Abstract

A happy  family is born  and  the inner  desire  of each  partner and  the individuals  who  are  in a family. But do not rule out the cherished goal, covenants they make together experiencing the shock  impacting on the creation of the marital discord,  disagreement, each  party still carries  each  ego  respectively. Therefore the  happy  marriage which  was  originally going to be cracks or divorce. With the divorce, the consequences are ‘Iddah. In the case of divorce and ‘Iddah arrangement was stipulated in Islamic law either globally or specifically (the four schools  of jurisprudence) and Islamic Law Compilation (KHI).The problems of this study was twofold: 1. How do the provisions of divorce and ‘Iddah according to the four schools of fiqh and Islamic Law Compilation  (KHI)? 2. How Relevance provisions of divorce and ‘Iddah according to the four schools of fiqh and Islamic Law Compilation  (KHI) In the era of modern society ?.The method used in this compiler is a comparative descriptive method that describes the view of the four schools  of jurisprudence about  the divorce arrangements and ‘Iddah then linked to Islamic Law Compilation (KHI) in Indonesia. Type of research is the research library (library research), whereas the approach used  in this study is a normative approach. In analyzing the data  compiler using the deductive method with deductive mindset is to analyze  the problem of divorce  and  ‘Iddah in general  and  then  withdrawn on dissent in the Four Schools  of Jurisprudence about  the  divorce  arrangements and  ‘Iddah.From the  analysis  that has  been done  in this study setting divorce  and ‘Iddah contained in Jurisprudence four schools  and Islamic Law Compilation  (KHI) do not have much difference, and with the relevance of Jurisprudence four schools  and Islamic Law Compilation  (KHI) portion  of provisions divorce and ‘Iddah that has prevailed  still be valid in the era of modern society

Abstract

Abstrak : Rumusan permasalahan dalam penelitian ini adalah bagaimana pertimbangan hakim dalam menolak itsbat nikah perkawinan anak dibawah umur pada penetapan Nomor 0092/Pdt.P/2018/PA.Mna; Bagaimana status hukum dan dampak perkawinan anak dibawah umur pada penetapan Nomor 0092/Pdt.P/2018/PA.Mna menurut hukum Islam dan hukum positi. Jenis penelitian adalah deskriptif kualitatif.  Teknik pengumpulan data yang digunakan adalah observasi, wawancara, dan dokumentasi.  Hasil penelitian, bahwa pertimbangan hakim dalam menolak itsbat nikah perkawinan anak dibawah umur pada penetapan Nomor 0092/Pdt.P/2018/PA.Mna adalah Undang-undang perkawinan Nomor 1 Tahun 1974 Pasal 7 ayat (1) dan (2) yang menyatakan bahwa perkawinan hanya di izinkan jika pihak pria sudah mencukupi umur 19 tahun dan pihak wanita sudah mencapai umur 16 tahun. Dalam hal penyimpangan terhadap ayat (1) pasal ini dapat meminta dispensasi kepada pengadilan atau pejabat lain. Apabila terjadi penolakan itsbat nikah maka perkawinan itu belum mempunyai kekuatan hukum, karena perkawinannya belum dicatatkan di KUA atau kantor catatan sipil. Status hukum dan dampak perkawinan anak dibawah umur pada penetapan Nomor 0092/Pdt.P/2018/PA.Mna menurut hukum Islam dan hukum positif adalah: a) jika kedua orang tuanya bercerai anak sulit mendapatkan harta gono gini karena secara hukum pernikahannya dianggap belum pernah terjadi menurut Negara. Hubungannya anak dengan harta gono gini, karena bapak atau ibu tetap memelihara dan mendidik anak-anaknya semata-mata berdasarkan kepentingan anak, bapak yang bertanggung jawab atas semua pemeliharaan dan pendidikan anak itu, bilamana bapak dalam kenyataan tidak dapat memenuhi kewajiban tersebut, pengadilan dapat menentukan bahwa ibu ikut memikul biaya tersebut. b) Istri dan anak juga tidak berhak atas nafkah dan warisan jika suami meninggal dunia. c) Anak kesulitan mendapatkan akta kelahiran sebab orang tuanya tidak mempunyai akta nikah.Kata kunci : Penolakan itsbat nikah, perkawinan anak dibawah umur. Abstract: The formulation of the problem in this study is how the judge's consideration in rejecting the marriage status of underage children in the determination of Number 0092 / Pdt.P / 2018 / PA.Mna; What is the legal status and impact of marriage for minors in the determination of Number 0092 / Pdt.P / 2018 / PA.Mna according to Islamic law and positi law. This type of research is descriptive qualitative. Data collection techniques used were observation, interviews, and documentation. The results of the study, that the judge's consideration in rejecting the marriage of a minor in the determination of Number 0092 / Pdt.P / 2018 / PA.Mna is Marriage Law Number 1 of 1974 Article 7 paragraphs (1) and (2) which states that Marriage is only permitted if the male has reached the age of 19 and the woman has reached the age of 16. In case of deviation from paragraph (1) of this article, dispensation may be requested from a court or other official. If there is a rejection of the marriage certificate, then the marriage does not have legal force, because the marriage has not been registered at the KUA or the civil registry office. The legal status and impact of the marriage of minors in the determination of Number 0092 / Pdt.P / 2018 / PA. Meaning according to Islamic law and positive law is: a) if both parents are divorced, the child is difficult to obtain property because legally the marriage is considered never occurs by State. The relationship between children and property is gono gini, because the father or mother continues to care for and educate their children solely on the basis of the child's interests, the father is responsible for all the care and education of the child, if in fact the father cannot fulfill this obligation, the court can determine that the mother shared the costs. b) The wife and children are also not entitled to support and inheritance if the husband dies. c) Children have difficulty obtaining a birth certificate because their parents do not have a marriage certificate.Keywords: Rejection of itsbat marriage, marriage of minors.

