Abstract

This article analyzes the inconsistency of the Constitutional Court's (MK) decisions regarding the application of the open legal policy doctrine, specifically focused on Decision Number 90/PUU-XXI/2023 concerning the minimum age requirements for Presidential and Vice-Presidential candidates. The purpose of this article is to examine the internal and external factors driving this jurisprudential shift and to evaluate its juridical and constitutional implications on the Indonesian legal system. The methodology employed is a normative legal research method using statutory, conceptual, and case approaches. The findings prove that the Constitutional Court shifted its paradigm from judicial restraint to aggressive judicial activism, transforming its role from a negative legislator into a positive legislator by introducing new alternative norm criteria outside the legislative process. This inconsistency is internally driven by fragmentation in legal reasoning among constitutional judges and externally influenced by political pressure and institutional conflicts of interest. The decision ultimately weakens the legal certainty framework, erodes the checks and balances system, and triggers the judicialization of politics in Indonesia. This study recommends a conceptual reconstruction of the open legal policy boundary to restore the Court's integrity.

Abstract

The implementation of probation in employment relationships within the hospitality industry continues to raise legal concerns, particularly when applied to employees under Fixed-Term Employment Agreements (Perjanjian Kerja Waktu Tertentu/PKWT), despite being prohibited under Indonesian labor law. This study examines the implementation of probation at Fourteen Roses Boutique Hotel and analyzes the legal protection available to employees affected by practices inconsistent with labor regulations. The research employs an empirical legal method using statutory, conceptual, and sociological approaches. Primary and secondary data were collected through interviews, documentation, and literature review, then analyzed qualitatively with quantitative support. The findings indicate that probation is still imposed on employees under PKWT, contrary to applicable labor legislation. The study also reveals the absence of clear probation procedures and inadequate fulfillment of employees’ normative rights during the probation period, resulting in legal uncertainty, reduced employment protection, and potential financial and legal losses for employees. These practices weaken the principles of legal certainty and worker protection embedded in Indonesian labor law. Therefore, stronger government supervision, stricter employer compliance with labor regulations, and clearer legal norms are required to prevent unlawful probation practices and ensure adequate legal protection for employees in the hospitality sector.

Abstract

Pregnancy outside lawful wedlock is a social and religious phenomenon that continues to develop in modern society. It not only raises moral debates but also creates complex issues in Islamic and positive law concerning the validity of marriage, marital relations, and the determination of a child's lineage (nasab). This study aims to analyze the issue of pregnant marriage from the perspectives of Prophetic Hadith, the four Sunni schools of jurisprudence (Hanafi, Maliki, Shafi'i, and Hanbali), and positive law under the Indonesian Compilation of Islamic Law (Kompilasi Hukum Islam or KHI). This study employs normative legal research using normative-theological, comparative, and statutory approaches. Legal materials were collected through a literature review of Hadith commentaries, classical fiqh texts, and Indonesian family law regulations. The findings indicate that no authentic Hadith explicitly addresses the marriage of a woman pregnant due to fornication; however, general Hadiths provide a basis for legal reasoning (istinbāṭ) to protect lineage (ḥifẓ al-nasab). The Shafi'i and Hanafi schools permit the marriage of a pregnant woman with either the man who impregnated her or another man, although the Hanafi school prohibits sexual relations until childbirth when she marries another man. In contrast, the Maliki and Hanbali schools consider such marriage invalid until childbirth and repentance. Meanwhile, Article 53 of KHI permits a pregnant woman to marry the man who impregnated her without waiting for childbirth. This provision reflects an approach based on public welfare (maslaḥah), legal certainty, women's dignity, and the civil rights of children.
