Abstract

Abstrak : Penelitian ini diadakan di KUA yang ada di Kabupaten Kaur dengan mengangkat permasalahan bagaimana pelaksanaan kursus calon pengantin yang dilakukan oleh KUA, dan sejauhmana keberhasilan pelaksanaan kursus calon pengantin dalam meminimalisir angka perceraian di Kabupaten Kaur serta bagaimana masyarakat Kabupaten Kaur memandang dalam pelaksanaan kursus calon pengantin sebagai syarat pernikahan dalam perspektif maslahah mursalah. Untuk menjawab permasalahan tersebut, penelitian yang digunakan yuridis empiris, dengan pendekatan Undang-Undang, dan pendekatan konseptual. Data didapat melalui pengamatan dan wawancara kepada kepala KUA, peserta Suscatin dan masyarakat, kemudian setelah data didapat dilakukan rekotruksi bahan dengan dianalisis secara yuridis kualitatif dengan metode deduktif dan induktif. Dari hasil penelitian menunjukan bahwa 1) Pelaksanaan kursus calon pengantin yang dilakukan oleh KUA di Kabupaten Kaur masih belum sesuai dengan Peraturan perundang undangan yang mengatur tentang suscatin, yaitu Peraturan Direktur Jendral Bimbingan Masyarakat Islam Departemen Agama Nomor DJ.II/491 Tahun 2009. 2) Keberhasilan pelaksanaan kursus calon penganti yang ada di KUA Kaur Utara, KUA Muara Sahung dan KUA Padang Guci Ulu, mulai terlihat dan dirasakan oleh masyarakatnya walaupun belum maksimal. 3) Pandangan masyarakat Kabupaten Kaur dalam pelaksanaan kursus calon pengantin sebagai syarat pernikahan dalam perspektif maslahah mursalah ada dua (2) pandangan Pertama, setuju dengan adanya kursus calon pengantin sebagai syarat perkawinan, Kedua, tidak setuju dengan kursus calon pengantin sebagai syarat perkawinan.Kata Kunci: Kursus Calon Pengantin, Perceraian dan Maslahah Mursalah Abstract : This research was conducted at the KUA in Kaur Regency by raising the issue of how the implementation of the prospective bride and groom course was carried out by the KUA, and how successful the implementation of the prospective bride and groom course was in minimizing the divorce rate in Kaur Regency and how the people of Kaur Regency viewed the implementation of the prospective bride and groom course. as a condition of marriage in the perspective of maslahah mursalah. To answer these problems, the research used juridical empirical, with a law approach, and a conceptual approach. The data were obtained through observations and interviews with the head of KUA, Suscatin participants and the community, then after the data was obtained, the material was reconstructed and analyzed qualitatively by using deductive and inductive methods. The results of the study show that 1) The implementation of the prospective bride and groom course conducted by the KUA in Kaur Regency is still not in accordance with the laws and regulations governing suscatin, namely the Regulation of the Director General of Islamic Community Guidance, Ministry of Religion Number DJ.II/491 of 2009. 2) The success of the implementation of the substitute candidate courses in North Kaur KUA, Muara Sahung KUA and Padang Guci Ulu KUA, is starting to be seen and felt by the community even though it is not optimal. 3) The views of the people of Kaur Regency in the implementation of the prospective bride and groom course as a condition of marriage in the perspective of maslahah mursalah there are two (2) views. First, they agree with the bride and groom course as a condition of marriage, Second, they do not agree with the prospective bride course as a condition of marriage. Keywords: Bride and Groom Course, Divorce and Maslahah Mursalah

