Abstract

The development of financial technology has led to the emergence of cryptocurrency as a decentralized digital instrument that enables fast and cross-border financial transactions. While this technology offers efficiency and flexibility in digital financial activities, it also creates opportunities for misuse in various forms of crime, including terrorist financing. This study aims to analyze the use of cryptocurrency as a means of financing terrorist activities in Indonesia, examine the existing legal framework governing terrorist financing, and identify the challenges faced in law enforcement. This research employs a normative legal method using statutory, conceptual, and case study approaches. The findings indicate that the use of cryptocurrency as a medium for terrorist financing still fulfills the elements of a criminal offense as regulated under Law Number 9 of 2013 concerning the Prevention and Eradication of Terrorism Financing. However, the characteristics of cryptocurrency, such as anonymity, decentralization, and cross-border transactions, create significant challenges in the processes of evidence gathering, transaction tracing, and identification of perpetrators. In addition, there is a regulatory gap between the recognition of crypto assets as economic commodities and the supervision of their potential misuse for terrorist financing. Therefore, stronger regulations are needed to explicitly integrate crypto assets into the terrorist financing prevention regime, along with improving the capacity of law enforcement agencies in blockchain transaction analysis and strengthening international cooperation to enhance the effectiveness of law enforcement in the digital economy era.

Abstract

The development of digital platforms such as TikTok has encouraged the emergence of affiliate-based marketing practices in e-commerce activities. Affiliate marketing is a digital marketing system that promotes another person's product or service through a special affiliate link and earns a commission if a purchase or transaction is made through that affiliate link. Product promotion content has become one of the most effective marketing methods in the digital world. However, in practice, there are cases where affiliates reuse video content belonging to creators for promotional purposes and to earn sales commissions without permission. This study aims to analyze the provisions of digital video copyright protection under Law Number 28 of 2014 concerning Copyright and to examine forms of copyright infringement in the use of TikTok videos by affiliates. The method used is a normative study, employing a legal approach, a conceptual approach, and factual analysis. Primary and secondary legal materials were used in this study, which was analyzed descriptively and qualitatively. The results of the study show that TikTok videos fall under the category of cinematographic works that are protected as stipulated in Article 40 paragraph (1) letter m of the Copyright Law. Copyright protection arises automatically based on the declarative principle since the creation is realized in a tangible form, covering moral and economic rights. The use of TikTok videos by affiliates for promotional purposes and to earn sales commissions constitutes commercial use which, if done without the creator's permission, violates the creator's economic rights as stipulated in Article 9 paragraph (3) and potentially violates moral rights under Article 5 of the Copyright Law.

Abstract

This study aims to analyze The Responsibility of the Regional General Hospital (RSUD) TC. Hilers Maumere regarding the practice of burning medical waste and to examine its conformity with the provisions of Law Number 17 of 2023 concerning Health and other regulations related to hazardous waste management. Medical waste management is an important issue because improper handling may cause environmental pollution and pose serious risks to public health. This research employs an empirical legal research method with a descriptive approach, examining how the law operates in society through field data collection and analysis of relevant legal regulations.The results show that RSUD TC. Hilers Maumere implements a waste management system that includes the separation of household waste, liquid waste, and hazardous and toxic waste (B3). Medical waste is categorized and packaged according to its type, weighed, temporarily stored in medical waste storage facilities, and then destroyed using an incinerator or transported by authorized third parties. However, the practice of burning medical waste must be strictly supervised to prevent environmental impacts and potential legal violations. Therefore, stronger supervision, compliance with medical waste management standards, and the implementation of firm legal responsibility are necessary to protect public health and environmental sustainability.

Abstract

Hospitals, as healthcare institutions, bear the responsibility of delivering safe, high-quality, and patient-centered services. Hospital accreditation serves as a crucial mechanism to ensure service quality and legal protection for patients, particularly in medical dispute cases. This study aims to analyze the impact of accreditation on patient legal protection, both preventively and repressively. The research employs a normative legal method with statutory and conceptual approaches, utilizing primary, secondary, and tertiary legal materials. Data were analyzed through document studies covering Law Number 17 of 2023 on Health, government regulations, presidential regulations, and technical regulations from the Ministry of Health regarding accreditation standards and procedures. The findings indicate that accreditation functions as a continuous evaluation mechanism to ensure medical services comply with safety standards and clinical governance, strengthens patients’ rights to information, informed consent, and quality care, and reduces the risk of medical disputes. However, implementation challenges exist, including limited resources, compliance performed as formalities, and inconsistent supervision. Therefore, accreditation is not merely an administrative symbol but a strategic legal instrument that enhances patient safety culture and hospital accountability, ensuring that healthcare delivery meets professional, ethical, and legal standards.

Abstract

Financial losses at several State-Owned Enterprises (SOEs) in Indonesia indicate significant problems in the operational management and governance of state assets. This situation not only impacts SOE business performance but also directly impacts state financial management, including transparency, accountability, and efficient budget utilization. This study aims to analyze the underlying causes of financial losses at SOEs and evaluate their impact on public financial governance in Indonesia. The method used is a literature review examining regulations, SOE financial reports, previous research, government oversight reports, and relevant academic studies. The results indicate that SOE losses generally occur due to weak internal management, decision-making that is not based on data, inefficient costs, poor governance, and inadequate government oversight. The impact on public financial governance can be seen in the increasing burden on state finances and declining public trust in the management of state assets. This study recommends strengthening the implementation of Good Corporate Governance (GCG), increasing transparency and accountability in reporting, utilizing digital technology for oversight, and comprehensive evaluation of the performance of directors and commissioners to support improvements in SOE governance and public finances.

