Abstract

This study raises  the  issue  of judgment KUA officials Segara  bay towards young marriage and  Maqasid  Syariah perspective to judgment KUA officials against young marriage. The purpose of this research is to know. This type of research that is used  in preparing this thesis  is qualitative  data  collection techniques of observation, interviews  and documentation, obtained through  informant interviews  at KUA officials and  local community leaders. After the data  obtained qualitatively analyzed by means of: data reduction (data reduction), presentation of data (data display), and draw conclusions (verification). The results showed that the Gulf KUA officials Segara judgment against young marriage that essentially  passive KUA not pick up the ball means KUA only receives and selects the terms  proposed by the prospective bridegroom and bride age if found lacking as has  been required by the Act No. 1 In 1974, the Syariah perspective Maqasid  Overview  judgment KUA officials against young age of marriage is correct because Islam maintain the benefit of the family in particular and society in general. This is in accordance with the rules of fiqh “Maslahah  Muarsalah” ie assuming that this law is just a tool that the end goal is to create a benefit for mankind. Given madaratnya arising from a young age marriage was a very big influence on domestic and social life, the government reserves the right to make the minimum marriage age limit requirement as stipulated in Law No. marriage 1 of 1974 Article 7 paragraph (1) and KHI Article 15 paragraph (1).

Abstract

Abstrak : Di Indonesia mediasi non litigasi (Alternative Dispute Resolution) telah diatur dalam pasal 1 ayat 10 Undang-undang nomor 30 tahun 1999. Prinsip win-win solution masih menjadi magnet utama masyarakat Indonesia memilih penyelesaian jalur non litigasi. Seperti halnya di kecamatan Moutong,yang mana sebagian besar masyarakatnya beragama Islam dan lebih memilih menyelesaikan sengketa kewarisannya melalui jalur mediasi non litigasi. Artikel ini mencoba menelusuri faktor-faktor yang melatarbelakangi alasan masyarakat Moutong memilih menyelesaikan sengketa mereka di Kantor Kecamatan, serta bagaimana proses dan mekanisme penyelesaiannya, dan bagaimana kekuatan hukumnya. Dengan menggunakan penelitian kualitatif, tulisan ini mencoba mendeskripsikan upaya mediasi non litigasi terhadap sengketa waris Islam di kecamatan Moutong, yang subyek penelitiannya merupakan pejabat kecamatan yang berperan sebagai mediator dalam sengketa waris Islam. Hasil penelitian menunjukkan bahwa faktor ekonomi dan geografis merupakan faktor terbesar yang menjadi pertimbangan masyarakat kecamatan Moutong lebih memilih menyelesaikan sengketanya dengan jalur non litigasi. Adapun sengketa waris Islam di kecamatan Moutong memiliki mekanisme tertentu yang harus ditempuh para pihak, kemudian dalam prosesnya mediator pada umumnya berpedoman pada Kompilasi Hukum Islam. Jika diperlukan, mediator setempat juga dibantu oleh praktisi hukum seperti jaksa atau kuasa hukum. Setelah proses perdamaian, kedua pihak mendapatkan Berita Acara Kesepakatan yang mengikat secara hukum dan surat wajib pajak (jika diperlukan).Kata Kunci: Mediasi non litigasi, Pembagian Harta Warisan, Kecamatan Moutong. Abstract: In Indonesia, non-litigation mediation (Alternative Dispute Resolution) has been regulated in article 1 paragraph 10 of Law number 30 of 1999. The principle of win-win solutions is still the main magnet for Indonesians to choose non-litigation solutions. Such is the case in Moutong sub-district, where most of the people are Muslim and prefer to resolve inheritance disputes through non-litigation mediation. This article tries to explore the factors behind the reasons for the Moutong community to choose to resolve their disputes at the District Office, as well as how the process and resolution mechanism are, and what is the legal force. By using qualitative research, this paper attempts to describe non-litigation mediation efforts on Islamic inheritance disputes in Moutong sub-district, where research subjects are sub-district officials who act as mediators in Islamic inheritance disputes. The results showed that economic and geographical factors were the biggest factors that were considered by the people of Moutong sub-district who preferred to settle their disputes by means of non-litigation. The Islamic inheritance dispute in Moutong sub-district has a certain mechanism that must be followed by the parties, then in the process the mediator generally refers to the Compilation of Islamic Law. If needed, the local mediator is also assisted by a legal practitioner such as a prosecutor or attorney. After the agreement process, both parties receive a legally binding Minutes of Agreement and a tax document (if required).Keywords: Non-litigation Mediation, Distribution of Inheritance, District Moutong.