Abstract

Marriage disputing that led to send a letter of divorce to the wife, so traditional authorities do mediation session for the peace of process, traditional  authorities seek to reconcile the husband and wife. When the peace can not be reached, so that the status  of husband and  wife officially divorced,  then  customs will hold treaty / agreement with a content that when the two sides will conduct a marriage with another person, a husband or wife will not demand to the authorities, the letter of the agreement signed on the stamp 6000 is known  by the traditional  authorities. There are three  issues  that must be studied in this thesis, namely: (1) How to solve the disputing processes conducted by the customary court ?, (2) How is the effectiveness of traditional  justice in reducing the number of divorce? (3) How is the legality of the customary verdict against divorce case ?. The purpose of this study was to determine how to resolve the dispute marriages customary justice, determine the  effectiveness of traditional  justice  in reducing the  divorce  rate  and  the  legality of the  decision Knowing customary in divorce  cases in the  district  of TanjungKemuning. In this  study,  using  field research, with  a qualitative descriptive research. To collect the data studied using interviews, literature  review and documentation. From these results it can be concluded that there  were  40 cases of disputes that separated in villages in district of tanjungkemuning as many as 24 cases successfully reconciled by traditional  authorities in the district of tanjungkemuning. The process is carried out emphasizes the nature  of kinship, not entailing excessive cost so the effective result that households back in harmony. The legality of the decision of customs that promote the agreement of both sides of husband and wife to the dispute are legal standing when tested with the theory of legal certainty of the decision does not have binding legal force because according to Law No. 1 of 74 Article 39, paragraph 1 says “Divorce can only be done  in courtroom after the court concerned to try and not managed to reconcile the two sides Similarly, the Islamic Law Compilation  (KHI) article 155 it is said that” “Divorce can only be done  in front of the Religious court after the Religious courts are tried and did not succeed to reconcile both sides.”

Abstract

Abstract: This Study examines the marriage arrangement as indicated by Islamic law and positive law in Indonesia. The exploration technique utilized is library research, which is a hunt of the writing identified with marriage arrangements. The methodology utilized is the syar'i approach, which is an Islamic lawful methodology and a juridical methodology, in particular a way to deal with the law, to be specific the Arrangement of Islamic Law, KUHPerdata, Law Number 1 of 1974 concerning Marriage. The consequence of the examination is that the marriage understanding in Islamic law is completed by focusing on the arrangements of the syara which are then remembered for the Islamic Law Accumulation. Marriage arrangements in certain law in Indonesia are taken from the Common Code and Law Number 1 of 1974 concerning Marriage.Keywords: Husband, wife, marriage agreement, Islamic law, positive law in Indonesia Abstrak: Penelitian tersebut membahas tentang perjanjian perkawinan menurut hukum Islam dan hukum Positif di Indonesia.  Metode penelitian yang digunakan yaitu library research yaitu penelusuran terhadap literatur-literatur yang berhubungan dengan perjanjian perkawinan.  Pendekatan yang digunakan yaitu pendekatan syar’i merupakan pendekatan hukum Islam dan pendekatan yuridis yaitu pendekatan terhadap Undang-undang yaitu Kompilasi Hukum Islam, KUHPerdata, Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan.  Hasil penelitian yaitu perjanjian perkawinan dalam hukum Islam dilakukan dengan memperhatikan ketentuan-ketentuan syara yang kemudian dimasukkan di dalam Kompilasi Hukum Islam.  Perjanjian perkawinan dalam hukum positif di Indonesia diambil dari KUHPerdata dan Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan. Kata Kunci: Suami, istri, Perjanjian perkawinan, hukum Islam, hukum positif di Indonesia

Abstract

This study discusses the implementation of the determination of Integrated  Marriage of The formulation of this re- search  are: Firstly, how is the society’s response to the enactment of Government Regulation  No. 19 of 2015  on Non-Tax  State Revenue in the Ministry of Religious Affairs? Second, what factors cause  the community to carry out marriage  in the Central Marriage on KUA Kecamatan Ratu Agung?The  type of this research  is descriptive research  with sociological juridical approach. Data collection using interview technique, observation, documentation. This study concludes  that: Firstly, the public welcomes a positive response to the enactment of Government Regulation No. 19 of 2015. The regulation is considered as the government’s new breakthrough to discipline the marriage  cost so as to minimize illegal levies. In addition, people  with limited economic abil- ity who want to get married  is greatly helped  by the existence  of this provision.  If previously the cost of marriage  is felt by them is quite high, with this provision they can perform the marriage  for free with the condition must be implemented in the Office of Religious Affairs and at work hours. Of course this gets a positive response from the community, because it is very helpful espe- cially for the middle to lower society. Secondly,  the factors that cause the community to carry out marriage  in the marriage  hall at the Office of Religious Affairs of Ratu Agung District are economic factors and work permits. In general, informants  stated that getting married  in the Office of Religious Affairs without cost so as to ease the financial burden. Abstract

