Abstract

Land dispute resolution through mediation is one of the alternative methods regulated in Article 44 Paragraph (5) of the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning the Handling and Settlement of Land Cases. This study aims to examine the legal strength of peace deeds produced through the mediation process at the Karawang Regency Land Office, as well as the effectiveness of its implementation in resolving land disputes. The method used is a normative juridical approach with reference to legal documents, legal doctrines, and interviews with relevant sources. The results of the study show that the peace deed has binding legal force equivalent to a court decision with permanent legal force, but its effectiveness in the field is still low due to factors such as lack of public understanding, the ego of the parties to the dispute, and the low level of attendance in the mediation process. To increase the success of mediation, it is recommended that BPN be more active in socialization, increase the capacity of mediators, and strengthen legal arrangements related to peace deeds so that they can be more reliable in the process of resolving land disputes.

Abstract

This research explores the implementation and impact of ASEAN Mutual Recognition Agreements (MRAs) in the context of the ASEAN Framework Agreement on Services (AFAS), focusing on the mobility of professional workers in the ASEAN region. This study proposes the implementation of MRA in the creative professions sector, especially the profession of dancers, which has not received adequate attention within the MRA framework. This study aims to analyze the effectiveness of the implementation of MRA in the engineering sector and identify the potential for adopting a similar model in the performing arts sector. Using a juridical normative approach, this study conducts a qualitative analysis with a comparative approach, comparing the application of MRAs in the engineering sector and creative professions. The results show that although MRAs have succeeded in increasing the mobility of professional workers in the engineering sector, their application to creative professions faces major challenges, such as the disharmony of qualification standards and non-uniform accreditation systems. This study suggests the need to develop a more inclusive legal framework and harmonize qualification standards to support the implementation of MRAs in the creative sector. The implication of this study is the strengthening of ASEAN economic and cultural integration through broader recognition of creative professions, which can enrich the region's cultural identity and enhance the competitiveness of the ASEAN creative economy globally.

Abstract

The decline in sales is one of the impacts of the Covid 19 pandemic on SME, and another impact is a decrease in production and a decrease in the total income of SME. Opinion leadership can solve consumer behavior in Indonesian society, especially after the Covid 19 pandemic. This research aim to determine the SME-based opinion leadership model in Indonesia during the Covid 19 pandemic and to analyze the relationship between opinion leadership and consumer behavior in SMEs during the Covid 19 pandemic. This research is quantitative through an online survey, the data analysis and hypothesis testing method use the Structural Equation Model - Partial Least Square (SEM-PLS). It was found that opinion leadership significantly affects consumer behavior in SMEs in Indonesia with four characteristics, professional, innovative, involved, and socialized. This research can be used for SME to start digitalizing by having a social media account to share information alongside the efforts of opinion leaders. Opinion leaders have a specialty depending on their capability, so they can promote SME products that match their personality. In addition, having many followers can make opinion leaders lead a community.

Abstract

The rapid development of information and communication technology has significantly transformed global social interactions and human civilization. While it provides numerous benefits, it also gives rise to various issues, including criminal acts such as hate speech. Hate speech, often associated with defamation, is a form of language crime regulated under the Criminal Code and the Law on Electronic Information and Transactions (ITE Law). This study examines the role of linguistic expertise in addressing hate speech crimes, particularly how linguists can contribute to identifying and analyzing the linguistic elements involved in these cases. This research uses a normative juridical approach to examine secondary data, including relevant laws and forensic linguistics literature. The findings indicate that linguistic analysis plays a critical role in determining the guilt or innocence of individuals involved in hate speech crimes in the judicial process. Linguists provide essential assistance in understanding the context and implications of speech, helping law enforcement effectively address hate speech issues. The study concludes that continued application and development of linguistic expertise are vital in improving the handling of hate speech cases and ensuring fair and accurate legal proceedings.

Abstract

This research evaluates business feasibility in the manufacturing sector using the Net Present Value (NPV) and Internal Rate of Return (IRR) methods. Both of these methods are financial analysis tools that play an important role in making investment decisions, especially in projects that require large capital investments and face market uncertainty. The NPV method assesses the potential profit of a project based on the time value of money, while the IRR identifies the minimum rate of return required for the investment to be viable. This study uses the Systematic Literature Review (SLR) approach to compile and analyze various studies that discuss the application of NPV and IRR in the manufacturing industry. By comprehensively understanding the application of these two methods, it is hoped that manufacturing companies can conduct more accurate investment assessments and maximize the sustainability of business projects.