Abstract

Penelitian ini dilatarbelangi dengan adanya berbagai masalah yang dihadapi di dalam keluarga yang dapat mengancam keharmonisan rumah tangga bahkan bisa berujung pada perceraian dan salah satu solusinya adalah konsultasi kepada Lembaga Konsultasi Kesejahteraan Keluarga (LK3) Mitra Sejahtera sebagai langkah preventif. Hasil penelitian menunjukkan bahwa: (1) Pelaksanaan pelayanan terhadap klien melalui dua tahap, (a) perekrutan klien yang meliputi klien datang sendiri dan jemput bola, dan (b) penanganan klien yang meliputi konseling, home visit, pemberdayaan serta rujukan. (2) Peran LK3 Mitra Sejahtera dalam pemberdayaan, meliputi sebagai pendamping klien sebelum dan setelah kegiatan pemberdayaan, sebagai fasilitator dari dinas sosial kepada klien, sebagai konsultan klien dalam membantu menentukan kuputusan, sebagai perlindungan sosial yaitu sebagai pelindung klien dari segala ancaman yang bisa saja menimpa klien. Sedangkan Peran LK3 Mitra Sejahtera dalam Pencegahan, yaitu mencegah klien agar persoalan keluarga tidak berujung pada perceraian dengan memberikan solusi-solusi yang berbeda sesuai dengan persoalan-persoalan keluarga yang kompleks. (3) Faktor pendukung LK3 Mitra Sejahtera dalam menjalankan perannya yaitu Komitmen/panggilan hati, dukungan keluarga, dan dukungan mitra lembaga dan dinas terkait. Faktor penghambat yaitu kurang keterbukaan klien dan dana yang terbatas.

Abstract

This study concludes  that: 1) maturity according  to Islamic law is marriage  done within the boundary of a person  has entered the baligh phase. Married adults are an attempt  to minimize the problems that make the concept  of sakinah,  mawaddah and rahmah households will not be achieved. Households need to be built on the basis of maturity so as to cause psychological maturity of each  partner  either husband or wife. This maturity will generate thoughts,  attitudes  and  behaviors that also mature in the household. Islamic Shari’a wants people  who want to marry is really people  who are ready mentally, physically and psy- chologically, mature  and  understand the meaning of a marriage  that is part of worship.  2) married  maturity  according  to Law No. 1 of 1974  is enacted in order  to provide  protection, justice and  safeguard the human side of Indonesian society. Married maturity  in Law No. 1 of 1974  aims to prevent  the occurrence of marriage  of children,  so that young  men  who become hus- band  and wife really have matured the soul of his body in forming a happy  and eternal family. Abstract

