Abstract

A Notary is a public official authorized to create authentic deeds and is obligated to maintain professional confidentiality. In the performance of their duties, particularly when a legal issue arises leading to criminal proceedings that require the summoning of a Notary, the Notary Honorary Council (Majelis Kehormatan Notaris/MKN) must provide approval pursuant to Article 66 of the Law on Notarial Office (UUJN). This provision gives rise to legal issues due to differences in regulation between the UUJN and the Indonesian Criminal Procedure Code regarding the authority of investigators to summon and examine individuals. This study aims to analyze the urgency of obtaining MKN approval in the summoning of notaries in criminal cases, as well as the position and role of the MKN after a notary has been designated as a suspect. This research employs a normative legal method using statutory and conceptual approaches. The findings indicate that MKN approval is essential as a form of protection for the honor, independence, and confidentiality of the notarial profession, while also functioning as a procedural supervisory mechanism within the law enforcement process. The role of the MKN continues even after a notary has been named a suspect, insofar as the case is related to the execution of the notary’s official duties. However, once approval has been granted, the MKN is no longer involved in the substance of the investigation. Therefore, the MKN plays an important role in balancing the protection of the notarial office with the enforcement of criminal law.

Abstract

Mediation is a dispute resolution method in which disputing parties engage a neutral third party as a mediator to help reach a peaceful agreement. This study examines the effectiveness of implementing mediation as an alternative civil dispute resolution method at the Class I-A Madiun District Court. Using normative legal research methods, which include statutory and conceptual approaches, this study shows that the effectiveness of mediation at the Madiun District Court is still relatively low, with a success rate of only around 7.51% from 2021 to 2025. Factors influencing the low success of mediation include low public understanding of mediation, the attitude of the parties involved who only follow formal procedures, and limited facilities. To improve the effectiveness of mediation, it is necessary to increase public understanding, provide more intensive mediator training, and improve mediation facilities in the courts. In addition, regulations need to be reviewed to provide sanctions for parties who do not carry out mediation in good faith, so that mediation can be an alternative dispute resolution that is more efficient and effective and reduces the burden of cases in the courts.

Abstract

The availability of medicines is an essential part of fulfilling patients' rights to safe, quality, and sustainable healthcare services, especially for National Health Insurance (JKN) or BPJS Kesehatan participants. However, in practice, drug shortages still occur, directly impacting patients. This study analyzes the impact of drug shortages at Karawang Regency Hospital on fulfilling the rights of BPJS Kesehatan patients and the role of local governments in addressing them. Using a normative juridical method supported by interviews and literature studies, the results show that drug shortages result in delayed therapy, worsening patient health conditions, and the incurring of additional costs because patients must purchase medicines independently. This condition contradicts the provisions of Presidential Regulation Number 82 of 2018 and Presidential Regulation Number 59 of 2024 and has the potential to violate the cooperation agreement between BPJS Kesehatan and hospitals. Therefore, strengthening the management of drug planning, procurement, and control by local governments is necessary to ensure the protection of patient rights and compliance with BPJS Kesehatan regulations.

Abstract

This study examines the extent to which the nuclear deterrence strategy formulated by John M. Collins was effective when applied in the context of the Cuban Missile Crisis of 1962, as well as how the event prompted changes in the global arms control system and international collective security approaches. Using historical qualitative methods-including an examination of policy documents, official speeches, and behind-the-scenes negotiation processes-this study outlines the five main components of Collins' version of nuclear strategy: deterrence, flexible response, command control, arms control, and war termination. The research findings emphasize that successful deterrence relies heavily on the credibility of the nuclear threat as well as the effectiveness of crisis communications, including the use of hotlines between Washington and Moscow and back-channel diplomacy. The thirteen-day crisis also triggered the Partial Nuclear Test Ban Treaty (1963), which laid the foundation for the subsequent arms control regime. The study concludes that sustaining strategic stability requires a reliable deterrence strategy underpinned by a robust command structure and diplomatic mechanisms.

