Abstract

Productive waqf is a new paradigm introduced in several regulations of endowment in Indonesia. This paradigm requires the management of waqf assets to be more productive, including “pesantren” as an institution that possesses numerous areas of waqf. This situation leads to various problems at pesantren institutions to implement the paradigm of productive waqf. The problems are related to the problems of public ownership to waqf asset, asset status, and legal persons of waqf especially in the sense of the competence and professionalism of nazhir at pesantren.

Abstract

This working paper discusses the need for human rights insight in the learning of Islamic religious education. The emergence of many violations of human rights values, such as the case of conflict among students, bullying disturbance, conflicts and violence, and so forth, is a shining example of powerlessness of an educational system in this country, specifically Islamic religious education. It is sure that there is something wrong in procedure and mechanism of religious education. After analyzing it in depth, author designed a systemic methodology of teaching of Islamic religious education with human rights insist.

Abstract

This working paper elaborates guarantee of Universal Declaration of Human Rights (DUHAM) and the Basic Constitution (UUD) 1945 on freedom of religion and its implementation in Indonesia, as well as how the Ahmadiyah, which is regarded as a religions heterodoxy, gets the freedom. Individual freedom to live make them do accordance with their will is guaranteed by Universal Declaration of Human Rights (DUHAM), including freedom of religion and belief. But in practice, especially in Indonesia, Ahmadiyah get many obstacles to practice their faith, particularly when doctrine (understanding) believed by a person or group does not accord with the given or old understanding. As a result, the freedom of religion is tied. In fact, human freedom is guaranteed by Universal Declaration of Human Rights (DUHAM).

Abstract

This paper describes the theory of punishment in Islamic education. Punishment in education is two sides of a coin that cannot be separated. Punishment is needed as implementation of regulations that are ejected to achieve the vision and mission of education. It should be a concern that punishment in education as a means of implementation of the learning process can provide the future success of students. In this case, the punishment is not contrary to human rights as long as intended for goodness.

Abstract

This paper analyzes the issue of human rights in the Islamic perspective and its relationship to education in Indonesia. That vision of Islam as mercy for universe can be seen from the universal values and the concern for the basic needs of every person who later becomes a part of human rights. Basic needs are basically in line with the thinking of international human rights which are declared as universal declaration of human rights. Fulfillment and protection of basic needs which are needed to ensure that all people get their rights properly.

Abstract

This article is summary of qualitative research in the perspective of gender which is conducted in 20 Islamic schools (madrasah) spread across the island of Java. The study focuses on issues of gender bias that occurs in primary and secondary education, especially those occur in the environment of Islamic school (Madrasah) as an educational institution that has Islamic characteristic. From critical analysis of the literatures and a result of field research, it proved that gender bias education resulted in disadvantage not only for women, but also men in the macro scale. While a just education in gender proved to have positive impact on every element of society. More specifically, it is known from field findings in this research that gender bias practices not only occur in the process of learning in the Islamic school sphere, but also in the source of learning routine activities of Islamic school (madrasah), extracurricular activities, even those related to small-scale policy in the level of educational unit.

Abstract

This paper discusses the freedom of obtaining information in Islam in the human rights perspective by examining critically act of number 39 of 1999. The law explains that in the dynamic growth of democracy country, freedom of getting information is a main thing. Therefore, involvement of the people to take part requires the presence of rules that creates an open environment system in order that what is to be every citizen's right is met. Law of number 39 of 1999 regulates in detail about freedom of information. The results of the analysis confirmed that implementation of law of number 39 of 1999 has not got optimal because itis not supported by humanist country climate.

Abstract

The purpose of this research is to determine the effects of the activities of communities, and factors that influence the success of ecosystem conservation of the critical lands in Imogiri. The research conducted through direct approach to the peasant community by inquiring their preference in the implementation of ecosystem conservation. The peasants’ preferences used to determine the factors influencing the community's interests in ecosystem conservation. This research employed quantitative method with Analytic Hierarchy Process (AHP) approach. The software used was Expert Choice Professional version 9.00 with Inconsistent Ratio (m)< 10%. Data collection was conducted using interview and structured-questionnaires. The result of the research shows that the major motivation of the community for carrying out conservation efforts was to increase their welfare. Moreover, environmental conservation was perceived as a basic human right that would, increase people's livelihood. In addition, people's participation was a strong factor that showed how the responsibility of ecosystem conservation was shared among the community. In this regard, the community has been an agent of change, who has changed the critical lands into the fertile lands that bring hope for the future generation.

Abstract

Step Real Counteract Communist Movement that contrast to Human Right through Education: A Critique Ideology. This discussion describes the emancipatory critical social theory of Jurgen Habermas anti-thesis to the ideology of Marxist-Leninist-Maoist-Communist Party. It Explained that the concept of rationalization of community development; emancipatory form of social interaction, has proceeded in a fear and balanced. Include: the rationalization of technical/job dimensions, rationalization of practice/dimensions of interaction or communication, and rationalization of the system/power dimension. By this, they can expand the technical mastery of the external world, capable of conditioning the situation of human communication that is free as well, and may set technical goals and practice themselves perfectly. This is the development of community/human to fit his (human), without getting stuck in ideology. While the Marxist-Leninist-Maoist-Communist Party, stuck into a one-sided rationalization, i.e. technical/instrumental action, so that people/humans evolved in shades of rational action aims/production (reification of self; mechanical, linear, scientific, and indoctrination (ideological), because there is no interaction and communication. His idea can be implemented through his educational concept. First, human beings should lead to the achievement of human beings capable of managing the world with shades of deep understanding (hermeneutics and Verstehen) the reality of his next life, as well as in dialogical relations system; equivalent, communicative, and egalitarian. Second, it must be supported by a curriculum that be able to nurture the potential of cognitive interests: technical, practice and emancipatory. Third, it must be realized by the method of learning with the theoretical and practical model.