Abstrak: Rumusan masalah penelitian ini adalah: 1) Bagaimana urgensi melakukan pemeriksaan kesehatan bagi calon pengantin dan pelaksanaan pemeriksaan kesehatan bagi calon pengantin Studi di Kabupaten Bengkulu Tengah? 2) Bagaimana pemeriksaan kesehatan bagi calon pengantin perspektif maqashid syari’ah Studi di Kabupaten Bengkulu Tengah Jenis Penelitian adalah penelitian lapangan (field reseacrh). Pengumpulan data menggunakan teknik observasi, wawancara dan dokumentasi yang di analisa berdasarkan dengan membaca dan mengutip informasi. Penelitian ini menyimpulkan bahwa: 1) Urgensi diperlukannya pemeriksaaan kesehatan ini untuk menjamin kesehatan calon pengantin, di bengkulu tengah dengan banyaknya kasus bayi dengan gizi buruk 37 orang, kasus stunting berjumlah 7,57%  dan HIV/AIDS sekitar 4-10 orang pada tahun 2021-2022. Pelaksanaan pemeriksaannya meliputi pemeriksaan fisik (berat badan, cek tinggi badan dan tekanan darah), mengisi kuisioner tentang kejiwaan, cek golongan darah, gula darah, pemeriksaan penyakit hepatitis, HIV/AIDS, sifilis, dan vaksin imunisasi TT (tetanus teksoid) bagi calon pengantin perempuan serta skrining, pemeriksaan laboratoium menggunakan sampel darah, urine atau jaringan tubuh, konseling pengobatan dan rujukan bila perlu. 2) Pemeriksaan kesehatan bagi calon pengantin perspektif maqashid syari’ah dalam pelakasanaannya tidak ada kemudharotan dan lebih banyak manfaatnya, perbuatan ini termasuk dalam tingkatan hajiyat yang merupakan kebutuhan sekunder yang berguna sebagai pemeliharan menjaga jiwa (hifzh nafs) dan menjaga keturunan (hifzh nasl).Kata kunci: Kata Kunci: Pemeriksaan Kesehatan, Calon Pengantin, Maqashid Syari’ah. Abstract: The formulation of the research problem is: 1) What is the urgency of conducting health checks for prospective brides and conducting health checks for prospective brides. Study in Central Bengkulu Regency? 2) How is the health check for prospective brides from the maqashid shari'ah perspective. Study in Central Bengkulu Regency. The type of research is field research. Data collection uses observation, interview and documentation techniques which are analyzed based on reading and citing information. This study concludes that: 1) The urgency of the need for this health check to ensure the health of the prospective bride and groom, in Bengkulu Tengah with 37 cases of malnourished infants, 7.57% of stunting cases and 4-10 HIV/AIDS cases in 2021 -2022. The examination includes a physical examination (weight, height and blood pressure check), filling out psychological questionnaires, checking blood group, blood sugar, checking for hepatitis, HIV/AIDS, syphilis, and TT immunization vaccine (tetanus textoid) for the bride and groom. women as well as screening, laboratory examination using blood, urine or body tissue samples, treatment counseling and referrals if necessary. 2) Health checks for prospective brides from a maqashid shari'ah perspective in its implementation there are no disadvantages and more benefits, this act is included in the hajiyat level which is a secondary need that is useful as maintenance of the soul (hifzh nafs) and guarding offspring (hifzh nasl).Keywords: Keywords: Health Checkup, Bride and Groom, Maqashid Syari'ah.

Abstract

Pada penelitian ini terdapat beberapa masalah pertama, Bagaimanakonstruksi penetapan sanksi Adat bagi pelaku zina yang hamil menurut hukum Islam di Kabupaten Rejang Lebong. Kedua, Bagaimana Pelaksanaan sanksi Adat bagi pelaku hamil di Kabupaten Rejang Lebong. Ketiga, Bagaimana presfektif hukum Islam terhadap sanksi adat bagi pelaku hamil diluar nikah di Kabupaten Rejang Lebong. Metoda yang digunakan dalam penelitian ini adalah field research (penelitian lapangan) dimana data-data telah dikumpulkan melalui wawancara, observasi, dan dokumentasi. Hasil penelitian ini menunjukan bahwa sanksi yang dilakukan oleh ketua adat/kutei di Kabupaten Rejang Lebong sebagai berikut: Pertama, Pelaku zina cuci kampung. Kedua, Pelaku zina didenda kutei 6 Real s/d 12 Real. Ketiga, siri sesagen berbuah. Keempat, Pelaku zina dipukul dengan 100 lidi. Kelima, tepung setawar. Dalam perspektif hukum Islam terhadap sanksi adat di Kabupaten Rejang Lebong bahwa pertama, Belum masuk dalam hukum Islam bertentangan dengan hukum Islam. Kedua, sanksi keduri menyampaikan keleluhur harus dihilangkan dan didihapus. Ketiga, sanksi hanya diberlakukan dengan cuci kampung. Keempat, Sanksi yang dalam Islam dirajam/didera 100 kali, sedangkan hukum adat adanya makna filosofinya hanya dipukul sebanyak 100 lidi dengan pukulan 18 kali. Kelima, kemaslahatan dan kemanfaatannya diberlakukan sanksinya tidak ada, karena tidak ada efek jera.