Abstract

This study aims to analyze the implementation of the motor vehicle tax relief policy and its impact on improving taxpayer compliance and Regional Original Revenue in the Province of East Nusa Tenggara. The research method used is a descriptive method with a qualitative approach that focuses on an in-depth understanding of the phenomenon. Data were obtained through literature review, field observations, and documentation related to the implementation of the motor vehicle tax amnesty policy in the region. The results show that the motor vehicle tax amnesty policy is one of the regional government’s strategies that is quite effective in increasing local tax revenue while encouraging taxpayer compliance in fulfilling their obligations. However, in its implementation, there are still several obstacles, such as low levels of awareness, understanding, and participation among some taxpayers in optimally utilizing the relief program. This condition causes the policy to not yet run fully effectively in increasing Regional Original Revenue. Therefore, efforts are needed to enhance continuous policy socialization, strengthen supervision, and develop more innovative, effective, and responsive public service strategies so that the motor vehicle tax relief program can be maximally utilized by the wider community.

Abstract

This study is motivated by a violent incident involving the stabbing of a female student within the premises of Universitas Islam Negeri Sultan Syarif Kasim Riau, which raises concerns regarding the effectiveness of the implementation of criminal law in higher education institutions. As an academic environment, a university is expected to ensure safety and legal protection for its academic community. However, this incident reveals gaps in preventive mechanisms and in the integration of criminal case management within the campus setting. This research aims to analyze the implementation of criminal law in the case from the perspective of the criminal justice system and to assess its conformity with the principles of criminal liability and  due process of law. The study employs a normative juridical method, utilizing statutory, conceptual, and case approaches, supported by document analysis and media reports. The findings indicate that the perpetrator’s conduct fulfills the elements of aggravated assault, as reflected in the presence of both actus reus and mens rea. Furthermore, the initial stages of investigation and inquiry were conducted in accordance with applicable criminal procedural law. Nevertheless, the integration between the criminal justice system and campus-based preventive policies remains suboptimal. This study recommends strengthening inter-institutional coordination and enhancing preventive measures within higher education institutions in order to establish a more comprehensive and equitable system of legal protection

Abstract

The development of social media has encouraged brands to utilize various digital features not only to promote their products but also to build interaction with their audiences. One of the most widely used features is TikTok Live, as it enables real-time two-way communication between brands and audiences. This study aims to examine the use of TikTok Live on the @hitabalikebaya account in increasing audience engagement. This research employs a descriptive qualitative method, with data collected through observation, in-depth interviews, and documentation. The informants in this study consist of the business owner, live hosts, and several audience members who have watched TikTok Live sessions on the account.This research uses a descriptive qualitative method with data collection techniques through observation, interviews, and documentation. The informants in this study consisted of the owner, live host, and several audiences who had watched TikTok Live on the account. The results show that TikTok Live functions as both a promotional medium and an interactive communication platform, allowing audiences to actively participate through comments and responses during the live sessions. This interaction is able to increase audience engagement, as reflected in activities such as giving likes, commenting, sharing the live stream, and following the account after watching. Based on the analysis using The Circular Model of Social Media Engagement (SoMe), the implementation of TikTok Live on the @hitabalikebaya account reflects the stages of share, optimize, manage, and engage in building audience engagement. Therefore, TikTok Live also serves as a medium for building closer and more sustainable relationships between brands and audiences.

Abstract

Food security is a strategic issue in regional development, particularly in urban areas with limited food production resources. Jakarta, as the center of government and national economy, is highly dependent on food supplies from other regions, making food budget management crucial for maintaining food availability and accessibility. This study aims to analyze the efficiency of the food budget managed by the Jakarta Provincial Government and its implications for improving food availability and accessibility. The method used is a literature study (library research) with a qualitative, descriptive, and analytical approach, utilizing secondary data from scientific journals, books, research reports, and government policy documents. The results indicate that efficient food budget management plays a crucial role in supporting food availability stability and increasing public access to adequate and affordable food. Effective, transparent, and performance-based budget management can enhance the effectiveness of food security programs and strengthen the food distribution system in urban areas. Therefore, local governments need to ensure that food budget allocations are used appropriately to achieve optimal impact on improving community food security.

Abstract

Saudi Arabia's involvement in the United Nations Commission on the Status of Women (UN CSW) has drawn criticism from most member states because of its apparent contradiction with the ideals of the UN CSW. This study discusses the occurrence of Saudi identity reform in the gender realm, influenced by international norms as the main driver. The study uses a descriptive qualitative method by collecting data sources from various scientific literature to examine the process and efforts of Saudi Arabia to make its progressive image accepted by the global community. Alexander Wendt's Constructivity Theory is used to explore the identity of Saudi Arabia being reconstructed through the interaction of international norms in the UNCSW forum. The research findings indicate that Saudi leadership at the UN CSW reflects an adaptation to international norms and efforts to reconstruct Saudi Arabia's global image as a supporter of gender equality despite domestic challenges. The results of this study provide insights into domestic policies, international pressures, and gender reform in Saudi Arabia, within the context of Saudi leadership at the CSW.
