Abstract

Legal interests that want order and uphold justice in society, put the consensual principle as a demand for legal certainty. As we understand that humans who live in an orderly society must be able to obey their words or utterances because it is something that is absolute from a good legal system. So that the law of the agreement has been declared valid if it has reached an agreement. The consensual principle is contained in article 1320 of the Civil Code which of course supports and complements each other with article 1338 paragraph 1 of the Civil Code. Meanwhile, in terms of buying and selling, it is contained in article 1458 of the Civil Code. The legal requirements for an agreement in Article 1320 of the Civil Code can be divided into 2 requirements, namely subjective conditions consisting of elements of agreement and skill and objective conditions consisting of elements of a certain matter and a legal cause.

Abstract

Collusion in the construction services industry has proven to be detrimental to business competition. Collusive practices in the tender process hinder fair competition and result in significant economic losses. Companies involved in such collusion cooperate to manipulate bidding prices, avoid genuine competition, and influence tender outcomes to their advantage. As a consequence, companies not engaged in the collusion lose opportunities to secure contracts, while project costs escalate. Collusive tendering also has negative impacts on the quality of construction work. When companies collude to win tenders, they may disregard necessary quality and safety standards. This can lead to lower quality, unsafe projects, and increased infrastructure failure risks. Furthermore, collusive tendering creates an unfair environment for small and new companies attempting to enter the construction market. They often struggle to compete with large companies involved in the collusion, which have advantages in resources and experience. As a result, innovation and healthy competition in the construction services industry are hindered, and the market becomes dominated by a few major players. To combat collusive tendering, crucial steps need to be taken. Governments and procurement agencies should enforce strict and effective regulations to prevent and penalize dishonest practices. Transparency in the tendering process, rigorous scrutiny of collusive practices, and severe sanctions for violations must be implemented. Additionally, awareness and active participation from all stakeholders, including construction companies, governments, and the public, are essential in addressing collusive tendering. By eliminating collusive tendering, the construction services industry can foster fair competition, encourage innovation, improve the quality of work, and provide equal opportunities for all participating companies in the market.

Abstract

South Sumatra Province is one of the provinces that has abundant natural resources and the largest is coal. The implementation of the case study was carried out in the cities of Palembang, Pagar Alam and Lubuk Linggau using homer software with components Controller Homer Load Following, Generic Biogas Genset (Size-Your-Own), Peimar SG300MBF, Bergey Excel 6-R, Surette 6 CS 25P, Princeton DRI-100 Converter, Hydro Natel Freejet Fi-7A49 kW.  Typical load profile determination assuming 100 houses in a village that have a daily load of 10.50 kWh or 3,832.50 kWh/year/house. After the simulation, it was concluded that the combination of an effective and efficient power generation system is Hydro / Solar / battery / converter (HSbc) in Pagar Alam City with energy production of 48,809 kWh / year. A reliable and sustainable Power Generation System is obtained in Hydro / battery / converter (Hbc). Net Present Cost and the highest carbon emissions are found in diesel power plants when compared to other renewable energy power plants.

Abstract

Humic acid to soil has positive effects on soil properties that result in improved soil fertility and maize yield. Maize growth and yield can also be enhanced by foliar application of salicylic acid. A field experiment was carried out at Agronomy Research Farm, The University of Agriculture Peshawar during summer season, 2021 to evaluate the response of maize to humic acid and foliar salicylic acid application. Results revealed that plots treated with humic acid at the rate of 15 kg ha-1 significantly increased plant height (217.8 cm), grains ear-1 (507), thousand grains weight (302.3 g) and grain yield (5309 kg ha-1). Salicylic acid with 750 mg L-1 showed taller plants (221.1 cm), maximum grains ear-1(502), heavier thousand grains weight (299.1 g) and maximum grain yield (5171 kg ha-1) which is statistically similar with the application of salicylic acid foliar spray at the rate of 500 mg L-1. Interaction between humic acid and salicylic acid was found to be non-significant except in case of grains ear-1 and grain yield. It was concluded that humic acid at the rate of 15 kg ha-1 and salicylic acid foliar spray of 750 mg L-1 is recommended for higher grain yield of maize in Peshawar.