Abstract

The  formulation  of  this  study  is:  First,  how  the  position   of  religious leaders in the community of Tebat Village Monok? Secondly,  what is the efforts of religious leaders  in the cultivation  of religious values at the wedding  party (Walimah al-’Ursy) in Tebat  Monok village Kepahiang district? This type of research  is descriptive  research  with sociological juridical ap- proach.Data collection  uses interviews,  observations and  documentation. This research  concludes  that:  First, the position  of religious leaders  in the Village  Tebat   Monok  Kepahiang  District  is  a  leader   of  religious  worship activities, train people  in religious practice  and  become a community advisor..  Secondly,  the efforts made  by religious leaders  in Tebat  Monok Village are: Establish a da’wah  approach by giving an enlightenment to the public on various occasions  such as in a lecture or gather- ing of citizens on how to implement  walimahan by paying close attention to the aspects  of religious teaching,  using a personal approach to Community by giving advice and  feedback  about  how it should  be done  so that the party is not redundant, does not cause  vice and benefit to the people  but still has the meaning for those who wish

Abstract

ABSRAKPenelitian ini bertujuan untuk mengetahui status talak menurut fikih dan ketentuan hukum nasional dan bagaimana cara mengharmonisasikan antara ketentuan fikih dan hukum nasional. Adapun hasil penelitian ini adalah secara aturan hukum Islam dan fikih dijelaskan bahwa selama rukun dan syarat perceraian terpenuhi, dimanapun dan kapanpun ketika suami mengucapakan talak maka cerai tersebut jatuh dan sah. Namun dalam aturan hukum nasional sebagaimana disebutkan dalam pasal 38 ayat (1) Undang-Undang Nomor 1 tahun 1974 dan pasal 115 Kompilasi Hukum Islam yang intinya perceraian itu dianggap sah dan jatuh jika diucapkan di depan sidang pengadilan. Maka untuk kehati-hatian agar aturan agama tidak dilanggar, hakim harus menggali dalam fakta-fakta di persidangan sudah berapa kali sang suami pernah mengucapkan talak. Jika sang suami pernah mengucapkan talak satu maka putusannya adalah memberikan izin menjatuhkan talak raji’, jika talak dua maka putusannya memberikan izin menjatuhkan talak bain kubra dan jika talak tiga maka putusannya memberikan izin menjatuhkan talak bain kubra. Seperti itu nampaknya solusi terbaik agar aturan agama tidak bertentangan dengan atura nasional.Kata Kunci: Status Talak, Hukum Islam dan Hukum Nasional ABSRACTThis study aims to determine the status of talak according to fiqh and the provisions of national law and how to harmonize the provisions of fiqh and national law. As for the results of this research are that according to the rules of Islamic law and jurisprudence, it is explained that as long as the terms and conditions of divorce are met, wherever and whenever the husband says divorce, the divorce falls and is legal. However, in the national law as stated in article 38 paragrafh (1) of law number 1 of 1974 and article 115 of the Compilation of Islamic Law, the point is that divorce is considered valid and falls if it is pronounced in front of a court session. So to be careful so that religious rules are not violated, the judge must dig into the facts in court how many times the husband had pronounced divorce. If the husband has ever said divorce one then the verdict is to give permission to drop talak raji ', if talaq is two then the verdict gives permission to drop talak bain kubra and if divorce is three then the verdict gives permission to drop talak bain kubra. Like that, it seems the best solution so that religious regulations do not conflict with national rules.Keywords: Divorce Status, Islamic Law and National Law

