Abstract

This study aims to determine the effectiveness of supervision conducted by the Environmental and Sanitation Agency (DLHK) of Karawang Regency regarding the mining activities of PT Mas Putih Belitung based on Law Number 32 of 2009 concerning Environmental Protection and Management. The study also examines the obstacles faced in monitoring the impacts of mining activities on public health and the environment. The research used an empirical juridical method with legislative and empirical approaches. Data were collected through interviews, observations, and literature studies, then analyzed qualitatively using Soerjono Soekanto’s theory of legal effectiveness. The findings show that DLHK supervision has been implemented but has not yet operated effectively. Several factors contribute to this condition, including limited human resources, inadequate facilities and infrastructure, weak administrative law enforcement, low community participation, and insufficient compliance by the company in environmental management practices. Therefore, stronger supervision, improved law enforcement, and greater collaboration between government, companies, and communities are necessary to ensure environmental protection and public health sustainability.

Abstract

The digital era has streamlined the commercialization of musical works, yet conversely heightens the risk of copyright infringement regarding the unauthorized use of songs. This study aims to analyze the legal review of unauthorized song usage, focusing specifically on the Supreme Court Decision Number 825 K/Pdt.Sus-HKI/2025. This study employs a normative juridical research method using a case approach and a statute approach. Secondary data were gathered through a literature review of relevant regulations, specifically Law Number 28 of 2014 concerning Copyright. The results indicate that utilizing another person's song for commercial purposes without valid permission from the creator or copyright holder constitutes a clear violation of economic rights, particularly reproduction, distribution, and public performance rights. Through Supreme Court Decision No. 825 K/Pdt.Sus-HKI/2025, the Panel of Judges reaffirmed the boundaries of law enforcement and civil liability regarding material damages for infringers. The judges' legal reasoning (ratio decidendi) reinforces the position of Collective Management Organizations (CMO) in royalty collection, while providing legal certainty on the evidentiary mechanisms of exclusive rights violations in court. The practical implication of this decision emphasizes the necessity for creative industry actors to secure formal licensing to mitigate future legal disputes.

Abstract

The changes to the provisions on evidence in the new Criminal Procedure Code (KUHAP) mark a significant shift in the evidentiary system under Indonesian criminal procedure. The expansion of evidence to include physical evidence as valid evidence, the explicit recognition of electronic evidence, judicial observation, and other evidence as long as it is legally obtained, alters the evidentiary system, which previously relied on classical categories. This situation raises questions about how these changes affect the evidentiary system and the dynamics of criminal litigation in court, particularly regarding the role of judges, the strategies of the parties, and the protection of the defendant's rights. This study aims to analyze the changes in the evidentiary system resulting from the addition of evidence in the new KUHAP and its impact on criminal litigation practices. The research method used is a normative juridical approach with descriptive specifications through a literature review of relevant laws and legal literature. The analysis shows that the expansion of evidence increases the complexity of the evidence, strengthens the role of judges in assessing the legality and authentication of evidence, and encourages a shift in the litigation strategies of prosecutors and advocates. The addition of evidence has the potential to increase the effectiveness of law enforcement, but also raises the risk of legal uncertainty and human rights violations if not supported by adequate technical guidelines and oversight mechanisms.

Abstract

This research discusses the authority of judges in declaring a lawsuit inadmissible (Niet Ontvankelijke Verklaard/NO) in civil cases based on Decision Number 82/Pdt.G/2025/PN Kwg. The issues examined in this study relate to the application of formal requirements of a lawsuit and the authority of judges in rendering an NO decision due to errors in determining legal subjects (error in persona). This study aims to analyze the application of civil procedural law regarding the formal requirements of a lawsuit and to examine the authority of judges in declaring a lawsuit inadmissible. The research method used is normative juridical with statutory and case approaches. The legal materials used consist of primary, secondary, and tertiary legal materials obtained through library research and analyzed qualitatively. The results of the study indicate that the formal requirements of a lawsuit hold a very important position in civil procedural law. Errors in determining legal subjects, particularly involving a party who has passed away without involving the heirs, result in a formally defective lawsuit and cause it to be declared inadmissible (Niet Ontvankelijke Verklaard). In Decision Number 82/Pdt.G/2025/PN Kwg, the judges exercised their authority in accordance with civil procedural law to maintain legal certainty and orderly judicial proceedings. However, the application of such authority is considered to be overly formalistic because it did not provide an opportunity to amend the lawsuit, thereby giving less attention to substantive justice for the plaintiff.

