Abstract

AbstrakArtikel ini membahas dua permasalahan pokok: pertama, kriteria yang digunakan oleh pembentuk undang-undang di bidang politik dalam menetapkan suatu perbuatan sebagai perbuatan pidana (kriminalisasi); dan kedua, fungsi sanksi pidana dalam undang-undang di bidang politik. Terkait dengan kriminalisasi, undang-undang di bidang politik yang termasuk ke dalam hukum administrasi, maka pertimbangan dari pembuat undang-undang tentu saja tidak sekedar kriminalisasi sebagaimana diatur dalam ketentuan hukum pidana dalam arti sebenarnya. Hal tersebut disebabkan adanya pertimbangan-pertimbangan tertentu. Pertama, perbuatan yang dilarang dalam hukum pidana administrasi lebih berorientasi pada perbuatan yang bersifat mala prohibita, sedangkan dalam ketentuan hukum pidana yang sesungguhnya berorientasi pada perbuatan yang bersifat mala in se. Kedua, sebagai konsekuensi dari adanya penggolongan dua kategori kejahatan tersebut, maka pertimbangan yang dijadikan acuan juga akan berbeda. Untuk yang pertama (mala prohibita), sanksi pidana itu dibutuhkan untuk menjamin ditegakkannya hukum administrasi tersebut. Dalam hal ini sanksi pidana berfungsi sebagai pengendali dan pengontrol tingkah laku individu untuk mencapai suatu keadaan yang diinginkan. Sedangkan untuk yang kedua (mala in se), fungsi hukum pidana dan sanksi pidana lebih berorientasi pada melindungi dan mempertahankan nilai-nilai moral yang tertanam di masyarakat tempat di mana hukum itu diberlakukan atau ditegakkan. Kata Kunci: Kebijakan, Kriminalisasi, Undang-Undang PolitikThis article discusses two main problems: firstly, the criteria used by the legislators in the field of politics in determining an act as a criminal act (criminalization); secondly, the function of criminal sanctions in legislation in the field of politics. Associated with criminalization, legislation in the field of politics that is included in administrative law, the consideration of the legislators of course not just criminalization as stipulated in the provisions of criminal law in the true sense. This is due to certain considerations. Firstly, the act which is forbidden in the administration of criminal law is more oriented to act is malum prohibitum offences, whereas in actual criminal law provisions in the act are mala in se offences. Secondly, as a consequence of the existence of two categories of classification of the crime, then consideration will also vary as a reference. For the first (mala prohibita), criminal sanctions are needed to ensure the enforcement of the administrative law. In this case the criminal sanction serves as controller and controlling the behavior of individuals to achieve a desired state. As for the second (mala in se), the function of criminal law and criminal sanctions is more oriented to protect and maintain the moral values that are embedded in a society where the law was enacted or enforced.

Abstract

This research methodology uses the approach of juridical sociology with descriptive of research type. The method of collecting data uses observation and interview. The method of analyze data uses qualitative description. The results of the research are: 1) the implementation of elementary school teacher’s discipline to obey the roles of discipline state officer at UPPK Taman Dinas Pendidikan, Pemuda dan Olah raga in Pemalang regency, namely the application of the government role number 53 on 2010 about discipline state officer, and the role of Pemalang regent number 26 on 2012 about the day and work-time of the state officers at Pemalang regency. 2) The problem which the implementation of elementary school teacher’s discipline to obey the roles of discipline state officer made is that not all the elementary school teachers obey the roles of discipline state officer about work-time of state officer. 3) The solution for solving the problem which the implementation of elementary school teacher’s discipline to obey the roles of discipline state officer made namely: a) Specific socialization of the roles of discipline state officer and work time is needed. b) Intensive monitoring of the roles of discipline and work time for state officer should be done. c) The firm sanction for the elementary school teachers who break the roles of discipline state officer should be given. d) The day and the work time of the elementary teachers should be revised become flexible work time so that the teachers can do their duties without breaking the role of state officer discipline, especially on the role of the state officer work-time.

