Abstract

Social justice in the Islamic economy is based on spiritual commitment and the concept of universal brotherhood among human beings which requires that all resources be sacred trust God, used to realize Maqashid Shari’ah, it is the fulfillment of human life. This paper describes the theory of social justice that focus on Islamic financial. The foundation of Islamic justice can be seen from al-Qur’an Surah al-Hadid: 25 affirming that justice has been emphasized by the Qur’an as the primary mission of the Prophets sent by God Almighty, including economic justice and the elimination of the income gap. Social justice in Islam is the implication of the fundamental principle underlying all the teachings of Islam, namely monotheism. At the level of practice, Islam prohibits usury, Islam seeks to build a society based on honesty and fairness. Justice in this context has two dimensions, namely the financiers are entitled to a reward, but should be commensurate with the risk and effort required, and the reward is determined by the profit. Implementation of Islamic justice theory in Islamic finance can be seen from mudharabah and Musharaka or commonly known as a profit and loss sharing.

Abstract

Gamping Sub-district using Islamic Law. Data used in this study were obtained from interview, observation, and documentation. The collected data were tested their validity using data source triangulation and analyzed using Miles and Huberman model. The conclusion of this study are: The reason of paddy field owners in Gamping Sub-district to choose profit sharing scheme compared to rental scheme or paying farm workers in managing their fields because they want to enjoy the yields gradually and do not want to be involved directly in managing the paddy field. The agreement of profit sharing in Gamping Sub-district in general is conducted orally, based on trust, without any witnesses. The term is not defined clearly. The profit sharing balance is set since the first time of agreement. The balance of profit sharing used in general is “maro” (½ part for sharecroppers and ½ part for owner) with all the production costs borne by the sharecroppers, and the yields are immediately halved. In the event of crop failure, it becomes the risk borne by the sharecroppers. The paddy land tax is paid by the owner. The crop yields reaching specific nisab or limit in general are not directly paid for the zakat. The implementation of profit sharing agreement for paddy fields in Gamping Sub-district is not fully in accordance with the Islamic law because there is no socialization from any parties related to the Islamic Law in agricultural cooperation, here is hereditary habit, the owners and sharecroppers do not want to use the red tape and complicated procedure, the owners have been good enough and fair with the common system used, and the sharecroppers accept the habit in force although they feel that it is hard and unfair.

Abstract

In the late 60s to early 70s, was born a consensus of Islamic law and economic experts who say that the interest in the banking system is part of usury, so the banks are not in accordance with the Islamic Shari’ah. As an alternative, the experts offer free banking model of the system of interest, with the concept of profit and loss sharing (PLS). However, the presence of Islamic banking bore the pros and cons among Muslim scholars. Among the leaders of the cons is Abdullah Saeed. This article discusses the thinking Abdullah Saeed who criticize the interpretation of usury and interest, the principle of PLS (mudarabah and loss), and the principle of sale (murabaha). The criticism is: (1) He said, usury is forbidden because of the exploitation of the poor, while the interest there is no element of exploitation so that interest is not included in the category of usury. (2) A number of requirements in practice only to protect banking PLS. So what happens is sharing the results, but do not share the risk. (3) Further Saeed see that Islamic banking is not better than conventional banking. Because in fact, the practice of Islamic banking also implement a “model of financial transactions such as interest” ie Murabaha. Murabaha profit are uncertain and affected by time, not much different from the concept of interest reproach.