Abstract

Differing views on the law regarding interfaith marriages, particularly regarding the interpretation of Article 2, Paragraph 1 of Law No. 1 of 1974 on Marriage, have led to a legal vacuum and uncertainty regarding interfaith marriages. Subsequently, the Supreme Court issued SEMA No. 2 of 2023 regarding the prohibition for judges to grant requests for the registration of marriages between people of different religions, in order to provide legal certainty regarding interfaith marriages. This study aims to analyze the prohibition on granting applications for interfaith marriages from the perspective of Utilitarianism. The research method used is normative legal research employing a literature review as the data collection technique. This study uses secondary data sources consisting of: 1). Legal materials, comprising Law No. 1 of 1974 on Marriage, SEMA No. 2 of 2023, Law No. 23 of 2006 on Population Administration, the Human Rights Law, books, and articles on law; 2). Non-legal materials, namely: language dictionaries and articles other than those on legal science. The result of this study is the prohibition of granting requests for the registration of marriages between people of different religions in accordance with the principles of Utilitarianism, namely that the utility value of this prohibition can be felt by as many people as possible. Abstrak. Adanya perbedaan pandangan tentang hukum perkawinan beda agama, terutama penafsiran Pasal 2 ayat 1 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan menyebabkan terjadi kekosongan dan ketidakspastian hukum tentang perkawinan beda agama. Kemudian, Mahkamah Agung menerbitkan SEMA Nomor 2 Tahun 2023 tentang larangan bagi Hakim untuk mengabulkan permohonan pencatatan perkawinan antar umat yang berbeda agama, guna memberikan kepastian hukum tentang perkawinan beda agama. Penelitian ini bertujuan untuk mengalisis larangan mengabulkan permohonan perkawinan antar umat yang berbeda agama perspektif Teori Utilitarianisme. Metode penelitian yang digunakan adalah jenis penelitian yuridis normatif dengan teknik pengumpulan data studi kepustakaan. Penelitian ini menggunakan sumber data sekunder yang terdiri atas: 1). Bahan hukum, yang terdiri dari Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, SEMA Nomor 2 Tahun 2023, Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan, Undang-Undang HAM, buku dan artiel tentang hukum; 2). Bahan non hukum, yaitu: kamus bahasa dan artikel selain tentang ilmu hukum. Hasil penelitian ini adalah larangan mengabulkan permohonan pencatatan perkawinan antar umat yang berbeda agama sesuai dengan prinsip Teori Utilitarianisme, yaitu nilai kebermanfaatan dari larangan ini dapat dirasakan oleh sebanyak-banyaknya orang.

Abstract

The Right of Ownership over Condominium Units (SHMSRS) established on an expired Building Use Right (HGB) derived from a Management Right (HPL) creates legal uncertainty regarding both the legal status of the condominium unit and the rights of its owner. Since SHMSRS includes ownership of the individual unit together with common land, common property, and common parts, the expiration of the underlying HGB raises legal issues concerning the continuity of these rights. This study aims to analyze the legal status of SHMSRS and the legal standing of its holder following the expiration of HGB over HPL. The research employs a doctrinal legal method with an explanatory research typology. The analysis is based on the Decision of the Ambon District Court Number 24/Pdt.G/2025/PN AMB, the Decision of the Ambon High Court Number 60/Pdt/2025/PT AMB, and the Decision of the Supreme Court Number 797 K/Pdt/2026. The findings indicate that, according to the courts’ legal reasoning, SHMSRS holders lose their legal standing due to the expiration of the principal HGB derived from HPL. Nevertheless, this study concludes that SHMSRS does not automatically become legally void when the HGB expires. Legitimate SHMSRS holders continue to possess legal standing within the framework of Build-Operate-Transfer (BOT) or Build-Transfer-Operate (BTO) schemes used in condominium development and marketing. Therefore, clearer legal regulations are necessary to ensure legal certainty and provide stronger legal protection for SHMSRS holders.