Abstrak : Tujuan penelitian ini adalah untuk menganalisis: Pertama, hubungan kerja antara Pemerintah Daerah Kabupaten Seluma dengan Kementerian Agama Kabupaten Seluma dalam. penyelenggaraan haji Kedua,faktor yang mempengaruhi hubungan kerja dalam. penyelenggaraan ibadah haji di Kabupaten Seluma. Jenis penelitian ini adalah penelitian kualitatif .Pengumpulan data menggunakan teknik wawancara, observasi dan dokumentasi. Teknik analisa data menggunakan reduksi data, display data dan penarikan kesimpulan. Penelitian ini menyimpulkan bahwa : Pertama, hubungan kerja antara Pemerintah Kabupaten Seluma dan Kementerian Agama Kabupaten Seluma telah terjalin dengan baik. Hubungan kerja menunjukan bahwa ada peran penting bagi Pemerintah Daerah dan Kementerian Agama dalam mensukseskan penyelenggaraan haji di Kabupaten Seluma. Pihak-pihak tersebut bertanggung jawab terhadap pelaksanaan penyelenggaraan haji sesuai dengan bidang tugasnya. Kementerian Agama Kabupaten Seluma berperan penting dalam soal pembinaan umat, pendidikan dan sosialisasi dalam hajinya. Kedua, faktor yang mempengaruhi hubungan kerjaantara Pemerintah Kabupaten Seluma dan Kementerian Agama Kabupaten Seluma dalam penyelenggaraan haji adalah Pertma, factor Pendukung yaitu minat masyarakat Kabupaten Seluma yang tinggi untuk dapat menunaikan ibadah haji, pengetahuan masyarakat tentang kedudukan haji dalam Islam, kemampuan masyarakat secara ekonomi, adanya sinergi antara pemerintah kabupaten dan pihak Kemenagalam pengelolaan haji. Kedua, faktor Penghambat yaitu wilayah Kabupaten Seluma yang luas hingga ke daerah pedalaman sehingga menyulitkan pelaksanaan sosialisasi dan pembinaan manasik kepada jamaah calon haji, masih kurangnya tenaga khusus yang mengelola pendaftaran haji secara on-line dan terbatasnya jaringan internet di Kabupaten Seluma.Kata Kunci : UU Nomor 13 tahun 2008, Hubungan Kerja, Penyelenggaraan Haji Abstract: The purpose of this study was to analyze: First, the working relationship between the Regional Government of Seluma District and the Ministry of Religion of Seluma District in organizing the Hajj. Second, the factors that influence the working relationship in the implementation of the pilgrimage in Seluma District. This type of research is qualitative research. Data collection uses interview, observation and documentation techniques. Data analysis techniques use data reduction, data display and conclusion drawing.This study concludes that: First, the working relationship between the District Government of Seluma and the Ministry of Religious Affairs of Seluma Regency has been well established. Working relationships indicate that there is an important role for the Regional Government and the Ministry of Religious Affairs in succeeding the implementation of Hajj in Seluma District. The parties are responsible for the implementation of Hajj in accordance with their field of duty. Ministry of Religious Affairs Seluma District plays an important role in the matter of fostering the people, education and socialization in hajinya. Second, the factors that affect the working relationship between the Government of Seluma District and the Ministry of Religious Affairs of Seluma Regency in performing the Hajj are: First, Supporting factor is the interest of the people of Seluma Regency who are high to be able to perform the pilgrimage, the knowledge of the society about the position of Hajj in Islam, the ability of the society economically, the synergy between the district government and the Ministry of Religious Affairs in the management of Hajj. Secondly, the inhibiting factor is the wide area of Seluma Regency up to the hinterland, making it difficult for the implementation of socialization and guidance of the pilgrims to pilgrims, still lack of specialized personnel who administer on-line hajj registration and limited internet network in Seluma District.Keywords: Law Number 13 of 2008, Employment Relations, Implementation of Hajj