Abstract

The term impeachment is not explicitly written in the constitution. In Big Indonesian Dictionary New Edition deposed mentioned is put positions; king abdicated. Prof. Jimly Asshiddiqie explained, impeachment is the uptake of the Arabic language which means derived from office. Or equal to the term 'impeachment ' in the constitution of Western countries. Dismissal of the President and / or Vice President of the mechanism is already provided for in Article 7A and 7B 1945. Prior to MPR dismiss both the President and / or Vice President , the mechanisms that must be taken is the first , the proposed dismissal of the President and / or Vice- president of the Board House of Representatives to the Assembly with only first submit a request to the Constitutional Court to examine, and decide upon the opinion of the House that the President and / or Vice President has violated the law in the form of treason against the State , corruption , bribery , criminal acts other heavy , or moral turpitude ; and / or opinions that the president and / or vice president is no longer eligible as president and / or vice president.

Abstract

Turkey and Greece are again dragged into a new conflict in the East Mediterranean. Turkey and Greece vie for supremacy in the eastern Mediterranean. Turkey, for its part, indicated that Greece's claim to the territory would amount to a siege in the country by giving Greece a disproportionate amount of territory. This study aims to rethink the conflict between Greece and Turkey in the waters of the Mediterranean sea in the view of international maritime law. This study uses an empirical juridical approach. The Result of this research is Turkey does not ignore the Greece rights, Greece ignores the international law with its extended or excessive maritime claims. Greece tries to give full entitlement of the islands in Mediterranean and Agean. Whereas the effect Formula is applied by international courts.

Abstract

Pengadilan Agama sebagai pengadilan keluarga di samping sebagai “institusi hukum” yang menegakkan kepastian hukum dan keadilan juga sebagai “institusi sosial” yang dinamis, yaitu senantiasa menjalankan pertukaran dengan lingkungannya yang lebih besar, dalam upaya menggali, mengikuti dan memahami nilai-nilai hukum yang hidup dalam masyarakat, menginterpretasikan teks undang-undang dalam konteks masyarakat serta perubahan-perubahannya. Seperti terjadi pada kaum perempuan yang mendapatkan pendidikan serta pekerjaan di luar rumah, maka terjadi perubahan kedudukan mereka di bidang sosial, budaya, politik, ekonomi. Faktor ini merangsang tuntutan masyarakat untuk adanya perubahan hukum, termasuk hukum keluarga Islam yang berlaku. Hukum keluarga Islam kontemporer di negara-negara Islam dan di negara-negara yang mayoritas penduduknya Islam seperti Indonesia mengalami perkembangan. Dengan demikian terjadi pula perkembangan studi hukum Islam di Indonesia. Adapun metode untuk memperbaharui hukum keluarga Islam antara lain dengan takhshish al-qadha’, takhayyur, reinterpretasi, siyasah syar’iyyah dan putusan hakim (pengadilan).Kata Kunci: Pengadilan Agama, Perkembangan, Hukum Islam.

