, while the child who has been  born to the marriage  remains  guardian to his father and for the needs  of his life is still the responsibility  of his parents, especially the father. The inheritance of the cancellation  of the marriage  remains joint property.  While fasid marriage  in view of Islamic law is a marriage  that must be canceled because of the terms or pillars of marriage  is not met and violate the rules set by sharia law

Abstract

Abstrak: Perundang-undangan menegaskan bahwa setiap perkawinan yang dilangsungkan harus di depan pejabat yang berwenang atau tercatat, tapi di Kecamatan Lintau Buo masih ada masyarakat yang pernikahannya tidak tercatat dan tidak memiliki buku nikah. Tujuan penelitian ini untuk mengetahui penyebab masyarakat tidak memiliki buku nikah di Kecamatan Lintau Buo dan untuk mengetahui upaya KUA dalam menagulangi  masyarakat yang tidak memiliki buku nikah. Penelitian ini merupakan penelitian lapangan (field research). Teknik pengumpulan data melalui observasi, wawancara, dan dokumentasi. Untuk menganalisa data, penulis menggunakan reduksi data, display data, dan penarikan kesimpulan atau verifikasi. Hasil penelitian penulis mengenai problematika pernikahan tidak tercatat disebabkan oleh: 1)Pernikahan tidak  mendapat restu orang tua. 2)Pernikahan duda atau janda karena kurang syarat administrasi di kantor KUA (akta cerai). 3)Pernikahan karena tertangkap basah oleh masyarakat. 4)Hamil diluar nikah. 5)P3N tidak melaporkan pernikahan. Ada sebanyak 120 orang yang belum memiliki buku nikah dan 5 orang yang melakukan istbat nikah di Pengadilan agama selama 2 tahun terakhir. Penyebab masyarakat tidak memiliki buku nikah karena buku nikah hilang, pegawai pencatat, pegawai pencatat nikah tidak memberikan buku nikah,  perkawinan tidak tercatat. Upaya yang dilakukan oleh pihak KUA dalam menanggulangi masyarakat yang tidak memiliki buku nikah adalah dengan cara wawancara dengan solusi dan  Sosialisasi.Kata kunci: Problematika, Perkawinan, Tercatat;  KUA. Abstrack : The law stipulates that every marriage that takes place must be in front of an authorized or registered official, but in Lintau Buo Subdistrict there are still people whose marriages are not registered and do not have a marriage certificate. The purpose of this study was to determine the causes of people who do not have a marriage book in Lintau Buo District and to find out the efforts of KUA in dealing with people who do not have a marriage book. This research is a field research (field research). Data collection techniques through observation, interviews, and documentation. To analyze the data, the writer uses data reduction, data display, and drawing conclusions or verification. The results of the author's research regarding the problems of unregistered marriages are caused by: 1) Marriage does not get the blessing of parents. 2) Marriage of a widower or widow due to lack of administrative requirements at the KUA office (divorce certificate). 3) Marriage due to being caught red-handed by the community. 4) Pregnant out of wedlock. 5) P3N did not report marriage. There are as many as 120 people who do not have a marriage book and 5 people who do istbat marriage in the religious court for the last 2 years. The cause of people not having a marriage book is because the marriage book is missing, registrar employees, marriage registrar employees do not provide marriage books, marriages are not registered. Efforts made by the KUA in tackling people who do not have a marriage book are by way of interviews with solutions and outreach.Keywords: Problematic, Marriage, Recorded, KUA.

Abstract

Consideration Of Judge In Religious Court Of Curup On Permitting The Polygamy Of Husband Who Do Not Eligible For Polygamy In According To Indonesia’s Positive Law. Religious Court in its task of giving a decision on the application for polygamy, guided by the rules, namely Law No. 1 of 1974, Government Regulation No. 9 of 1975 and the Compilation of Islamic Law. Examples of cases that occurred in 2013 in case No. 142 / Pdt.G / 2013 / PA CRP.and Case Number: 542 / Pdt.G / 2013 / PA CRP. This paper is discussing a review of Islamic law against the decision of the permission for polygamy who do not eligible, consideration of the judge in deciding the permission of polygamy and the power of law permits polygamy who are not eligible. This type of research is normative empirical, and data analysis with qualitative methods. Collecting data using techniques of documentation, interviews and observation. The results of this study indicate first, in Islamic law, the decision on case number 142 / Pdt.G / 2013 / PA CRP and case number 542 / Pdt.G / 2013 / PA CRP were determined by a panel of judges have compatibility with the context of ijtihad, and the results of its legal can be carried out without shutting down the previous law. The result of this decision is a form to fill a legal vacuum. Then, the Religious Court judges of Curup perform legal breakthrough (contralegem), because it does not apply Article 4 (2) of Law No. 1 of 1974 in the examination of the case. So the legal reasoning used by the judge in deciding the case number 142 / Pdt.G / 2013 / PA CRP and case number 542 / Pdt.G / 2013 / PA CRP is weak because it does not correspond to the reasons for the permissibility of polygamy in the legislation.

