Abstract

This study aims to analyze the conceptual role of Introduction to Legal Science and the Indonesian Legal System in understanding the development of Islamic Business Law in Indonesia. The research employed a qualitative approach using a library research method with a conceptual analysis framework. Data were collected from primary legal sources, including statutory regulations, and secondary sources such as books, scholarly journals, and relevant legal literature. The findings indicate that Islamic Business Law has evolved from a normative concept of fiqh muamalah into an integral part of the Indonesian national legal system through legislative recognition, institutional development, and legal enforcement mechanisms. The study also reveals that the Introduction to Legal Science provides a theoretical foundation for understanding legal principles, functions, and objectives, while the Indonesian Legal System explains the legal position and institutional legitimacy of Islamic Business Law within the national legal framework. Furthermore, Islamic Business Law demonstrates adaptability to contemporary economic developments, particularly digital transactions, without abandoning fundamental Sharia principles. This study contributes a conceptual framework integrating legal theory and the Indonesian legal system to provide a more comprehensive understanding of Islamic Business Law in contemporary legal and economic contexts.

Abstract

This study examines the role of economic law actors and business organizations in Indonesia within the framework of national business law and Islamic business and commercial law. The research aims to analyze the legal position, rights, obligations, and responsibilities of various business entities while evaluating their relevance to the development of the digital economy and their compatibility with sharia principles. This study employs a normative legal research method using statutory, conceptual, and comparative approaches. Data were collected through an extensive review of legislation, legal doctrines, scholarly publications, and other relevant legal sources concerning business organizations and Islamic commercial law. The findings indicate that Limited Liability Companies (PT) remain the dominant form of business organization because they provide legal certainty, separate legal personality, and limited liability protection for shareholders. Nevertheless, the rapid growth of digital platforms, technology-based enterprises, and innovative business models has created legal challenges that require more adaptive regulatory frameworks. From the perspective of Islamic business and commercial law, business organizations are considered legitimate provided that their activities comply with the principles of justice, transparency, accountability, mutual consent, and lawful transactions while avoiding prohibited elements such as riba, gharar, and maysir. The novelty of this study lies in integrating the analysis of economic law actors and modern business organizations with Islamic legal principles to provide a more comprehensive perspective on contemporary business regulation in Indonesia. The study concludes that harmonization between national economic law and sharia principles is essential for creating a sustainable, ethical, and legally certain business environment that supports long-term economic development.

Abstract

Property (māl) in Islam is regarded as a trust from Allah SWT that must be acquired, managed, and utilized in accordance with Sharia principles. This study aims to analyze the Islamic concept of wealth and property ownership through the interpretation of Surah Al-Baqarah verses 254, 261, and 267, supported by relevant hadiths. This research employs a library research approach by examining the Qur’an, hadiths, classical and contemporary scholarly works, and related academic literature. The findings reveal that Islam acknowledges individual property ownership while emphasizing that such ownership is fiduciary rather than absolute, since ultimate ownership belongs to Allah SWT. The analysis demonstrates that the selected verses establish an integrated framework of Islamic wealth management encompassing responsible ownership, ethical acquisition, quality spending, and philanthropy as essential components of socioeconomic justice. The study contributes to the development of Islamic economics by reinforcing the Qur’anic foundation of wealth governance and highlighting the integration of spiritual accountability with social responsibility in property management. In conclusion, wealth in Islam functions not only as an economic asset but also as a means of worship and the realization of public welfare (maslahah).

