Abstract

The conversion of agricultural land into tourism areas has become an increasingly significant phenomenon in Badung Regency due to the rapid growth of the tourism sector. This condition raises various legal issues related to agricultural land protection and spatial utilization control. This study aims to analyze the regulation of agricultural land conversion into tourism areas under Regional Regulation of Badung Regency Number 4 of 2025 and its implementation in Badung Regency. This research employs an empirical legal research method using statutory, conceptual, and socio-legal approaches. Data were collected through literature studies, documentation, and interviews with relevant stakeholders. The collected data were analyzed qualitatively and presented descriptively. The results indicate that Regional Regulation of Badung Regency Number 4 of 2025 comprehensively regulates the conversion of agricultural land through provisions concerning agricultural areas, tourism areas, Sustainable Food Agricultural Areas (KP2B), Spatial Utilization Suitability Approval (KKPR), supervision, and sanctions. However, its implementation has not been fully effective due to the high rate of agricultural land conversion driven by tourism development, increasing land values, and the lack of optimal supervision and law enforcement. The data show that the area of paddy fields in Badung Regency decreased from 9,023.38 hectares in 2023 to 8,379.84 hectares in 2025. Therefore, stronger supervision and consistent law enforcement are required to achieve a balance between tourism development and agricultural land protection.

Abstract

The Sale and Purchase Binding Agreement (PPJB) is a highly important legal instrument in property transactions in Indonesia. In civil law, the validity and dispute resolution related to PPJB are essential aspects that require in-depth analysis. A sale and purchase process using the PPJB structure generally requires a transfer clause, both physically and juridically, known as juridical delivery or juridische levering. Juridical delivery is carried out through the signing and execution of the Deed of Sale and Purchase (AJB) before a Land Deed Official (PPAT). Therefore, if the AJB has not been made, legal transfer or juridical delivery has not yet occurred, even though the PPJB has been agreed upon by the parties. Thus, there is a fundamental difference between a PPJB and a sale and purchase agreement. In a PPJB, delivery of the object or transfer of rights occurs later, whereas in a sale and purchase agreement, the transfer occurs directly. This research is descriptive analytical using a normative juridical approach, with collected data processed and analyzed qualitatively through an inductive method to obtain relevant and systematic conclusions.

Abstract

This study was motivated by the inheritance distribution practice among the Muslim Batak Angkola community in Halongonan District, where an additional share of the inheritance is allocated to unmarried sons to cover marriage expenses. This practice raises questions regarding its conformity with Islamic inheritance law and the concept of 'urf (custom) in Islamic jurisprudence. The study aims to analyze the inheritance distribution mechanism practiced by the community and assess its legal status from the perspectives of Islamic inheritance law and 'urf. This research employed an empirical legal method with a qualitative approach by collecting data through interviews, observations, and document analysis. The findings reveal that inheritance distribution is carried out only after the deceased's obligations, including funeral expenses, debt settlement, and the execution of valid wills, have been fulfilled in accordance with Islamic principles. However, the community maintains a customary practice of reserving a portion of the estate for unmarried sons as financial support for marriage preparation, reflecting values of family responsibility, compassion, and social solidarity. Nevertheless, from the perspective of Islamic inheritance law, this practice is inconsistent with the rules of faraidh because it alters the inheritance shares explicitly prescribed by Islamic law. Therefore, the practice cannot be classified as 'urf sahih (valid custom) but rather constitutes 'urf fasid (invalid custom) because it contradicts the established principles of Islamic law.