Abstract

Using of Contraception to Delay Pregnancy for Newlyweds in Islamic Law Review (Case Study in District of Selebar, Bengkulu City). This study raises the issue of the factors that cause the delay of pregnancy for newlyweds and legal substitute delay pregnancy for newlyweds in the district of Selebar, Bengkulu by using contraceptives according to maqasid sharia. The purpose of this study was to determine the factors that cause a delay of pregnancy for newlyweds and to determine the legal of delaying pregnancy for newlyweds in the district of Selebar, Bengkulu by using contraceptives according to maqasid Sharia. This study used qualitative methods, the data collection techniques used were observation, interviews and documentation, then after the data obtained were analyzed by deduction methodes, data presentation and conclusion. From the results of the study showed that the factors that cause delay pregnancy for a newlyweds in District of Selebar, Bengkulu city, are; economic factors, because the newlyweds cople still want to pursue a career, as well as a joint agreement between the husband and wife of not willing to have a children yet, while the use of contraceptives according to maqasid sharia to delay the pregnancy due to economic reasons and feared that the parents can not give education to the children, then it is permissible in Islam, but delaying the pregnancy by using contraception for reasons cople still want to pursue a career until his career reached the peak, then it is forbidden in Islam. However, Islam does not forbid totally the use of contraception but it has to be specific reasons, and acceptable.

Abstract

Abstrak Berlakunya Undang-undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan membawa perubahan dalam sistem Peradilan Tata Usaha Negara di Indonesia. Salah satu perubahan tersebut berkaitan dengan upaya administratif. Upaya administratif merupakan penerapan atau implementasi dari negara hukum Pancasila. Negara hukum Pancasila menitiberatkan pada asas gotong royong, yang mana asas gotong royong diderivasi melalui asas kerukunan dan musyawarah. Sehingga upaya administratif merupakan penerapan dari asas kerukunan dan musyawarah, yang menganggap bahwa peradilan merupakan sarana terakhir (ultimum remedium) untuk menyelesaikan masalah. Penelitian ini mencoba untuk menganalisa konsep mengenai upaya administratif dan penerapannya di pengadilan. Isu hukum dalam penelitian ini pertama apakah upaya administratif harus ditempuh terlebih dahulu sebelum mengajukan gugatan sengketa tata usaha negara ke Pengadilan Tata Usaha Negara, kedua apakah keputusan tata usaha negara awal atau keputusan upaya administratif yang dijadikan obyek sengketa apabila mengajukan gugatan di Peradilan Tata Usaha Negara, ketiga bagaimana tenggang waktu mengajukan Gugatan di Peradilan Tata Usaha Negara setelah adanya Upaya Administratif. Diharapkan dari penelitian ini didapatkan formulasi norma yang dapat memberikan perlindungan bagi rakyat khususnya dalam hal sengketa Tata Usaha Negara.Kata Kunci : Upaya Administratif, Pengadilan Tata Usaha Negara, Sengketa Administrasi                       Pemerintahan. AbstractEnacted of Act Number 30 of 2014 on Government Administration leads the change of administrative court system in Indonesia. One of these change related to administrative effort. Administrative effort was application or implementation of Pancasila legal state. Pancasila legal state focus on the principle of mutual cooperation (gotong royong), which the mutual cooperation derived from harmony and deliberation. Thus administrative effort was aplication of harmony and deliberation principles, thought that judicial is the last effort to solve the problem. This research try to analyze the concept of administrative effort and it implementation at the court.  Legal issues in this research is: first, do administrative effort must be taken before sues to administrative court; and second, whether original administrative decision or edministrative effort decision that used as an dispute object when apply a administrative lawsuit to administrative court. Expected of this research can be found a norm that can be provides legal protection for the people especially in administrative dispute.Keywords : Administrative Efforts, State Administrative Courts, Decisions.