Abstrak Untuk mengatasi krisis lahan pemakaman di kota-kota besar maka salah satu solusinya adalah dengan merubah tatacara peletakkan jenazah di dalam kubur pada prosesi pemakaman yaitu di letakkan secara berdiri, tidak di baringkan seperti biasanya. Apa yang menjadi sebab adanya wacana penguburan secara berdiri di pemakaman kota-kota besar?. Bagaimana tinjauan hukum Islam terhadap penguburan secara berdiri?. Untuk mengetahui apa permasalahan-permasalahan pemakaman yang terjadi di kota-kota besar. Untuk mengetahui bagaimana tinjauan hukum Islam terhadap penguburan secara berdiri. Jenis penelitian yang dilakukan berupa penelitian library research yaitu penelitian yang menggunakan buku dan literatur sebagai objek utama. Penelitian ini didesain dalam bentuk penelitian kepustakaan (library research). Adapun hasil penelitian menyimpulkan Penyebab adanya wacana penguburan secara berdiri adalah Perkembangan penduduk, dan tingkat kematian yang tinggi yang tidak di barengi dengan ketersediaan lahan pemakaman serta prosesi pemakaman yang biasa dilakukan membuat tanah makam semakin hari semakin menipis. Penguburan secara berdiri boleh dilakukan bila kondisi pemakaman tersebut sudah dalam keadaan sulit dan darurat, berdasarkan dalil istihsan bidharurah, kaedah fiqhiyyah Ad-Dhararu Yuzalu (Kemudharatan dihilangkan) dan kaedah fiqhiyyah Ad-Dharurat Tubihu al-Mahzhurat (darurat itu membolehkan larangan).Kata kunci : Penguburan Berdiri, Hukum Islam AbstractTo overcome the burial land crisis in big cities, one solution is to change the procedure for placing the body in the grave during the funeral procession, which is to put it standing up, not lying down as usual. What are the reasons for the discourse on standing burials in the cemeteries of big cities? How does Islamic law review standing burials? To find out what funeral problems that occur in big cities. To find out how Islamic law reviews stand for burial. This type of research is in the form of library research, namely research using books and literature as the main object. This research was designed in the form of library research (library research). The results of the research conclude that the cause of standing burial discourse is population development, and a high mortality rate which is not accompanied by the availability of burial land and funeral processions that are usually carried out making the burial ground increasingly depleted. Standing burial may be carried out when the condition of the burial is already in a difficult and emergency situation, based on the proposition of bidharurah istihsan, the ad-Dhararu Yuzalu fiqhiyyah principle (Kemudharatan is removed) and the ad-Dharurat law of fiqhiyyah Tubihu al-Mahzhurat (emergency allows prohibition).Keywords: Standing Burial, Islamic Law

Abstract

The marriage dispensation is filed by the parents of the man and woman to the Religious Court which is his residence, the Religious Court after examining in court and believes that there are possible matters to grant the dispensation, the Religious Court provides the marriage dispensation with a determination. The Panel of Judges provides the stipulation under article 7 paragraph (1) of Law Number 1 Year 1974, with the consideration to avoid the occurrence of greater mudharat such as pregnancy before marriage.The child marriage under age due to pregnant factors base on Islamic law concerning with themarital status and the status of children born after six months of marriage have nasab, guardianship, inheritance and livelihoods of both parents. However, if the child is born before six months of marriage, it has no nasab, guardianship, inheritance and livelihood relationships from his father, unless there is recognition and proof of the child's biological relationship.
