Abstract

Indonesia is a country of law, the application of law in this country has become the government's commitment from time to time. However, in reality, the application of law in Indonesia faces complex obstacles and problems, one of the contributing factors is allegedly that the level of public awareness of the law is still low. This can be seen from the high level of lawlessness and crime that occurs from time to time. In theory, law enforcement must be supported by three things, namely: legal substance, structure and culture. This means that law enforcement will be effective if it is supported by three elements, namely: the existence of legal rules applied by the government, the existence of legal structures that are realized by the presence of law enforcement officials, and there is a culture or legal culture, namely public awareness to implement the rule of law. This paper tries to analyze the efforts made by the government to foster legal awareness among the public. Among others, by strengthening religious understanding and practice through religious institutionalization and intensification of religious values, strengthening the education system, strengthening economic problems, and implementing reward and funisment systems. However, the effectiveness of the program must continue to be tested with consistency and continuous evaluation.

Abstract

In studies of siyâsah fiqh, shura (consultation) is an obligatory constitutional principle to be implemented in an Islamic government as a means to reach consensus in politics and to control executive power. Such roles prevent dictatorship and unfair acts of a ruler. Nevertheless, in its conceptual and praxis levels, shura crosses path with modern democracy, a western product. This meeting point gives birth to discourses and speculations that are diversely appreciated by Islamic scholars represented by this question: are the two notions identical? This issue requires analysis by elaborating boundaries of similarities and differences in the principles of the two concepts in order to obtain a holistic and proportional account. Analysis reveals that shura and democracy are distinctive concepts. Such a conclusion is drawn due to differences in terms of both principles and implementation. On the other hand, both concepts are not conflicting since democracy can be part of Islamic political system as long as it is oriented towards and its system of values are based upon religious and morality values.

Abstract

Before the integration of Islamic education into the national education system in Indonesia in 1975 occurred the dichotomy of Islamic education and general education. In order to eliminate the dichotomy of education is done by following the tendency that occurs. The trend is from pesantren to Madrasah, and from Madrasah to school; from a dichotomy to a uniform and integrated system of education is realized and controlled in one hand of government, with one common policy for all. Recognition of the existence of Madrasah education is then followed adjustments to the school system in general. The initial process will be followed by the release of the Joint Ministerial Decree of the Minister of Religion, the Minister of Education and Culture, and the Minister of Home Affairs in 1975 which has implications for Islamic education and education within the framework of the national education system of Indonesia.