Abstract

Sanctions Against The Polygamist Without Permission Of Religious Courts In The Perspective Of Book Of Criminal Law Based On Islamic Law. This study raised the issue of people who marry without permission polygamist Islamic Court may be sanctioned in accordance with Article 55 of the Criminal Code and the Islamic legal review of legal sanctions those who marry without permission polygamist Islamic Court under Article 55 of the Criminal Code. The purpose of this study was to determine the polygamists who marry without the permission of the Religious Court may be sanctioned in accordance with Article 55 of the Criminal Code and to know the Islamic legal review of legal sanctions those who marry without permission polygamist Islamic Court under Article 55 of the Criminal Code. This research uses normative juridical method, with the primary law legal materials and secondary law, after law materials collected and then selected and refined by considerations of reliability (honesty) and validity (validity) and then analyzed by juridical qualitative deductive method. From the results of the study showed that people who marry without permission polygamist religious court essentially can not be subject to criminal sanctions under Article 55 of the Criminal Code before the polygamist gets criminal sanctions first. When polygamist has gained criminal sanctions, then the people who marry polygamist can be penalized inclusion as contained in Articles 55 and 57 of the Criminal Code. While the law sanctions those who marry without permission polygamist religious courts in the review of Islamic law no difference is no difference polygamists and people who marry polygamist gets the same punishment between direct actors and indirect actors, for he has done each of these makers including jarimah ta’zir and punishment also sentenced ta’zir. While Personality ‘jarimah ta’zir not separate between one and the other ta’zir jarimah.

Hal ini disebabkan oleh masih adanya yang menyalahkan gunakan perkawinan dengan menodai makna dan tujuan dari perkawinan itu sendiri dengan melakukan zina atau berhubungan seks di luar nikah yang berakibat rusaknya sebuah perkawinan sehingga menimbulkan permasalahan yang mana di sebut perkawinan wanita hamil di luar nikah kemudian dapat menimbulkan permasalahan baru yaitu dengan status anak mereka yang dapat menimbulkan perselisihan dalam lingkungan masyarakat pada umumnya ataupun para ahli hukum mengenai status anak tersebut sah atau tidak sahnya perkawinan tersebut dilaksanakan, khususnya yang berkaitan dengan perwalian.  Hasil kajian menunjukkan bahwa meskipun MK telah memutuskan hubungan perdata antara anak zina dengan ayah biologisnya, namun masalah perwaliannya dalam pernikahan anak zina tidak secara tegas disebutkan dalam pernikahan tersebut. Dengan demikian anak zina sejalan dengan hukum nasional Indonesia selama ini (Pasal 43 ayat (1) UU No. 1 Tahun 1974), tidak memiliki hak dari ayahnya. Karena anak zina hanya memiliki hubungan dengan ibunya, maka dari ayah biologisnya anak tersebut tidak memiliki hak apapun yang bisa diperolehnya, karena secara hukum baik hukum agama maupun hukum nasional dia tidak memiliki pertalian darah (nasab) dengan laki-laki yang merupakan ayah biologisnya. Dari sinilah anak zina tidak memperoleh hak-hak materil dan moril dari ayahnya, seperti hak pemeliharaan, hak nafkah, hak perwalian nikah bagi anak perempuan dan hak saling mewarisi. Kata kunci : status perwalian, anak zina, KHI dan UU Nomor 1 Tahun 1974  AbstrackThis research is motivated by the recent rise of children born out of wedlock or adultery. This is due to the fact that there are still those who blame the use of marriage by tarnishing the meaning and purpose of marriage itself by committing adultery or having sex outside of marriage which results in damage to a marriage causing problems which are called marriage of pregnant women out of wedlock which can then cause problems. new, namely the status of their child which can cause disputes in the community in general or legal experts regarding the status of the child whether the marriage is valid or not valid, especially in relation to guardianship. The results of the study show that although the Constitutional Court has severed the civil relationship between the adulterous child and the biological father, the issue of guardianship in the marriage of an adulterous child was not explicitly stated in the marriage. Thus, adultery children in line with Indonesian national law so far (Article 43 paragraph (1) Law No.1 of 1974), do not have rights from their father. Because an adulterous child only has a relationship with his mother, from his biological father the child does not have any rights that can be obtained, because legally, both religious law and national law, he does not have blood ties (nasab) with a male who is his biological father.