Abstract

Employee performance plays a crucial role in the success of an organization, including the Demak Regency Transportation Agency. This study aims to examine the direct effects of self-efficacy and work motivation on performance, as well as their influence through OCB as an intervening variable. Using an explanatory research design with a quantitative approach, the study surveyed 85 employees from the Demak Regency Transportation Office using a census method. Data were collected via a Likert-scale questionnaire and analyzed with Partial Least Squares (PLS) through SmartPLS 3. The results revealed that both self-efficacy and work motivation have a positive and significant impact on employee performance. Furthermore, OCB was found to mediate the relationship between self-efficacy, work motivation, and performance. These findings confirm that increasing self-efficacy, work motivation, and OCB can encourage more optimal performance. In conclusion, effective management of self-efficacy, work motivation, and OCB variables can be an important strategy in improving the performance of Demak Regency Transportation Agency employees. This research provides a practical contribution to human resource management in the government sector.

Abstract

Social support between students in completing the final project makes students' academic resilience increase. This study aims to determine the relationship between peer social support and academic resilience in final year students of the Faculty of Health Sciences, University of 'Aisyiyah Yogyakarta. This research method uses a quantitative approach. The research population is all final semester students of the Faculty of Health Sciences, University of 'Aisyiyah Yogyakarta who are in the age range of 20-24. The sampling technique uses the convience sampling technique.The results showed that there was a relationship between peer social support and academic resilience in final year students of the Faculty of Health Sciences, University of 'Aisyiyah Yogyakarta, which was shown with a significance value of 0.000<0.05. Furthermore, the value of peer social support contribution to effective academic resilience was 60.2%, while the remaining 39.8% was influenced by other factors that could affect academic resilience variables.

Abstract

This research intended to determine the components of the scientific approach included in learning activities of the English textbook entitled Bahasa Inggris "Think Globally Act Locally". This study also described the kind of learning activities of the book that apply the scientific approach. This study belongs to qualitative descriptive research; therefore, the writer used an observation checklist as a technique of data collection and content analysis as the tool of data analysis. The findings showed that the English textbook Bahasa Inggris: "Think Globally Act Locally" has 95 learning activities throughout all book chapters that included components of the scientific approach, including observing, questioning, experimenting, associating, and communicating activities. The findings also showed the repetition and similarity of instruction in learning activities, including Reflecting and Communicating activities, through eleven book chapters. However, the writer argues that this book could be considered a good ELT textbook. However, it still needs improvement to make the learning activities more varied, especially reflection and communication.

Abstract

The Juvenile Criminal Justice System in Indonesia prioritizes an approach that educates and rehabilitates children who are facing the law. Restorative approaches, such as diversion and restorative justice, have become very relevant to achieve these goals. This study aims to examine legal protection for the application of restorative justice in handling juvenile crimes and understand diversion and restorative justice as a mechanism for resolving criminal acts outside the formal criminal justice process. This study uses a non-doctrinal method with qualitative descriptive analysis. The data used is sourced from primary, secondary, and tertiary legal documents. The results of the study show that diversion functions as a transfer of the settlement of children's cases from the formal criminal justice process to a mechanism outside the judiciary. This provides opportunities for children to improve themselves and avoid negative stigma due to formal justice. Meanwhile, restorative justice involves all parties affected by criminal acts with the aim of repairing damaged relationships, recovering losses, and preventing the recurrence of criminal acts. Thus, concluding a restorative approach both through diversion and restorative justice is effective in creating a more humane child penal system. This approach can focus on victim recovery and also provide child rehabilitation to perpetrators of crimes to ensure the sustainability of social recovery.

Abstract

The Constitutional Court (MK) decision number 168/PUU-XX1/2023 has a major impact on the world of employment and the business world where the Indonesian economy is facing pressure and slowdown due to global economic challenges. Even during the last few months in mid-2024, there has been a deflationary trend that shows a decline in people's purchasing power, which has a major impact on domestic consumption. This condition directly affects various business sectors, especially labor-intensive industries that have a great dependence on national economic stability. Moreover, there are still industries that have not recovered from the impact of Covid-19 in 2020-2021. The author tries to analyze the legal consequences and their social and commercial impact on the Constitutional Court's Decision on the Fixed-Time Work Agreement (PKWT) which can only be a maximum of 5 (five) years, which includes the extension period of the employment agreement.
