MILRev Is a scientific law journal with a focus on studies in the field of Islamic law, starting from fiqh, fatwa, or qanun (laws, shariah regional regulations, compilations of Islamic laws). The aim is to develop knowledge in the field of Islamic law, in order to be able to respond to the needs of the wider community for scientific and contemporary Islamic law studies. This journal is intended for academics, researchers, and practitioners, who conduct research on Islamic law, both normative (library) and empirical (socio-legal) research. This journal is published twice a year and involves editorial teams, reviewers, and writers from within and outside the country

Abstract

The digital era or commonly known as 4.0 where everything is strived to shift to digitalization. One of the impacts of digitalization is in the fieldof muamalah (buying and selling transactions). Especially at this time in Indonesia experiencing a corona virus outbreak (Covid-19), where the government provides rules of life to the community so that activities are carried out at home as an effort to protect themselves. This activity will provide a surge in buying and selling transactions online, be it through Shoope, Tokopedia, Lazada, and others. Legal efforts are needed to identify whether the transaction is in accordance with the law in muamalah, namely fiqh muamalah? The method used in this research is legal research methods with qualitative analysis, the approach uses normative data. The result of the research is that online transactions are in accordance with muamalah fiqh, the use of the contract is the salam contract. This is because the community orders by giving the characteristics of the object of the item to be purchased, while the seller provides a description of the item itself in detail.

Abstract

The legal system used in Indonesia is a civil law legal system, namely a codified or written legal system. The contribution of Islamic law in Indonesia is the development, guidance and application of Islamic law as positive law in the context of efforts to develop and foster national law. The Role of Islamic Law in Legal Development in Indonesia. The dynamic character of Islamic law must be developed to support the development of national law in the realm of legal development in Indonesia. It is necessary to provide limits on the scope of areas of life covered by Islamic law in the context of developing national law. These limitations in the field of Islamic law must be followed up by Islamic legal experts. The cultivation of Islamic law is carried out with an effort to formulate principles for Islamic legal decision making that better reflect current needs accompanied by proportional humanitarian considerations. During the period of Indonesian independence, Islamic law, Western law and customary law both became materials for the development of national legal unification.

Abstract

The increasingly advanced development of the world accompanied by the era of globalization and the rapid development of science and technology in several areas of people's lives, such as medical, legal, social and economic, has had a major influence, including legal issues. This research was prepared using the library study method, namely by collecting various reading sources that are in accordance with the outline of the theme, then compiling them into a discussion regarding the law of online buying and selling. To ensure that Islamic law remains dynamic, responsive and highly adaptable to the demands of change, this is by reviving and reviving the spirit of ijtihad among Muslims. In this position, ijtihad is the inner dynamic for the birth of change to guard the ideals of universality of Islam as a shalihun li kulli masa wal makan teaching system.

Abstract

During the Covid-19 pandemic, the Indonesian government prohibited people from performing Friday prayers in mosques based on the MUI fatwa. Based on these problems, this research wants to see whether some people obey the regulations or continue to perform Friday prayers because they think that Friday prayers are obligatory. Then we will look for the law on not performing Friday prayers because of a dangerous disease outbreak. There will be an equation of original law with maslahah murlah based on a review of Islamic legal philosophy. The law on Friday prayers is fardlu 'ain for men if the obligatory conditions are met. Friday prayer is the obligatory prayer of two rak'ahs which is carried out in congregation at Zuhr time, preceded by two sermons. The Covid-19 outbreak is not only a national problem in a country, but is also a global problem. In anticipating and reducing the number of corona virus sufferers in Indonesia, measures have been taken, including providing a policy of limiting activities outside the house. In Indonesia, the MUI urges Muslims to temporarily replace Friday prayers with midday prayers at home in the Covid 19 emergency situation to avoid a mudhorot, namely contracting an epidemic.