Abstract

Penelitian ini mengangkat permasalahan dasar Yuridis Hakim Pengadilan  Agama Arga Makmur  memutuskan pembatalan perkawinan karena kawin paksa dan analisis perspektif hukum Islam terhadap putusan Pembatalan Perkawinan karena  alasan kawin paksa. Adapun yang menjadi tujuan dalam penelitian ini adalah untuk mengetahui dasar Yuridis Hakim Pengadilan  Agama Arga Makmur  memutuskan pembatalan perkawinan karena kawin paksa dan analisis perspektif hukum Islam terhadap putusan Pembatalan Perkawinan karena  alasan kawin paksa. Penelitian ini menggunakan metode penelitian lapangan (Field Research) dan penelitian kepustakaan (Library Research), yang bersifat deskriptif  analitik. Data didapat melalui wawancara kepada informan hakim dengan mengunakan wawancara mendalam dan dokumentasi, kemudian dianalisis secara kualitatif.  Dari hasil penelitian menunjukkan bahwa aspek yuridis dan pertimbangan serta dasar hukum Pengadilan Agama Arga Makmur tentang perkara pembatalan perkawinan karena kawin paksa, yakni Undang- Undang 1 Tahun 1974 tentang perkawinan, dan Kompilasi Hukum Islam Pasal 71 huruf  (f)  yang  menyatakan,  “Suatu  perkawinan  dapat  dibatalkan  apabila Perkawinan  yang  dilaksanakan  dengan  paksaan”,  dan  Undang-Undang  1 Tahun 1974 tentang perkawinan pasal 27 ayat 1 yakni “Seorang suami atau istri dapat mengajukan permohonan pembatalan perkawinan apabila perkawinan dilangsungkan dibawah ancaman yang melanggar hukum”. kemudian Kawin paksa dalam hukum Islam tidak dibenarkan  hal ini dapat di lihat dari dalil nash baik dalam al-Qur’an maupun hadits, dan  ijma’ ulama. Rasulullah menetapkan suatu ketetapan hukum tentang keberadaan hak seorang wanita dalam menentukan pasangan hidupnya, serta membatalkan hukum suatu perkawinan yang dilandasi oleh pemaksaan dan keterpaksaan meskipun yang memaksa dalam hal ini adalah seorang ayah.  Abu Hanifah dan para pengikutnya menetapkan: ayah tidak boleh memaksa anak  putri yang sudah dewasa untuk menikah dengan seseorang, ayah atau wali wajib merundingkan masalah perkawinan itu dengan anak putrinya, kalau putrinya itu mau maka akad nikanya sah, tetapai kalau putrinya tidak mau maka tidak sah akad nikah itu.

Abstract

Division of joint post-divorce property  for a career wife (a study of the Bengkulu  Religious Court’s decision). There  are two problems in this research, namely,  how  the concept of sharing  of joint property  for the wife of a career in the event  of divorce,  and what  is the basis of judges  consideration of Bengkulu  Religious Court in deciding the case of sharing  of joint property  for the  wife  of a career. Descriptive  qualitative  research method, while  data  collection techniques are  documentation,  observation and  interview.  Data  sources include  primary  and  secondary data.  The informant of the  judges  of the  Bengkulu  Religious Court. Secondary data  of religious  court  ruling on the  distribution of common property.  The results  of this study explain  that the distribution of joint property  for wives whose career is not clearly regulated in the  Compilation  of Islamic  Law, therefore in the  case  of sharing  of joint property  for the  wife of a career, becomes the ijtihad area  of the judge  to see  the case  casuistically  by taking into account the contribution and role of each.  Respectively.  The basis of consideration of the judges  of the Bengkulu Religious Court in determining the distribution of joint property  for wives of post-divorce careers, has been in accordance with theories based on the judges’ good judgment, procedurally in accordance with applicable law, because in its judgment the judge  has taken legal norms  Appropriate  to the articles  in the legislation,  and  has  fulfilled the normative juridical aspects, sociological and philosophical, so that the realization  of legal certainty,  legal justice and legal benefits.  Consideration of the judges of the Bengkulu  Religious Court in deciding the case  of sharing  of joint property  for the wife of the career, the majority of the decision based on the provisions  of the Compilation  of Islamic Law, some judges to explore  other sources of law as required Article 5 paragraph (1) Law Number  48 Year 2009 on Judicial Power  And the principle  of ius novita novit, in deciding the matter of sharing  the property  with the judges  of the Bengkulu  Religious Court based on casuistry.