Abstract

This study aims to examine the concept of ecology within Islamic studies, explore the ecological approaches employed to understand the relationship between humans and the environment, and analyze the practical implementation of these approaches in environmental management and conservation from an Islamic perspective. The research adopts a qualitative design using a library research approach. Data were collected through a comprehensive review of the Qur'an, Hadith, scholarly books, peer-reviewed journal articles, and other relevant literature addressing ecology, environmental ethics, and Islamic thought. The data were analyzed using a descriptive-analytical method by integrating normative and conceptual approaches to interpret the ecological values embedded in Islamic teachings. The findings reveal that ecology in Islam extends beyond the reciprocal relationship between living beings and their environment, encompassing humanity's spiritual responsibility as khalifah (steward) of the Earth. The Islamic ecological framework is founded upon the principles of tawhid, amanah, rahmatan lil-'alamin, ta'abbud, ta'aqquli, and takhalluq, which collectively shape a comprehensive environmental ethic. The study further demonstrates that the practical application of these principles promotes sustainable natural resource management, prevents excessive environmental exploitation, strengthens ecological awareness, and affirms that environmental conservation constitutes an integral expression of Islamic teachings as well as a fundamental moral obligation of humankind.

Abstract

The increase in marriage dispensation applications following the amendment of Law Number 16 of 2019 reflects new dynamics in the practice of religious courts. This study aims to analyze judicial considerations in deciding marriage dispensation cases at the Religious Court of Jember and to identify the dominant underlying factors. This field research employs a qualitative method with a juridical-empirical approach. Primary data were obtained through interviews with judges, while secondary data were derived from statutory regulations, legal literature, and court decisions. The findings indicate a significant rise in applications in 2022, with the majority of cases granted. The dominant factors include premarital pregnancy, parental pressure, economic constraints, weak religious education, social media influence, concerns over social stigma, and the impact of changes in the minimum marriage age regulation. Judges’ considerations are based on normative (Qur’anic and Islamic legal maxims), juridical, sociological, and public interest (ijtihad) perspectives. The novelty of this study lies in examining the shift in judicial reasoning patterns after the amendment of Law 16/2019, highlighting a stronger emphasis on sociological analysis and the prevention of greater harm. These findings demonstrate the dialectical relationship between positive legal norms and social realities in religious court practice.

Abstract

This study explores the historical dynamics of Kejeruan Bingai during the Langkat Sultanate era (1770–1946), addressing the limited scholarly attention to this local polity within North Sumatran historiography. The research focuses on the origins, political development, socio-religious life, factors of decline, and surviving material heritage of Kejeruan Bingai. Using a qualitative historical method, the study applies systematic stages of heuristics, source criticism, interpretation, and historiography. Data were obtained through field observations, in-depth interviews with local informants, and critical analysis of written sources. The findings demonstrate that Kejeruan Bingai emerged as part of the Langkat Sultanate’s political integration strategy, initiated by King Wan Jabar and institutionalized under Sultan Tengku Musa through the formation of Kejeruan administrative units. Bingai developed into a subordinate local kingdom led by five rulers and reached its peak during the reigns of Tengku Masrurah, Tengku Abdul Khani, and Tengku Muhammad Daud, marked by Islamic educational institutions, mosque construction, and colonial-era infrastructure development. This study’s novelty lies in its reconstruction of Kejeruan Bingai as an active local governance entity rather than a peripheral domain, offering a new interpretation of Langkat’s political structure and enriching local Islamic historiography in North Sumatra.

Abstract

This study aims to analyze conceptually and historically Ibn Khaldun’s contributions to the development of sociology within the Islamic intellectual tradition, particularly through his seminal work Muqaddimah. Employing a qualitative approach with library research methods, this study examines key sociological concepts formulated by Ibn Khaldun, including ‘ashabiyah (social cohesion), ‘umr?n (civilization), and the cyclical theory of the rise and decline of societies and states. Unlike conventional historical narratives, Ibn Khaldun developed a systematic analytical framework that integrates social, political, economic, and cultural dimensions of human civilization. The novelty of this research lies in positioning Ibn Khaldun’s thought as a foundational paradigm for contemporary Islamic sociology, offering an alternative to Western-centric sociological theories by grounding social analysis in Islamic epistemology and ethical values. The findings demonstrate that Ibn Khaldun’s sociological framework remains relevant for addressing modern social dynamics and contributes significantly to the formulation of an integrative, value-based, and context-sensitive sociological discourse within Islamic scholarship.