Abstract

Teacher certification policy implementation is one of the government's efforts to improve teacher professionalism and educational quality through the Teacher Professional Education (PPG) program. However, there remains a gap between policy objectives and certification outcomes, particularly among elementary school teachers in Bandung Regency, where a considerable number of teachers remain uncertified. This study aims to analyze the implementation of teacher certification policy for elementary school teachers in Bandung Regency during 2023–2024 based on the content of policy and context of implementation dimensions proposed by Merilee S. Grindle. This study employed a qualitative approach with a descriptive method. Data were collected through interviews, observations, and documentation and analyzed using data reduction, data display, and conclusion drawing techniques. The findings indicate that policy implementation has been supported by relatively good coordination among implementers. However, certification, which is intended to enhance teacher competence and professionalism, is more commonly perceived as a means of obtaining professional allowances. In addition, the implementation process still faces challenges related to limited human resources, dependence on the Basic Education Data system (Dapodik), inadequate facilities and infrastructure, and the central government's dominance in determining quotas and program implementation.

Abstract

This study examines the legal and social issues surrounding the restoration of the rights of child victims of the 2016 Oikumene Church bombing in Samarinda. It aims to analyze efforts to restore victims’ rights and evaluate the accountability of the regional government in protecting affected children. A socio-legal, non-doctrinal approach was employed using primary data collected through purposive interviews with the victim’s family, police officers, prosecutors, and representatives of the East Kalimantan Women and Children Protection Unit (UPTD PPA), complemented by a literature review. Data were analyzed descriptively and qualitatively. The findings reveal that both the central and regional governments have implemented victim recovery measures, but only partially. Court-awarded compensation was limited, overseas medical expenses were borne privately, and educational assistance was provided only once, while medical treatment in Samarinda was funded by the regional government. The East Kalimantan UPTD PPA has played an important role in assisting child victims. Although preventive and repressive legal protection mechanisms exist, preventive efforts through deradicalization remain inadequate. Stronger coordination, transparency, and systematic cooperation among government institutions and law enforcement agencies are essential to ensure comprehensive protection and restoration of child victims’ rights.

Abstract

River contamination by the palm oil industry threatens the constitutional right to a healthy environment, creating a jurisprudential dilemma between ecological justice and socio-economic stability. District Court Decision No. 168/Pid.B/LH/2023/PN Bls, which imposed a probationary sentence on a corporate executive for river pollution, has sparked academic debate regarding the efficacy of non-custodial sanctions. This study examines the judge’s legal reasoning in applying probation and evaluates its juridical implications for environmental criminal law enforcement and river ecosystem protection. Employing a normative legal research methodology with statutory and case approaches, secondary data were analyzed qualitatively through deductive legal syllogism. The findings reveal that the ratio decidendi integrates three dimensions: the defendant’s subjective-personal circumstances, the principle of proportionality, and a restorative-sociological approach prioritizing ecological recovery and local economic continuity. Juridically, probation signifies a paradigm shift from retributive-punitive to restorative-reparative justice, yet risks undermining deterrence if decoupled from autonomous corporate liability and rigorous institutional oversight. It is concluded that probation constitutes a progressive instrument in environmental criminal law when applied selectively, supported by sustained monitoring mechanisms, and reinforced by a robust corporate accountability framework to ensure equilibrium between ecological restoration and legal certainty.

Abstract

Alcohol related crime remains a persistent challenge for public security because conventional policing strategies primarily focus on responding to criminal incidents rather than addressing criminogenic conditions that continuously reproduce crime. Existing studies have largely examined alcohol regulation, policing strategies, or crime prevention separately, leaving limited understanding of how legal, institutional, and social factors interact to shape policing effectiveness. This study aims to evaluate policing effectiveness in controlling alcohol related crime in Jayapura City and to develop a policing model oriented toward criminogenic factor control. A socio legal approach was employed through qualitative analysis of regulatory frameworks, institutional practices, field observations, and in depth interviews to examine interactions between law in books and law in action. Findings show effectiveness depends less on enforcement intensity and more on integration of regulatory coherence, institutional capacity, discretion, and community participation. Hybrid policing improves responses but fails to reduce structural criminogenic mechanisms. The study identifies a criminogenic ecosystem shaped by regulatory tensions, informal alcohol distribution, social demand, weak deterrence, and institutional limits sustaining recurring crime. It proposes a Problem Oriented Community Policing Model for criminogenic control integrating harmonization, risk based policing, community engagement, and collaborative governance. This model advances socio legal policing theory and offers practical guidance for preventive, adaptive, and sustainable policies in complex risk contexts. These findings contribute empirically clarifying causal linkages between governance structures and crime reproduction, highlighting importance of coordination, policy consistency, and long term prevention strategies.