Abstract

The annulment of a marriage certificate as a product of state administrative law creates complex juridical issues concerning the legality of marriage administration, protection of civil rights, and legal certainty within society. This study aims to analyze the legal consequences of the annulment of Marriage Certificate Number 0026/26/I/2020 in the Decision of the Bandar Lampung State Administrative Court Number 15/G/2023/PTUN.BL and to examine the judges’ considerations from the perspective of siyasah qadha’iyyah. This research employs a normative juridical method using statutory, case, and conceptual approaches within Islamic political jurisprudence. Data sources were obtained from court decisions, legislation, classical Islamic legal texts, and relevant scientific journals. The findings indicate that the annulment of a marriage certificate revokes the administrative legal force of the marriage registration but does not automatically invalidate the marriage contract under Islamic law as long as the pillars and conditions of marriage are fulfilled. The decision demonstrates that the State Administrative Court has authority to examine the administrative aspects of marriage certificate issuance but lacks authority to determine the substantive validity of the marriage itself. From the perspective of siyasah qadha’iyyah, the judges’ decision reflects the implementation of justice, public benefit, legal certainty, and supervision over state administrative officials. This study emphasizes the necessity of strengthening marriage administration systems based on good governance principles and maqashid al-shari’ah to prevent administrative legal disputes in marital affairs.

Abstract

Culinary MSMEs play a crucial role in supporting the regional economy, including in Kolaka Regency, Southeast Sulawesi. However, sole proprietorships in this sector still face significant challenges, particularly related to limited access to capital. This study aims to explore the relationship between limited capital and the sustainability of sole proprietorships in the culinary sector in Kolaka Regency, considering influencing factors such as family support, local government policies, and local market dynamics. This study employed a qualitative approach with a case study method. Data were obtained through in-depth interviews, field observations, and documentation. Informants were purposively selected from sole proprietorships in the culinary sector who had been operating their businesses for at least two years. The results show that limited capital is not only a simple financial barrier but also directly impacts the business's ability to innovate, maintain product quality, expand market reach, and survive competition. Most entrepreneurs rely on personal capital and informal loans from family, while access to formal financial institutions remains very limited due to complicated administrative procedures and low financial literacy. Business sustainability is heavily influenced by personal adaptation strategies, community support, and the gradual building of customer trust. This study recommends strengthening financial literacy, simplifying credit access procedures, and enhancing local government involvement in building a more environmentally friendly business ecosystem for local culinary MSMEs.

Abstract

Cross-border marriages increasingly produce estates composed of land, buildings, company shares, receivables, intellectual property, and digital business assets located in different jurisdictions. This study examines how children born from mixed marriages can obtain effective inheritance protection when the estate is affected by the lex rei sitae principle and by restrictions attached to the location or legal form of the asset. The research uses a normative legal method with statutory, conceptual, comparative, and case approaches, supported by a matrix of Indonesian legal instruments and recent scholarship on private international law and business succession. The analysis shows that a child’s status as an heir should be separated from the capacity to hold, register, or control a particular asset. Lex rei sitae provides strong certainty for immovable property, but its blanket application to all business assets creates fragmentation because shares, receivables, intellectual property, and digital assets require different connecting factors. The study proposes a calibrated protection model that coordinates lex successionis, lex rei sitae, lex societatis, mandatory rules, and the best interests of the child. This model requires early asset mapping, valid proof of parentage and citizenship, succession planning, liquidity safeguards, and coordinated recognition procedures across jurisdictions.