Abstract

Commitment or often termed the government's political will to implement and enforce the rights of the ratification of several international human rights instruments are still being encouraged and is a logical consequence of the ratification of human rights. At the national level, there are government programs through the National Action Plan human rights ideal, but at the regional / local, still going violations of human rights and the implementation of a slightly run due to differences in the interpretation of the meaning of human perception among law enforcement, people’s (civil society) and the government.In this study, the observed variables are: first, the consequences of the government's participation in the ratification of treaties on human rights, which is then transformed into national legislation. Here, researchers are more focused on the political will of the government, and second, people's perception of human rights before the government took part in the ratification of treaties on human rights and the changes are positive or merely lip service and political imagery alone.Approach or method that is applied using a socio-legal research or empirical legal research. Key informants of this research is the Head of the sub-directorate of economic, social, cultural and development at the Directorate General for Multilateral Directorate of Human Rights and Humanitarian Ministry of Foreign Affairs, Head of legal harmonization in the Directorate General of Human Rights of the Ministry of Law and Human Rights, Commissioner Assessment and Counseling sub Commission on Human Rights at the National Commission on Human Rights and Resource Development Deputy Head of Human Rights in ELSAM (Institute for Policy Research and Advocacy). AbstractThe existence of disharmony between law enforcement agencies, and the Commission president lately konstructive communication requires effort to achieve synergy in order to achieve the eradication of corruption in Indonesia. The approach used in this study is normative. Efforts should be made to create constructive communication between law enforcement agencies, the president of the Commission and institutions in order to eradicate corruption is an effective and efficient trusting, synergistic interaction between law enforcement agencies, and the president of the Commission, in favor of the truth. AbstractWorker is very play an active role in company. The Businessman always depend on to workers. An company can walk well if the businessman and the worker do all of their should be. The government very concentrate to protect them. Act 13 of 2003 on employment regulate in detail rights and obligation of workers. Boundaries between workers and employers set out clearly, so that no one harmed. They can not be separated very closely related. Progress of a company depends on how the management of the employers and the work of the workers. Keywords: worker, businessman, rights and obligation  Abstrak Pekerja atau buruh adalah sangat berperan aktif disebuah perusahaan. Pengusaha selalu bergantung pada pekerja atau buruh. Perusahaan bisa berjalan baik jika pengusaha dan pekerja menjalankan tugas dengan sebaik-baiknya. Pemerintah sangat konsentrasi mengenai perlindungan terhadap ketenagakerjaan. Undang-undang No.13 tahun 2003 tentang ketenagakerjaan mengatur secara rinci kewajiban dan hak para pekerja. Batasan antara pekerja dengan pengusaha diatur dengan jelas, sehingga tidak ada yang dirugikan. Pekerja dan pengusaha tidak bisa dipisahkan, kaitannya sangat erat sekali. Majunya suatu perusahaan tergantung bagaimana pengelolaan dari pengusaha dan hasil kerja dari para pekerja. Kata kunci: pekerja, pengusaha, hak dan kewajiban.

Abstract

Salah  satu  lingkup  otonomi   suatu  lembaga  Pendidikan Tinggi  adalah  hak untuk  menetapkan    prioritasnya  sendiri  dan  melakukan  penelitian  ilmiah  kearah manapun  tujuannya dengan  mempertimbangkan kepentingan masyarakat (Wissenschafisfreiheit).    Sebagai   salah  satu  alternative  yang  tepat   dipilih   adalah dengan memberdayakan penelitian yang berbasis atau berpotensi Hak Kekayaan lntelektual (HaKI),  seperti  penelitian dibidang  Paten,  Hak Cipta,  Desain  Industri  dll. Dengan   penelitian  di  bidang  HaKI   ini  di  samping   berfungsi  pengembangan  ilmu juga  bisa sebagai   sumber  pembiayaan  perguruan tingi  yang  bersangkutan  dalam kerangka   pelaksanaan  pemberian  status  otonomi. Namun     persoalan  pokok  yang dihadapi  adalah   masih  lemahnya  kesadaran   hukum  terhadap arti  pentingnya HaKI baik   dikalangan   masyarakat   luas   maupun   kalangan    Perguruan  Tinggi   (swasta maupun  negeri).

Abstract

The prevention of crime is also explained by Criminology. So that Criminology is also include the study of the reaction of society against crime. It might be argued that this belongs, strictly speaking to the domain of sociology of the criminal law but it has to be admitted that the reaction of the state which is the subject matter of penology. They are both strongly by criminogenic forces and should therefore be studied by criminologist. Edwin H Sutherland and Cressey said that the prevention of crime or the reaction of society against crime include within criminology scope the processes of making laws of breaking laws and of reacting toward the breaking laws.The reraction of society against crime include to critize the punitifly of the social reaction and the treatment of raection of society against crime. The reaction of society against crime is also about social perseption about social order and development of perseption of society for social order is depent on development of society which consist of traditional society and modern society.Keyword : Concept of Crime prevention, Reaction of society against crime