Abstract

This study examines the process of change in the agricultural production structure in Tolok Hamlet and its impact on social interactions and socio-religious practices within the Bilah Muslim community. The research aims to analyze how shifts in agricultural commodities occurred and how these transformations influenced patterns of social relations and religious life in a rural Muslim society. This study employs a descriptive qualitative approach, with data collected through in-depth interviews, participant observation, and documentation. Informants consisted of local community leaders, oil palm farmers, former rice and rubber farmers, and village officials who were directly involved in or affected by changes in agricultural production. The findings reveal that the Bilah Muslim community initially relied on subsistence rice farming to meet basic needs. However, limited irrigation infrastructure, recurrent flooding, and declining productivity encouraged a transition to rubber plantations. This shift was short-lived due to high rainfall and frequent crop failures. The most significant transformation occurred with the introduction of oil palm plantations initiated by PT. Socfindo in 1978, which offered greater economic stability and has since become the dominant livelihood source in Tolok Hamlet. These changes in agricultural production structure have reshaped social interactions, particularly in consumption patterns, perceptions of land value, labor relations, and access to production capital. Furthermore, socio-religious practices have also transformed, including changes in the meaning of work in Islam, patterns of mutual cooperation (gotong royong), and practices of charity and mutual assistance. This study contributes to the discourse on social change in rural Muslim communities by highlighting the intersection between economic transformation and socio-religious dynamics within the framework of Islamic rural sociology.

Abstract

The among-among tradition is a religio-cultural practice of Javanese Muslim communities that functions as a medium of gratitude, prayer, and social solidarity. Amid the dynamics of modernization, this tradition has undergone shifts in its material aspects, implementation procedures, and patterns of social participation. The research problem addressed in this study is: how do the forms and driving factors of the transformation of the among-among tradition in the Javanese Muslim community of Tanjung Medan Village manifest, and how can these changes be analyzed through Auguste Comte’s theory of social change?. Unlike previous studies that primarily examine among-among as a cultural ritual or a symbol of social cohesion, this research specifically employs Auguste Comte’s theory of social evolution as an analytical framework to interpret its transformation within a contemporary rural Muslim context. Thus, the study not only describes the changes but also situates them within a classical sociological perspective. This study applies a qualitative descriptive approach. Data were collected through observation, in-depth interviews with six key informants, and documentation. The data were analyzed through data reduction, data display, and conclusion drawing, with source triangulation to ensure validity. The findings indicate transformations in menu composition, food packaging materials, invitation distribution patterns, and a decline in children’s participation as the primary participants. These changes are influenced by internal factors (local innovations, social dynamics, and demographic shifts) as well as external factors (modernization, technological development, and cross-cultural interaction). From the perspective of Auguste Comte, these findings reflect a shift from a theological stage toward a more rational and functional pattern in social practice.  The results demonstrate that the transformation of the among-among tradition is not merely symbolic but also reflects a reorientation of values and rationality within the local Javanese Muslim community.

Abstract

​Social media digitalization triggers a social anxiety crisis known as Fear of Missing Out (FOMO) among youth, necessitating adaptive religious guidance innovations. This descriptive qualitative study aims to analyze the effectiveness of cyber dawah on the Roblox platform via the detikINET YouTube channel in addressing youth mental health issues. Observation was conducted on the interactions of three teenage participants (Raisya, Anarasya, Surya) and a preacher (Ustadz Jojo). The results indicate that the study mechanism is interactively structured through the "Masjid Al-Blok" virtual map, gaming activities, and account anonymity, providing psychological comfort. Internalizing the "FOMO Dunia vs FOMO Akhirat" material through fostering qana'ah successfully reorients teenagers' material ambitions toward spiritual deeds. In conclusion, the integration of cyber dawah and the preacher’s noble attitude significantly serves as a mental healing instrument to stabilize teenagers' unstable emotional turbulence in the digital era.
