Abstract

The registration of patent in Indonesia give a positive value to Indonesia’s economic growth because the bigger the number of patents in a country the higher the country’s capability to innovate. The government issues Law number 13/2016 on patents in order to protect the patents which have been registered in Indonesia so it is expected to motivate inventory, especially foreign citizens. In practice, those foreign citizen consider that article 20 of the Patent Law is a constraint because they are obligated to make products or follow the process applied in Indonesia, support the technology transfer, absorb the investment, and/or provide employment. Article 20 of patents law is also considered to violate the TRIP’s provisions. The government amends the patent law by issuing Law Number 11/20 on Job Creation but it crates a different positive law that is applied in Indonesia. The research problems are how about the development of invention registration for foreign citizen in the Directorate General of Intellectual Property during that last years, how about the benefits of giving legal protection for foreign citizen’s invention in Indonesia on Indonesia’s economic growth, and how about the legal implication ow Law Number 11/2020 on Job Creation on Patent Law, especially in relation to the grant of a patent for the invention of foreign citizen in Indonesia. The research method used is juridical normative method with a descriptive analyctical approach and the source of data is secondary data. The data collection technique is library research. The data are analyzed qualitatively and are obtained from the research result using deductive method. The result indicates that there is an increase by 25% in 2020. The legal protection for patents registered by foreign citizens can increase Indonesia’s economics condition due to employment opening, and an increase in knowledge and skill of Indonesias society. The application of Job Creation is considered not incaccordance with article 28 C Paragraph (1) of the Constitution of the Republic of Indonesia as the goal and purpose of forming the country.

Abstract

The separation between the patterns of resolving election disputes and the separation of institutions for resolving election disputes will ultimately lead to potential legal uncertainty, prolonged settlement, and even dualism of election dispute resolution institutions. Therefore, a more integrative approach is needed in resolving election disputes which includes the idea of forming a special electoral court institution. However, the discourse on the formation of a special electoral court institution requires further discussion regarding the position of the intended special judicial institution, whether it falls within the jurisdiction of the Constitutional Court or the Supreme Court. The research method used in this study is normative legal research with a legislative approach and a case approach. Given the complexity of the law in resolving local election disputes which are separated into process disputes and results disputes, an integrative special judicial body is indeed needed to examine and decide on election disputes, not only limited to election results, but also covering all aspects of the election. Essentially, democratization of regional head elections as previously described also includes reforming local election regulations, including legal means for resolving election disputes that provide legal certainty. In this regard, one option is to establish a special local election court or a special electoral court in general.

Abstract

Objective study This For know effectiveness convenience use payment transaction cashless finance _ to QRIS use . Problems in study This is Still there are students of the Sharia Business Management Study Program at the Faculty of Islamic Religion UMSU who do not know or use QRIS Bank Syariah. Approach research used _ in study This use approach quantitative . Study This use method Data analysis techniques using data quality tests , validity tests , reliability tests , assumption tests classic , normality test , heteroscedasticity test , autocorrelation test , regression test simple , hypothesis test , partial test t count (t test), test of determination , with amount sample as many as 32 determined respondents with non-probability sampling technique . Method data collection used is questionnaire .Research results show effectiveness convenience use payment transaction cashless finance _ influential to utilization QRIS use . this _ proven with he refused hypothesis H0 through testing hypothesis Where there is t count value (26.547) > t table (1.69389), with a sig value of 0.000 <0.05 indicates H0 is rejected and Ha is accepted . Based on the Determination test An R Square value of 0.879 or 87.9% indicates about 87.9% variable The use of the Indonesian Standard Quick Response Code (Y) is influenced by convenience use payment transaction non- cash finance ( X). Temporary the rest 12.1 % is influenced by variables that are not researched in study this .