Abstract

This study  discusses  the implementation of the determination of Integrated  Marriage  of Religious Court  Class IIA Manna  in District Kedurang  South  Bengkulu  Regency.  the establishment of marriage  is a provision  of marriage  proven  by a religious court. The legal basis of marriage  isbat is the Compilation of Islamic Law contained in Article 7 paragraph (1) Com- pilation  of Islamic Law affirms that marriage  can only be proved  by the Marriage Certificate made  by the Officer of Marriage Recorders. This indicates  that marriages  that do not have  proof of registration  can be submitted to the establishment of mar- riage in religious courts accompanied by certain requirements. The purpose of the isbat marriage  is to get a new marriage  book through  the establishment of ratification in accordance with the Law No. 1 of 1974 without doing aqad  marriage  again. Among the reasons  for implementing the establishment of Integrated  Marriage is to provide  solutions for couples  whose marriages  are not recorded. The purpose of this study is to know the rule of law issued by the Supreme Court relating to the establishment of Integrated  Marriage and the application of Supreme Court Regulation  No. 1 Year 2015 By Manna  Religious Court. This type of research  is a type of field research  using qualitative  descriptive  approach. The research  data  is taken directly from the research location  and the data  is obtained by using interview method, observation and documentation method. After the data  collected to analyze the data collected in this study used analytical descriptive-analytic technique, which describes all the things that focus in this research. The results of this study indicate  that the Regulation  of the determination of Integrated  Marriage contained in Perma  No 1 Year 2015 which regulates the mechanism of implementation of an integrated determination session. As for the rule of law remains  based  on existing rules. Meanwhile,  the establishment of integrated marriage  is conducted by Manna  Religious Court in Kedurang  sub-district in accordance with Perma  No 1 year 2015.  Legal basis of the determination of Marriage Regula- tion Terhadi  namely  KHI Article 7 paragraph (1). Abstract