Abstract

 Abstrak: Rumusan masalah bagaimana pelaksanaan fungsi dan peran Sentra Pelayanan Kepolisian Terpadu berdasarkan Peraturan Kepala Kepolisian Republik Indonesia Nomor 22 Tahun 2010 di Kepolisian Sektor Ratu Samban di masa pandemi Covid -19. Kedua, faktor apa saja yang mempengaruhi  pelaksanaan fungsi dan peran Sentra Pelayanan Kepolisian Terpadu berdasarkan Peraturan Kepala Kepolisian Republik Indonesia Nomor 22 Tahun 2010 dalam memberikan pelayanan kepada masyarakat di masa pandemi Covid-19. Jenis penelitian ini adalah yuridis sosiologis. Penelitian ini menyimpulkan : pertama, sentra pelayanan terpadu Kepolisian Sektor Ratu Samban sesuai dengan Peraturan Kepala Kepolisian Republik Indonesia Nomor 22 tahun 2010 menjalankan fungsi antara lain pengkoordinasian dan pemberian bantuan serta pertolongan, antara lain penanganan tempat kejadian perkara meliputi tindakan pertama di tempat kejadian perkara dan pengolahan tempat kejadian perkara, pengaturan jalan dan pengawalan lalulintas, pelayanan melalui telepon, pesan singkat, faksimili, internet (jejaring sosial), dan surat. Penyajian informasi umum yang berkaitan dengan kepentingan masyarakat sesuai dengan ketentuan peraturan perundang-undangan.  Jenis layanan yang diberikan di adalah penanganan tempat kejadian perkara, pengaturan jalan dan pengawalan lalulintas dan pelayanan administrasi. Kedua, sentra pelayanan terpadu Polsek Ratu Samban berperan sebagai : pertama, instrumen penegakan hukum pendukung mencegah penyebaran penyakit dan instrument edukasi masyarakat. Ketiga, faktor yang mempengaruhi pelaksanaan fungsi dan peran sentra pelayanan kepolisian terpadu  Polsek Ratu Samban adalah pertama faktor pendukung fasilitas seperti gedung, kebersihan, kerapihan dan kenyamanan ruang, Aparat sopan dan menarik, tempat parkir luas. Faktor penghambat terdiri dari keterbatasan jumlah personil dan kekurangan fasilitas kerja.Kata kunci : Peraturan Kepala Kepolisian Republik Indonesia Nomor 22 Tahun 2010, Peran dan Fungsi  Abstract: The formulations how is the implementation of the functions and roles of the Integrated Police Service Center based on the Regulation of the Chief of Police of the Republic of Indonesia Number 22 of 2010 in the Ratu Samban Police Sector during the Covid-19 pandemic. Second, what factors affect the implementation of the function and role of the Integrated Police Service Center based on the Regulation of the Chief of the Indonesian National Police Number 22 of 2010 in providing services to the community during the Covid-19 pandemic. This type of research is juridical sociological. This study concludes: first, the integrated service center of the Ratu Samban Police Sector in accordance with the Regulation of the Chief of the Police of the Republic of Indonesia Number 22 of 2010 carries out functions, including coordinating and providing assistance and assistance, including handling the scene of the case including the first action at the scene of the case and processing crime scene, road management and traffic control, telephone service, short message, facsimile, internet (social networking), and mail. Presentation of general information related to the public interest in accordance with the provisions of the legislation. The types of services provided are handling of crime scenes, road management and traffic control and administrative services. Second, the integrated service center of the Ratu Samban Police acts as: first, a supporting law enforcement instrument to prevent the spread of disease and an instrument for public education. Third, the factors that influence the implementation of the function and role of the integrated police service center of the Ratu Samban Police are the first factors supporting facilities such as buildings, cleanliness, tidiness and comfort of space, polite and attractive officers, spacious parking lots.