Abstract

Nitrous oxide (N₂O) is a chemical compound that has legitimate uses in the medical, food, and automotive sectors. However, its misuse as an inhalant to obtain psychoactive effects has recently increased, particularly through whip cream chargers that are widely sold, including on online marketplaces. The issue arises because N₂O has not yet been classified as a narcotic or psychotropic substance under Indonesian positive law, creating a legal gap in supervision and law enforcement regarding its distribution. This study aims to analyze the classification of N₂O within the perspective of narcotics and psychotropic law in Indonesia and to examine criminal liability for distributors involved in the free sale of N₂O in the form of whip cream chargers. This research uses a normative juridical method with statutory and conceptual approaches. Legal materials were obtained from legislation, books, journals, and expert opinions, which were analyzed qualitatively. The results show that although N₂O is not categorized as a narcotic or psychotropic substance, its misuse and distribution may still be subject to sanctions under the Health Law, Consumer Protection Law, and Electronic Information and Transactions Law. Distributors as business actors may be held criminally liable if they distribute products without proper authorization, fail to meet safety and quality standards, or provide misleading information to consumers. Therefore, strengthening administrative regulations and distribution supervision is necessary to prevent the misuse of N₂O in Indonesia.

Abstract

Public participation is a fundamental principle in democratic governance, including the formulation and implementation of Regional Spatial Planning Regulations (RTRW). Community involvement is essential to ensure that spatial planning policies accommodate public interests, support sustainable development, and prevent conflicts in land use. This study aims to analyze the regulation and implementation of public participation in the formulation and implementation of the Regional Spatial Planning Regulation of Karawang Regency. The research employs an empirical juridical method using statutory and conceptual approaches. Data were collected through literature studies and interviews with the Regional Public Works and Spatial Planning Office of Karawang Regency and analyzed qualitatively. The findings indicate that public participation has been accommodated through various consultation mechanisms and public aspirations channels as stipulated by relevant laws and regulations. However, its effectiveness still faces challenges, particularly in optimizing community involvement throughout the spatial planning process. Therefore, strengthening a more inclusive, transparent, and sustainable public participation mechanism is necessary to support effective spatial governance and ensure that spatial planning policies align with public interests.

Abstract

Sport fishing or recreational fishing has grown rapidly in Indonesia as a maritime tourism sector, yet it remains inadequately regulated from the perspectives of animal welfare and Islamic environmental jurisprudence. This study employs a normative legal research method with statute, conceptual, and comparative. The findings reveal that Indonesian law, primarily the Fisheries Act No. 45/2009 and Ministerial Regulation No. 27/2021, remains anthropocentric and administratively limited, failing to address the ethical dimension of fish suffering as sentient beings. From the Islamic jurisprudential perspective, the principle of la dharar wa la dhirar and the maqashid al-syariah framework indicate that sport fishing conducted purely for recreation, without proportionate benefit (maslahah), is ethically problematic. Furthermore, the principles of fiqh al-bahr including hima (protected zones), prohibition of israf (excess), and ihya’ al-mawat (ecosystem rehabilitation) alongside fatwas from MUI, Majma’ al-Fiqh al-Islami, and Dar al-Ifta’ al-Mishriyyah, collectively provide a robust normative basis for integrating Islamic values into fisheries regulation. This study recommends revising Ministerial Regulation No. 27/2021 to incorporate humane handling standards, enacting specific animal welfare regulations for recreational fisheries, and formally integrating Islamic environmental jurisprudence as an ethical foundation for national fisheries policy.

Abstract

The dynamics of the wedding service industry are frequently confronted with various external and internal operational disruptions that culminate in a failure of contractual performance (default). This study aims to critically analyze the juridical qualifications of technical transportation constraints invoked as a force majeure defense in wedding service disputes, while concurrently evaluating the institutionalization of consumers' immaterial restitution rights pursuant to Article 19 of Law Number 8 of 1999 on Consumer Protection. Employing a normative juridical research method with statutory and case approaches, the findings demonstrate that internal operational friction, such as logistics fleet failures, strictly fails to satisfy the legal parameters of force majeure. Since such exigencies are inherently foreseeable, they must be mitigated through sound corporate risk management, thereby leaving the vendor fully liable for all subsequent damages. Given the non-repeatable nature of wedding ceremonies, performance failures inflict severe, irreversible immaterial injuries upon consumers, characteristically manifesting as enduring psychological trauma and the degradation of social dignity before the public. This study concludes that the current remediation framework suffers from a distinct legal gap, as informal, out-of-court settlements routinely marginalize moral and psychic losses. Consequently, a progressive legal interpretation alongside a standardized valuation mechanism for immaterial damages based on the principle of fairness (redelijkheid) is profoundly imperative to guarantee legal certainty and robust consumer protection.