Abstrak: Perebutan hak asuh anak merupakan salah satu persoalan yang timbul dari perceraian. Kedua orang tua yang bercerai masing-masing merasa lebih baik dan berhak untuk mendapatkan hak asuh anak. Perebutan hak asuh anak secara tidak langsung telah melanggar hak anak sehingga diperlukannya perlindungan terhadap hak anak dan pemberian sanksi terhadap pihak-pihak yang tidak menjalankan putusan hakim dan melanggar hak anak. Penelitian ini bertujuan untuk mengetahui upaya hukum yang dapat diberikan kepada anak guna melindungi hak-hak anak pasca perceraian orang tuanya dan akibat hukum terhadap pihak yang tidak mendapat hak asuh yang menguasai anak secara paksa. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan menggunakan bahan studi kepustakaan dengan cara mengumpulkan sumber hukum primer dan sekunder, mengkaji, dan menganalisa sesuai dengan topik pembahasan dalam penelitian ini. Hasil dari penelitian ini, terdapat hak-hak anak yang harus dilindungi pasca perceraian orang tua sebagaimana diatur dalam UU Perkawinan dan UU Perlindungan Anak, serta perlu diperhatikan pula asas yang terbaik bagi anak dalam segala tindakan terkait anak.Kata kunci: Hak Anak, Perlindungan Hukum, Hukum Positif. Abstract: The struggle for child custody is one of the problems that arise from divorce. Both parents who are divorced each feel better and are entitled to child custody. The struggle for child custody has indirectly violated the rights of the child so that the need for protection of the rights of the child and the imposition of sanctions on those who do not carry out the judge's decision and violate the rights of the child. This study aims to determine the legal remedies that can be given to children in order to protect children's rights after their parents' divorce and the legal consequences for those who do not have custody who control the child forcibly. The research method used is a normative juridical approach using literature study materials by collecting primary and secondary legal sources, reviewing, and analyzing according to the topics discussed in this study. According to the results of this study, there are children's rights that must be protected after parental divorce as regulated in the Marriage Law and Child Protection Act, and it is also necessary to pay attention to the best principle for children in all actions related to children.Keywords: Children's Rights, Legal Protection, Positive Law.

Abstract

Penelitian ini bertujuan untuk menganalisis apa implikasi hubungan keperdataan ayah biologis terhadap anak hasil nikah siri pasca Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010, dan bagaimana perspektif istihsan terhadap hubungan keperdataan ayah biologis terhadap anak hasil nikah siri pasca Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010. Jenis penelitian ini adalah penelitian kepustakaan (library research). Teknik pengumpulan data menggunakan  Metode Dokumen (Documentation). Hasil kesimpulan menyatakan bahwa implikasi hubungan keperdataan ayah biologis terhadap anak hasil nikah siri pasca Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 adalah anak siri mendapatkan nafkah hadhanah (pemeliharaan), anak siri mendapatkan wasiat wajibah, anak hasil nikah siri mendapatkan perlakuan yang adil dan anak hasil nikah siri wajib berbakti kepada ayah biologisnya. Kemudian persektif istihsan mengenai hubungan keperdataan ayah biologis dengan anak hasil nikah siri pasca Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010, tidak bertentangan dengan konsep istihsan dalam hukum Islam.

Abstract

This research  raises the  problem;  (1). How  is the  determination of the  sanction  of the  law that  is applied  in the Government Regulation  Substitute  Law (PERPPU)  No. 1 of 2016  according  to the  perspective of Islamic Law, (2). How  is the determination of the sanction  of the law that is stipulated  in the Government Regulation  in Lieu of Law (PERPPU)  No. 1 of 2016  according  to the perspective of Indonesian Criminal Law. This research  is a normative legal research  with normative juridical approach to trace the legal basis, be it in Islamic law or Criminal Law of Indonesia especially  related  to sanction  of kebiri, method of collecting data  using library method, after data  collected and  then analyzed  and  interpreted by using deduc- tive method that is to draw general  facts to make  facts or conclusions  gained  previously  into something  special. The results of this study conclude  that; (1). In the perspective of Islamic Law, chemical  punishment is categorized  as a punishment that has a minimum  and  maximum restriction  determined by the judge,  so it can  be classified as a ta’zir punishment. (2). According to the Indonesian Criminal Law perspective, the determination of the sanction  of kebiri aims to safeguard the welfare of the Indonesian people  from the pedophile actors,  to give a deterrent effect and  as a form of responsibility  towards  the law of the perpetrators.