Abstract

Jihad is a Muslim who is serious about achieving something that can bring him closer to Allah SWT, and distance himself from anything that is forbidden by Him. Nowadays jihad is often understood not as it should be. This condition is triggered by several reasons, one of which is a wrong interpretation of the meaning of jihad, whether understood by some Muslims or non-Muslims. For non-Muslims, they consider jihad in Islam to be an uncontrollable, irrational situation and has the connotation of total war. This exclusive attitude gave birth to radicalism in religion, and again it was Islam that was accused of being the originator of all acts of violence in various parts of the world. Departing from that, this research tries to discuss the conception of jihad in radical Islamic movements. The study in this paper is based on literature. Reference sources used are fiqh books, both classical and contemporary. Not only books and textbooks are references for this paper, the references are quotes from journals related to the content of the study in this paper

Abstract

This study aims to discuss the meaning of social and cultural values ​​from the perspective of Islamic legal philosophy or Islamic law itself. In our country, Indonesia has very high socio-cultural values, where the culture found in Indonesia is very diverse. And apart from that, social factors arising from various cultures must be related or in harmony with Islamic law for Muslims. And also has the factor of mutual respect for religious communities. This research is a literature study with the data collection technique being documentation. An important finding in this research is that Islamic law will be able to change social society, if Islamic law is obeyed and implemented and becomes a guide, and even becomes a custom for society. Apart from that, Islamic law can change social society if Islamic law is absorbed into positive law for a country.

Abstract

Discourses about professional ethics of judges started out from the reality of law enforcement officials (especially judges) that ignore the values of morality. Although the professional actors (judges) already have a professional code of ethics as a moral standard, apparently it has not had a positive impact, especially not being able to change the negative image of society on the face. One way to uphold the rule of law is to uphold ethics, professionalism, and discipline. The code of ethics of the judges profession in principle contains moral values ​​that underlie professional personality, namely freedom, justice and honesty.

Abstract

The holy book Al-Qur'an was revealed as a guide for mankind, every guidance and legality contained in the verses of the Al-Qur'an has its own purpose, the main purpose of which is to benefit mankind. One of the contemporary problems that occurs among Muslims is the relationship between politics and Islam, which is still a matter of debate, especially among Islamic thinkers. This also responds to the current Islamic revival to the ongoing economic, political and military crisis. Therefore, this article discusses his criticism of the secular state and its implementation in public law.

Abstract

In a country, economic development is the process of how that country can develop. National development is carried out in order to achieve a developed country and make the people there prosperous. Economic development cannot be separated from a country, the process and impact reap many pros and cons in various ways. In its continuity, economic development will not occur without being accompanied by the provision of large capital funds. Often the government brings in funds or, let's say, borrows funds from foreign countries to support the success of economic development. As a result, foreign debt has piled up, hampering economic development. Foreign debt that occurs in developing countries, especially Indonesia, cannot be avoided. Foreign debt occurs due to various factors, one of which is limited human resources that are less effective, which indirectly forces a country to borrow funds from foreign countries because an ineffective workforce does not produce sufficient financial resources for economic development. From an Islamic legal perspective, foreign debt contains the element of usury, why is that because foreign debt always contains interest, in Islam anything that contains usury is clearly not permitted. Of course, the government, especially the Indonesian government, must pay attention to this matter.

Abstract

Health is an important factor in human life because in healthy conditions, humans can carry out activities comfortably and do a lot of good by providing benefits to others. Everyone always strives for various ways and efforts that are considered good to support health. Transplantation is one of the many ways to cure disease that can be done using technology. Transplantation is a problem that falls within the scope of Islamic law which is not only a classical problem but has also entered the scope of contemporary problems. In looking at a legal phenomenon that occurs, Islamic legal experts analyze legal cases by looking at what has been determined by the Al-Quran and Hadith. The response of Islamic law to the emergence of the phenomenon of organ transplantation is proof of the relevance of Islamic law in covering problems in the health sector. Therefore, this research will discuss the concept of health in Islamic law through an analysis of the law on organ transplantation. Regarding organ transplants, Islam highly respects the glory of humans, both living and dead. Humans are blessed with a perfect body shape, intelligent mind and the ability to regulate this universe. So it is natural that God glorifies humans above other creatures. That's why we are prohibited from trampling on other people's dignity. One must not destroy one's soul, self-esteem, feelings, even towards a corpse.
