Abstract

Children are the future and the nation's next generation who have limitations in understanding and protecting themselves from various influences of the existing system. Sexual violence against children often occurs, so it impacts the child's physical and psychological aspects, which can be carried over to the child's maturity and interfere with the child's development. The description of a child as a victim can use in proving a crime. The method used in this study is normative juridical research. The nature of the research used is descriptive analysis, and data analysis carries out qualitatively using library data collection techniques. The results of this study found that the position of a child as a witness in a criminal case has legally recognized in the Criminal Procedure Code. However, the statement of a child witness cannot be accounted for in criminal law by the provisions of Article 160, paragraph (3) of the Criminal Procedure Code, Article 185, paragraph (7) of the Criminal Procedure Code, and Article 184 Criminal Procedure Code. The strength of the child's testimony can be said not to have reliable evidentiary power to determine whether the defendant has committed a crime but rather to strengthen the judge's conviction. In the judge's consideration of sentencing decisions, in general, the information given by the child is used by the judge as a guide and reinforcement of other legal evidence based on adjustments and links with evidence and facts that occurred in court, which use as a reinforcement for the judge's conviction and as a consideration in imposing a criminal sentence. In giving sentencing decisions in the decision file No.39./Pid.Sus/2016/PN Sbg the statement of the child as a victim witness adds to the confidence of the Panel of Judges.

Abstract

The comparison of the law of evidence in criminal offenses is based on the civil code, which includes three theories of evidence: the theory of the law of evidence according to positive law, the theory of the law of evidence according to the judge's consideration, and the theory of the law of evidence according to negative law. This research used the juridical normative method, which is deductive in nature. The data were obtained from primary, secondary, and tertiary legal materials, gathered through documentary study (library research), and analyzed using deductive logic. The conclusion was reached through explaining something from general to specific in relation to court verdicts that are final and conclusive. The research concluded that electronic information, electronic documents, and/or their prints are valid evidence and an extension of documents according to the law of procedure applicable in Indonesia. This evidence cannot be separated from Article 184 of the KUHAP, as they have the same position and function as documents used as evidence. The opinions of forensic digital experts also strengthen the validity of electronic evidence before the court by reconstructing it so that the proceedings are clear.

Abstract

Holding company Mining Industry Indonesia (MIND ID) is one of the state-owned holding companies in Indonesia. MIND ID is a holding company in the mining sector which was formed based on Government Regulation Number 47 of 2017. The state financial status of state-owned enterprises and or subsidiaries of state-owned enterprises is still a matter of debate. There is an assumption that a state-owned company and/or its subsidiaries have state finances, but another opinion states that there is no state finance in the state-owned company but rather becomes the finances of the state-owned company. Supreme Court Decisions No. 21 P/HUM/2017 and No. 7 P/HUM/2018 principally state that a subsidiary of a SOE in a SOE holding structure does not turn into an ordinary Limited Liability Company, but remains a SOE. Then one of the cases of financial losses in state-owned enterprise subsidiaries as examined and tried in the Pangkal Pinang District Court Decision, namely in Decree Number 1 / Pid.Sus-TPK / 2021 / PN Pgp. The case in question is a case of alleged corruption in a subsidiary of the SOE Holding Company Mining Industry Indonesia (MIND ID), namely PT Timah, Tbk. In this decision, the panel of judges held that the SOE subsidiary, in this case, PT Timah, Tbk in the holding company of the Indonesian Mining Industry (MIND ID) is not a state-owned enterprise but a national private company. The consideration of the panel of judges in Decision Number 1/Pid.Sus-TPK/2021/PN Pgp regarding the financial status of the state in state-owned subsidiaries is different from the consideration of the panel of judges in the review decision in Decision Number 7 P/HUM/2018 Jo. Decision No. 21 P/HUM/2017.

Abstract

Angklung is a musical instrument consisting of several bamboo pipes arranged vertically and tied with string or rattan, so that when it is hit or shaken it produces a different sound depending on the size and thickness of the bamboo pipe. The vibrations given will cause the resulting sound resonance. The position of the handrails and how to shake are good learning parameters for beginners in operating the angklung. Knowing the number of vibrations or beats on the angklung can provide harmonization and resonance to be played together. These conditions require measurement and observation methods with the beat density of the angklung to form synchronization and harmonization. Piezoelectric sensors and Arduino are used to read the resulting vibrations. Under the conditions of the resulting vibration will cause noise. In the process of removing noise or interference, it is carried out using the Kalman Filter algorithm. The Kalman Filter algorithm is one that is widely used for noise filtering and for estimating the state of the system. The average obtained for knocks without using Kalman Filter is 9.3 beats and for those using Kalman Filter is 7.8 for a target of 5 beats. While the results of the 20-beat target condition produce an average for sensors without Kalman Filter producing an average number of beats of 25.3 and those using Kalaman Filter produce an average value of 23.3 beats.