Abstract

The treatment of elderly defendants within the criminal justice system requires an approach that is not only oriented toward legal certainty but also takes into account the humanitarian conditions of the defendant. The enactment of Law Number 20 of 2025 concerning the Criminal Procedure Code introduces specific provisions regarding elderly persons through Article 148. This provision grants elderly persons the right to appropriate services, facilities, and infrastructure according to their physical and psychological conditions, as well as access to elderly healthcare services. More importantly, it provides that imprisonment should, as far as possible, not be imposed on defendants over 75 years of age based on judicial considerations and the judicial provisions of the Criminal Code. This study aims to analyze the parameters that judges may use in determining decisions involving elderly defendants and to examine the relationship between Article 148 of Law Number 20 of 2025 and the sentencing guidelines contained in Law Number 1 of 2023 concerning the Criminal Code. This research employs a normative juridical method using a statutory approach and a conceptual approach. The findings indicate that advanced age does not eliminate criminal responsibility; However, the age and personal circumstances of the defendant must be seriously considered in determining the type and severity of punishment. The parameters include the defendant's age, physical and psychological health, degree of culpability, motive and purpose of the offense, social and economic circumstances, life history, conduct after committing the offense, the impact of punishment on the defendant and the victim, victim forgiveness, and the values ​​of justice and humanity. Therefore, the application of Article 148 should be directed toward proportional, individualized, and humane sentencing while maintaining due consideration for the interests of victims and the protection of society.

Abstract

Criminal judges' legal reasoning determines how legal norms are connected to proven facts and how judicial decisions are justified. In Indonesia, this reasoning cannot be separated from Pancasila as the philosophical foundation of the state. This study analyzes the structure of criminal judges' legal reasoning from the perspective of the first principle of Pancasila, Belief in the One and Only God, and examines how divine values can function within judicial consideration without replacing positive law. The study employs normative juridical research using statutory, conceptual, philosophical, and case approaches. Legal materials are analyzed qualitatively through legal interpretation and argumentation. The analysis identifies a sequential reasoning structure comprising the identification of legal facts and issues, selection and interpretation of relevant norms, connection of norms to facts, assessment of evidence, evaluation of criminal responsibility, formulation of legal arguments, and determination of the decision. The first principle operates as a moral-philosophical foundation that reinforces honesty, integrity, impartiality, responsibility, proportionality, judicial independence, and respect for human dignity. The study proposes a three-layer model of judicial reasoning consisting of legal, rational, and moral-philosophical layers. This model clarifies that Pancasila-based reasoning should strengthen, rather than substitute, legality, evidence, and accountable judicial argumentation.

Abstract

The principle of civilian supremacy is a constitutional foundation of Indonesia’s state system, affirming that the highest authority in governance belongs to civilian institutions rather than the military. This study examines the constitutionality of restrictions on civil positions for active Indonesian National Armed Forces (TNI) members as an instrument for strengthening civilian supremacy, and analyzes the appointment of active TNI members to civil positions against this principle. This research employs a doctrinal legal approach, utilizing statutory, theoretical, historical, and comparative methods, with the Philippines as a comparative country. The findings reveal that Article 47 of Law No. 3 of 2025 on TNI has not fully functioned as a consistent instrument for strengthening civilian supremacy, as it still includes four agencies—Bakamla, BNPB, BNPP, and BNN—that lack substantive connection to national defense functions. The appointment of three active TNI officers based on Decree No. Kep/1545/XII/2024 to agencies outside the limitatively enumerated list, without prior resignation or retirement from active military service, violates Article 47(2) of the TNI Law and reflects a substantive blurring of the boundary between defense and civil governance functions, resembling the dual-function (dwifungsi) practice of the ABRI era. These findings indicate that without normative correction, the consolidation of civilian supremacy built since the 1998 reform is at risk of regression. The study recommends that the Parliament harmonize Article 47 by limiting the list exclusively to agencies with substantive defense functions, that the Constitutional Court provide authoritative interpretation in the ongoing material review, and that the TNI Commander establish administrative verification procedures prior to issuing appointment decrees for active soldiers to civil positions.