Abstract

Abstrak: Rumusan masalah dalam penelitian ini adalah: 1) Bagaimana pelaksanaan pemanfaatan harta waris bersama dengan cara gilir sawah pada masyarakat Kecamatan Kelam Tengah Kabupaten Kaur Provinsi Bengkulu? 2) Bagaimana pandangan hukum Islam terhadap pemanfaatan harta waris bersama dengan cara gilir sawah pada masyarakat Kecamatan Kelam Tengah Kabupaten Kaur Provinsi Bengkulu? Jenis penelitian ini adalah penelitian yang memfokuskan data dari lapangan (field research) kualitatif. Teknik pengumpulan data yang peneliti gunakan adalah dengan menggabungkan observasi non partisipasi, wawancara mendalam, dan dokumentasi. Teknik yang digunakan adalah dengan reduksi data (data reduction); penyajian data (display data); dan terakhir penarikan kesimpulan (conclusion drawing). Penelitian ini menyimpulkan bahwa: 1) Pemanfaatan harta waris bersama dengan cara gilir sawah ini dilakukan dengan cara bergilir berurut dari istri atau suami yang ditinggal selanjutnya ke anak pertama seterusnya dan tidak dimiliki seutuhnya hanya diambil manfaatnya saja. 2) Menurut hukum Islam, pemanfaatan harta waris bersama dengan cara gilir sawah boleh dilakukan karena adanya saling ridha dan sepakat di anatara para ahli waris.Kata Kunci: Pemanfaatan Harta Waris, Hukum Islam. Abstract : The problem in this study are: 1) How is the implementation of the use of shared inheritance by gilir sawah in the community of Kelam Tengah, Kaur, Bengkulu? 2) What is the view of Islamic law on the use of shared inheritance by gilir sawah in the people of Kelam Tengah, Kaur, Bengkulu Province? This type of research is a research that focuses on qualitative data from the field (field research). The data collection technique that the researcher uses is to combine non-participatory observation, in-depth interviews, and documentation. The technique used is data reduction (data reduction); data presentation (data display); and finally drawing conclusions (conclusion drawing). This study concludes that: 1) The use of joint inheritance by gilir sawah is carried out in a sequential manner from the wife or husband who is left behind to the first child onwards and is not fully owned, only the benefits are taken. 2) According to Islamic law, the use of joint inheritance by way of shifting fields may be carried out because of mutual pleasure and agreement between the heirs.Keywords: Utilization of Inheritance, Islamic Law.

Abstract

Protection of the rights of adopted children in the matter of property inheritance in the perspective of book of civil law and Islamic law. Adoption in civil law is an act which equalized adopted children with birth children, both in terms of caring and inheritance (Articles 11,12,13 and 14 of Stb. 1917 No. 129). In Islamic law, adoption will not result in a blood relationship and do not become the basis and cause of inheritance, because the basic principle of the heir is a blood relation. This article examines: 1. What is the legal position of adopted child in the matter of property inheritance in the perspective of book of civil law and Islamic law? 2.Which of the two legal systems that provide adequate protection for adopted child? This type of research is library research, with qualitative methods, and normative juridical approach. The result is; the legal position of adopted child for the right of inheritance in the Book of Civil Law has the same status as the heirs for an inheritance. But according Stb. 1917 No. 129, this provision provides that the limitation of the adopted child only becomes heir on the part that are not mentioned in the wills. Being in Islamic law, the position of adopted children can not be equated with birth children, they can not receive inheritance from the adoptive parents, and vice versa, but the children may receive the will treasure. In between the legal system, Islamic law provides adequate protection to the adopted children, because it has a child care institution.