Abstract

The aim to be achieved from this research is to analyze and find out the legal protection for trade secret holders; to analyze and find out the contractual relationship between employees and companies in maintaining and protecting Trade Secrets; and to analyze and find out the application of information confidentiality proving law in cases of violations of boiler machine trade secrets based on Supreme Court Decision No. 3305/K/Pdt/2016 dated 24 January 2017 and the Lunpia Express trade secret violation case based on Supreme Court Decision No. 2535K/Pdt/2016 dated 8 December 2016. This research used a documentation study approach with qualitative data analysis. The results of the study show that the Supreme Court's Decision No. 3305/K/Pdt/2016 dated 24 January 2017 stated that PT. HCMI was proven to have violated trade secrets by using the same production and sales methods as PT. BPE obtained from Calvin Jonathan Barus, et al as former employees of PT. BPE. This is inseparable from the verification process which proves that PT. BPE is the first distributor of boiler machines that have economic value and keep their production methods secret.

Abstract

As public officials appointed by the state, notaries do not receive state honoraria; however, they receive honoraria for legal services rendered in accordance with their authority. The use of notary services is affected by the ability to pay (ATP) due to the financial ability. However, according to Article 37 paragraph (1) of the Law on Notary Position and Article 3 number (7) concerning the Notary Code of Ethics for the Extraordinary Congress of the Indonesian Notary Association held in Banten in 2005, “Notaries are obliged to provide notarial pro bono services to financially disadvantaged individuals”. The implementation of these notarial pro bono services for financially disadvantaged individuals in Medan has been going well due to the humanity, notary's morality, and integrity.

Abstract

The validity of online buying and selling transactions through a marketplace with a Cash on Delivery system is principally regulated in Article 1320 of the Civil Code which contains the terms of the validity of an agreement based on an agreement between the buyer and seller or marketplace. However, in practice there are still deficiencies in fulfilling the legal requirements of the agreement which results in a sale and purchase agreement with the Cash on Delivery system in online buying and selling transactions not fulfilling the validity of the agreement in positive law in Indonesia. The responsibility provided by the Shopee Indonesia website manager for losses suffered by consumers has been fully regulated through the provision of consumer reporting facilities for losses experienced by consumers, blocking negative content, providing Shopee Indonesia guarantees, refunds to consumers, following up on fake accounts. sellers, as well as protection of consumer personal and credit card data. However, in practice sellers and buyers who use the Shopee platform have not fully obtained their rights when they experience losses due to buying and selling online.

Abstract

Copyright protection, especially for music or song creations, is a serious problem, because Indonesia is categorized as one of the countries where the level of copyright piracy is quite high. Even though there has been a law and a Collective Management Organization that has been formed specifically to deal with royalties for music and song creators, until now the level of royalty payments, especially in the city of Medan, is still low. Signs of improvement for the future of those who choose their livelihood as creators, musicians, singers are yet to be seen.

Abstract

Legal issues that are often faced by people in the current era of information disclosure are related to the delivery of information, communication and/or data electronically, especially related to hate speech or defamation, one of which was committed by Abdul Hasiolan Siregar with Decision Number Number 1/Pid. sus/2019/PN. Mdn. The mistake started at the investigation stage. It is true that structurally the defendant is the chief editor of the Medanseru.co media and this is based on the Press Law, so the defendant must be responsible for all editorial content on the Medanseru.co media page. However, the facts in the trial revealed that the online media medanseru.co was not officially registered on the Kominfo website, meaning that Medanseru.

Abstract

Marigold flower (Tagetes erecta L.) is an ornamental flowering plant that belongs to the Astarecae family. Marigold flowers are used as ornamental plants in pots and as flower bouquets. The demand for marigold flowers is very high, so efforts are needed to quickly propagate marigold plants and produce good quality. Efforts to provide marigolds are carried out by increasing the production and quality of marigold plants. Tissue culture is an in vitro technique of plant propagation and is effective in producing large, uniform and disease-free plants. Giving ZPT 2,4-D and Kinetin can stimulate good callus growth and affect the success of callus induction. This study aims to determine the effect of giving 2,4-D and kinetin on the growth of marigold callus induction. The experiment used a randomized block design consisting of two factors, namely 2, 4-D with four concentration levels, namely 0 ppm, 0.5 ppm, 1 ppm and 2 ppm and kinetin with four concentration levels, namely 0 ppm, 0.5 ppm, 1 ppm and 2 ppm with three replicates. The results showed that the combination treatment without 2,4-D and 0.5 ppm kinetin gave the best response when callus appeared 11.67 HST and the treatment of 1 ppm 2,4-D and 2 ppm kinetin gave the best response on the percentage of successful callus induction marigolds.