Abstract

The rise of homosexual molestation crimes in Indonesia raises deep concerns, both from the perspective of positive law and Islamic criminal law, considering that these acts are contrary to moral values, religion, and social norms that exist in society. This study aims to analyze the perspective of Islamic criminal law on homosexual molestation crimes and examine its relevance to the provisions of Article 414 Paragraph (1) of Law Number 1 of 2023 concerning the new Criminal Code (KUHP). This study uses a normative juridical method with a statute approach, a comparative approach, and a conceptual approach. through a literature study of primary and secondary legal sources. The results of the study indicate that Islamic criminal law categorizes homosexual molestation as an act of liwath which is threatened with strict sanctions in the form of had or ta'zir, while Article 414 Paragraph (1) of the new KUHP provides a maximum prison sentence of nine years. The novelty of this study lies in the comparative analysis that brings together the construction of Islamic law and Indonesian positive law in an integrative study framework. This research contributes to enriching the body of criminal law knowledge in Indonesia and provides conceptual recommendations for the development of legal policies that are more responsive to the values ​​of justice and the welfare of the community.

Abstract

This study aims to analyze the responsiveness of public services provided by DP3AP2KB of Lhokseumawe City in handling cases of violence against women and children. This research employed a descriptive qualitative approach. Data were collected through observation, interviews, and documentation involving informants related to women and child protection services. The results indicate that the responsiveness of DP3AP2KB services has been implemented relatively well, as demonstrated by the officers' prompt response in receiving reports, providing information, assisting victims, and coordinating with relevant institutions. However, several obstacles remain in the implementation of services, including limited human resources, budget constraints, and inadequate supporting facilities. Improving service responsiveness requires strengthening institutional capacity, enhancing cross-sectoral coordination, and developing services oriented toward the needs of victims. In addition, continuous public education regarding reporting mechanisms and legal protection is necessary to encourage community participation and increase early detection of violence cases. Regular training for service personnel and stronger collaboration with health facilities, law enforcement agencies, educational institutions, and community organizations are expected to improve service quality, accelerate case resolution, ensure victim recovery, and strengthen sustainable protection efforts.

Abstract

This study aims to analyze the dysfunction of the juvenile criminal justice system in reducing juvenile crime rates in Pesisir Selatan Regency, identify the factors contributing to this dysfunction based on the theory of law enforcement effectiveness, and formulate strategies to strengthen the system in accordance with the socio-cultural characteristics of the Minangkabau community. Data were collected through document analysis of legislation, official institutional documents, and relevant scholarly literature, and were analyzed using descriptive qualitative methods. The findings indicate that diversion has been implemented in accordance with Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and has successfully resolved several juvenile cases through a restorative justice approach. However, these procedural achievements have not significantly reduced overall juvenile crime rates due to persistent dysfunctions in preventing recidivism, coordinating between the formal legal system and traditional nagari institutions, and limitations in facilities, personnel, and integrated data management. Analysis based on Soerjono Soekanto's theory of law enforcement effectiveness reveals that the effectiveness of the juvenile criminal justice system is influenced by legal, institutional, infrastructural, societal, and cultural factors that remain inadequately integrated. Therefore, strengthening the juvenile criminal justice system requires the development of local policies integrating nagari institutions into diversion and post-diversion supervision, enhancing inter-agency coordination, improving the capacity of law enforcement personnel, establishing an integrated data management system, and optimizing the Minangkabau philosophy of adat basandi syarak, syarak basandi Kitabullah as the foundation for sustainable restorative justice.