Abstract

Abstrak Pembagian harta warisan berdasarkan hukum Kewarisan Islam merupakan suatu kewajiban yang harus dijalankan, karena ini merupakan suatu bentuk keimanan dan ketakwaan kepada Allah dan Rasul-Nya. Akan tetapi, pada kenyataannya ada masyarakat Bengkulu yang melakukan pembagian  warisan dengan menggunakan prinsip kekeluargaan dan kesepakatan bersama antara ahli waris, kemudian dibuatlah Akta nya di hadapan Notaris. Adapun rumusan masalah dalam Penelitian ini adalah : 1) Bagaimana pembagian harta warisan yang dilakukan oleh ahli waris berdasarkan akta yang dibuat dihadapan notaris?, 2) Bagaimana kedudukan akta pembagian warisan yang dibuat dihadapan notaris perspektif Sadd Adz-Dzari'ah?. Jenis penelitian ini adalah penelitian kepustakaan (library research). Teknik pengumpulan data menggunakan  Metode Dokumen (Documentation). Hasil kesimpulan menyatakan bahwa, 1) Ahli waris dalam membagi harta peninggalan tersebut tidak menggunakan sistem kewarisan Islam tetapi dibagi secara kekeluargaan yaitu dengan cara masing-masing pihak saling bermusyawarah mencari jalan keluar dari masalah kewarisan yang dihadapi. 2) Pelaksanaan pembagian warisan secara kekeluargaan, bukan dimaksudkan untuk menghindar dari furudhul muqaddarah (bagian yang sudah diatur jelas dalam nash),tetapi tidak lain demi kemaslahatan bagi semua ahli waris dan menghindari kemudharatan. Untuk mencegah terjadinya kemudharatan tersebut, maka dibuatlah Akta Pembagian Waris di hadapan notaris. Sehingga dalam perspektif sadd adz dzari’ah, kedudukan pembuatan akta pembagian waris hukumnya sunnah.Kata kunci : Warisan, Akta Notaris, Sadd Adz-Dzari’ah.AbstractThe distribution of inheritance based on Islamic inheritance law is an obligation that must be carried out, because this is a form of faith and piety to Allah and His Messenger. However, in fact there are Bengkulu people who do the distribution of inheritance using the principle of kinship and mutual agreement between heirs, then the Deed is made before the Notary. The formulation of the problem in this research are: 1) How is the distribution of inheritance made by the heirs based on the deed made before the notary perspective of Sadd Adz-Dzari'ah?, 2) What is the position of the inheritance distribution deed made before the notary perspective of Sadd Adz-Dzari’ah?. This type of research is library research. Data collection techniques using the Document Method. The conclusion states that, 1) The heirs in dividing the inheritance do not use the Islamic inheritance system but are divided in a family manner by means of each party discussing each other looking for a way out of the inheritance problem being faced. 2) The implementation of the distribution of inheritance in a family, not intended to avoid furudhul muqaddarah (the part that is clearly set out in the text), but is nothing but for the benefit of all heirs and avoid kemudharatan. To prevent this kemudharatan, then made the Deed of Inheritance before the notary public. Abstract

Perbedaan putusan Pengadilan Agama lebong dengan Pengadilan Tinggi Agama Bengkulu mengenai putusan nomor 0059/Pdt.G/2015/PA.Lbg tanggal 14 Maret 2016 tentang gugatan pembatalan perkawinan merupakan problem hukum yang patut untuk dianalisis. Oleh karena itu, penelitian ini bertujuan untuk mengetahui proses penyelesaian perkara banding di Pengadilan Tinggi Agama Bengkulu, dan mengetahui hal-hal yang menjadi pertimbangan hakim Pengadilan Tinggi Agama Bengkulu dalam memutus perkara pembatalan perkawinan Nomor 7/Pdt.G/2016/PTA.Bn. Jenis penelitian yang digunakan adalah yuridis normatif, menggunakan bahan hukum berupa data sekunder dan data primer. Metode yang digunakan adalah studi dokumen atau bahan pustaka. Kemudian dilakukan analisa secara yuridis kualitatif. Hasil penelitian menunjukkan bahwa pertimbangan majelis hakim Pengadilan Tinggi Agama Bengkulu dalam membatalkan putusan Pengadilan Agama Lebong dan mengabulkan gugatan pembatalan perkawinan yang dimintakan oleh Penggugat, berdasarkan fakta bahwa penggugat dan suami masih terikat secara sah menurut hokum perkawinan sebagai suami isteri. Namun ketika melangsungkan pernikaan dengan isteri kedua, suami melakukan pemalsuan identitas terhadap tergugat dan Kantor Urusan Agama mengaku yang bersangkutan berstatus duda dengan menunjukkan surat panggilan Pengadilan Agama Curup padahal putusan Pengadilan Agama Curup adalah menolak permohonan cerai suami terhadap penggugat.
